Library Advisory Board
I am pleased to forward you the application of Ms. Marie Parrish. Ms. Parrish has
applied for the vacancy on the Library Advisory Board. The vacancy was created when
Mac MacDonald resigned upon moving out of the City recently. Ms. Parrish's term in
Position #3 would expire 12/31/07.
Lodging Tax Advisory Board
Two positions on the Lodging Tax Advisory Board have become vacant recently.
Dwight MacLean, General Manager of the Ramada Limited Tukwila, has resigned. We
have received and I am forwarding the application of Meilee Anderson. Ms. Anderson is
Corporate Sales Manager of Comfort Suites (Family Fun Center). She is eager to work
with our Board, having served on a similar Board in Spokane.
Tina Tuft, Asst. General Manager of Westfield, has been promoted to a corporate
regional position and will not be able to attend meetings regularly. We have received and
I am forwarding the application of Nicole Grubbs, Marketing Director at Westfield. Ms.
Grubbs has served on a similar Board in Lynnwood.
Unless I hear otherwise from the Council prior to November 6, I will invite these
individuals to the Regular City Council meeting on November 20, 2006, to have these
appointments confirmed. Thank you.

SPONSOR'S The uninterruptible power supply units were advertised on September 9 15, 2006. One
SUMMARY bid was received on October 2, 2006. The bid of $4,650.00 per unit was from Cascade
Signal Corporation. Cascade Signal Corporation is a regular supplier to the Public Works
Department and they produce a reliable and high quality product. Most of the other
equipment needed for the Signal Project is listed on the State's Bid List.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, INCREASING THE CITY OF TUKWILA REGULAR LEVY
FROM THE PREVIOUS YEAR, COMMENCING JANUARY 1, 2007, ON
ALL PROPERTY, BOTH REAL AND PERSONAL, IN COMPLIANCE WITH
RCW 8155.120; PROVIDING FOR SEVERABILITY; AND ESTABLISHING
AN EFFECTIVE DATE.
WHEREAS, the City of Tukwila has properly given notice of a public hearing, held
on November 20, 2006, pursuant to RCW 84.55.120; and
WHEREAS, the City, after hearing and duly considering all relevant evidence and
testimony presented, has determined that the City requires an increase in property tax
revenue from the previous year, in addition to the increase resulting from the addition of
new construction and improvements to property and any increase in the value of State
assessed property, in order to discharge the expected expenses and obligations of the
City; and
WHEREAS, the City has determined that it is in its best interest and necessary to
meet its expenses and obligations for the property tax revenue to be increased for 2007,
and the final assessed valuation calculation has been determined;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. An increase in the regular property tax levy, in addition to any amount
resulting from the addition of new construction and improvements to property and any
increase in the value of state- assessed property, is hereby authorized for the 2007 levy in
the amount of $109,225, which is a percentage increase of 1.0% from the previous year.
Section 2. Severability. If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance or its application to any person br situation should be held to
be invalid or unconstitutional for any reason by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of the
remaining portions of this ordinance or its application to any other person or situation.
Section 3. Effective Date. This ordinance or a summary thereof shall be published
in the official newspaper of the City, and shall take effect and be in full force and effect
January 1, 2007.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, LEVYING THE GENERAL TAXES FOR THE CITY OF
TUKWILA IN KING COUNTY FOR THE FISCAL YEAR COMMENCING
JANUARY 1, 2007, ON ALL PROPERTY, BOTH REAL AND PERSONAL,
IN SAID CITY WHICH IS SUBJECT TO TAXATION FOR THE PURPOSE
OF PAYING SUFFICIENT REVENUE TO CARRY ON THE SERVICES OF
THE SEVERAL DEPARTMENTS OF SAID CITY FOR THE ENSUING
YEAR AS REQUIRED BY LAW; PROVIDING FOR SEVERABILTTY; AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Tukwila has considered the City's anticipated
financial requirements for 2007 and the amounts necessary and available to be raised by
ad valorem taxes on real, personal and utility property; and
WHEREAS, the final assessed valuation calculation has been determined;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Regular Tax Levy.
A. There shall be and hereby is levied on all real, personal, and utility property in the City
of Tukwila, in King County, whose estimated assessed valuation is $3,909,827,327, current taxes
for the ensuing year commencing January 2007, in the amount and at the rates specified below:

