Mayor Mullet ;f'l ~bliC Works Director U May 17, 2006 Six-Year Trausportation Improvement Prol!1'am (2007 - 2012) ISSUE Annual update of the Six-Year Transportation Improvement Program for the years 2007 - 2012. BACKGROUND The Transportation Improvement Program (TIP) is updated annually as required by RCW The TIP is adopted by resolution after a public hearing at the local agency level and incorporated into the regional and state TIPs. The TIP is primarily a financial planning document for projects competing for grants. Any project submitted for federal grant funding must be included in the local, regional and state adopted TIPs. The TIP is a rolling plan showing various funding sources: grants, developer, and local funds. Projects "roll" as funds or stages (design report, final design, construction) occur. Tukwila's TIP and CIP list many of the same transportation related projects. The TIP lists only those transportation related projects planned within the next six years that are deemed regionally significant. The City's CIP lists transportation projects planned in the next six years and beyond, as well as water, sewer, surfuce water, and capital facilities. The TIP is required to be adopted by July I, while the CIP is prepared during summer/fall in conjunction with the City's budget preparation. Differences between the two may be due to priority changes, funding availability changes, or other factors that normally occur during the time between adoption of each document. ACTION TAKEN The "Draft" 2007 - 2012 TIP was created by modifying the 2006 - 2011 TIP to add projects, remove projects, adjust project costs, and reprioritize the list of projects. The attached spreadsheet shows the project additions, deletions and revisions. Deleted: Deleted. WHEREAS, pursuant to the requirements of RCW Chapters 35.77 and 47.26 as amended, the City Council of the City of Tukwila has previously adopted a Transportation Improvement Program and thereafter periodically modified said Transportation Improvement Program by resolution; and WHEREAS, the City Council has reviewed the work accomplished under said program, determined current and future City street and arterial heeds, and based upon these findings has prepared a Six-Year Transportation Improvement Program for the ensuing six calendar years (2007 2012); and WHEREAS, a public hearing was held on the said Six-Year Transportation Improvement Program on June 12, 2006; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1 Filing of Program. Scientific studies have documented the loss of approximately 98% of the estuarine habitat in the Duwamish. Furthermore, the site is located within the -critical mixing or "transition" zone between fresh and salt water which is vital to juvenile salmonids as they become accustomed to salt water, on their migration to Puget Sound and beyond. The proposed resoration will replace and expand intertidal estuary functions including shallow backwater zones, shallow marsh areas and integral habitat benches at appropriate elevations. It is important to provide off-channel opportunities to juvenile fish where they can feed and rear. Longer residency times in the estuarj allow for larger, healthier smolts prior to ocean migration. This proposal was presented to the CAP at their meeting of May 9, 2006. The CAP recommended forwarding it to the COW for discussion and approval of a resolution. The item is on the COW agenda for June 12,2006. BACKGROUND Staffhas developed a program for off-site mitigation of wetland impacts. The objective of the program is to provide a flexible mechanism for off-site wetland mitigation in situations where small wetland fills cannot be avoided on a property, and where on-site mitigation is not practical. The program would provide a small network of city-owned and possibly some privately-owned sites that could be used by developers (particularly for small infill developments) for wetland enhancement and creation. It would also achieve no net loss of wetland and/or an increase in wetland functions by consolidating wetland compensation or restoration actions into larger, less isolated and/or higher functioning sites. This program is not intended to alter the mitigation sequencing requirement in the Sensitive Areas Ordinance (TMC 18.45.090 C), which states that applicants must demonstrate that reasonable efforts have been made to avoid and minimize impacts. Only after it is demonstrated that avoidance and on-site mitigation is not practicable, or would result in a net wetland loss or a net loss in wetland function, 'would off-site mitigation under this program be considered. s. Fax: 206.431-3665 TMC 18.45.090E already allows for off-site mitigation under certain circumstances when: (a) On-site mitigation is not scientifically feasible due to problems with hydrology, soils, waves or other factors; or (b) Mitigation is not practical due to potentially adverse impact from surrounding land uses; or (c) Existing functional values created at the site of the proposed restoration are significantly greater than lost wetland values; or (d) Established regional goals for flood storage, flood conveyance, habitat or other wetland functions have been established and strongly justify location of mitigation at another site. Therefore, no change in the Sensitive Areas Ordinance would be required in order to implement the proposed program. DISCUSSION/ANAL YSIS/ALTERi'lATIVES Staff carried out an analysis of City-O\vned properties to identify those with potential wetland mitigation sites, in cooperation with Public Works, Parks and Recreation, and the Fire Department. Three City-owned sites were selected as the best initial candidates for the program and a consultant was hired to