Fuhrer, Finance Director a Date: May 29, 2007 Subject: Declaration of Surplus Property 7210 S. 180 and 7220 S. 180 ISSUE: Declaring the properties located at 7210 and 7220 S. 180 Street surplus to the City's needs. BACKGROUND: In 2001 the City acquired the above referenced properties in association with the S. 180 Street Underpass Capital Improvement Project. The 7210 and 7220 properties are commonly referred to as the Candle Shop and Crystal Springs Warehouse respectively. The project management team utilized office space in the warehouse throughout the construction teem. Both properties have since been underutilized DISCUSSION: The Candle Shop is in a deteriorated state and should likely be demolished. The Crystal Springs Warehouse, while admittedly in a better condition, does show signs of moderate earthquake damage stemming from the Nisqually seismic event. In addition, it was necessary this past winter to perform repairs on the flat roof. Furtheimore, administration has evaluated the feasibility of utilizing one or both of the properties, however it was determined that the associated repairs and service modifications necessary for City use are cost prohibitive. Moreover, during the past 18 months a number of outside parties have expressed interest in purchasing the properties. In March 2007, the City commissioned the services of an appraiser to ascertain a fair market valuation. The appraisal totaled $480,000 in a current "as is" condition. Given the physical layout of the properties and ingress /egress considerations, the parcels were commonly valued. The procedures for a sale of City property are codified in Tukwila Municipal Code (TMC) Chapter 2.64. The salient points of the TMC are: Property Appraisal Council Authorization To Sell At A Minimum Price City Clerk Publishes A Call For Bids At Least (5) Calendar Days Before Final Date For Competitive Bid Submission. RECOMMENDATION: Given the condition of the properties, the absence of a pressing City need, and the added benefit of restoring the property valuation to the tax rolls, it is recommended that the Council declare the property surplus and authorize the Mayor to carry out a sale of the property within the parameters of TMC Chapter 2.64 and at a minimum bid level of 480,000. Surplus of Citv owned property on South 180 Staff is requesting that two properties currently owned by the City located at 7210 South 180 and 7220 South 180 be declared surplus. These properties are not being utilized by the City and their questionable conditions make it cost prohibitive for the City to make necessary repairs for 4...--- such use. Staff recommends these properties be put up for public bid at the minimum cost for both parcels whose common value has been appraised at $480,000. Permit Application for Fireworks Display at Starfire Snorts Complex Staff is recommending that the Fireworks Permit Application submitted by Mr. Tom Whitacre for the fireworks display at Family 4 at the Fort be approved. Mr. Whitacre has provided the fireworks display for the City's annual celebration for the past several years without incident. Staff reported that they will be working with the City of Renton's Fire Department since a portion of the commercial property identified for the fireworks fall out area is within Renton city limits. Additionally, staff has identified and addressed potential issues that could occur and have developed plans in response to those. One issue of particular note is the timing of the fireworks show in relation to the train schedule, which has been coordinated with the railroad. UNANIMOUS APPROVAL. FORWARD TO JUNE 11 COW. C. Adoption of the 2006 International Fire Code Staff detailed the recommended changes to the code, many of which were housekeeping. Councilmember Robertson requested additional information concerning the difference in safety of sprinklered homes compared to non- sprinklered. UNANIMOUS APPROVAL. FORWARD TO JUNE 11 COW. D. Update of Fire Service Consolidation Study Chief Olivas explained that the City of SeaTac is interested in a study to determine the feasibility of our Fire Departments consolidating. The SeaTac Council will discuss this matter at its June 12 City Council meeting and probably give staff the green light to move forward. If that happens, Tukwila will be asked to share the costs associated with such a study. Please find the attached memo in regard to the application for the public fire works display this year at the Starfire baseball complex in conjunction with the City's Family Fun at the Fort 4 of July event. This event has been very successful in past years, and we have not had any fireworks related incident as a result of this show. We have had issues in the past with visitors using fireworks within the park, but have since installed signage notifing the visitors upon entry into the park that fireworks are illegal within Tukwila. This made a significant impact on last years incidents of fireworks being discharged within the park. 1 have not received confirmation from Assistant Chief Peden, Fire Marshal for the City of Renton. In years past they have had no concerns with the permitted fire works display, however they do have a new Fire Chief this year. I will pass on this confirmation when I receive word from Renton Fire. Olivas, Fire Chief 908 Memorandum Date: May 29, 2007 To: Chief Olivas From: B/C Tomaso Re: Public Fire Works Display Permit I have reviewed the permit application information provided by Mr. Tom Whitacre, who has applied for the permit for a public fireworks display at the Starfire Sports Complex, 14600 Starfire Way. Mr. Whitacre is a licensed Pyrotechnic Operator with the State of Washington and with the Bureau of Alcohol, Tobacco and Fire Arms. The State Department of licensing also licenses Mr. Whitacre to transport fire works. The display will be held in conjunction with the City's planned event on the 4 of July, "Family Fun at the Fort", being organized by the Park and Recreation Department. This will be a 25 to 30 minute show starting at approximately 2200 hours. The fireworks will be transported to the site in the AM of July 4 and will be under the required supervision until they are discharged. The mortar tubes and other equipment will be brought to the location on July 2 3rd The application was reviewed to WAC 212 -17 and accepted industry