B. The said taxes herein provided for are levied for the purpose of payment upon the
general bonded indebtedness of the City of Tukwila, the General Fund, and for the maintenance
of the departments of the municipal government of the City of Tukwila for the fiscal year
beginning January 1, 2007.
Section 2. Collection. This ordinance shall be certified to the proper County officials, as
provided by law, and taxes here levied shall be collected to pay to -the Finance Director of the City
of Tukwila at the time and in the manner provided by the laws of the State of Washington for the
collection of taxes for non chartered code cities.
Section 3. Severability. If any section, subsection, paragraph, sentence, clause or phrase
of this ordinance or its application to any person or situation should be held to be invalid or
unconstitutional for any reason by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of the remaining portions of
this ordinance or its application to any other person or situation.
Section 4. Effective Date. This ordinance or a summary thereof shall be published in the
official newspaper of the City, and shall take effect and be in full force and effect January 1, 2007.

Subject: Adoption of proposed ordinance renewing a temporary moratorium on land
divisions and certain land use decisions in the Longacres TOD planning area.
Background
In September 2002, Council adopted an ordinance establishing a six -month moratorium on the
acceptance of certain land divisions and land use decisions within the transit- oriented
development (TOD) planning area surrounding the Sounder Commuter Rail/Amtrak station (see
Figure 1). The moratorium was intended to preserve land available for development or
redevelopment and restrict land uses that do not implement the vision for the area until land use
and transportation plans and regulations supporting the TOD at the station are in place.
Ordinance 2123, renewing the moratorium, was adopted in June 2006 and expires December 2,
2006. Council must decide whether to renew or modify the ordinance, or let the moratorium
lapse. To date, Council has renewed the moratorium seven times, modifying it to provide more
flexibility in use of the parcels while the Tukwila Urban Center (TUC) plan was being
developed.
On October 24, 2006, CAP authorized staff to forward the proposed ordinance to Council for a
public hearing, which was held on November 13, 2006. There was one public comment given at
the hearing regarding the moratorium on boundary line adjustments (BLA), and the Council
directed Staff to revise the ordinance to allow BLAs, with conditions. There is likely to be little
negative effect on the larger parcels of land if the modifications are adopted. New parcels of land
cannot be created by a BLA, and the individual lots must still meet the zoning standards. No
written comments were received.
Discussion
The current ordinance with the Council directed revisions:
Prohibits the filing of all permits and approvals related to land divisions and such uses or
activities as manufacturing, industrial auto oriented businesses.
Exempts the filing of and approvals related to the expansion of existing businesses on
existing lots, sign permits and building permits for tenant improvements, and the
extension of a current land use permit.
More uses are permitted in the TOD area than affected by the moratorium. The
moratorium does not affect the filing of approvals related to all other uses currently
allowed under TUC zoning, which support and implement the vision for the area,