develop conceptual mitigation plans and cost estimates for each of the three sites. The initial sites are: Fire Station 53 (undeveloped portion), Macadam wetland site (excluding the Winter Garden site), and an existing parklbicycle trail along the Green River. Privately-owned properties that could be candidates as wetland mitigation sites were also identified and property owners are being contacted by Staff to detennine their interest in making their property available to developers as mitigation sites. The City's role in this would be to match developers with interested property owners. Staff evaluated three alternative wetland mitigation management instruments that could be used to implement the program: 1) Alternative 1 Wetland Banking. This would require the City to implement mitigation up front at a designated site and later "sell" credits to developers that need to do off- site wetland mitigation. This approach would involve a complicated and lengthy authorization process with the Corps of Engineers and Department of Ecology 2) Alternative 2: Consolidated Mitigation at designated sites. This would be an informal program that directs off-site mitigation to designated sites, but the mitigation would be carried out by the developer under City supervision., and S. This approach would establish fees to be charged to developers in-lieu of them carrying out wetland mitigation. The City would then use the fees to implement a mitigation plan. The benefits of using any of the three alternative management instruments include: . Consolidating mitigation for many small losses in larger sites can be more environmentally beneficial than traditional piecemeal on-site compensatory mitigation; . Selected mitigation sites can be more efficiently monitored than numerous smaller sites, providing some economies of scale with respect to staff oversight; . The wetland resources on city-o\vned property can be protected in perpetuity; . Some wetland mitigation projects could work hand in hand with Parks and Recreation Department projects; and . Some mitigation could be directed to the GreenJDuwamish River in support of\VRlA 9 goals. The attached report entitled "Offsite Wetland Mitigation Program for Tuk.'"\vila" provides a detailed evaluation of off-site wetland mitigation program options. RECOMMENDATION As indicated in the "Off site Wetland J'vlitigation Program for Tulmila", staff recommends City Council approval of Alternative 2, consolidated mitigation at selected sites and approval of the attached proposed resolution. Till Artwork Update. Bill Gorjance and Brian Kennedy from the Arts Commission presented the Art Commission's proposal for three permanent art locations on TIE. The artist, Mara Smith, is a renowned artist who did the TukwiIa Gateway carvings. The TIB artwork consists of three separate carvings done in raw brick reflecting Tukwila' s natural beauty, one a panoramic sketch of Mt. Rainier, another of a heron, and another of an Eagle in flight. The artist's process involves carving the raw brick, which takes approximately one month, then firing the brick and drying the brick, which takes another month, followed by inserting the sketch into one of the panels. The Art Commission carried over funding from the 2005 budget to complete this artwork and it is within the budgeted amount. According to Bruce, the installation of the art work will cost another $10,000 and will be taken from another budget. We are currently waiting for the formal contract to be signed before work can begin. Presentation was on the agenda for information only. No action requested at this time. 2. Interlocal Al!reement with City of Seattle for Hearinl! Examiner services. The Interlocal Agreement with the City of Seattle for Hearing Examiner services has been in effect for one year and will need to be renewed ifTukwila wants to continue using Seattle for Hearing Examiner Services. Peter Beckwith presented a draft of the proposed Interlocal Agreement with the recommendation that the agreement be renewed for two years rather than one year. An increase of $5.00 per hour is being proposed making the compensation $75 per hour, plus mileage and a 515 flat fee for round trip travel to Tukwila. Also, due to the high incidents offailure-to-appear for drug forfeiture hearings, the draft agreement contains a clause that drug asset forfeiture hearings shall have a one- hour minimum hearing examiner service charge unless Tukwila notifies Seattle of the hearing cancellation at least 24 hours prior to the scheduled hearing time. DCD is the primary consumer of these services and Steve Lancaster said his department is pleased with the services and the fact that the hearing examiner is wj\ling to travel to Tukwila to conduct the hearings. Forward to CO'V with committee recommendation for approval at the next Regular Meeting. ~. Off-site wetland mitigation nrol!1'am. Sandra Whiting, Urban Environmentalist, explained the objectives of the off-site wetland mitigation program and what it will accomplish. In cases where small wetland fills cannot be avoided, and where on-site mitigation for wetland impacts is not feasible, the program would provide alternatives for developers by identifying potential sites where they could carry out off-site wetland mitigation. After investigating three alternatives, staff is recommending the consolidated mitigation approach at designated sites. Consolidated mitigation would direct off-site mitigation to designated sites where the mitigation would be carried out by the developer under the City's supervision. After careful analysis, staff is proposing three initial sites for implementation of a conceptual off-site mitigation plan. The three sites are: (a) The Macadam wetland (b) Fire Station 53 wetland and (c) North of the Riverview Plaza office complex along the Green River. Private property and additional city owned sites, such as Tukwila Pond, could also be candidates for off-site mitigation in the future. Committee Recommendation: Fonvard to COW for discussion and approval of a Resolution authorizing the use of City owned properties for wetland mitigation and establishing criteria for determining fees on a case-by-case basis. 