Public surveys were filled out by residents as well as a mail out/phone survey completed by registered voters. The new Park, Recreation and Open Space Plan authorizes the City of Tukwila to perform a comprehensive work plan into the parks and recreation system. A public hearing on the plan will take place on June 9,' 2008. An adopted open space plan is required by the Washington State Recreation and Conservation Office in order to qualify for state and federal grant funding. It is the recommendation of the Parks and Recreation Department to adopt the new Park, Recreation and Open Space Plan by ordinance and to repeal ordinance number 1959. Cc. Rhonda Berry, City Administrator DRAFT AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ADOPTING A NEW PARK, RECREATION AND OPEN SPACE PLAN FOR THE CITY OF TUKWILA; REPEALING ORDINANCE NO. 1959; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, RCW 35A.63.062 authorizes the City of Tukwila to perform comprehensive park and open space planning; and WHEREAS, the Tukwila City Council requested that (through the Parks and Recreation Department), the administration prepare an updated Park, Recreation and Open Space Plan; and WHEREAS, the City administration and Parks Commission have completed review and modification of the plan, and have forwarded the plan to the City Council for adoption; and WHEREAS, the plan was presented to the public for comment and modification at a public hearing on June 9, 2008; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. The Park, Recreation and Open Space Plan (Exhibit A), as presented with this ordinance, is hereby adopted as the Park, Recreation and Open Space Plan for the City of Tukwila. Section 2. A copy of the Plan, adopted by this ordinance, shall be authenticated and recorded by the City Clerk along with this ordinance and, pursuant to RCW 35A.12.140, at least one copy of the Plan shall be filed in the City Clerk's Office for use and examination by the public. Section 3. A copy of this ordinance and the Park, Recreation and Open Space Plan shall be filed with the following City departments: 1. Community Development 2. Public Works Department 3. Finance Department 4. Parks Sr Recreation Department 5. Mayor's Office Section 4. The most recent Comprehensive Park and Recreation Plan, adopted by Ordinance No. 1959, on June 18, 2001, is hereby repealed. Section 5. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. BACKGROUND The Transportation Improvement Program (TIP) is updated annually as required by RCW. The 1'lP is adopted by resolution after a public hearing at the local agency level and incorporated into the regional and state 'HI's. The TIP is primarily a fmancial planning document for projects competing for grants. Any project submitted for federal grant funding must be included in the local, regional and state adopted 'l'IPs. The TIP is a rolling plan showing various funding sources: grants, developer, and local funds. Projects "roll" as funds or stages (design report, final design, and construction) occur. Tukwila's TIP and Capital Improvement Plan (CIP) list many of the same transportation related projects. The TIP lists only those transportation related projects planned within the next six years that are deemed regionally significant. The City's CIP lists transportation projects planned in the next six years and beyond, as well as water, sewer, surface water, and capital facilities. The TIP is required to be adopted by July 1 on an annual basis, while the CIP is prepared during summer /fall in conjunction with the City's budget preparation. Differences between the two may be due to priority changes, funding availability changes, or other factors that normally occur during the time between adoption of each document. ACTION TAKEN The attached spreadsheet is the "Draft" 2009 2014 HP and was created by modifying the 2008 2013 TIP to add or remove projects, adjust project costs, and reprioritize the list of projects. Added: Project 15 TUC/TOD Pedestrian Improvements Deleted: Project 16 Southcenter Blvd. (I -5 TIB) RECOMMENDATION Forward the resolution to the next Committee of the Whole meeting to hold a Public Hearing and adopt the updated annual Six -Year Transportation Improvement Program of 2009 2014. WHEREAS, pursuant to the requirements of RCW Chapters 35.77 and 47.26 as amended, the City Council of the City of Tukwila has previously adopted a Transportation Improvement Program and thereafter periodically modified said Transportation Improvement Program by resolution, and WHEREAS, the City Council has reviewed the work accomplished under said program, determined current and future City street and arterial needs and, based upon these findings, has prepared a Six-Year Transportation Improvement Program for the ensuing six calendar years (2009 2014), and WHEREAS, on June 9, 2008 a public hearing was held regarding the City's Six-Year Transportation Improvement Program; NOW, THEREFORE, THE CITY COUNCIL OF THE CFI Y OF TUKWILA, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. Differences between the two plans are often based on and reflective of the time between the adoptions of each document. Two changes are noted in the current document; one addition and one deletion: Addition: Tukwila Urban Center /Transit Oriented Development Pedestrian Improvements has been added to the plan in order to seek and qualify for grant funds (State requires inclusion in plan for grant consideration). Deletion: Southcenter Boulevard (from I -5 to Tukwila International Boulevard) this project will return to the plan in another budget cycle; the current project portion is assigned to Sound Transit and there is no need to include it in the current plan. Permanent Easements and Temporary Construction Easements Staff is requesting full Council approval to begin the property acquisition process, and if needed, condemnation authority, to obtain property for the Tukwila Urban Center Access project. It is standard for City staff to request condemnation