including those that are easily redevelopable such as auto sales lots, contractor or storage
yards, or commercial parking.
Allows BLAs, provided it is to accommodate the development of a use permitted under
the ordinance.
To date, Staff has not been made aware of any other negative effects from the moratorium on
plans to develop or redevelop properties in the TOD, most likely due to the limited scope of the
moratorium. Should a specific project be proposed that falls outside the uses permitted under the
moratorium, Staff will consider the appropriateness of the project and bring it forward to the
Council for deliberation.
Proposed Next Steps
At the next regular meeting on November 20, 2006 Council has the following options:
a) Adopt the proposed ordinance with the proposed modifications. The moratorium remains
in effect for six months, at the end of which Council must hold another public hearing
and renew, modify, or allow it to lapse.
b) Modify the proposed ordinance. It remains in effect for six months, at the end of which
Council must hold another public hearing and either renew, modify, or repeal the
moratorium.
c) Take no action. When Ordinance No. 2123 expires on December 2, 2006, land divisions,
development activities and land uses will occur in the area as allowed under the City's
zoning. Planning and implementation of the TUC vision and other transportation
improvements may be more difficult.
Staff Recommendations
Adopt the proposed ordinance with the proposed modifications. Set the effective date of the
ordinance to December 2, 2006, when the current ordinance expires.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, RENEWING A SIX -MONTH MORATORIUM ON
ACCEPTANCE OF APPLICATIONS FOR CERTAIN LAND DIVISIONS
AND DEVELOPMENT ACTIVITIES AND LAND USES WITHIN THE
AREA DESIGNATED FOR TRANSIT- ORIENTED DEVELOPMENT
AROUND THE TEMPORARY COMMUTER RAIL/AMTRAK STATION AT
LONGACRES; PROVIDING FOR SEVERABILITY; AND DECLARING AN
EMERGENCY.
WHEREAS, the City recognized the unique opportunity to promote a more
compact, mixed use, pedestrian supportive pattern of development that makes effective
use of its proximity and accessibility to the Sounder commuter -rail and Amtrak station
in Tukwila, and includes a mix of retail, service, office and residential uses; and
WHEREAS, a more intensive pattern of transit oriented development (TOD) would
assist the City with the redevelopment of the Tukwila Urban Center, one of thirteen
designated urban centers within King County, and provide workers with commercial,
public and recreational services close to where they live or work; and
WHEREAS, a more intensive pattern of TOD would benefit the region by assisting
in achieving Growth Management Act requirements and increasing local and regional
transit ridership; and
WHEREAS, in August 2001, the City held a workshop, inviting other key
stakeholders to explore the possibilities for a TOD in the Longacres area; and
WHEREAS, the workshop resulted in strong support for the project and a "vision"
for land use and transportation in the Longacres TOD area; and
WHEREAS, to implement this vision, the City applied for and was awarded a $1.5
million grant by the Federal Highways Administration to prepare a master plan for the
Longacres area, identifying land use, urban design and transportation /circulation
objectives, as well as to prepare implementing ordinances and design guidelines,
complete environmental review of the plan and designate it as a planned action, and
integrate the design of the permanent commuter rail /Amtrak station; and
WHEREAS, while the City anticipates the TOD master plan project to be completed
by the middle of 2007, some issues need to be addressed immediately in order for the
TOD project to be successful; and
WHEREAS, the Tukwila Urban Center (TUC) zoning district allows for a variety of
high- intensity regional uses in the TOD planning area, including light industry and
warehousing, some of which may not be of appropriate type, density or character to
support the intent of a TOD; and
WHEREAS, the Longacres site is considered one of the region's key opportunities
for TOD, primarily due to the large amount of vacant and re- developable land
surrounding the station; and

