HomeMy WebLinkAbout1922-06-29 Adjourned Minutes386 June 29, 1922. An Adjourned meeting of the Town Council was held at the residence of ?fir. C. G. Sanders on the above date at eight o'clock. This meeting was adjourned from the night before, June 28th, and in the meantime the members of the Council met on the site of the proposed regrade and finally came to a definite conclusion. me Mayor and all members of the Council except Mr. Lemon were present. The condition of Marren Avenue was considered from every angle; and after taking into consideration the fact that School District No. 144 has expended considerable money in improving its grounds, thereby benefitting the Town to a very large extent by removing a large amount of yardage from Avenueand the further fact that the Avenue was left in an unfinished and unsatisfactory condi- tion by the failure in 1919 of Mesbrs. Smith and Fielding to complete the im- provement of Warren Avenue in accordance with their contract with the Town of Tukwila, to the detriment of the Town and several of its residents, it was regularly moved and second and carried that this improvement be carried forward and that a sum of money not to exceed Four Hundred Dollars appropriated for the purpose; and that in view of the fact there were insufficient funds in the Treas ury of the Town to complete this worts, the Mayor and Treasurer be empowered and authorized to renew the loan of One Thouasnd Dollars with Mr. R. E. Ives for One year beginni on the day of July, 1922, and the following resolutions were unanimously adopted: WHEREAS, In 1919 the firm of Smith and Fielding, Contractors, entered into a writ•• ten form of agreement or ,contract, wherein and whereby the said Smith and Field• ing were, among other improvements, to Improve:: Warren Avenue in the Town of Tukwila by certain grading and filling; and, WHMM The sa id ftrm of Smith and Fielding neglected, failed and refused to finish and complete the work expressed and stipulated in their contract with the Town ,@f Tukwila, and particularly failed, neglected and refused to- complete the im- provement by grading and filling as aforesaid of the said Warren ff�renue; and 7-ERMS, As a result os such failure, neglect and refusal on the part of the said Smith and Fielding to complete said improvements by grading and filling the said W Avenue has been left in in unfinished and highly unsatisfactory condition, to the detriment and disadvantage of the said Town of Tukwila and some if its residents; and, WHEREAS, School District No. 144 has improved its property, too its School grounds,. by building thereon a School building and by grading the grounds and bringing them up to a sightly and commendable condition. To accomplish this work the said District No. 144 has graded a portion of said Warren Avenue, but still leaving said Warren Avenue in an unfinished and unsatisfactory condition; and, TH9REAS, Warren Avenue constitutes the best approach to the above mentioned School House and grounds and will be traveresed every day by pupils and patrols of the School, and for that reason as well as for the reason that it is to the best in- terests of the Public, it is deemed by the Town Council practical and for the greatest good to the greatest number that Warren Avenue be immediately brought to a suitable grade and put in such condition as will permit of Sidewalks being con- structed thereon; and The Grading machinery and tools used by said District No. 144 are still upon the site of this improvement, and are accessible to the use of the Town Tukwila.