standards, and I find everything is within these guidelines I do have some concerns this year regarding the railroad right of way, baseball fields and the limited access this allows. In addition, a portion of the fall out area includes a portion of a commercial property within the City of Renton. I have contacted Renton Fire Officials and have not received a response at the time of this memo. Last year the Renton Fire Marshal approved our plan, which is the same as in previous years. Crowd control can be a potential issue, as the crowd that assembles to watch the fire works show has increased each and every year. To mitigate these issues I believe the following measures should be done: Stage two fire apparatus at the site: one apparatus on each side of the Railroad right of way. Apparatus shall be out of service during the display and for 30 minutes following display. Have Tukwila Police provide crowd control during the Public display. A minimum of 4 officers will be required. Provide traffic control to the Fort Dent Way and Interurban Ave intersection to expedite traffic flow. (2 additional Tukwila Police shall be available to respond to the site if requested.) Comply with Fire Works Permit Conditions attached. Only personnel required to shoot the display will be within the safety perimeter. 9. Portable fire extinguishers shall be in place, prior to unloading of pyrotechnics from transport vehicle. Permit Application for Fireworks Display at Starfire Sports Complex Staff is recommending that the Fireworks Permit Application submitted by Mr. Tom Whitacre for the fireworks display at Family 4 at the Fort be approved. Mr. Whitacre has provided the fireworks display for the City's annual celebration for the past several years without incident. Staff reported that they will be working with the City of Renton's Fire Department since a 4\ portion of the commercial property identified for the fireworks fall out area is within Renton city limits. Additionally, staff has identified and addressed potential issues that could occur and have developed plans in response to those. Explanatory notes and legend to lend clarity to the plan and identify the manufacturer and model number of each alarm component used. The plan review fees are as follows: Commercial: For 1 -5 heads: Base fee $75.00. Commercial: For 6 or more heads: Base fee $150.00 $1.50 per device in excess of 10 devices. Single Family: $50.00 base fee $1.50 per device in excess of 10 devices. All companies installing automatic fire alarm systems shall have a State electrical contractor's license. B. All persons installing automatic fire alarm systems shall hold a State low voltage installer's certificate or journeyman electrician certificate per RCW 19.28.041. An apprentice certificate is acceptable for installers when supervised by a certified journeyman per RCW 19.28.4. C. A City of Tukwila electrical permit shall be posted at all automatic fire alarm system installations per TMC 16.04.020 -8. D. All equipment, devices, and wiring shall be listed by Underwriters Laboratories or Factory Mutual and shall be approved for the purpose which they are intended. No one shall perform any type of modification to any device that would void its UL /FM listing. E. If determined necessary by the authority having jurisdiction, control panels shall have sufficient auxiliary power outlets for automatic door closures, relay boards for elevator control, HVAC detectors, air pressurization, and all other auxiliary devices. They shall also have sufficient power for 4-wire smoke detectors, remote LED indicating lights and duct detectors with relays. F. Remote alarm annundation /indication is required at the main entrance if the control panel is not visible from the main entrance. G. When the control panel is located inside a room, the outside of the door shall have a sign in 1 -inch letters that reads "Fire Alarm" or "Fire Alarm Control." A rechargeable battery backup is required on any automatic fire alarm system installation. There shall be enough battery capacity at all times to run the alarm system in standby for 24 hours and after that time, sound all alerting devices for at least five minutes. At the end of the battery life cycle, batteries shall be replaced. I. Audible devices shall be placed in buildings and be so located that, with all intervening doors closed, the alarm device shall be heard at not less than 15 decibels above the ambient noise levels; sleeping areas shall be a minimum of 75 decibels. Visible alarms shall be placed throughout the building in all assembly areas; common use areas, including toilet rooms and bathing facilities; hallways and lobbies; and hotel guest rooms. Individual offices, mechanical rooms, and small storage rooms are not included. J. Whenever possible, the control panel shall be located in a heated main corridor or a heated main lobby. When the control panel is located inside a room, the room shall be heated, and kept at an ambient temperature between 40° and 100 °F. The outside of the door shall have a sign in 1 -inch letters, which reads "Fire Alarm" or "Fire Alarm Control." AT NO TIME SHALL THE CONTROL PANEL BE LOCATED IN AN EXTERIOR LOCATION. K. All new alarm systems shall be addressable. Each device shall have its own address and shall annunciate individual addresses at a UL central station. Section 3. Ordinance No. 2131, as codified at TMC Chapter 16.40.120, "Special Requirements," is hereby amended to read as follows: 16.40.120 Special Requirements A. The guest room detectors of hotel /motel occupancies shall annunciate at a panel located at or near the front desk. These detectors will not transmit an alarm to the UL central station. The alarm panel, located at or near the front desk, shall be monitored 24 hours a day by the hotel /motel staff. B. Multi- family dwellings and lodging houses fully protected by an automatic sprinkler system shall have detectors installed in accordance with the International Building Code. Common areas and exit corridors shall be protected by detectors and manual pull stations, monitored by a UL central station. C. When monitoring of an existing system is lost for any reason, a fire watch must be posted during non business hours. The fire watch person shall call the recorded fire prevention phone line at two-hour intervals confirming the