WHEREAS, any significant amount of new development occurring prior to the
establishment of a desired pattern of uses in the TOD master plan could jeopardize the
City's ability to implement the TOD plan; and
WHEREAS, the City's Municipal Code allows for the division of land and
adjustment of boundary lines that, if allowed to occur in the TOD planning area, would
make future land assemblage for a TOD project difficult and costly, and threaten the
successful implementation of the TOD master plan; and
WHEREAS, within the TOD planning area, the City desires to take immediate steps
to preserve the land available for development or redevelopment and restrict land uses
that do not implement the vision for the area until the TOD at Longacres master plan
and environmental review are completed, certain implementing zoning regulations are
adopted by the City, and other related regional transportation infrastructure issues are
decided; and
WHEREAS, the City also desires to ensure public input on these issues; and
WHEREAS, the moratorium will expire on December 2, 2006 and the TOD
planning process is not yet completed; and
WHEREAS, a public hearing on this proposed ordinance was held on
November 13, 2006; and
WHEREAS, the City desires to provide for an exemption to the moratorium for
residential mixed -use TOD projects within one quarter mile of the Sounder Commuter
Rail /Amtrak Station property, as amended by Ordinance 2085; and
WHEREAS, within the designated TOD planning area, the City desires to preserve
the land necessary for relocating the 100 foot -wide Union Pacific Railroad right -of -way
to the area immediately adjacent to the west side of the Burlington Northern Santa Fe
Railroad 100 -foot right-of-way by prohibiting further development within this corridor,
since this relocation is integral to the successful development of a TOD; and
WHEREAS, the City desires to preserve the status quo for the protection of the
health, safety and welfare of City residents, as it relates to development in Tukwila,
until these matters are more fully considered; and
WHEREAS, the City desires to renew the Ordinance, with modifications, for a
subsequent six-month period;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Findings of Fact. The "Whereas" clauses, above, are hereby adopted by
reference as the City Council's findings of fact as if fully set forth herein.
Section 2. Moratorium Area Identified. For the purposes of this ordinance, "the
TOD planning area" is identified in Figure 1. This area is bounded by I -405 on the north,
Tukwila City limits on the east, the southern boundary of parcel number 2523049006 on
the south, and West Valley Highway on the west.
Section 3. Moratorium on Activities. A moratorium originally established by
Ordinance No. 1996, on September 16, 2002, and most recently renewed by Ordinance
No. 2123, on May 15, 2006, is hereby renewed, regarding the filing of permits and
approvals within the TOD planning area relating to:
A. Land divisions: This includes all permits and approvals related to
subdivisions, short subdivisions and lot consolidations.

B. Development Activities and Land Uses. This includes all applications and
approvals for any and all:
1. Rezones.
2. Conditional use permits.
3. Unclassified use permits.
4. Variances.
5. Binding site plans.
6. Required environmental review.
7. Building permits.
8. Land altering permits;
Relative to the followine activities and uses:
a. Amusement parks.
b. Automobile, recreational vehicles or travel trailer sales rooms. No
dismantling of cars or travel trailers or sale of used parts allowed.
c. Automotive services.
d. Cemeteries and crematories.
e. Commercial laundries.
f. Drive -in theaters.
g. Drive- through restaurants.
h. Electrical substations distribution.
i. Heavy equipment repair and salvage.
j. Internet data /telecommunication centers.
k. Manufacturing, processing and /or packaging of foods, including but
not limited to, baked goods, beverages (except fermenting and distilling), candy,
canned or preserved foods, dairy products and byproducts, frozen foods, instant foods
and meats (no slaughtering).
1. Manufacturing, processing and /or packaging pharmaceuticals and
related products, such as cosmetics and drugs.
m. Manufacturing, processing, and /or packaging previously prepared
materials including, but not limited to, bags, brooms, brushes, canvas, clay, clothing,
fur, furniture, glass, ink, paint, paper, plastics, rubber, tile, and wood.
n. Manufacturing, processing, assembling, packaging and /or repairing
electronic, mechanical or precision instruments such as medical and dental equipment,
photographic goods, measurement and control devices, and recording equipment.
o. Manufacturing, processing and /or assembling previously prepared
metals including, but not limited to, stamping, dyeing, shearing or punching of metal,
engraving, galvanizing and hand- forging.