authority at the beginning of a property acquisition process for public projects. Although it is highly unlikely that any that any parcel of land within this area will require condemnation, establishing the ordinance prepares the City for condemnation proceedings, if required. The City needs to acquire the right -of -way from two properties, in addition to some temporary construction easements and a permanent easement. In addition, I was able to contact the event staff for the All Nations Cup Soccer Tournament, and they will have four security staff available for assisting with crowd control during the June 22 fireworks' show. I have since modified the conditions' letter for that fireworks' display and will require two uniformed Police Officers instead of the four originally called for in the conditions' letter; a revised conditions' letter is in your packets. Olivas, Fire Chief Date: May 28, 2008 To: Chief Olivas From: B/C Tomaso Re: Public Fire Works Display Permit 1 have reviewed the permit application information provided by Mr. Tom Whitacre, who has applied for the permit for a public fireworks display at the Starfire Sports Complex, 14600 Starfire Way. Mr. Whitacre is a licensed Pyrotechnic Operator with the State of Washington and with the Bureau of Alcohol, Tobacco and Fire Arms. The State Department of licensing also licenses Mr. Whitacre to transport fire works. Sister Community Soccer Awards will hold the display in conjunction with the All Nations Cup Soccer Tournament and the closing ceremony on June 22, 2008. The display will be 15 to 20 minutes in length at the end of the closing ceremony that is anticipated to be 2200 hours. The fireworks will be transported to the site in the AM of June 22 and will be under the required supervision until they are discharged. The mortar tubes and other equipment will be brought to the location on June 20 and 21 The application was reviewed to WAC 212 -17 and accepted industry standards, and I find everything is within these guidelines. I do have some concerns this year regarding the railroad right of way, baseball fields and the limited access this allows. In addition, a portion of the fallout area includes a portion of a commercial property within the City of Renton. I have contacted Renton Fire Officials and have not received a response at the time of this memo. Last year the Renton Fire Marshal approved our plan, which is the same as in previous years. Crowd control can be a potential issue, as the crowd that assembles to watch the fire works show has increased each and every year. Last year the traffic leaving the site was managed with the available Tukwila Police on site and available patrol units. Mr. Whitacre is a licensed Pyrotechnic Operator with the State of Washington and with the Bureau of Alcohol, Tobacco and Fire Arms. The State Department of licensing also licenses Mr. Whitacre to transport fire works. The display will be held in conjunction with the City's planned event on the 4 of July, "Family Fun at the Fort being organized by the Park and Recreation Department. This will be a 35 to 40 minute show starting at approximately 2200 hours. The fireworks will be transported to the site in the AM of July 4 and will be under the required supervision until they are discharged. The mortar tubes and other equipment will be brought to the location on July 2 3 The application was reviewed to WAC 212 -17 and accepted industry standards, and I find everything is within these guidelines. I do have some concerns this year regarding the railroad right of way, baseball fields and the limited access this allows. In addition, a portion of the fallout area includes a portion of a commercial property within the City of Renton. I have contacted Renton Fire Officials and have not received a response at the time of this memo. Last year the Renton Fire Marshal approved our plan, which is the same as in previous years. Crowd control can be a potential issue, as the crowd that assembles to watch the fire works show has increased each and every year. Last year the traffic leaving the site was managed with the available Tukwila Police on site and available patrol units. Public displays of fireworks shall be allowed pursuant to the definitions and permit provisions found in RCW 70.77.255, 70.77.260 (2), 70.77.280 through 70.77.295, and City requirements in TMC 8.12.020 -3.c, 3.d 3.e below. c. Applications for public display of fireworks shall be made in writing at least 14 days before the proposed display. The Fire Marshal shall investigate the safety, supervision, responsibility and preparation for the display, and shall report to the City Council those findings. d. (2) The chief of the Washington state patrol, through the director of fire protection, shall prescribe uniform, statewide standards for retail fireworks stands including, but not limited to, the location of the stands, setback requirements and siting of the stands, types of buildings and construction material that may be used for the stands, use of the stands and areas around the stands, cleanup of the area around the stands, transportation of fireworks to and from the stands, and temporary storage of fireworks associated with the retail fireworks stands. All cities and counties which allow retail fireworks sales shall comply with these standards. (3) No retail fireworks permit may be issued to any applicant unless the retail fireworks stand is covered by a liability insurance policy with coverage of not less than fifty thousand dollars and five hundred thousand dollars for bodily injury liability for each person and occurrence, respectively, and not less than fifty thousand dollars for property damage liability for each occurrence, unless such insurance is not readily available from at least three approved insurance companies. If insurance in this amount is not offered, each fireworks permit shall be covered by a liability insurance policy in the maximum amount offered by at [east three different approved insurance