all-clear status of the building. In the event of a fire emereencv, the fire watch shall call 911 immediately report the fire emersencv. D. Duct detectors shall send a supervisory signal only and shall not cause an alarm. E. Lock boxes shall be provided for an access to alarm panels and sprinkler risers. F. The limits referred to in Chapter 38, section 3804.2 of the International Fire Code, in which storage of liquefied petroleum gas is restricted, shall apply throughout the City. NFPA 58 shall be used as the installation euide for all propane systems. Section 2. Ordinance No. 2129, as codified at TMC 16.16.070, "Amendments to the International Fire Code," is hereby amended to read as follows: 16.16.070 Amendments to the International Fire Code. A. Portable fire extinguishers shall be installed in all occupancies. No exceptions will be allowed. B. Section 503 of the International Fire Code (2003 Edition) adopted by TMC Chapter 16.16 is hereby amended to read as follows: Section 503.2. 1. GENERAL. Fire apparatus access roads shall be provided and maintained in accordance with the provisions of this section. 2. DEFINITIONS. The following definitions shall apply in the interpretation and enforcement of this section a. "Fire apparatus access road(s)" means that area within any public right -of- way, easement, or private property designated for the purpose of permitting fire trucks and other firefighting or emergency equipment to use, travel upon and park. b. "Vehicle" means a machine propelled by power, other than human power, designed to travel along the ground or rail, by the use of wheels, treads, runners or slides, and shall include, without limitation, truck, automobile, trailer, motorcycle, tractor, buggy, wagon and locomotive. 3. REQUIREMENTS STANDARDS. a. When required by the Fire Department, hard- surfaced fire apparatus access road(s) shall be provided around facilities which, by their size, location, design or contents warrant access which exceeds that normally provided by the proximity of city streets. b. Fire apparatus access road(s) shall be required when any portion of an exterior wall of the first story is located more than 150 feet from Fire Department vehicle access. 4. SURFACE. Fire apparatus access road(s) shall be either asphalt or reinforced concrete, a minimum of two inches thick, or, when specifically authorized by the Fire Department, compacted crushed rock or other alternate surfaces may be used. Fire apparatus access roads shall be designed and maintained to support the imposed loads of fire apparatus. 5. WIDTH. The minimum unobstructed width of a fire apparatus access road shall be not less than 20 feet. 6. Aerial apparatus access roads shall not be less than 26 feet in width. 7. VERTICAL CLEARANCE. All fire apparatus access roads shall have an unobstructed vertical clearance of not less than 13 feet, 6 inches. Exceptions: a. When conditions prevent the installation of an approved fire apparatus access road, the Fire Marshal may permit the installation of a fire protection system or systems in lieu of a road. b. When there are not more than two Group R, Division 3 or Group U occupancies, the requirements of this section may be modified, provided, in the opinion of the Fire Marshal, firefighting or rescue operations would not be impaired. c. Clearances or widths required by this section may be increased when, in the opinion of the Fire Marshal, clearances or widths are not adequate to provide fire apparatus access. 8. TURNING RADIUS. The turning radius of a fire apparatus access road shall be approved by the Fire Marshal. 9. TURNAROUNDS. All dead end apparatus access roads in excess of 150 feet shall be provided with approved provisions for the turning around of fire apparatus. 10. BRIDGES. When a bridge is required to be used as access under this section, it shall be constructed and maintained in accordance with the applicable sections of the International Building Code or other regulations adopted by the City, and shall use designed live loading sufficient to carry the imposed loads of fire apparatus. 11. GRADE. The gradient for a fire apparatus access road shall not exceed 15 with a cross slope no greater than 5 12. OBSTRUCTION. The required width of any fire apparatus access road shall not be obstructed in any manner, including the parking of vehicles. Minimum required widths and clearances established under this section shall be maintained at all times. 13. SIGNS. a. When required, approved signs or other approved notices shall be provided and maintained for fire apparatus access roads to identify such roads and prohibit the obstruction thereof or both. Fire apparatus access roads shall be de by painting the curb yellow and a 4-inch wide line and block letters 18 inches high, painted in the lane, at 50 -foot intervals, stating, "FIRE LANE NO PARKING," color to be bright yellow, or by the posting of signs stating, "FIRE LANE NO PARKING," and painting the curb. Signs shall be posted on or immediately next to the curb line or on the building. Signs shall be 12 inches by 18 inches and shall have letters and background of contrasting color, readily readable from at least a 50 -foot distance. Signs shall be spaced not further than 50 feet apart nor shall they be more than four feet from the ground. c. Residential fire apparatus access roads shall be marked with sia rts as described in "b" above; no strinine or oaintina shall be reauired. 14. PARKING PROHIBITED. Except when necessary to avoid conflict with other traffic, or in compliance with the direction of a police or fire official or traffic control sign, signal or device, no person shall stop, stand or park a vehicle, whether occupied or not at any place where official fire lane signs are posted, except a. Momentarily to pick up or discharge a passenger or passengers, or b. Temporarily for the purpose of and while actually engaged in loading property. 15. FIRE APPARATUS ROAD(S) AS PART OF DRIVEWAYS AND /OR PARKING AREAS. The Fire Department may require that areas specified for use as driveways or private thoroughfares shall not be used for parking. These areas, when specified, shall be marked or identified by one of the two means detailed in TMC 16.16.070B.13.b. or TMC 16.16.070B.13.c. 16. EXISTING BUILDINGS. When the Fire Department determines that a hazard, due to inaccessibility of fire apparatus, exists around existing buildings, they may require fire apparatus access road(s) to be constructed and maintained. 