4. Joint meetin!!: with SeaTac City Council's Land Use Committee. Following up on a previous discussion about arranging a joint meeting between our CAP committee and the City of SeaTac's Land Use Committee, Steve Lancaster offered two dates for the committee's consideration, J\!ne 8111 or June 15111, and suggested a topic of mutual interest to the two committees might be a discussion of the issues surrounding the Sound Transit Light Rail Station. Committee members agreed this topic was a good choice for a discussion between the two committees. Steve asked committee members to email him their preferred date, and he will contact Steve Butler of the City of SeaTac for their input. 5. 2006 First Quarter Reports. Committ-ee members reviewed 1" Quarter Reports and asked questions of staff. Steve Lancaster reported that the new plumbing permit process is working very well. Bruce Fletcher reported that the hanging flower basket program will be returning this summer He said he has received many compliments about our parks. Bruce was asked about the proposed pea patch parks at Riverton and at Cascade View Bruce said that due to vandalism at Cascade View Park, a decision has been made not to have a pea patch there and to create 20 pea patch spots at Riverton Park and make them available to gardeners for $25.00 each. Joe voiced his concern about unwanted activities occurring at some of our parks and Bruce said the weekend staff will be starting soon and he will ask them to keep an eye on things. At~ALYSIS The low bid is of S326,066.15 is 24% over the engineer's estimate of $262,534 40. An analysis of the bid results found that most of the differences were in five of the bid items. On four of these items, the Engineer's Estimate did not accurately account for the costs associated with difficult site access issues. On the remaining item, an incorrect cost was used that did not include materials. Bid results from the three bidders were consistent with each other and no irregular bid results were found. It was concluded that the Engineer's Estimate was in error and that the low bid from Dennis R. Craig Construction be accepted for the construction of the project. Dennis R. Three (3) bids were received, with Dennis R. Craig Construction providing the low bid of $326,066.15, approximately $63,000 over the Engineer's Estimate of $262,53400 The majority of this difference occurs in the following 5 line items: Item 5 - Clearing and Grubbing Item 8 - Gravel Borrow Item 17 - Ditch Excavation Item 19 - Storm Drain Pipe, 18" Item 21 - Outfall Check Valve $8,400 difference $8,100 difference $17,000 difference $18,000 difference $15,000 difference Items 5,8,17 and 19 All of these bid items require hauling of material to and from each of the 5 individual outfall sites along the Green 1 Duwamish River Trail. These cost differences are consistent amongst the 3 bids received; therefore, we would conclude that we did not adequately account for the costs associated with accessing these remote sites for construction. Item 21 Our hand calculations identify a material cost of $4,700, with an estimate of $1,500 for the installation for a total of $6,200 each. The installation cost of $1,500 was erroneously entered into the Engineer's Estimate rather than the total estimated cost of $6,200 This results in a difference of nearly $15,000. Dennis R Craig's bid on the other 22 items in the proposal were generally consistent with the Engineer's Estimate, and the 5 items noted above were generally consistent between the 3 bids received. Duwamish Gardens Acquisition ALEA Funding Assistance Resolution Ryan discussed the previous grant proposals with the Committee in April 2006 and this resolution is a requirement of the lAC funding. This project is currently unfunded and will be added to the 2007 CIP The local match may be zero, depending on success with other grant sources, yet we have tentatively committed $50,000 on the grant application. BACKGROUND In July 2005, Lee Voorhees, an attorney with Foster Pepper Shefelman spoke with staff on the basics of forming Local Improvement Districts (LID). One key recommendation that !vir. Voorhees made to staffwas to consider doing a feasibility study on whether an LID would be financially beneficial for a specific project. LID's are complex funding mechanisms that are legally restricted from assessing more than the project would increase property values. Therefore making sure that a project does, indeed, increase property values is essential. Mr. Voorhees suggested that such a study could be done by any MAl certified appraiser. Macaulay & Associates was selected in the fall to conduct the feasibility study out of several appraisers. The study showed a definite benefit of the project, indicating that formation of an LID would be quite feasible. ANALYSIS Staff was directed to retain Macaulay & Associates to develop a scope of work for the next step in the LID formation. This next step will provide the details of how much each parcel \vill benefit and an approximate amount each parcel would be assessed in the LID. The final assessment amount \vill be determined when the project has been completed and all other sources of funding (grants, city funds, impact fees, etc.) are fully accounted