Start: 6:00 p.m. Mayor Haggerton announced the purpose of the Executive Session is to discuss: Potential Property Acquisition — Pursuant to RCW 42.30.110(1)(b) Pending Litigation - RCW 42.30.110(1)(i) It will last no more than 60 minutes, and no decisions will be made during the Executive Session. End: 6:50 p.m. CALL TO ORDER/PLEDGE OF ALLEGIANCE /ROLL CALL Mayor Haggerton called the Regular Meeting of the Tukwila City Council to order at 7:00 p.m. and led the audience in the Pledge of Allegiance. ROLL CALL Christy O'Flaherty, City Clerk, called the roll of the Council. Present were Councilmembers Joe Duffie, Dennis Robertson, Allan Ekberg, Verna Seal, Kathy Hougardy, De'Sean Quinn and Kate Kruller. AMEND AGENDA MOVED BY HOUGARDY, SECONDED BY ROBERTSON TO AMEND THE AGENDA TO ADD ITEM 7A UNDER NEW BUSINESS, AN OFFER OF JUDGEMENT. MOTION CARRIED 7 -0. SPECIAL PRESENTATIONS a. A presentation from King County Councilmember Julia Patterson. Julia Patterson, King County Councilmember, expressed that she would like to extend a formal "goodbye," having spent 12 years representing the 5th District of King County, which includes the City of Tukwila. Her term is over at the end of 2013 and she will not be seeking re- election. While she has been a King County Councilmember for 12 years, she started in public service 24 years ago in the newly formed City of SeaTac. She recounted the accomplishments of South King County cities to include an Tukwila City Council Regular Meeting Minutes November 4, 2013 Page 2 of 9 increase in parks and trails systems, transit development involving the Light Rail system, the Sounder Train, rapid bus services that include essential east -west connections, and improvements in public health policies. As she leaves office, she remains concerned about a stable, dedicated funding source for human services and hopes efforts will continue to seek solutions to serve the most vulnerable populations. She thanked the Council and Mayor for the honor of serving the community. The Mayor and Councilmembers applauded Ms. Patterson, each expressing their gratitude to her for being an inspiration, a role model, a tireless public servant, graceful under pressure, and personally accessible and available to community members. Mayor Haggerton presented Ms. Patterson with a Certificate of Appreciation for her dedication and commitment to the City of Tukwila. b. Third Quarter update on Strategic Plan. Joyce Trantina, Mayor's Office. Joyce Trantina, Mayor's Office Project Analyst, utilized a Powerpoint presentation to provide an update on the Strategic Plan for the 3rd Quarter, with the following highlights: Strategic Plan Goals 1. A Community of Inviting Neighborhoods & Vibrant Business Districts 2. A Solid Foundation for All Tukwila Residents 3. A Diverse & Regionally Competitive Economy 4. A High- Performing & Effective Organization 5. A Positive Community Identity and Image 2013 PRIORITY 1 - CRIME REDUCTION, TUKWILA INTERNATIONAL BOULEVARD (TIB) ❖ Tukwila Police Dept. and staff conducted tours of TIB in August and September ❖ August 27, 2013 search /seizure of motels ❖ Patrol Admin. Assistant/Crime Prevention officer roles filled 2013 PRIORITY 2 - IMPROVED ENVIRONMENT FOR COMMUNITY LIVABILITY ❖ Two derelict properties have been abated under the recently amended Nuisance Ordinance ❖ Rental housing inspections have commenced in Zone 3, which encompasses Tukwila International Blvd 2013 PRIORITY 3 - STRENGTHENED FINANCIAL FUNDAMENTALS :• City's Compensation Policy has been adopted ❖ Year -end (2012) was better than anticipated and current reserves are higher than expected ❖ Staff are continuously evaluating revenue opportunities 2013 PRIORITY 4 - UPDATED PLANS AND POLICIES THAT ARE ALIGNED WITH THE COMMUNITY'S VISION ❖ Comprehensive Plan update continues — several elements have been finalized ❖ PROS Plan — Strategies /Recommendations being developed ❖ Global to Local health promoters /liaisons in place and we are beginning our City Government 101 efforts 2013 PRIORITY 5 - IMPROVED ACCESS TO CITY SERVICES /DECISION MAKING ❖ Testing completed on the City's new permit software, TRAKiT ❖ Several City events have been videotaped and produced for TV21 content 2013 PRIORITY 6 - COUNCIL /STAFF /PARTNERS ENGAGED IN A SHARED COMMITMENT TO THE COMMUNITY'S VISION ❖ Second High Performing Organization training held in September ❖ Cultural Awareness training beginning across City departments ❖ Staff working with service providers to support health care enrollment efforts The Councilmembers asked clarifying questions regarding the presentation and thanked Ms. Trantina for the updated information. Kathy Stetson, Code Enforcement Officer, provided an update on Code Enforcement activities, using a Powerpoint presentation. Key points included: 2013 Focus • Tukwila International Boulevard • Mobile Food Vendors • Rental Housing Licensing /Inspections • Abatement of nuisance properties • Ordinance updates Tukwila International Boulevard In 2013 we proactively inspected for: • Garbage, Debris • Deteriorated structures • Inadequate landscaping • Broken windows • Graffiti • Sign code violations • Construction without permits Rental Housing Licensing • There are 628 rental properties (not "units ") with 2013 licenses • Inspections have uncovered multiple life- safety issues which have been corrected • Landlords and tenants have expressed appreciation for the program Rental Properties • ADU 16 properties /16 units • SFR /Condo 473 properties /473 units • Duplex 27 properties /54 units • 3 -Plex 13 properties /39 units • 4 -Plex 41 properties /164 units • Apts (5 +) 58 properties /3057 Units • Total 628 properties /3803 units Rental Inspections • 2011 — 746 units inspected • 2012 — 533 units inspected • 2013 — 1377 units inspected by 12/31/13 • 2014 — 1146 units inspected by 12/31/14 City Inspectors are on track to inspect 320 +/- units between October 1 — December 15, 2013 Abatement Process • Process is complicated • Requires heavy use of staff time • Numbers are growing faster than Code Enforcement can work them Abatement Properties About 90 properties have been identified as nuisances under TMC 8.28.030 • Vacant dangerous buildings • Severe overgrowth • Accumulation of rubbish, junk vehicles List is being prioritized based on risk to community Case Load • 2012 cases opened 400 • 2012 cases closed 361 • 2013 cases opened 256 to date • 2013 cases closed 240 to date Tukwila City Council Regular Meeting Minutes November 4, 2013 Page 4 of 9 Other Duties • Respond to citizen complaints • Business License enforcement • Neighborhood Outreach • Coordinate volunteer assistance to needy residents • Crime Hot Spots Task Force • Monitor State legislation The Councilmembers asked questions regarding the presentation and offered comments as follows: Appreciation to the 3 Code Enforcement staff members for good work; Recognition that the abatement process is based in legal requirements that take time; Awareness of challenges involving language barriers; Gratitude for Code Enforcement staff working on off -hours to resolve differences; Acknowledgement that the citizens consider code enforcement a priority; and Advocacy for additional staffing. Jack Pace, Community Development Director, relayed that efficiencies are being pursued with the City Attorney's Office regarding the abatement process. The new permit system is also anticipated to provide efficiencies. Mr. Pace explained that extra labor will be utilized to handle the workload, and then the situation can be assessed for a recommendation for the 2015 -2016 budget period. The Councilmembers thanked Ms. Stetson for the informative presentation. CITIZEN COMMENTS Jacqueline Carroll, 16241 49th Avenue South, expressed that she is committed to the ideal that every man, woman and child in the community learn to swim to prevent drowning. She is concerned about gender segregation at the pool and what she heard at the last MPD Board Meeting. She wants the City's legal team to identify why her tax dollars can be used to segregate her gender from the local pool due to religious beliefs. Approximately 10 young women commented (at the last MPD meeting) on their appreciation of the segregation. All but 2 of them are Muslim, and none of the women live in Tukwila. In her viewpoint, religious beliefs should not be a criteria for use of tax dollars for gender segregation. No female or male Tukwila residents spoke in favor of this. The staff implemented the segregation at the pool without informing the MPD Commissioners and without legal review. She would like to see grants pursued so the group can rent the pool for their swimming needs. She wants City and State lawyers to provide case law and statutes to verify that gender segregation can withstand a legal challenge. CONSENT AGENDA a. (Removed from Consent Agenda) Councilmember Kruller said the vouchers seemed sound, however, the MPD vouchers are mixed in with the City vouchers. It is her understanding it was determined that they should be separated. Peggy McCarthy, Finance Director, conveyed that was an oversight and will be corrected for the future. c. A resolution authorizing the cancellation of past due accounts receivable and returned check write -offs. [Reviewed and forwarded to Consent by Finance and Safety Committee on 10/22/131 (Removed from Consent Agenda) Councilmember Kruller asked if there was a dispute process regarding bills. Ms. McCarthy explained that dialogue occurs with account holders regarding accounts receivable related issues. There is not a specific dispute process. While these accounts are being taken off the books, the credit collection agency still pursues payment on behalf of the City. Ms. Kruller relayed that she has seen dispute resolution processes at other cities