17. ENFORCEMENT. It shall be the duty of the Tukwila Fire Marshal and /or the authorized designee(s) to enforce subsection 503.2. 18. VIOLATION PENALTY. Any person violating any of the provisions of Section 503.2, "Fire Apparatus Access Roads,' shall be guilty of a misdemeanor, which upon conviction, shall result in a fine of not more than $75.00 or by imprisonment for not more than 30 days, or by both such fine and imprisonment. Section 3. Ordinance No. 2129, as codified at TMC 16.16.080, "Fees," is hereby amended to read as follows: 16.16.080 Fees. A. Permit Fees: A fee of $100.00 shall be charged for each permit required by the International Fire Code. B. Re- inspection Fees: 1. RE- INSPECIION FEES FOR NEW CONSTRUCTION, TENANT IMPROVEMENTS, AND SPOT INSPEC:IIONS. When an inspection is requested for new construction, tenant improvements or spot inspections, and then the Fire Inspector finds that the work is not complete, not ready for inspection, or does not comply with fire code requirements, a follow -up inspection will be required, and a re- inspection fee of $80 will be assessed. 2. RE- INSPECTION FEES FOR COMPANY -LEVEL INSPECTIONS. A re- inspection fee of $60 will be assessed when, on the follow -up inspection 30 days after the initial company level inspection, the inspectors find that the violations have not been corrected. A re- inspection fee of $85 will be assessed when, on a second follow -up inspection, the inspectors find that the violations have not been corrected. A re- inspection fee of $110 will be assessed when, on a third follow -up inspection, the inspectors find that the violations have not been corrected. A re- inspection fee of $135 will be assessed when, on a fourth and subsequent follow -up inspections, the inspectors find that the violations have not been corrected. Exception: The Tukwila Fire Prevention Bureau reserves the right to require pre approval, by one of the agencies listed above, for any modification to a hydraulically designed system regardless of the size of the job. B. All sprinkler drawings shall be prepared by persons meeting the requirements of RCW 18.160. C. At least three complete sets of blueprint drawings with information regarding the automatic sprinkler system as identified in NFPA 13, Sections 6-1, 6 -2 and 6-3, and at least one civil engineering blueprint showing the underground installation from watermain tap to base riser, shall be submitted to the Tukwila Fire Prevention Bureau for approval prior to installation or modification of any equipment. One set of approved plans shall be located at the job site. D. Drawings submitted for approval must include floor layout drawn to scale, no smaller than 1/8 -inch scale, showing all rooms and spaces with accurate measurements. Drawings shall include the building permit number. E. As- builts shall be provided prior to system acceptance and final approval, if any modifications not shown on the original plans have been done to the system. Hazardous operations. 2. Hazardous contents. 3. Critical exposure problems. 4. Limited accessibility to the building. 5. Inadequate water flow availability. C. Sprinklers are required in all Group R, Division 1, 2 and 3, occupancies (as defined in the IBC) having three or more floor levels or containing 5 or more dwelling units. D. Sprinklers are required in Group A occupancies (as defined in the IBC) such as nightclubs, discos or restaurants where the total gross floor area exceeds 5,000 square feet. E. This shall include all water control valves, tamper devices, pressure supervision and waterflow switches. Permanent, all- weather sprinkler riser zone maps shall be installed at the fire department connection and riser. L All exterior components of sprinkler systems shall be painted red, either Rustoleum #7564 "Safety Red") or Farwest Paint #253 ("Mandarin Red"). This includes: post indicator valves /outside stem and yoke valves, wall indicating valves, fire department connections, and water motor gong. J. The Fire Department connection shall have a downward angle bend between 22.5 and 45 degrees, with a 5 -inch Storz fitting. Permit Application for Fireworks Display at Starfire Snorts Complex Staff is recommending that the Fireworks Permit Application submitted by Mr. Tom Whitacre for the fireworks display at Family 4 at the Fort be approved. Mr. Whitacre has provided the fireworks display for the City's annual celebration for the past several years without incident. Staff reported that they will be working with the City of Renton's Fire Department since a portion of the commercial property identified for the fireworks fall out area is within Renton city limits. Additionally, staff has identified and addressed potential issues that could occur and have developed plans in response to those. One issue of particular note is the timing of the fireworks show in relation to the train schedule, which has been coordinated with the railroad. UNANIMOUS APPROVAL. FORWARD TO JUNE 11 COW. C. Update of Fire Service Consolidation Study Chief Olivas explained that the City of SeaTac is interested in a study to determine the feasibility of our Fire Depai taients consolidating. If that happens, Tukwila will be asked to share the costs associated with such a study. BACKGROUND The Transportation Improvement Program (TIP) is updated annually as required by RCW. The TIP is adopted by resolution after a public hearing at the local agency level and incorporated into the regional and state TIP's. The TIP is primarily a financial planning document for projects competing for grants. Any project submitted for federal grant funding must be included in the local, regional and state adopted TIP's. The TIP is a rolling plan showing various funding sources: grants, developer, and local funds. Projects "roll" as funds or stages (design report, final design, construction) occur. Tukwila's TIP and CIP list many of the same transportation related projects. The TIP lists only those transportation- related projects planned within the next six years that are deemed regionally significant. The City's CIP lists transportation projects planned in the next six years and beyond, as well as water, sewer, surface water, and