AN ORDINANCE providing for the licensing of
business within the City of Tukwila for the
purpose of regulation of such business, con-
trolling the admission of new businesses in
the corporate limits of the City of Tukwila,
defining offenses, providing penalties and
repealing Ordinance No. 208.
WHEREAS, the City of Tukwila, by Ordinance No. 208, has required
the licensing of business within the City limits of Tukwila for the purpose
of regulating business conducted within the City; and
WHEREAS, the required license fee under Ordinance 208 has been
found to be insufficient to cover the costs of issuing said licenses
NCW, THEREFORE, BE IT ORDAINED by the City Council of the City
of Tukwila as follows:
Section 11. For the purpose of this Ordinance the following
definitions shall apply:
The word ttperson" shall mean any individual, receiver, agent, trustee
in bankruptcy, trust, estate, firm, co- partnership, joint venture company,
joint stock company, business trust, corporation, society, or group of
individuals acting as a, unit, whether mutual, cooperative, fraternal, non-
profit or otherwise.
The term r "person engaged in businesso shall mean the owner or one
primarily beneficially interested in lawful business for profit and not employees.
The term t'business"' shall mean any operation performed by any person which
involves the mamufacturing or processing of materials of any type, the sale
of goods, wares, or merchandise, the rendition of services or the repair of
goods, wares or merchandise, the leasing or rental of three or more units of
real property for residential purposes, to the general public, or a portion
thereof, for any consideration, at each established place of business, store,
apartment house, office, shop or yard within the city limits of the City of
Tukwila,.

Section 2. Anny person desiring to establish or conduct any business
enterprise or undertaking, within the corporate limits of the City of Tukwila,
shall first apply to the City Council for a license to conduct such business.
This application shall be upon a form to be furnished by the City Clerk, in
which shall be stated the residence of the applicant, the nature of the business
activity in which he desires to engage, the place where it is proposed to be
conducted, the former business license number for this particular business,
if any, and amount of fees prescribed by this Ordinance.
Section 3. If, upon investigation,fthe City Council or committee
appointed by it ascertains that it is desirable that the applicant be allowed
to conduct such business within the corporate limits of the City of Tukwila,
the City Council shall instruct the Clerk to issue a license to the applicant
upon the payment of the fee of $25.00, which license shall grant to the
applicant the privilege to conduct such business as a designated location in
the City of Tukwila. Such license may be renewed by payment of the year's
fee prior to January 1st.
Section 4. The license fee set forth in this Ordinance shall be for
the calendar year, and each person engaged in business must pay the full license
fee either for the current year or portion thereof during which year or portion
thereof he engages in business;
Section 5. The license fee shall be increased in the following
increments for failure to acquire license within thirty days of commencing
business operations or for failure to renew said license within thirty days of
expiration date:
30 60 days overdue 5.00 additional
60 90 days overdue 10.00 additional
90 i120 days overdue 15.00 additional
120 --1 days overdue 20.00 additional
150 days or more overdue $25.00 additional
Section 6. The license granted in pursuance hereof shall be personal
to the licensee and it shall not be assignable or transferable to any other person.
Section 7. The license granted in pursuance hereof shall be used to JJ
conduct the business or type of business at the designated address for which

such license is ussued, Any change in the nature of the business shall necessitate
a renewed application to the Council,
Section 8. It shall be unlawful for any person to engage in or carry
on any business activity in the City of Tukwila without first procuring a
license as provided above. Such license shall thereafter be prominently
displayed in the place of business of the applicant.
Section 9. Nothing in this Ordinance shall be construed to require a
license by any person for the sale of agricultural products or produce when the
person selling such agricultural products or produce has raised or produced them
within the corporate limits is of the City of Tukwila.
Section 10. If any person engaged in business shall fail or refuse
to pay the license fee for any year as herein provided, he shall not be granted
a license for the current year until such delinquent license fees as set forth
above have been paid in addition to the current years required fee. Such fees
may be collected by the City of Tukwila by proper legal action brought for
that purpose if any person engaged in business fails or refuses to pay the
license fee. This remedy is cumulative and not exclusive..
Section 11. No license issued under this Ordinance shall be revoked
or denied without cause. The holder of any license denied or revoked for cause
shall be granted a public hearing if the holder so requests. No section or part
section of this Ordinance shall be amended without thirty (30) days public
notice prior to such change.
Section 1?2, Any person vib1ating any of the provisions of this
Ordinance shall be punished by a,. fine of not exceeding five hundred dollars
($500.00) or by imprisonment for not to exceed ninety (90) days, or both. Each
day of continued violation of this Ordinance shall constitute &separate
offense hereunder,
Section 13, The City Clerk shall have the power and it shall be her
duty from time to time to adopt, publish and enforce rules and regulations not
inconsistent with this Ordinance or with the law for the purpose of carrying
out the provisions hereof and it shall be unlawful for any person to violate or
fail to comply with any such rule or regulation.

Section 14. Ordinance No. 208 of the City of Tukwila is hereby
declared to be repealed as of December 31, 1968.
Section 1 If any section, paragraph, or portion of this Ordinance
shall for any reason be held by a court of competent jurisdiction to be
unconstitutional or invalid, such ruling shall not affect the remaining items,
parts or provisions of this Ordinance.

The foregoing proposed Ordinance will be considered by the City Council of
the City of Tukwila in regular session on Monday, December 2 1968 at 8:00 P.M.