companies. BACKGROUND The City acquired the play equipment as part of the park transfer from King County in 2003. In 1996, King County installed the Landscape Structures play equipment. This playground equipment has met its life expectancy and was replaced in a new location in the park with Park Project 03- PK07- FTDENT -07. The new playground improvement project was completed on April 16, 2008. DISCUSSION: Staff chose to leave the play equipment up during construction to allow a place for the children to play while the new playground was installed. It is now time to remove and dispose of the old playground equipment. RECOMMENDATION It is recommended that the City Council declare the Capital Equipment as surplus and authorize the Mayor initiate the disposal of the old Fort Dent Playground Equipment. Committee members asked clarifying questions of staff and identified general typographical errors. BACKGROUND Prior to the demolition of the barn from the old Codiga Farm site, staff measured and drew the gable barn structure. This information was used to create a unique gabled picnic shelter for the park being constructed at Codiga Park. This is one of the ways that the history of the site is being demonstrated in the design of the park. At this time, we are making purchases for various park amenities for three different parks. The order for all these items will be placed at the same time to save money on freight and to receive a discounted price prior to an unusual mid -year price increase. The items for Codiga Park will be "owner provided and contractor installed" while staff will install the other items at the Spray Park and Macadam Winter Garden. The picnic shelter is a 'long lead' item. The City ordering the shelter now will allow for a shorter construction contract with a completion date this fall, permits pending. DISCUSSION: Staff has obtained a bid from the State Bid list for the unique picnic shelter and various park amenities for three different parks: CODIGA: Picnic Shelter, 3 benches, 3 trash cans, 4 picnic tables; SPRAY PARK: 3 benches 1 trash can; and MACADAM WINTER GARDEN: 1 trash can. RECOMMENDATION It is recommended that the City Council authorize the Mayor to sign a Purchase Order for Northwest Playground Equipment, Inc. (State Bid Contract No. 14803) in the amount of $43,990.35 to purchase the Codiga Park picnic shelter and additional park amenities. BACKGROUND The Transportation Improvement Program (TIP) is updated annually as required by RCW. The 1'lP is adopted by resolution after a public hearing at the local agency level and incorporated into the regional and state 'HI's. The TIP is primarily a fmancial planning document for projects competing for grants. Any project submitted for federal grant funding must be included in the local, regional and state adopted 'l'IPs. The TIP is a rolling plan showing various funding sources: grants, developer, and local funds. Projects "roll" as funds or stages (design report, final design, and construction) occur. Tukwila's TIP and Capital Improvement Plan (CIP) list many of the same transportation related projects. The TIP lists only those transportation related projects planned within the next six years that are deemed regionally significant. The City's CIP lists transportation projects planned in the next six years and beyond, as well as water, sewer, surface water, and capital facilities. The TIP is required to be adopted by July 1 on an annual basis, while the CIP is prepared during summer /fall in conjunction with the City's budget preparation. Differences between the two may be due to priority changes, funding availability changes, or other factors that normally occur during the time between adoption of each document. ACTION TAKEN The attached spreadsheet is the "Draft" 2009 2014 HP and was created by modifying the 2008 2013 TIP to add or remove projects, adjust project costs, and reprioritize the list of projects. Six -Year Transnortation Improvement Plan (TIP) 2009 -2014 Staff is seeking Council adoption, via resolution, of the 2009 -2014 Six -Year Transportation Improvement Plan (TIP). Staff discussed the annual update to the TIP. This annual rolling program is generally modified to reflect the City's CIP, as the two are updated at different times of the year. Differences between the two plans are often based on and reflective of the time between the adoptions of each document. Two changes are noted in the current document; one addition and one deletion: Addition: Tukwila Urban Center /Transit Oriented Development Pedestrian Improvements has been added to the plan in order to seek and qualify for grant funds (State requires inclusion in plan for grant consideration). Deletion: Southcenter Boulevard (from I -5 to Tukwila International Boulevard) this project will return to the plan in another budget cycle; the current project portion is assigned to Sound Transit and there is no need to include it in the current plan. The Committee recommends forwarding the update to COW for discussion. A public hearing will be held prior to passing the resolution at the same meeting. UNANIMOUS APPROVAL. FORWARD TO JUNE 9 COW FOR DISCUSSION AND PUBLIC HEARING. B. Tukwila Urban Center Access Proiect (Klickitat) Ordinance for Acauisition of Right -of -Way. Permanent Easements and Temporary Construction Easements Staff is requesting full Council approval to begin the property acquisition process, and if needed, condemnation authority, to obtain property for the Tukwila Urban Center Access project. It is standard for City staff to request condemnation authority at the beginning of a property acquisition process for public projects. Although it is highly unlikely that any that any parcel of land within this area will require condemnation, establishing the ordinance prepares the City for condemnation proceedings, if required. The City needs to acquire the right -of -way from two properties, in addition to some temporary construction easements and a permanent easement. One property owner (Westfield), not listed in the memo provided by staff, has already agreed to grant the appropriate easements and is not mcluded on the property list. DISCUSSION Final design for Tukwila Urban Center Access Project (Klickitat) is complete. Right -of -Way (ROW) is needed along the project in order to construct the proposed improvements. Temporary construction easements and one permanent easement are also necessary. The project is scheduled for advertisement in the third or fourth quarter of 2008, once the ROW is secured and the Local Improvement District (LID) funding mechanism is established. There are only two parcels affected by ROW acquisition, but three parcels will be affected by easements. As with previous projects that have involved acquiring additional property, the City will do everything within its power to work cooperatively with the property owners. However, should the City not be successful in these efforts, condemnation of the property would be required. Letters have been mailed to property owners notifying them of this potential condemnation and the Council's schedule for ordinance approval. RECOMMENDATION Approve ordinance authorizing the acquisition of property for the Tukwila Urban Access Project. WHEREAS, in order to maintain and improve existing public streets and to meet the current and future requirements and goals of the City of Tukwila Comprehensive Plan and related planning documents, it will be necessary for the City to acquire real property; and WHEREAS, the City of Tukwila will be reviewing and approving specific project plans, schedules and budgets for the Tukwila Urban Center Access Project (Klickitat- Southcenter Parkway Access Revision, Project Number 84 -RW19) (the "Project and WHEREAS, in order to complete the Project, it has been determined that the City of Tukwila must acquire the property and property rights described in Exhibit A for public use of public streets; and WHEREAS, the City of Tukwila is authorized by RCW 35A.64.200 and Chapter 8.12 RCW to initiate eminent domain proceedings for the condemnation of the property; and WHEREAS, the City of Tukwila has commissioned appraisals to determine the fair market value of the properties and will continue to negotiate in good faith with the owners of the properties authorized to be acquired, with the intent of reaching agreement for the voluntary acquisition of the property for fair market value; and WHEREAS, the funds necessary to acquire the property by voluntary purchase or to pay just compensation adjudged due after condemnation shall be paid from City of Tukwila funds; and WHEREAS, following proper public notice, the City Council held a public hearing on June 16, 2008, regarding the acquisition of land for the Project pursuant to Chapter 8.12 RCW; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. Public Use and Necessity Declared. The City Council of the City of Tukwila finds construction of the Project to be a public use, specifically the construction of public streets and public walkways providing for additional vehicular and pedestrian capacity. The City Council finds construction of the Project to be necessary and in the best interest of the citizens and motorists within the City of Tukwila. Section 2. Mayor Authorized. The Mayor is hereby authorized to negotiate and prepare such agreements as are customary and necessary for the acquisition of the real property interests described in Exhibit A, said property to be used for the public use of C:\Documents and Setting Users\Desktop\KellyMSDATA \Ordinances \TUC Klickitat- Southcenter Condemnation.doc GL:ksn 6/4/2008 Page 1 of 2 construction of the Project. Execution of such final agreements by the Mayor shall occur only after approval by the City Council at an open public meeting. Section 3. Settlement. The Mayor is further authorized to settle condemnation litigation or enter administrative settlements (a settlement in lieu of initiating condemnation litigation) for the acquisition of the real property interests described in Exhibit A. Such settlements shall be made only upon the recommendation of legal counsel, for amounts deemed to be a reasonable estimation of fair market value, and shall be subject to final approval by the City Council at an open public meeting. Section 4. Condemnation. In addition to the authority granted to the Mayor in Sections 2 and 3 above, condemnation proceedings are hereby authorized to acquire property and property rights and /or rights of property described in Exhibit A. The Mayor is additionally authorized to make minor amendments to the legal descriptions of properties described in the attached Exhibit A, as may be necessary to correct scrivener's errors or to conform any legal description to the precise boundaries of the property actually acquired for construction of the Project. Condemnation of the property is subject to the making or paying of just compensation to the owners or possessors thereof, in a manner provided by law. Section 5. Compensation and Source of Funds. Compensation shall be made for the land taken and damaged. The funds necessary to acquire the property by purchase or to pay just compensation adjudged due after condemnation shall be paid from the City of Tukwila's Capital Improvement Program funds. Section 6. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 7. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five days after passage and publication as provided by law. Six -Year Transportation Improvement Plan (TIP) 2009 -2014 Staff is seeking Council adoption, via resolution, of the 2009 -2014 Six -Year Transportation Improvement Plan (TIP). Staff discussed the annual update to the TIP. This annual rolling program is generally modified to reflect the City's CIP, as the two are updated at different times of the year. Differences between the two plans are often based on and reflective of the time between the adoptions of each document. Two changes are noted in the current document; one addition and one deletion: Addition: Tukwila Urban Center /Transit Oriented Development Pedestrian Improvements has been added to the plan in order to seek and qualify for grant funds (State requires inclusion in plan for grant consideration). Deletion: Southcenter Boulevard (from I -5 to Tukwila International Boulevard) this project will return to the plan in another budget cycle; the current project portion is assigned to Sound Transit and there is no need to include it in the current plan. The Committee recommends forwarding the update to COW for discussion. A public hearing will be held prior to passing the resolution at the same meeting. UNANIMOUS APPROVAL. FORWARD TO JUNE 9 COW FOR DISCUSSION AND PUBLIC HEARING. B. Tukwila Urban Center Access Proiect (Klickitat) Ordinance for Acauisition of Right -of -Way. Permanent Easements and Temporary Construction Easements Staff is requesting full Council approval to begin the property acquisition process, and if needed, condemnation authority, to obtain property for the Tukwila Urban Center Access project. It is standard for City staff to request condemnation authority at the beginning of a property acquisition process for public projects. Although it is highly unlikely that any that any parcel of land within this area will require condemnation, establishing the ordinance prepares the City for condemnation proceedings, if required. The City needs to acquire the right -of -way from two properties, in addition to some temporary construction easements and a permanent easement. One property owner (Westfield), not listed in the memo provided by staff, has already agreed to grant the appropriate easements and is not included on the property list. Transoortation Committee Minutes Mav 28 2008 Paae 2 Staff also reported that the condemnation notification process has changed, and several new requirements have been placed on the party seeking acquisition (which in this instance is the City). In response to a general inquiry from the Committee, staff reported that this project was delayed for a time due to design issues and discussions with property owners. UNANIMOUS APPROVAL. Annual Concurrencv Model Update Contract with Fehr Peers/Mirai for Model Update Staff is seeking full Council approval to enter into a consultant agreement with Fehr Peeers/Mirai in the amount of $32,453 for transportation modeling services. This consultant agreement will conduct transportation analysis and update the City's Transportation Model and ensure that the City is meeting the needs of the Concurrency Management Program. Current development throughout the City requires that model be updated annually to reflect the needs of the City. As a side note, staff reported that effective June 1, 2008, Mirai will merge with Fehr Peers. Mirai has provided some of the City's past modeling services (2002, 2006 and 2007). UNANIMOUS APPROVAL. Annual Concurrencv Model Update Contract with Traffic Data Gathering for Traffic Counts As an information only item which ties into the previous agenda item, staff reported that the City is entering into an agreement with Traffic Data Gathering. This agreement will provide services related to traffic counts. Staff has eliminated and added count locations (i.e.: do to congestion, etc.) which need to be updated as well as intersection, turning and 24 -hour volume counts. Any substantial/notable changes in traffic counts will return to the Committee for presentation at a later time. INFORMATION ONLY. E. Interurban Avenue South Pavement Repair Contract Acceptance and Closeout Staff is seeking full Council approval for project completion, contract acceptance and authorization to release retainage for the Interurban Avenue South Pavement Repair which was completed on March 25, 2008. The final cost of the project was $30,655.94, which includes a $2,081.94 overrun as a result of an increase in the amount of asphalt concrete pavement needed to complete the project. This project bid award originally came to Committee on January 15, 2008. UNANIMOUS APPROVAL. FORWARD TO JUNE 2 CONSENT AGENDA. F. Review of Draft Walk Roll Plan Staff provided a general overview of the draft Walk and Roll Plan which was distributed to Council approximately three weeks ago. The draft Plan is currently available on the City's website, and staff has been gathering suggestions from the public as well as the City's Planning Commission. A brief history of the Plan's formulation was given, including information about the grant through Washington State Department of Community, Trade and Economic Development which was awarded to the City in 2006 to develop a City -wide non motorized plan exclusive to pedestrian and bicycle traffic. Once adopted, this will be a functional plan which will be utilized as a guide to assist in project prioritization as well as grant applications. The intent of the Plan is to build on what is currently in the City's Comprehensive Land Use Plan regarding the building and establishment of the connectivity of pedestrian and bicycle routes. BACKGROUND In December 2005, the City updated its Transportation Element as part of the state- required update to the Comprehensive Plan. In the Transportation Element, level of service standards are established which Tukwila is required to implement and maintain. One tool to assist the City is the emme /2 traffic model that was used to develop the Transportation Element. Mirai Associates, now called Fehr and Peers/Mirai, was the consultant retained by Tukwila in 2002 to develop the city -wide transportation model as well as update the Concurrency Model in 2006 and 2007. At this time, the model should be updated once each year. As development occurs, the frequency of the update should be adjusted to reflect the City's needs. ANALYSIS Regular and continuing maintenance of the City's traffic model is beneficial in several ways. First, in 2015 when the City will next update the Comprehensive Plan, a much smaller expense and effort will be required to model transportation needs. Second, by using the