and suggested the Council consider this at future planning meetings. Councilmember Kruller inquired if the bill regarding the signal pole assembly replacement was for the pole that is repeatedly hit on Tukwila International Boulevard. Ms. McCarthy replied that she would look into that and report back. Councilmember Kruller asked why we changed from Evergreen Professional Recovery to Armada Corporation for collection services. Ms. McCarthy explained that Armada has provided additional electronic services and better meets the City's needs. Councilmember Kruller expressed appreciation to the Council, Mayor and staff for accommodating the additional questions. MOVED BY ROBERTSON, SECONDED BY DUFFIE THAT THE VOUCHERS BE APPROVED. Tukwila City Council Regular Meeting Minutes November 4, 2013 Page 8 of 9 REPORTS a. Mayor Mayor Haggerton attended the recent System Wide Improvement Framework (SWIF) event for the Green River. Representatives from King County, the Army Corps of Engineers, FEMA, and Boeing toured the entire levee system. On November 2, 2013, the Mayor attended the Strategic Planning meeting at the Tukwila School District along with City staff members David Cline, City Administrator; Mike Villa, Police Chief; Evie Boykan, Human Services Manager; and Nate Robinson, Teen Program Specialist. The Mayor reported that Military Road between South 166th Street and South 176th Street will be closed for 18 months beginning November 6, 2013. The City of SeaTac is closing the road for improvements to include traffic signals, and water and utility lines. b. City Council Councilmember Duffie apologized for being unable to attend the Utilities Committee meeting this evening. Council President Hougardy will be hosting the Council Coffee Chat this coming Saturday. She said the group photo for the Council is being rescheduled, with more information forthcoming from the Council Analyst. Additionally, she is working on having Coffee Chat events at other venues in the City. She referenced correspondence regarding a Civics Class on November 19, 2013, which will involve a facilitated conversation with students. She asked the Council if they would like the reading material forwarded to them, and they responded in the affirmative. Ms. Hougardy asked the Councilmembers to let the Council Analyst know if they will be attending so RSVPs can be provided. Councilmember Ekberg reported that Sound Transit has provided 62 new parking stalls near the Tukwila Light Rail Station. The City will need to review whether this provides adequate relief to the ongoing parking issues. Councilmember Quinn attended the November 1, 2013 Teen Night event. Additionally, he was inducted into the Pacific Northwest Semi -Pro Hall of Fame (football). He would like to see the Council consider a resolution supporting the City of Richmond, California (in their effort regarding a "Plan to Preserve Homeownership, Reset Mortgages and Aid Local Economies "). Councilmember Kruller attended the November 1, 2013 Teen Night event. The teens are very plugged in to what is occurring in the community, and she will continue to have conversations with them. She recounted a story regarding her neighbor's car being stolen that was later found by the City of Fife. She encouraged everyone to be mindful of car safety. c. Staff David Cline, City Administrator, referenced the City Administrator Report and 2013 Work Plan status report for the 3ra Quarter in the packet and offered to answer any questions. He reported that there were 40 -50 people at the Tukwila School District Strategic Plan meeting on November 2, 2013. The group did some drafting of vital signs in the community as well as development of goal and mission statements. A second meeting is forthcoming. Additionally, Mr. Cline reported that the National League of Cities Conference is being hosted in the City of Seattle. Tukwila is privileged to have a mobile workshop and a City spotlight regarding our collaboration with the Regional Fire Authority and Community Schools Collaboration. Councilmember Kruller inquired about the survey regarding the Comprehensive Pian Update and the efforts at Rainbow Trailer Haven. She would like to know how many people were in attendance, what the content of the survey is, and what the results were. Intergovernmental Laurel Humphrey, Council Analyst, asked that any Councilmembers wishing to attend the Museum of Flight Veterans Day Ceremony let her know. MISCELLANEOUS Mayor Haggerton inquired about expectations from the City regarding the citizen comment about the pool that should have come before the MPD (Metropolitan Park District). MPD Board President Seal said the issue is being handled by the MPD. Councilmember Kruller explained the Council reviews the vouchers to understand how money is being spent on a daily basis and to look at the numbers and understand whether the process is going well.
