AN ORDINANCE OF THE CITY OF 'TUKWILA. RELATING TO Et -BACK REQUIREMENTS AND AMENDING ORDINANCE NO. 251. Ordinance 533 was amended or repealed by the following ordinances. AMENDED BY: REPEALED BY: 635 1758 5181 468 F ORDINANCE NO. AN ORDINANCE OF THE CITY OF TUKWILA RELATING TO SET -BACK REQUIREMENTS AND AMENDING ORDINANCE NO. 251. 1. WHEREAS, the Planning Commission has recommended that certain amendments be made to the regulations relating to set -back requirements to promote the orderly development of the City of Tukwila; and 2. WHEREAS, public hearings on said recommendation were .held before the Planning Commission and the City Council of the City of Tukwila and the City Council having received favorable recommendation of the Planning Commission to enact said amendments; and, 3. WHEREAS, the City Council of the City of Tukwila finds that the amendments are within the public health, safety, and 2. general welfare, NOW, THEREFORE, the City Council of the City of Tukwila do ordain as follows: SECTION 1. That Section.4 -1 Concerning HEIGHT, YARD AND AREA REGULATIONS: Paragraph 2. FRONT YARDS of Ordinance No 251 reading as follows: "2. FRONT YARDS: The front yards in this district shall have a minimum depth of twenty -five (25) per cent of the depth of the lot, but the depth of such front yard need not be more than thirty (30) feet." be and the same hereby is amended as follows, with the amended "portion by addition or revision designated by italics: "2. On a corner lot, the side yard regulation shall be the same as for interior lots, except in the case of reversed frontage where interior lots have been platted or sold fronting on the side street. In this case, there shall be a side yard on the street side of the corner lot not less than one -half (1/2) of the front yard required in Paragraph 2, except that the building line shall not be less than forty (40) feet from the center line of the street in a residential area.“ SECTION 3. FRONT YARDS: The front yards in this district shall have a minimum depth of fifteen (15) per cent of the depth of the lot but the depth of such front yard need not be more than twenty (20) feet, provided the distance from the center line of the street to the building is not less than forty -five (45) feet in residential areas and fifty (50) feet in other areas." SECTION 8. That Section 4 -4 Concerning HEIGHT, YARD AND AREA REGULATIONS: Paragraph 3.c. SIDE YARDS of Ordinance No. 251 reading as follows: "c. That Section 4 -4A Concerning HEIGHT, YARD AND AREA REGULATIONS: Paragraph 2. FRONT, SIDE AND REAR YARDS of Ordinance No. 251 reading as follows: SECTION 10. That Section 4 -9 Concerning HEIGHT, YARD AND AREA REGULATIONS: Paragraph 2.a. FRONT YARDS of Ordinance No. 251 reading as follows: "2. FRONT, SIDE AND REAR YARDS: Each lot shall have front, side and rear yards of not less than the depths and widths as follows: Front Yard: 20 feet Side Yards: When height of building is one story least side yard is 5 feet, sum of side yards 10 feet. When height of building is two stories, least side yard is 6 feet, sum of side yards, 14 feet. When height of building is three stories, least side yard is eight feet, sum of side yards 18 feet. When height of building is over three stories, least side yard is 2 feet additional each side yard for each story over 3, except that a side yard abutting upon a street need not exceed ten (10) feet in such case." be and the same hereby is amended as follows, with the amended portion by addition or revision designated by italics: "2. FRONT, SIDE AND REAR YARDS: Each lot shall have front, side and rear yards of not less than the depths and widths as follows: Front Yard: 20 feet, provided the building line is not less than forty -five (45) feet from the center- line of the street in residential areas and fifty (50) feet in other areas. Side Yards: When height of building is one story least side yard is 5 feet, sum of side yards 10 feet. When height of building is two stories, least side yard is 6 feet, sum of side yards, 14 feet. When height of building is three stories, least side yard is eight feet, sum of side yards, 18 feet. When height of building is over three stories, least side yard is 2 feet additional each side yard for each story over 3, except that a side yard abutting upon a street need not exceed ten (10) feet in such case, provided the building line is not less than thirty -five (35) feet from the centerline of the street in residential areas and forty (40) feet in other areas." 5 "2. FRONT YARDS: a. There need be no front yard in this district, except when the district abuts or adjoins a District R -1, R -2, R -3, or R -4 within the same block and on the same side of the street. Provided this situation occurs, the front yard requirements for this district shall be the same as that for the abutting or adjoining residential districts (R -1 to R -4 inclusive) when the residences or lots front on the same street, but need not be more than twenty (20) feet." be and the same hereby is amended as follows, with the amended portion by addition or revision designated by italics: SECTION 11.• That Section 4 -9 Concerning HEIGHT, YARD AND AREA REGULATIONS: Paragraph 2.b. FRONT YARDS of Ordinance No. 251 reading as follows: 6 5184 473 "2. FRONT YARDS: a. There need be no front yard in this district, provided the distance from the center line of the street to the building line, in non residential areas, is not less than thirty (30) feet. When the district abuts or adjoins a District R -1, R -2, R -3 or R -4 within the same block and on the same side of the street, the front yard requirements and distances from street center line for this district shall be the same as that of the abutting or adjoining residential districts." "b. When the rear line or a portion of the rear line of residentially zoned property is adjacent to or abuts the business district, there shall be a setback for buildings facing the street whose property line forms a street side line of the residentially zoned property, equal in depth to the depth of the existing or required side yard in the residentially zoned district, whichever is the greater, but need not be more than ten (10) feet." be and the same hereby is amended as follows, with the amended portion by addition or revision designated by italics: "b. When the rear line or a portion of the rear line of residentially zoned property is adjacent to or abuts the business district, there shall be a setback for buildings facing the street whose property line forms a street side line of the residentially zoned property, equal in depth to the