q. Recreation facilities (commercial indoor), including bowling alleys,

r. Warehouse storage and /or wholesale distribution facilities.
Sign permits, building permits for tenant improvements, the extension of current
land use permits, and expansion of existing businesses on existing lots are exempt from
this ordinance. Boundary line adjustments are allowed only when it is to accommodate
the development of uses permitted under this ordinance, as approved by the
Community Development Director.
Section 4. Moratorium on Development Adjacent to the Burlington Northern
Santa Fe (BNSF) Railroad right -of -way. In addition to the provisions of Section 3
above, any permitted or conditional uses allowed within the TUC district under TMC
Chapter 18.28 are prohibited on properties located within 100 feet of the BNSF Railroad
right -of -way between I-405 and Longacres Way, unless the property is to be developed
under an approved developer agreement with the City.
Section 5. Effective Period of Moratorium. The moratorium renewed by this
ordinance shall become effective as set forth in Section 9 below, and shall continue in
effect for six months thereafter unless repealed, renewed or modified by the City
Council after a subsequent public hearing and entry of findings of fact.
Section 6. Work Program. The Mayor is authorized to allocate the necessary
resources to prepare a work program to address the land use and transportation
planning issues identified in this ordinance and the City shall implement such a work
program.
Section 7. Exemption. Residential mixed -use transit- oriented development
projects within one quarter mile of the Sounder Commuter Rail /Amtrak Station
property are specifically exempted from this moratorium except for property located
within 100 feet of the Burlington Northern Railroad right -of -way as set forth in
Section 4 above.
Section 8. Severability. If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance or its application to any person or circumstance, be declared
unconstitutional or otherwise invalid for any reason, or should any portion of this
ordinance be pre empted by state or federal law or regulation, such decision or
preemption shall not affect the validity or constitutionality of the remaining portions of
this ordinance or its application to any other persons or circumstances.
Section 9. Effective Date. This ordinance, or a summary thereof, shall be published
in the official- newspaper of the City and shall take effect and be in full force on
December 2, 2006.

CITY OF TUKWILA, WASHINGTON, ADOPTING
A LAND USE FEE SCHEDULE.
WHEREAS, the City Council has requested that staff review and update fees on a
regular basis; and
WHEREAS, the City intends to update these fees on an annual basis with any
increases tied to growth in City expenses; and
WHEREAS, the Mayor's 2007 budget calls for a minimal general fund increase of
4% for general operations; and
WHEREAS, the City needs to provide permit fees for the new land use
applications created by the Wireless Telecommunication Chapter; and
WHEREAS, the City intends to periodically review the fees in comparison to those
charged by neighboring jurisdictions;

On Monday, November 20, the Finance and Safety Committee is scheduled to complete
its review of the budget. It is scheduled that this information will be reviewed that same

A public hearing is scheduled to be held on December 4. These documents (budget

RE: Non Represented Wages and Benefits for 2007
Every other year, a Non Represented wages ere increased by the Consumer price Index,
All Wage Earners (CPI -W) (first half of calendar year to first half of following calendar
year). This year the increase is 3.5°A. 90% of the CPI -W as stated above results in a
3.1% COLA increase for the non represented employees, including those above the wage
schedule.
Benefits for 2007 remain the same as in 2006, with the exception of premiums for
employee healthcare benefits. Employees paid a share of the premium in 2006 and it
appears an adjustment will be made to the plan so that City employees will be reimbursed
for 2006 premiums. The premium increase for 2007 is 6.4 which is below the
maximum 10% cap the City pays. Thus there is no premium share or plan modifications
actually made for 2007.
It is requested that the Council approve this resolution in its entirety. Thank you.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, UPDATING AND CLARIFYING THE NON REPRESENTED
EMPLOYEES' COMPENSATION AND ADOPTING THE NON REPRESENTED
SALARY SCHEDULE AND BENEFITS SUMMARY EFFECTIVE JANUARY 1, 2007.
WHEREAS, the Tukwila City Council approved Resolution No. 1537, dated December 1,
2003, which provided that a COLA would be applied to the non represented employee wage
schedule in odd numbered calendar years; and
WHEREAS, the COLA would be based on the Consumer Price Index, All Wage Earners
(CPI -W) Seattle- Tacoma Bremerton Area Semi- Annual Average (first half of calendar year to
first half of following calendar year); and
WHEREAS, the CPI average for the above stated period of time (first half of 2005
compared to first half 2006) is 3.5 and
WHEREAS, 90% of the CPI W provides for a 3.15% wage increase;
NOW, THEREFORE, THE CITY COUNCIL' OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY RESOLVES AS FOLLOWS:
Section 1. Consumer Price Index (CPI) and Non Represented Wage Plan.
A. The 2006 wage schedule for non represented employees shall be increased by 3.15%
based on 90% of the Consumer Price Index, All Wage Earners (CPI -W) Seattle- Tacoma-
Bremerton Area Semi Annual Average (first half of calendar year {2005} to the first half of the
following calendar year {2006 and effective January 1, 2007.
B. Employees currently above the top step of the 2006 wage schedule shall also receive a
3.15% COLA for 2007. The 3.15% shall be applied to their actual wage that is above the control
point.
C. Merit will continue to be eliminated from the plan at this time due to economic
conditions as well as a desire that the wage schedule for non represented employees better
reflect the wages offered by those jurisdictions determined to be comparable, and may be
reconsidered as a plan element in subsequent years.
Section 2. Non Represented Wage Schedule and Benefits Summary.
A. The non- represented wage schedule, attachment "A" hereto, shall be approved,
effective January 1, 2007.
B. The non represented benefits summary, attachment "B," shall be approved, effective
January 1, 2007.

