WITNESSETH: That for and in consideration of the mutual covenants herein expressed, it is hereby agreed between the above parties as follows: 1st - A side sewe shall be constructed as follows: (See attached legal description of location of easement) SEE RTT-P. cke. d - 1e 3 P77) Nwy, 2nd - There shall be, and each party does grant unto the other, an easement 5 feet wide for sewer along the line as constructed for the use of said properties and for the purpose of constructing, installing, reconstructing, replacing, repairing, maintaining and operating a sewer pipeline and lines and all necessary connections and appurtenances thereto, together with the right of ingress and egress therefrom for the purpose of enjoying the easement, and also granting to Grantees and to those acting under or for Grantees the use of such additional area immediately adjacent to the above easement as shall be required for the construction of the sewer pipeline or lines in the easement, such additional area to be held to a minimum necessary for the purpose, and immediately after the completion of the construction and installation, or any subsequent entry upon the easement, Grantees shall restore the premises as near as may be to its condition immediately before such construction or entry. 3rd - The cost of construction of said sewer shall be borne by the owners of the said properties as follows: As mutually agreed 4th - The cost of maintenance, repair or reconstruction of that portion of the sewer used in common shall be borne in equal shares, except that the owners of any lower parcel shall not be responsible for the part of the sewer above their connection; and when necessary to repair, clean or reconstruct the sewer, the parties to this agreement shall have a right of entry for that purpose. 5th - This agreement shall be a covenant running with the land and shall be binding upon all parties, eirs and assigns forever.
