HomeMy WebLinkAboutCivilService 2013-09-09 MinutesCity of Tukwila 6200 Southcenter Boulevard • Tukwila, Washington 98188 Jim Haggerton, Mayor September 9, 2013 The following commissioners attended the regularly scheduled meeting of the Tukwila Civil Service Commission: Ron Johnston, Carol Zuvela and Dennis Sivak. Others in attendance were Acting Fire Chief Chris Flores, Police Commander Dennis McOmber and Kim Gilman, Civil Service Examiner. CALL TO ORDER 5:00 p.m. APPROVAL OF MINUTES APPEAL HEARING: Chair Johnston called the meeting to order. The Chair asked if there were any corrections needed for the August5, 2013 Commission Meeting minutes. No corrections were noted. MOVED BY SIVAK, SECONDED BY ZUVELA THAT THE AUGUST 5, 2013 COMMISSION MEETING MINUTES BE APPROVED AS WRITTEN. MOTION CARRIED. Lateral Police- Officer Candidate Akeem Eleam requested an appeal to the Chief's decision to remove him from the Lateral -Entry eligibility list. The Chief Examiner began the hearing proceedings by reading the hearing procedures to all in attendance. Commander McOmber stated that information that the applicant disclosed during the polygraph made him unsuitable for work as a Tukwila Police Officer. Specifically, the candidate admitted to having sex on duty on 3 occasions, sleeping on duty numerous times, had solicited a prostitute 2 times after he became a police officer, had received a 15 day suspension for not using verbal commands prior to engaging in physical force on an aggressive prisoner, and used his department issued shotgun to go rabbit hunting. These reasons lead to the Chief's decision to remove Mr. Eleam from the Lateral -Entry eligibility list. Commander McOmber presented a copy of the Department's memo to the Commission. 1 City of Tukwila 6200 Southcenter Boulevard • Tukwila, Washington 98188 Jim Haggerton, Mayor FIRE DEPARTMENT BUSINESS Staffing Update Candidate Akeem Eleam responded that he is currently 27 but starting out in his career he made some mistakes. He stated that he was 24 -25 years of age when these things occurred. He explained that after Hurricane Isaac hit he worked 21 days straight with no days off. The Department allowed officers to go home while on duty to visit family members during that time, at which point he visited his girlfriend. He stated that he had solicited a prostitute while visiting the Dominican Republic. Mr. Eleam said that he is not a liability to his current Department, and that he is viewed as a "Go -To" officer. He presented copies of letters that his supervisors wrote on his behalf. Mr. Eleam stated that he is a hard- worker and honest, and that he does not start fights with people. He explained that the prisoner threatened to kill him. Commissioners asked how long Mr. Eleam was employed as a police officer. He responded that he had been a police officer for 4 years. He was then asked what he hoped to gain by having his name put back on the eligibility list. The candidate responded that it was important to him, that it was "for me ". The Examiner explained that the Commissioners would deliberate in an Executive Session after tonight's meeting, and that a decision would be sent to the Candidate via postal mail within 10 days. The Chair closed the hearing. Acting Chief Chris Flores reported that the Department is at full capacity, with the exception of the Chief's absence. Acting Chief Flores distributed a memo requesting that the Commission approve an extension to Bill Rodal so that he could continue in his temporary Fire Captain assignment from September 1, 2013 until November 6, 2013. Mr. Rodal had already served 6 months previously. Acting Chief Flores noted that the top 3 candidates from the 2 City of Tukwila 6200 Southcenter Boulevard • Tukwila, Washington 98188 Jim Haggerton, Mayor current Fire Captain's list had all had the opportunity to serve in a temporary appointment over the last 6 months. MOVED BY SIVAK, SECONDED BY JOHNSTON THAT THE TEMPORARY FIRE CAPTAIN APPOINTMENT FOR BILL RODAL BE EXTENDED EFFECTIVE SEPTEMBER 1 TO NOVEMBER 6, 2013. MOTION CARRIED. POLICE DEPARTMENT BUSINESS Staffing Update Certification of Entry -Level Police Officer Eligibility List Certification of Lateral -Entry Police Officer Eligibility List GENERAL BUSINESS Civil Service Annual Conference PST Annual Meeting Commander McOmber reported that not much has changed in the staffing levels at the Department since the report made at the August meeting. The Examiner presented the Commissioners with an eligibility list containing 12 names in consideration for the Entry -Level Police Eligibility list. She noted that of the 16 candidates that participated in the oral boards, only 12 passed and were added to the list. The Examiner presented the Commissioners with one name added to the existing Lateral -Entry eligibility list. The candidate was tested on September 3`d. There are a total of 3 names on the list. No Commissioners were interested in attending this year's conference in Yakima. Commissioner Zuvela indicated that she would be interested in attending the Annual Meeting on October 16th in Lynnwood. Acting Chief Flores and the Civil Service Examiner will also be in attendance. City of Tukwila 6200 Southcenter Boulevard • Tukwila, Washington 98188 Jim Haggerton, Mayor Civil Service Rules Revision The Civil Service Examiner read the following revised Civil Service Rules language into the record: Rule Page # Proposed Language VII, Section 2 Applications p. 10 Consistent with the Police and /or Fire Department Retirement Systems Medical Physical Standards currently. IX, Eligible Lists, Section 1 Order of Names on Lists p. 12 Names on eligible lists for a class shall be in order according to the final earned rating in the examination, including veteran's points in compliance with RCW 41.04.010, except that employees laid off from a position in that class shall be given prior preference over original applicants in order of seniority. IX, Eligible Lists, Section 3 Removal of Names from Lists p. 12 In case of such removal, the Secretary and Chief Examiner shall notify in writing the candidate so affected at his or her last known address by certified mail, return receipt requested. The name of a person so removed may be reinstated only if satisfactory explanation of the circumstances is made to the Commission within 10 business days of receipt. IX, Eligible Lists, Section 3 Removal of Names from Lists p.12 The name of any person appearing on a eligibility list may be removed by the Secretary and Chief Examiner if the candidate fails to respond to a notice of certification, if he or she declines an appointment without reason satisfactory to the Commission, if he or she failed a background process, or if he or she can not be located by postal authorities through certified mailing. II, The Civil Service Commission, Section 1 Organization P. 7 The Commission may meet in executive session, in compliance with RCW 42.30.140 (2). i III, The Secretary and Chief Examiner, Section 2 Duties p. 8 The Secretary and Chief Examiner shall keep the records of the Commission, preserve all reports made to it, superintend and keep a record of all examinations held under its discretion, and perform other such duties as the Commission may prescribe (ie. Prepare eligibility lists and arrange for certification of the list by the Commission). Failure to Respond p. 13 Whenever a candidate whose name has been certified for appointment fails to answer an inquiry of the Secretary and Chief Examiner or of the appointing officer within 10 business days succeeding the mailing of such notice of certification via certified mail, return receipt requested, or who fails to accept an appointment when offered it within the same period, or within the next succeeding business day notification is supplied verbally by telephone, he or she may be deemed to have declined appointment. XI, Probationary Period. Section 2. Rejection of Probationer p. 14 Notice of the rejection with the reason thereof shall be given the probationer and a copy forwarded to the Commission.