capital facilities. The TIP is required to be adopted by July 1 on an annual basis, while the CIF is prepared during summer /fall in conjunction with the City's budget preparation. Differences between the two may be due to priority changes, funding availability changes, or other factors that normally occur during the time between adoption of each document. Six -Year Transportation Improvement Program (2008 -20131 Staff briefly discussed the annual update to the Six -Year Transportation Improvement Program (TIP). This annual rolling program is generally modified to reflect the City's CIP as the two are updated at different times of the year. Robin explained that one new item has been added to the TIP as this item was a new addition in the 2007 -2012 CIP. That item is the addition of a left turn pocket off of Macadam Road at South 144` Street. The Committee inquired to the funding for this particular addition. Staff remarked i. I that the project is not scheduled for design until 2010 which is far enough into the future that A....__ impact fees are expected to contribute to project funding. Additionally, staff explained that the need for this project has been established based on the impact of other forthcoming developments. Establishing this need, as well as listing it as a project in the TIP, will assist in securing funding for the project. Based on Committee recommendation, staff will modify the information memo regarding the TIP prior to being submitted to full Council for language specifications and to reflect the respective CIP page referring to the Macadam turn pocket addition. Prior to passing a resolution for the TIP a public hearing must be held. The Committee recommends forwarding the update to COW for discussion and to set a public hearing regarding the matter. UNANIMOUS APPROVAL. FORWARD TO JUNE 11 COW FOR DISCUSSION. B. 2006 Overlay and Repair Program Proiect Completion and Acceptance In March, the 2006 Overlay and Repair Project was completed. Staff is seeking for Council to accept completion of the project and authorize the release of the appropriate retainage. This completion and acceptance is a standard process which is followed for all project completions in the City. Four change orders were associated with the project, and overruns were attributed to increased traffic control labor. Overall, the project went well and the contractor did a satisfactory job. PRESENTATIONS No presentations. II. BUSINESS AGENDA A. 2007 Small Drainaee Proeram Bid Award Ryan Larson discussed the annual small drainage program and also the private storm system adoption program. There are certain locations in the City where public infrastructure is located on private property. Easements have been obtained, which permits the City access to the drainage system in order for us to proceed with the needed improvements. We combined the two projects into one construction project to save money. Ryan briefly reviewed each site location and also added that we have not worked with Road Construction Northwest before but their references were good. UNANIMOUS APPROVAL. FORWARD TO JUNE 11 COW. B. Municipal Water Law Jim explained that this is another "unfunded mandate" that requires the City to adopt a Water Use Efficiency Rule. The main components of the Municipal Water Law is water quality (which we already follow under the Safe Drinking Water Act), conservation, unaccounted water loss, and alternate sources of water (we only have CWA and the golf course pumps from the river). Most of the ,law is already in our adopted Water Plan and we have had a goal for many years in the annual budget for water loss of less than 10 To check water loss, Mike stated that we have a leak detection survey done every three years. Mike also would like to meter fire lines to determine if water is being used through those lines and not being accounted for. We may require that any new development would have to install a meter at the fire line. The new law states that if we do not meet the 10% loss goal, we have to have a Correction Plan. The City would also have to hold Public Hearings on our water plan and discuss water conservation. Jim H. asked about fire hydrant theft and reuse water consumption. We are trying to implement a reuse (or purple meter) at the golf course to utilize the reuse water rather than the river. There was a discussion of pressure reducing valves and how that affects our council members and our citizens. INFORMATION ONLY. III. FUTURE AGENDAS Jim H requested that CWA water connection fees be discussed, especially as the City is updating the fire code for sprinkler systems. IV. BACKGROUND Due to the delay of removing the overhead utility lines by Seattle City Light, we closed out the main construction contract with R.W. Scott in 2005 to avoid a delay claim. At that time we knew that at a later date we would contract out for the minor cleanup items. Seattle City Light removed their overhead lines on March 1, 2007 and we are still waiting for Qwest and Comcast to remove their overhead utilities and the poles. Once the poles are removed, we will have to patch the roadway and the sidewalks where the poles were located. The Final Cleanup project was advertised for bids on May 3 and May 10, 2007, and only one bid was opened on May 18, 2007. The engineer's estimate was $47,000.00. Dennis R. Craig Construction submitted a bid in the amount of $115,518.00, which is $68,518.00 over the engineer's estimate. The budgeted amount for this project is $50,000. ANALYSIS The sole bid appears to be indicative of the current bidding climate. RECOMMENDATION Reject the bid and re- package the work to solicit bids from the Small Works Roster. In order to conduct this analysis and update the current model, City staff is seeking authorization to enter into an agreement for transportation modeling services with Mirai Transportation Planning and Engineering in the amount of $50,928. If this agreement is approved, Sabey Corporation will be assessed a standard concurrency test fee and additional study costs for the specific site. Staff also reported that they are meeting with Sabey and the City of Seattle regarding the potential of a jurisdictional boundary change as the subject site is shared between the two cities. Tukwila Transit Center Grant Annlication Cyndy shared with the Committee that regardless