NON- REPRESENTED EMPLOYEE BENEFITS 2007
SOCIAL SECURITY (FICA): Social Security benefits shall be provided as contained in
Section 2.52.010 of the Tukwila Municipal Code (TMC).
STATE -WIDE EMPLOYEE RETIREMENT SYSTEM (PERS): Retirement shall be
provided as contained in Section 2.52.020 of the TMC.
HOLIDAYS: Holidays shall be provided as contained in Section 2.52.030 of the TMC.
SICK LEAVE: Sick leave shall be provided as contained in Section 2.52.040 of the TMC.
MEDICAL INSURANCE: The City shall pay 100% of the 2007 premium for regular
full-time employees and their dependents under the City of Tukwila self insured
medical/ dental plan. Premium increases above 10% per year shall result in a modified
plan document to cover the additional cost above 10 or a premium shall be
implemented for the difference, at the City's discretion. The City reserves the right to
select all medical plans and providers. Regular part -time employees shall be entitled to
benefits on a pro -rata basis. Employees who choose coverage under the Group Health
Cooperative plan shall pay the difference between the City of Tukwila plan full- family
rate and the rate charged to them by Group Health.
DENTAL INSURANCE: The City shall provide 100% of the 2007 premium for the
regular full -time employees and all dependents under the City of Tukwila self insured
medical /dental plan for dental coverage. Regular part-time employees shall be entitled
to the same benefits on a pro-rata basis.
LIFE INSURANCE: For regular full -time employees, the City shall pay the premium
for Plan C (Multiple of annual earnings) or similar group life and accidental death and
dismemberment insurance policy. Said plan shall be at 100% of annual earnings
rounded up to the next $1,000.
VISION /OPTICAL/HEARING CARE: The City shall provide coverage for eye
examinations, vision, optical and hearing care to non represented regular full-time
employees and their dependents at the rate of $200 per person, to a maximum of $400
per family unit, each year. Regular part -time employees and their dependents shall be
entitled to benefits on a pro -rata basis.
DISABILITY INSURANCE: The City shall provide 100% of the premium for regular
full -time employees for a comprehensive Iong -term disability policy.
VACATION: Following the 6th month of continuous employment, annual vacation
leave of 6 full days (each day is calculated at 8 hours, regardless of schedule worked)
shall be granted. Thereafter, an additional day of annual leave shall accrue each month,
up to a total of 12 .days. Three additional days of annual leave shall be granted on the
employee's anniversary date after the 3rd, 4th, and 5th years. After 6 years, the
employee shall be granted 1 day per year additional annual leave to a maximum of 24

