SPONSOR'S As a result of the November 6, 2007, General Elections there will be a position vacancy on

SUBJECT: Council Position Vacancy Council Position No. 7
As a result of the November 6, 2007, General Elections there will be a position vacancy on the
Tukwila City Council as of January 1, 2008. It will be the Council's responsibility to appoint an
individual to serve the remainder of Council Position No. 7 through December 31, 2009.
The process of appointment to Tukwila City Council is not statute related and neither the Tukwila
Municipal Code (TMC) nor the Revised Code of Washington (RCW) specifies how the Council should
conduct an appointment process.
According to the TMC 2.04.190:
In order to fill the vacancy with the most qualified person available until an
election is held, the Council will widely distribute and publish a notice of the
vacancy, the procedure and any application form for applying. The Council will
draw up an application form, which contains relevant information to answer set
questions posed by the Council. The application forms will be used in conjunction
with an interview of each candidate to aid the Council selection of the new
Councilmember.
According to the Revised Code of Washington (RCW 42.12.070):
Where one position is vacant, the remaining members of the governing body
shall appoint a qualified person to fill the vacant position.
Additionally, the Council must appoint a qualified person to fill the vacancy within 90 days of the
occurrence of the vacancy.
In the interest of the Tukwila community and consistency within City operations, it is beneficial for the
Council to approve a detailed appointment process which clearly defines the parameters in which a
Council vacancy will be filled. Attached to this memo, you will find a proposed process for

Below you will find an outline detailing the dates associated with the proposed appointment process I
believe you will find this to be useful for taking a quick overlook at the entire appointment process
from both an applicant and administrative view.

Completed applications will be copied and forwarded to Councilmembers for review by 5:00 p.m. on
Friday, January 4, 2008. Prior to that date, I will keep all applications and accompanying materials
secure. Applications and accompanying materials become public information once they are submitted
and will be included in the agenda packet for the January 10, 2008, Special Meeting. However, as
mentioned above, each Councilmember will receive a complete packet containing all submitted
materials on Friday, January 4.
Candidate interviews will be conducted at a special meeting tentatively scheduled for Thursday,
January 10. Interview questions will be provided to candidates prior to the interviews in the applicant
packet. The interview process will be run by the City Attorney. Councilmembers will be given rating
forms to assist in their individual evaluation of each candidate. The special meeting will break for an
executive session after the interview process, and will reconvene following for nominations of
candidates and a vote for appointment. The Mayor will break a tie vote. The newly appointed
Councilmember will be sworn in on Monday, January 14, 2008 at the Committee of the Whole
meeting.
Interview questions as well as application materials have been formulated from and based on
research conducted of local government agencies throughout the nation who have run appointment
processes for vacant council positions. Additionally, all information has been reviewed and deemed
appropriate by the City Attorney. I hope that you will find this process to be fair and equitable; one
that will ensure that the Tukwila City Council is able to appoint the best candidate to Council Position
No. 7. Please conduct a thorough review of all attachments and be prepared to discuss them at the
December 10 Committee of the Whole meeting.

DUTIES. RESPONSIBILITIES COMPENSATION
General Purpose of City Council
City Councilmembers serve at large and represent residents and businesses in Tukwila
by setting policy, adopting the annual budget, and representing Tukwila in outside
intergovernmental organizations, boards, commissions and committees.
Duties of the City Council
The City Council has the power to tax; borrow money; set policies; operate and supply
utilities and municipal services; set employee compensation; acquire, improve,
maintain, beautify or vacate public property; and render local social, cultural or
recreational services as they see fit.

SPECIAL MEETING INTERVIEW PROCESS
Candidate interviews will take place at a Special Meeting of the full Council on
Thursday, January 10, 2008, in the Council Chambers.
The interview process will be run and moderated by the City Attorney.
Candidate interviews will be limited to 30 minutes each. This will include five minutes at
the beginning of the interview to provide a brief introduction and overview of
qualifications. The remaining 25 minutes will be designated for a predetermined set of
questions. The interview questions will be provided in advance in the applicant packet.
At the end of the City Attorney run interview proce on- candidate members of the
public will have an opportunity to ask one ques per a ience member directed to the

Tacoma on Saturda January 26, 2008, and a Council Retreat in Suquamish from
Friday, February 22 t ough Sunday, February 24, 2008. Please ensure that your
calendar allows you to attend these activities.
Persons appointed to fill a vacant elective office must file a financial affairs statement
with the Public Disclosure Commission detailing certain financial information about
themselves, their spouse and any dependent children which then becomes public
information for anyone to access. More information can be obtained from the Public

Appointment to the City Council will require your attendance at a number of regularly scheduled and
special meetings, which occur in the evenings, on weekends, and/or during the weekday.
Councflmembers also serve on Council committees, regional boards and commissions, and represent