of a lack of specific site identification for the Tukwila Transit Center, staff is continuing to seek grant funding opportunities for the project. Cyndy explained that the most recent grant application was submitted to the Federal Transit Authority (FTA). Due to recent grant requirement changes by the FTA, King County Metro (Metro) was the only authorized agent able to submit a grant request for the Tukwila Transit Center. Metro agreed to submit this project as a part of their overall grant application. Unfortunately, this change only allowed the City to request a portion (approximately $1 million) of the full project funding. If this grant is successful and funding is awarded, the monies will allow the City to begin construction of the Transit Center in a phased approach on the west side, and postpone other elements of the project until additional funding becomes available. BACKGROUND In December 2005, the City updated its Transportation Element as part of the state required update to the Comprehensive Plan. In the Transportation Element, level of service standards are established which Tukwila is required to implement and maintain. One tool to assist the City is the emme /2 traffic model that was used to develop the Transportation Element. Mirai Associates, now called Mirai Transportation Planning and Engineering, was the consultant retained by Tukwila in 2002 to develop the city -wide transportation model as well as update the Concurrency Model in 2006. At this time, the model should be updated once each year. If more or less development occurs then the frequency of the update should be adjusted to reflect the City's needs. ANALYSIS Regular and continuing maintenance of the City's traffic model is beneficial in several ways. First, in 2015 when the City must update the Comprehensive Plan, a much smaller expense and effort will be required to model transportation needs. Second, by using the model to support concurrency management, the City will be assured that adequate transportation facilities will be available to support growth in a timely manner. It is a powerful tool in scientifically assigning priorities and planning capacity- related road projects. Thirdly, by the City assuming this responsibility, it should speed up the development process and shorten approval times for new applications. Much, if not ultimately all, of the costs of the concurrency model update will be borne by the development community in the form of the Concurrency Test Fee, which was implemented in March 2007. This cost to the developer will be a savings of both time and money due to the dramatic change in Transportation Impact Analysis (TIA) requirements. The scope is set up to accomplish two major tasks: update the City's overall concurrency model as well as perform site specific analysis for a proposed development on the Associated Grocers site. That potential development is being studied by the Sabey Corporation. They will be assessed the standard concurrency test fee (set at $24,300) and have verbally agreed to pay for the additional study costs they have requested, shown in this contract as $16,000. Project Designation. The Consultant is retained by the City to perform transportation modeling services in connection with the project titled Concurrence Mangement 2. Scope of Services. The Consultant agrees to perfouu the services, identified on Exhibit "A" attached hereto, including the provision of all labor, materials, equipment and supplies. 3. Time for Performance. Work under this contract shall commence upon the giving of written notice by the City to the Consultant to proceed. The Consultant shall perform all services and provide all work product required pursuant to this Agreement by December 31, 2007, unless an extension of such time is granted in writing by the City. 4. Payment. The Consultant shall be paid by the City for completed work and for services rendered under this Agreement as follows: A. Payment for the work provided by the Consultant shall be made as provided on Exhibit "B" attached hereto, provided that the total amount of payment to the Consultant shall not exceed $50,928 without express written modification of the Agreement signed by the City. B. The Consultant may submit vouchers to the City once per month during the progress of the work for partial payment for that portion of the project completed to date. Such vouchers will be checked by the City and, upon approval thereof, payment shall be made to the Consultant in the amount approved. C. Final payment of any balance due the Consultant of the total contract price earned will be made promptly upon its ascertainment and verification by the City after the completion of the work under this Agreement and its acceptance by the City. D. Payment is provided in this section shall be full compensation for work performed, services rendered, and for all materials, supplies, equipment and incidentals necessary to complete the work. E. The Consultant's records and accounts pertaining to this Agreement are to be kept available for inspection by representatives of the City and state for a period of three (3) years after final payments. Copies shall be made available upon request. 5. Ownership and Use of Documents. All documents, drawings, specifications and other materials produced by the Consultant in connection with the services rendered under this Agreement shall be the property of the City whether the project for which they are made is executed or not. The Consultant shall be permitted to retain copies, including reproducible copies, of drawings and specifications for information, reference and use in connection with the Consultant's endeavors. The Consultant shall not be responsible for any use of the said documents, drawings, specifications or other materials by the City on any project other than the project specified in this Agreement. 6. Compliance with Laws. The Consultant shall, in performing the services contemplated by this Agreement, faithfully observe and comply with all federal, state, and local laws, ordinances and regulations, applicable to the services to be rendered under this Agreement. 