You may recall that earlier in the year we ordered a replacement pumper. At the time, my
proposal was to replace both 1986 International Pumpers. Although the majority of the
council seemed to be in favor of this concept, there were insufficient funds in the 107
account to make the proposal a reality. The proposed contribution to the 107 fund in 2007
will give us sufficient funds to order the second replacement pumper.
We have until December 1, 2006 to order a second pumper with the 2006 engine; if we
order the second pumper, it will be a duplicate of the one we ordered earlier in the year.
There will be a modest increase in price, approximately five percent because of inflation.
In addition, if we sign a contract with Ferrara by the specified date, they will make the
effective date of the contract January 2, 2007; no funds will be spent in 2006 for this
apparatus.
If we delay ordering a second pumper until 2007, we will be purchasing a new generation
of engine and exhaust system. Manufacturers still have not identified the cost impact of
these changes. While I agree with reducing emissions, I think it is better for us to let the
manufacturers work the bugs out before we buy the new generation of fire apparatus.
I recommend that you approve the purchase of a second replacement pumper from
Ferrara Manufacturing.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, ESTABLISHING A MORATORIUM ON THE
DEVELOPMENT OF LOTS THAT DO NOT MEET THE CITY'S MINIMUM
LOT AREA PROVIDING FOR SEVERABILITY; AND DECLARING AN
EMERGENCY.
WHEREAS, there are lots within the City that do not meet the City's minimum lot
area; and
WHEREAS, many of these lots were created prior to the enactment of Washington
State's subdivision statutes and the City's subdivision regulations; and
WHEREAS, the City has received and will continue to receive development
applications for the development of these Iots; and
WHEREAS, the City needs to study the best method for regulating the
development of these substandard lots; and
WHEREAS, uncertain regulation has and will result in the development of lots that
are inconsistent with the City's Zoning Code and Comprehensive Plan, which will
impact noise, density, environmental degradation, traffic, and fire safety within the
City; and
WHEREAS, pursuant to RCW 35.63.200, RCW 35A.63.220 and RCW 36.70A.390, the
City may adopt a moratorium for a period of up to six months, provided that a public
hearing on the moratorium is held within 60 days after its adoption; and
WHEREAS, RCW 35A.12.130 authorizes an ordinance to take effect immediately if a
majority plus one of the Council members deem the ordinance necessary for the
protection of public health, public safety, public property, or the public peace; and
WHEREAS, without an immediate effective date, applications for development of
these lots could establish vested rights to develop lots in neighborhoods and places that
are inconsistent with the City's Zoning Code and Comprehensive Plan, and enable legal
challenges to the City's ability to regulate these lots;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Findings of Fact. The "Whereas" clauses above are hereby adopted by
reference as the City Council's finding of fact as if fully set forth herein.
Section 2. Purpose. The purpose of this moratorium is to allow the City adequate
time to adopt regulations for lots that do not meet the City's minimum lot area. The
Mayor is authorized to allocate the necessary resources to prepare a work program to
address the land use planning issues identified in this ordinance, and the City shall
implement such a work program.

Section 3. Moratorium Imposed. The City Council hereby imposes a moratorium
on the development of lots that do not meet the City's minimum lot area. However, this
moratorium shall not be construed to prevent the issuance of building, mechanical or
plumbing permits for repair or maintenance of existing structures. Additionally, this
moratorium shall not prohibit the construction of new accessory buildings or additions
to existing structures, development that is vested prior to the enactment of this
moratorium, or development approved by the City through its variance process within
the 365 days preceding the enactment of this moratorium.
Section 4. Effective Period of Moratorium. The moratorium shall become effective
as set forth in Section 8 below, and shall continue in effect for six months thereafter unless
repealed, renewed, or modified by the City Council after a subsequent public hearing and
entry of findings of fact.
Section 5. Public Hearing to be Held. A public hearing on the issue of the
moratorium shall be held no later than 60 days after the date of adoption herein.
Section 6. Severability. If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance or its application to any person or situation should be held to
be invalid or unconstitutional for any reason by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of the
remaining portions of this ordinance or its application to arty other person or situation.
Section 8. Effective Date. This ordinance, as a public emergency ordinance
necessary for the protection of the public health, public safety, public property or public
peace, shall take effect and be in full force immediately upon its adoption. Pursuant to
Matson v. Clark County Board of Commissioners, 79 Wn.App. 641, 904 P.2d 317 (1995),
underlying facts necessary to support this emergency declaration are included in the
"WHEREAS" clauses above, all of which are adopted by reference in Section 1 as findings
of fact, as if fully set forth herein.

at a Regular Meeting thereof this day of 2006.