model to support concurrency management, the City will be assured that adequate transportation facilities will be available to support growth in a timely manner. It is a powerful tool in scientifically assigning priorities and planning capacity- related road projects. Thirdly, by the City assuming this responsibility, it should speed up the development process and shorten approval times for new permit applications. Much, if not ultimately all, costs of the concurrency model update will be borne by the development community in the form of the Concurrency Test Fee, which was implemented in March 2007. The cost to the developer will be a savings of both time and money due to the dramatic change in Transportation Impact Analysis (TIA) requirements. RECOMMENDATION Authorize the Mayor to execute an agreement with Fehr and Peers/Mirai, not to exceed $32,453 to provide transportation modeling services to maintain the City's model and support the Concurrency Management Program. Attachment: Consultant Agreement for Transportation Modeling Services (p: \cyndy\concurrency impact fees\information memo ongoing concurrency model 5- 08.doc) CONSULTANT AGREEMENT FOR TRANSPORTATION MODELING SERVICES THIS AGREEMENT is entered into between the City of Tukwila, Washington, herein -after referred to as "the City and Fehr and Peers/Mirai, hereinafter referred to as "the Consultant in consideration of the mutual benefits, terms, and conditions hereinafter specified. 1. Project Designation. The Consultant is retained by the City to perform transoortation modeling services in connection with the project titled Concurrence Mangement 2. Scope of Services. The Consultant agrees to perform the services, identified on Exhibit "A" attached hereto, including the provision of all labor, materials, equipment and supplies. 3. Time for Performance. Work under this contract shall commence upon the giving of written notice by the City to the Consultant to proceed. The Consultant shall perform all services and provide all work product required pursuant to this Agreement by December 31, 2008, unless an extension of such time is granted in writing by the City. 4. Payment. The Consultant shall be paid by the City for completed work and for services rendered under this Agreement as follows: A. Payment for the work provided by the Consultant shall be made as provided on Exhibit "B" attached hereto, provided that the total amount of payment to the Consultant shall not exceed $32,453 without express written modification of the Agreement signed by the City. B. The Consultant may submit vouchers to the City once per month during the progress of the work for partial payment for that portion of the project completed to date. Such vouchers will be checked by the City and, upon approval thereof, payment shall be made to the Consultant in the amount approved. C. Final payment of any balance due the Consultant of the total contract price earned will be made promptly upon its ascertainment and verification by the City after the completion of the work under this Agreement and its acceptance by the City. D. Payment is provided in this section shall be full compensation for work performed, services rendered, and for all materials, supplies, equipment and incidentals necessary to complete the work. E. The Consultant's records and accounts pertaining to this Agreement are to be kept available for inspection by representatives of the City and state for a period of three (3) years after final payments. Copies shall be made available upon request. 51- 2 d/6"(//-5 5. Ownership and Use of Documents. All documents, drawings, specifications and other materials produced by the Consultant in connection with the services rendered under this Agreement shall be the property of the City whether the project for which they are made is executed or not. The Consultant shall be permitted to retain copies, including reproducible copies, of drawings and specifications for information, reference and use in connection with the Consultant's endeavors. The Consultant shall not be responsible for any use of the said documents, drawings, specifications or other materials by the City on any project other than the project specified in this Agreement. 6. Compliance with Laws. The Consultant shall, in performing the services contemplated by this Agreement, faithfully observe and comply with all federal, state, and local laws, ordinances and regulations, applicable to the services to be rendered under this Agreement. 7. Indemnification. The Consultant shall indemnify, defend and hold harmless the City, its officers, agents and employees, from and against any and all claims, losses or liability, including attorney's fees, arising from injury or death to persons or damage to property occasioned by any act, omission or failure of the Consultant, its officers, agents and employees, in performing the work required by this Agreement. With respect to the perform- ance of this Agreement and as to claims against the City, its officers, agents and employees, the Consultant expressly waives its immunity under Title 51 of the Revised Code of Washington, the Industrial Insurance Act, for injuries to its employees, and agrees that the obligation to indemnify, defend and hold harmless provided for in this paragraph extends to any claim brought by or on behalf of any employee of the Consultant. This waiver is mutually negotiated by the parties. This paragraph shall not apply to any damage resulting from the sole negligence of the City, its agents and employees. To the extent any of the damages referenced by this paragraph were caused by or resulted from the concurrent negligence of the City, its agents or employees, this obligation to indemnify, defend and hold hauuiless is valid and enforceable only to the extent of the negligence of the Consultant, its officers, agents and employees. 