As we agreed, I have reviewed the matter of floor elevation with the Public Works Department and Fred Satterstrom and I have walked the site in reference to the topographical information provided with your building permit drawings. Our firm conclusion on this matter is that the elevation of the first floor should be at or below 84.0 (based on your survey information). Should you desire to place it higher than 84.0, review by the Planning Commission pursuant to Section 2 C of Tukwila Ordinance #1041 must be required by this office. Since.the application deadline for the regular April Planning Commission meeting is 5:00 p.m. Thursday, 13 April 1978, you may desire to indicate your intentions very quickly. Craig requested a clarification of my letter indicating a significant difference between the plans previously approved by the Planning Commission and the plans submitted for building permit. As I noted in my previous letter, the proposed mounding for the first floor elevation differs greatly from the below -grade first floor elevation depicted in the plans approved by the Plan- ning Commission. To clarify the matter, the plans approved by the Planning Commission include a post - development cross- section through the property. It indicates the entire first floor to be sub - grade. The plans submitted under application #77 -00 include contours and a different cross- section. This new information reveals the fact that only the east end of the first floor will be sub - grade. Moreover, it indicates that the west end of the first floor will be significantly higher than the existing grade. Consequently, this office deems the permit drawing to reflect significant revisions which, under Ordinance #1041, should be reviewed by the Planning Commis- sion to "ensure the development design complements the residential neighborhood." Your options remain as outlined in my previous letter. Dear Mr. Schneider: As you may remember, the City Council at an earlier meeting, decided that a . waiver to Ordinance #1035 was not required due to the time you submitted your building permit application. Their action, however, was to refer it back to the administration to determine if it required a waiver under resolution #489. The administration's decision was to have a testing laboratory conduct a soils investigation and to use that in determining if a waiver to resolution #489 was • required. We contacted you and got a release allowing Cascade Testing Laboratory to go on your site to conduct the study. We are now in receipt of that study which includes setback recommendations and foundation design recommendations for the proposed structure. In looking over your proposal, it is apparent that there is proposed excavation that will occur in areas in access of 25% slope. This is not consistent with Section 4.0.1 of resolution #489 and consequently a waiver is required. I will reverse this requirement for a waiver if your site plan will show that there will be no disruption to any of the land, and no grading done, at any point within 10 feet of the top of the steep slope and no disruption to the slope below the top. In addition, we will need the following information before we will be in a position to issue the building permit: 1. A revised site plan showing the exact location of the buildings. This must demonstrate compliance with the soils reports as far as setbacks go. 2. A certification by a professional engineer registered in the State of Washington to the effect that the proposed development is in compliance with the soils investigation report on the property submitted to the City by Cascade Testing Laboratory.. .