depth of the existing or required side yard in the residentially zoned district, whichever is the greater, but need not be more then ten (10) feet, provided the building line is not less than thirty -five (35) feet from the centerline of the street." SECTION 12. That Section 4 -9 Concerning HEIGHT, YARD AND AREA 'REGULATIONS: Paragraph 3. SIDE YARDS of Ordinance No. 251 be and the same hereby is amended by addition of new Paragraph 3.d. as follows, with the amended portion by addition or revision designated by italics: "d. On a corner lot, platted or unplatted, the minimum distance from the center line of the street to the build- ing line shall be thirty (30) feet." SECTION 13. That Section 4 -10 Concerning HEIGHT, YARD AND AREA REGULATIONS: Paragraph 2. FRONT AND SIDE YARDS of Ordinance No. 251 reading as follows: 5.1 '84 474 7 "2. FRONT AND SIDE YARDS: There need be no front or side yard in this district except where the district abuts or adjoins a District R -1, R -2, R -3 or R -4 within the same block and on the same side of a street. When this situation occurs, and the majority of the buildings or lots in the residential district face on the above street, there shall be a setback from the said street for any building in the business district equal to one -half (1/2) of the front yard requirement for the abutting or adjoining residential district given in paragraph 2 under the Height, Yard and Area Regulations for that district; and when the side prop- erty line of residential property forms the greater portion (at least 70 of the street property line in the residential district given in paragraph 3 under the Height, Yard and Area Regulations for that district, but need not be more than eight (8) feet. There shall be a side yard along the side line of a property in the business district, which line abuts, adjoins or is within eight (8) feet of a boundary of a residential district, equal to eight (8) feet measured from the residential district boundary line." be and the same hereby is amended as follows, with the amended portion by addition or revision designated by italics: "2. FRONT AND SIDE YARDS: There need be no front or side yard in this district provided the distance from the center line of the street to the building line is not less than twenty five (25) feet in a residential area and thirty (30) feet in other areas, and except where the district abuts or adjoins a District R -1, R -2, R -3 or R -4 within the same block and on the same side of a street. When this situation occurs, and the majority of the buildings or lots in the residential district face on the above street, there shall be a setback from the said street for any building in the business district equal to one -half (1/2) of the front yard requirement for the abutting or adjoining residential district given in paragraph 2 under the Height, Yard and Area Regulations for that district; and when the side prop- erty line of residential property forms the greater portion (at least 70%) of the street property line in the residential district given in paragraph 3 under the Height, Yard and Area Regulations for that district, but need not be more than eight (8) feet. SECTION 14. That Section 4 Concerning HEIGHT, YARD AND AREA REGULATIONS: Paragraph 2.a. FRONT AND SIDE YARDS of Ordinance No. 251 reading as follows: "2. FRONT AND SIDE YARDS: a. There need be no front or side yard in this district, except when the district abuts or adjoins a District R -1, R 2, R -3 or R- 4 the'same block and on the same side 5184 475 of the street. Provided this situation occurs, and the majority of the buildings or lots in the residential district face on the said street, there shall be a set -back from the said street for any building in the industrial district equal to one half (1/2) of the front yard requirement for the abutting or adjoining residential district as given under the Height, Yard and Area Regulations for that district; and when the side property line of resi- dential property forms the greater portion, at least 70% of the street property line in the residential district, there shall be a set -back in the industrial district equal to the side yard requirement for the said residential district as given in Paragraph 2 or 3 under the Height, Yard and Area Regulations for that district, but need not be more than eight (8) feet." That Section 4 -20 Concerning OFF STREET PARKING AND LOADING REGULATIONS of Ordinance No. 251 reading as follows: "SECTION 4 -20 OFF STREET PARKING AND LOADING REGULATIONS The off street parking spaces, as required by this section, shall apply to new structures only, or to units or additional assembly areas to be added to an existing structure. Existing buildings or structures may provide off street parking but must comply with the requirements of this section as to the location and construction of the park- ing space for such type of structure. However, the full compliance with the number of spaces required need not be fulfilled. Any off street parking area already in use or established hereafter, shall not be reduced below the limits required by this section by the construction of any addition to a building or structure nor by the erection of an additional building or structure on the property." be and the same hereby is amended as follows, with the amended portion by addition or revision designated by italics: 8 "2. FRONT AND SIDE YARDS: a. There need be no front or side yard in this district, provided the distance from the center line of the street to the building line is not less than thirty (30) feet for normal service streets, and forty (40) feet when on a designated arterial street. When the district abuts or adjoins a District R -1, R -2, R -3 or R -4 within the same block and on the same side of the street, the front yard requirements and distances from street center line for this district shall be the same as that of the abut- ting or adjoining residential districts. When the side property line of residential property forms the greater portion, at least 70% of the street property line in the residential district, there shall be a set -back in the industrial district equal to the side yard requirement for the said residential district as given in Paragraph 2 or 3 under the Height, Yard and Area Regulations for that district, but need not be more than eight (8) feet." 5184 476 Attest: c 9 "SECTION 4 -20 OFF STREET PARKING AND LOADING REGULATIONS The off street parking spaces, as required by this section, shall apply to new structures only, or to units or additional assembly areas to be added to an existing structure.