8. Insurance. The Consultant shall secure and maintain in force throughout the duration of this contract comprehensive general liability insurance, with a minimum coverage of $500,000 per occurrence and $1,000,000 aggregate for personal injury; and $500,000 per occurrence/ aggregate for property damage, and professional liability insurance in the amount of $1,000,000. Said general liability policy shall name the City of Tukwila as an additional named insured and shall include a provision prohibiting cancellation of said policy except upon thirty (30) days prior written notice to the City. Certificates of coverage as required by this section shall be delivered to the City within fifteen (15) days of execution of this Agreement. 9. Independent Contractor. The Consultant and the City agree that the Consultant is an inde- pendent contractor with respect to the services provided pursuant to this Agreement. Nothing in this Agreement shall be considered to create the relationship of employer and employee between the parties hereto. Neither the Consultant nor any employee of the Consultant shall 2 be entitled to any benefits accorded City employees by virtue of the services provided under this Agreement. The City shall not be responsible for withholding or otherwise deducting federal income tax or social security or for contributing to the state industrial insurance program, otherwise assuming the duties of an employer with respect to the Consultant, or any employee of the Consultant. 10. Covenant Against Contingent Fees. The Consultant warrants that he has not employed or retained any company or person, other than a bonafide employee working solely for the Consultant, to solicit or secure this contract, and that he has not paid or agreed to pay any company or person, other than a bonafide employee working solely for the Consultant, any fee, commission, percentage, brokerage fee, gifts, or any other consideration contingent upon or resulting from the award or making of this contract. For breach or violation of this warrant, the City shall have the right to annul this contract without liability, or in its discretion to deduct from the contract price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage fee, gift, or contingent fee. 11. Discrimination Prohibited. The Consultant, with regard to the work performed by it under this Agreement, will not discriminate on the grounds of race, color, national origin, religion, creed, age, sex or the presence of any physical or sensory handicap in the selection and retention of employees or procurement of materials or supplies. 12. Assignment. The Consultant shall not sublet or assign any of the services covered by this Agreement without the express written consent of the City. 13. Non Waiver. Waiver by the City of any provision of this Agreement or any time limitation provided for in this Agreement shall not constitute a waiver of any other provision. 14. Termination. A. The City reserves the right to terminate this Agreement at any time by giving ten (10) days written notice to the Consultant. B. In the event of the death of a member, partner or officer of the Consultant, or any of its supervisory personnel assigned to the project, the surviving members of the Consultant hereby agree to complete the work under the terms of this Agreement, if requested to do so by the City. This section shall not be a bar to renegotiations of this Agreement between surviving members of the Consultant and the City, if the City so chooses. 15. Attorneys Fees and Costs. In the event either party shall bring suit against the other to enforce any provision of this Agreement, the prevailing party in such suit shall be entitled to recover its costs, including reasonable attorney's fees, incurred in such suit from the losing party. 3 16. This Agreement, together with attachments or addenda, represents the entire and integrated Agreement between the City and the Consultant and supersedes all prior negotiations, representations, or agreements written or oral. This Agreement may be amended only by written instrument signed by both the City and the Consultant. The City will work with Fehr and Peers /Mirai (the Consultant) to identify traffic count locations. 2. The City will provide traffic count raw data to the Consultant. The Consultant will review the raw data and adjust the counts for PM peak hour. The City will provide a list of the transportation improvements including new roadway construction, signal additions and changes to signal timings that were implemented since the last modeling. The Consultant will calculate 2008 levels of service using Synchro. The Consultant will prepare an existing condition section in the report. 3. The City will update the existing land use database that was provided to the Consultant for the 2007 modeling. The Consultant will convert the land use data to employment and households that will be suitable for modeling. 4. The Consultant will update the base year model with the 2008 counts. The Consultant will use the model created in 2007 based on the new PSRC model. The Consultant will validate the new base year model with 2008 traffic counts. 5. The Consultant will review the most recent CIP report. The Consultant will include the relevant transportation improvement projects in the model. The Consultant will identify the housing and employment growth for next 6 years within the City and the region. With the changes in the roadway network and the land use growth projections, the Consultant will develop a 2014 concurrency model. Using the 2014 Tukwila travel demand model, the Consultant will forecast the 2014 traffic volumes. 6. The Consultant will post- process the model volumes and calculate 2014 concurrency levels of service for all designated intersections in the City. 7. The Consultant will identify potential improvements where the intersections operate level of service below the concurrency standard. The Consultant will attend a meeting to discuss the analysis results and the potential improvements. 8. The Consultant will calculate levels of service with the recommended improvements. 