7. Indemnification. The Consultant shall indemnify, defend and hold harmless the City, its officers, agents and employees, from and against any and all claims, losses or liability, including attorney's fees, arising from injury or death to persons or damage to property occasioned by any act, omission or failure of the Consultant, its officers, agents and employees, in performing the work required by this Agreement. With respect to the perform- ance of this Agreement and as to claims against the City, its officers, agents and employees, the Consultant expressly waives its immunity under Title 51 of the Revised Code of Washington, the Industrial Insurance Act, for injuries to its employees, and agrees that the obligation to indemnify, defend and hold harmless provided for in this paragraph extends to any claim brought by or on behalf of any employee of the Consultant. This waiver is mutually negotiated by the parties. This paragraph shall not apply to any damage resulting from the sole negligence of the City, its agents and employees. To the extent any of the damages referenced by this paragraph were caused by or resulted from the concurrent negligence of the City, its agents or employees, this obligation to indemnify, defend and hold harmless is valid and enforceable only to the extent of the negligence of the Consultant, its officers, agents and employees. 8. Insurance. The Consultant shall secure and maintain in force throughout the duration of this contract comprehensive general liability insurance, with a minimum coverage of $500,000 per occurrence and $1,000,000 aggregate for personal injury; and $500,000 per occurrence/ aggregate for property damage, and professional liability insurance in the amount of $1,000,000. Said general liability policy shall name the City of Tukwila as an additional named insured and shall include a provision prohibiting cancellation of said policy except upon thirty (30) days prior written notice to the City. Certificates of coverage as required by this section shall be delivered to the City within fifteen (15) days of execution of this Agreement. 9. Independent Contractor. The Consultant and the City agree that the Consultant is an inde- pendent contractor with respect to the services provided pursuant to this Agreement. Nothing in this Agreement shall be considered to create the relationship of employer and employee between the parties hereto. Neither the Consultant nor any employee of the Consultant shall 2 be entitled to any benefits accorded City employees by virtue of the services provided under this Agreement. The City shall not be responsible for withholding or otherwise deducting federal income tax or social security or for contributing to the state industrial insurance program, otherwise assuming the duties of an employer with respect to the Consultant, or any employee of the Consultant. 10. Covenant Against Contingent Fees. The Consultant warrants that he has not employed or retained any company or person, other than a bonafide employee working solely for the Consultant, to solicit or secure this contract, and that he has not paid or agreed to pay any company or person, other than a bonafide employee working solely for the Consultant, any fee, commission, percentage, brokerage fee, gifts, or any other consideration contingent upon or resulting from the award or making of this contract. For breach or violation of this warrant, the City shall have the right to annul this contract without liability, or in its discretion to deduct from the contract price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage fee, gift, or contingent fee. 11. Discrimination Prohibited. The Consultant, with regard to the work performed by it under this Agreement, will not discriminate on the grounds of race, color, national origin, religion, creed, age, sex or the presence of any physical or sensory handicap in the selection and retention of employees or procurement of materials or supplies. 12. Assignment. The Consultant shall not sublet or assign any of the services covered by this Agreement without the express written consent of the City. 13. Non Waiver. Waiver by the City of any provision of this Agreement or any time limitation provided for in this Agreement shall not constitute a waiver of any other provision. 14. Termination. A. The City reserves the right to terminate this Agreement at any time by giving ten (10) days written notice to the Consultant. B. In the event of the death of a member, partner or officer of the Consultant, or any of its supervisory personnel assigned to the project, the surviving members of the Consultant hereby agree to complete the work under the terms of this Agreement, if requested to do so by the City. This section shall not be a bar to renegotiations of this Agreement between surviving members of the Consultant and the City, if the City so chooses. 15. Attorneys Fees and Costs. In the event either party shall bring suit against the other to enforce any provision of this Agreement, the prevailing party in such suit shall be entitled to recover its costs, including reasonable attorney's fees, incurred in such suit from the losing party. 3 16. The City will work with Mirai to identify traffic count locations. 2. The City will provide traffic count raw data to Mirai. Mirai will review the raw data and adjust the counts for PM peak hour. The City will provide a list of the transportation improvements including new roadway construction, signal additions and changes to signal timings that were implemented since the last modeling. Mirai will calculate 2007 levels of service using Synchro. Mirai will prepare an existing condition section of the report. 3. The City will update the existing land use database that was provided to Mirai for the 2006 modeling. Mirai will convert the land use data to employment and households that will be suitable for modeling. 4. Mirai will update the base year model with the new counts. Mirai will use the model created in 2006 based on the new PSRC model. Mirai will validate the new base year model with 2007 traffic counts. 5. The City will provide the City's CIP. Mirai will include the relevant transportation improvement projects in the model. The City and Mirai will work together to identify the growth projection for next 6 years. With the changes in the roadway network and the land use growth projections, Mirai will develop 2013 concurrency model. Mirai will obtain the 2013 traffic volumes from the updated Tukwila model. 