Subject: Draft Ordinance Setting Councilmember Compensation For
The Period January 1, 2008 through December 31, 2011
City Ordinance 2023 Setting Councilmember Compensation is set to
expire on December 31, 2007, A new ordinance is required to provide city
staff the ability to process councilmember pay subsequent to the
aforementioned sunset date.
A few important points surround the issue of council compensation.
Foremost is that Article 11, Section 8 of the Washington State Constitution
prohibit elected officials who set their own compensation (versus a Salary
Commission) from receiving increases (or decreases) in compensation
during their terms of office. Secondly, the cost of a health care policy is no
longer considered to be additional compensation for city elected officials
thanks to legislative action taken during the 2007 session. Finally, Tukwila
Municipal Code (TMC) 2.05.010 (B) states "At any time the Tukwila
compensation falls below the mean of the other Valley Communication
cities, Tukwila will review the stipends and may increase its stipend to the
level of those other cities."
No change to the current (2007) level of compensation is proposed in
accordance with the constitutional limitation and the results of a survey of
Valley Communication cities, a copy of which is also attached.
Furthermore, given the 2007 legislative action, reference to health care
benefits has been stricken from the draft ordinance.
This item was reviewed with the Finance and Safety Committee at the
December 3` meeting. Two (2) changes were proposed to the draft
ordinance. The first change proposed was to add "at the current (2007)
level" in the ordinance title. The second change proposed was to insert
"continue to" into the first sentence of Section 1 (A) Monthly
Compensation Levels. Both changes have been incorporated into the
ordinance included in this agenda packet.
In closing, I look forward to reviewing this information with you.

2.05.020 Council Benefits
Each member of the City Council, beginning January

have the ability to join the City's self insured medical and
dental plan which is offered to non represented
employees. This benefit will cover only the Coun-

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, AMENDING TUKWILA MUNICIPAL CODE CHAPTER
2.05 TO FIX THE AMOUNT OF COMPENSATION AT THE CURRENT
LEVEL (2007) FOR COUNCILMEMBERS THROUGH 2011; REPEALING
ORDINANCE NO. 2023; PROVIDING FOR SEVERABILITY; AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, Ordinance No. 2023 set Council compensation levels for the years 2003
through 2007; and
WHEREAS, the City Council recognizes that the current economy warrants a
conservative compensation that does not rise beyond the current scale; and
WHEREAS, a uniform stipend ensures that all Council members receive the same
salary for several years; and
WHEREAS, due to legislative action during 2007, the cost of a health care policy is
no longer considered to be additional compensation for elected officials;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Chapter 2.05 of the Tukwila Municipal Code is hereby amended to read
as follows:
2.05.010 Council Compensation
A. Monthly compensation levels. Pursuant to the provisions of RCW 35A.12.070,
members of the Tukwila City Council shall continue to receive the following monthly
compensation during the years listed here according to their position and the date their
term of office comrnences:

Section 2. Repealer. Ordinance No. 2023 is hereby repealed.
Section 3. Severability. If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance or its application to any person or situation should be held to
be invalid or unconstitutional for any reason by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of the
remaining portions of this ordinance or its application to any other person or situation.
Section 4. Effective Date. This ordinance or a summary thereof shall be published
in the official newspaper of the City, and shall take effect and be in full force and effect
on

A. 2007 Budget Amendment Ordinance

B. Donation of Surplus Pt er
Staff is requesting ful Cicil .p aro al rplus a 1986 Pumper. This truck will be donated to
Puget Sound Skills Cen er for c ss i ction. Committee members were informed of two changes
made to the resolution b the Attorney. Those changes include listing the vehicle's identification
number and a statement t at the fire truck is worth less than $500. UNANIMOUS APPROVAL.

C. Council Salaries
During a year -end review of salary related issues, Finance staff identified the expiration of Council
salaries in accordance with Ordinance 2023. Kevin discussed that staff conducted a comparison of
Council stipends with those in surrounding Valley cities. It was determined that Tukwila Council
compensation continues to fall within the average of surrounding cities; and the monthly stipend will
continue to be $1050. The draft ordinance sets the stipends through 2013.
The Committee discussed some re- wording of the draft ordinance and expressed a desire for the
incorporation of clarifying language that would emphasize that the Council is not receiving a salary
increase. UNANIMOUS APPROVAL. FORWARD TO DECEMBER 10 COW.
III. ANNOUNCEMENTS
No announcements.
W. MISCELLANEOUS
As information only, staff informed the Committee of an extension of the current contract for Commercial
Development Solutions (Lisa Verner's contract). The current contract expires on December 31, 2007;
however, the City has not expended all of the funds associated with the contract. Staff would Iike to
modify the existing contract by extending the expiration date in order to utilize unspent contract funds.