9. The Consultant will prepare a draft concurrency status report and submit it for staff review, and submit the final report after all staff comments are addressed. Annual Concurrencv Model Update Contract with Fehr Peers/Mirai for Model Update Staff is seeking full Council approval to enter into a consultant agreement with Fehr Peeers/Mirai in the amount of $32,453 for transportation modeling services. This consultant agreement will conduct transportation analysis and update the City's Transportation Model and ensure that the City is meeting the needs of the Concurrency Management Program. Current development throughout the City requires that model be updated annually to reflect the needs of the City. As a side note, staff reported that effective June 1, 2008, Mirai will merge with Fehr Peers. Mirai has provided some of the City's past modeling services (2002, 2006 and 2007). UNANIlVIOUS APPROVAL. Annual Concurrencv Model Update Contract with Traffic Data Gathering for Traffic Counts As an information only item which ties into the previous agenda item, staff reported that the City is entering into an agreement with Traffic Data Gathering. This agreement will provide services related to traffic counts. Staff has eliminated and added count locations (i.e.: do to congestion, etc.) which need to be updated as well as intersection, turning and 24 -hour volume counts. Any substantial/notable changes in traffic counts will return to the Committee for presentation at a later time. INFORMATION ONLY. E. Interurban Avenue South Pavement Repair Contract Acceptance and Closeout Staff is seeking full Council approval for project completion, contract acceptance and authorization to release retainage for the Interurban Avenue South Pavement Repair which was completed on March 25, 2008. The final cost of the project was $30,655.94, which includes a $2,081.94 overrun as a result of an increase in the amount of asphalt concrete pavement needed to complete the project. Review of Draft Walk Roll Plan Staff provided a general overview of the draft Walk and Roll Plan which was distributed to Council approximately three weeks ago. The draft Plan is currently available on the City's website, and staff has been gathering suggestions from the public as well as the City's Planning Commission. A brief history of the Plan's formulation was given, including information about the grant through Washington State Department of Community, Trade and Economic Development which was awarded to the City in 2006 to develop a City -wide non motorized plan exclusive to pedestrian and bicycle traffic. Once adopted, this will be a functional plan which will be utilized as a guide to assist in project prioritization as well as grant applications. The intent of the Plan is to build on what is currently in the City's Comprehensive Land Use Plan regarding the building and establishment of the connectivity of pedestrian and bicycle routes. BACKGROUND The City Council unanimously approved Phase One of the City's Emergency Management Initiatives on May 21, 2007. One of the items included in Phase One was for First Responder Support with a budget of $100,000.00 for the purchase of a self contained Disaster Emergency Response Trailer (DERT). The intent was to provide shelter support for up to 100 emergency workers. To support sustainable operations through the response, relief and recovery phases following an emergency, the City must provide safe food, water and shelter to First Responders and emergency workers. Additionally, the City must provide immediate emergency disaster supplies for staff should a disaster occur while personnel are on the job. City staff will need rapid access to food, water, personal protective materials, First Aid supplies and accurate information alerting personnel on safe actions that must be taken. The American Red Cross has developed a DERT configuration that has proven very successful in responding to shelter needs in the region. The American Red Cross also offers Disaster Supply Kits for 10 people that can be distributed to City owned facilities to provide immediate access following a disaster and AM/FM NOAA radios with hand crank generators and cellular phone chargers which will be essential during an emergency. In order to provide water to emergency workers, the City must be able to draw water from the North Hill Reservoir, fire hydrants or portable water blivets. An Emergency Water Distribution System can provide safe drinking water from the sources listed above and includes a manifold system, a generator and single use water bags. Work continues on the development of a comprehensive plan for an Emergency Food Program. The program will be finalized over the coming months. The Personnel Director is in the process of performing an analysis and creating position descriptions. The expectation is that the CERT staff member can be on board in mid- August, 2007 and the Emergency Operations Coordinator hired by mid September, 2007. II The Councilmembers expressed support for the initiative and also indicated the desire for continued discussion and Council involvement in the additional phases of the overall project. Purchase of Disaster Emergencv Response Trailer (DERT) and Eouinment Staff is seeking full Council approval to purchase two Disaster Emergency Response Trailers (DERT), disaster supply kits, an emergency water distribution system and National Oceanic and Atmospheric Administration (NOAA) weather radios in the amount of $61,000. Staff provided an overview of the contents of the DERT trailers and associated equipment. The trailers can be purchased under state contract and are standard Homeland Security trailers under Washington State Emergency Management Division designation. The contents will be reflective of a standard American Red Cross shelter support supplies configuration. The intent of these trailers is to provide shelter supplies for 100 first responders /emergency workers. Upon approval to purchase, staff anticipates implementation of the equipment by late August.