6. Mirai will post process the model volumes and calculate 2013 concurrency levels of service for all designated intersections in the City. 7. Mirai will identify potential improvements where the intersections operate level of service below the concurrency standard. If needed, Mirai will attend a meeting to discuss the analysis results and the potential improvements. 8. Mirai will calculate levels of service with the recommended improvements. 9. Mirai will prepare a draft concurrency status report and submit it for staff review. Mirai will submit the final report after all staff comments are addressed. For the supplemental Concurrency Analysis for the Sabey Corporation's proposed development on the Associated Grocer's site: 10. Mirai will meet with the City of Tukwila staff to understand the proposed redevelopment site plan and traffic access needs. City of Seattle staff, City of Tukwila staff and Mirai will identify the study area and the intersections where the level of service should be evaluated. The redevelopment completion year will also be identified. 11. Mirai will review the existing conditions for the project. This will include documentation of the existing use of the project site, traffic controls, intersection volumes and level of service, transit services, and non motorized transportation facilities. 12. Mirai will count PM peak hour intersection traffic volumes for not more than 4 locations. It is likely that the new traffic counts within the City of Seattle would be needed. Mirai will use the available traffic counts from the City of Tukwila. 13. The City will provide the traffic reports and the agreement for the Boeing development in the vicinity of the Associated Grocer site. Mirai will identify the committed improvements identified in the agreement within the study area. Mirai also review the capacity reserved for the trips generated by the Boeing development. For the future traffic impact analysis, the travel capacity reserved for the Boeing development will be added to the background traffic as if it were being used. 14. Mirai will use the updated City of Tukwila's concurrency model to estimate the background traffic without the proposed AG site redevelopment. Mirai will add the agreed Boeing traffic to the background traffic from the concurrency model without the AG development. 15. Mirai will estimate the trip generation for the proposed redevelopment uses at the Associated Grocer site and identify the additional trips over the existing conditions. Mirai will adjust the ITE trip generation rates to accommodate the trip reductions due to the mixed use conditions. 16. Mirai will establish trip distribution for the AG site using the Tukwila concurrency model. Then, Mirai will assign the net trips to the network. The assigned trips will be added to the background traffic forecasts for the planning year. Mirai will calculate levels of service using Synchro software. 17. For the City of Tukwila, Mirai assumes that the City's update of the concurrency analysis will include the proposed AG site redevelopment. Mira will summarize the Tukwila's concurrency update analysis for the study area. For the City of Seattle, Mirai will calculate the screenline volume to capacity ratios where they are applicable. 18. Mirai will identify potential measures needed to mitigate the traffic impacts directly resulting from the Associated Grocer site redevelopment. Mirai will discuss options for those mitigating measures with City staff. 19. Mirai will document the traffic impact and prepare a draft report. The draft report will be submitted to the City of Seattle and City of Tukwila. Mirai will address all comments before a final report is completed. Tukwila International Boulevard Phase 1 Final Clean -Up Bid Rejection Staff is seeking Council approval to reject all bids received for the Clean -Up of Tukwila International Boulevard Phase I. One bid was received for the project and exceeded the engineer's estimate by more than $68,000. Staff intends to repackage the project specifications and send out for rebid to the City's Small Works Roster. Staff expects to have the project ready for rebid in June. The Committee has requested that the information memo submitted by staff be revised to explain the Phase I clean -up requirements which will include asphalt and concrete patching and sidewalk repair as well as identify time constraints involved with the main project contract close -out. Concurrencv Modeling This agreement will update the City's Transportation Model and ensure that the City is meeting the needs of the Concurrency Management Program. The Sabey Corporation is proposing redevelopment of the Associated Grocers site. In response to this redevelopment, Sabey Corporation has requested that the City assist them in performing site specific analysis of the site. In order to conduct this analysis and update the current model, City staff is seeking authorization to enter into an agreement for transportation modeling services with Mirai Transportation Planning and Engineering in the amount of $50,928. If this agreement is approved, Sabey Corporation will be assessed a standard concurrency test fee and additional study costs for the specific site. Staff also reported that they are meeting with Sabey and the City of Seattle regarding the potential of a jurisdictional boundary change as the subject site is shared between the two cities. Tukwila Transit Center Grant Application Cyndy shared with the Committee that regardless of a lack of specific site identification for the Tukwila Transit Center, staff is continuing to seek grant funding opportunities for the project. Cyndy explained that the most recent grant application was submitted to the Federal Transit Authority (FTA). Due to recent grant requirement changes by the FTA, King County Metro (Metro) was the only authorized agent able to submit a grant request for the Tukwila Transit Center. Metro agreed to submit this project as a part of their overall grant application. Unfortunately, this change only allowed the City to request a portion (approximately $1 million) of the full project funding. If this grant is successful and funding is awarded, the monies will allow the City to begin construction of the Transit Center in a phased approach on the west side, and postpone other elements of the project until additional funding becomes available.