for. At the same time, right-of-way needs to be acquired for the project. HNTB, the city's lead consultant on the design, has retained a firm to assist in the acquisition but they are unable to both negotiate the purchase price and conduct a fair market value assessment due to a conflict of interest. Since Macaulay & Associates is familiar with the project area, it was logical to approach them to conduct the necessary appraisals. The attached scope of work includes both tasks. Financial Impact The LID Special Benefit Study will not exceed $84,000 and the appraisal work will not exceed $9,000, for a total contract amount not to exceed $93,000. The $84,000 can be folded into the costs assessed in the final LID. RECOMMENDATION Authorize the Mayor to execute an agreement with Macaulay & Associates in the amount not to exceed $93,000 to provide a Special Benefits Study and Right-of-Way assistance for the Tubvila Urban Center Access Project (Klickitat). \\!uk2\voll\pubworks'qndjA.k1ickitat:\information memo -lid formation ~C3uly contr2ct 6-6-06.doc CONSULTAl\'T AGREEMEJ\'T FOR APPRAISAL SERVICES THIS AGREEMENT is entered into between the City of Tukwila, Washington, herein-after referred to as "the City", and Macaulay & Associates hereinafter referred to as "the Consultant", in consideration of the mutual benefits, terms, and conditions hereinafter specified. 1 Project Designation. The Consultant is retained by the City to to conduct a preliminary sPecial benefit study for a proposed Local Improvement District and appraisal reports for right of way aCQuistion services in connection with the project titled Tukwila Urban Center Access Improvement ProiectlKlickitat ' 2. Scope of Services. The Consultant agrees to perform the services, identified on Exhibit "A" attached hereto, including the provision of all labor, materials, equipment and supplies. 3 Time for Performance. Work under this contract shall commence upon the giving of written notice by the City to the Consultant to proceed. The Consultant shall perform all services and provide all work product required pursuant to this Agreement within 45 calendar days ITom the date written notice is given to proceed, unless an extension of such time is granted in writing by the City 4 Payment. The Consultant shall be paid by the City for completed work and for services rendered under this Agreement as follows: A. Payment for the work provided by the Consultant shall be made as provided on Exhibit "A" attached hereto, provided that the total amount of payment to the Consultant shall not exceed $93,000 without express written modification of the Agreement signed by the City B. The Consultant may submit vouchers to the City once per month during the progress of the work for partial payment for that portion of the project completed to date. Such vouchers will be checked by the City and, upon approval thereof, payment shall be made to the Consultant in the amount approved. C. Final payment of any balance due the Consultant of the total contract price earned will be made promptly upon its ascertainment and verification by the City after the completion of the work under this Agreement and its acceptance by the City D Payment is provided in this section shall be full compensation for work performed, services rendered, and for all materials, supplies, equipment and incidentals necessary to complete the work. E. The Consultant's records and accounts pertaining to this Agreement are to be kept available for inspection by representatives of the City and state for a period of three (3) years after final payments. Copies shall be made available upon request. 5 Ownership and Use of Documents. All documents, drawings, specifications and other materials produced by the Consultant in connection with the services rendered under this Agreement shall be the property of the City whether the project for which they are made is executed or not. The Consultant shall be permitted to retain copies, including reproducible copies, of drawings and specifications for information, reference and use in connection with the Consultant's endeavors. The Consultant shall not be responsible for any use of the said documents, drawings, specifications or other materials by the City on any project other than the project specified in this Agreement. 6. Compliance with Laws. The Consultant shall, in performing the services contemplated by this Agreement, faithfully observe and comply with all federal, state, and local laws, ordinances and regulations, applicable to the services to be rendered under this Agreement. 7 Indemnification. The Consultant shall indemnify, defend and hold harmless the City, its officers, agents and employees, from and against any and all claims, losses or liability, including attorney's fees, arising from injury or death to persons or damage to property occasioned by any act, omission or failure of the Consultant, its officers, agents and employees, in performing the work required by this Agreement. With respect to the perform- ance of this Agreement and as to claims against the City, its officers, agents and employees, the Consultant expressly waives its immunity under Title 51 of the Revised Code of Washington, the Industrial Insurance Act, for injuries to its employees, and agrees that the obligation to indemnify, defend and hold hannless provided for in this paragraph extends to any claim brought by or on behalf of any employee of the Consultant. This waiver is mutually negotiated by the parties. This paragraph shall not apply to any damage resulting from the sole negligence of the City, its agents and employees. To the extent any of the damages referenced by this paragraph were caused by or resulted from the concurrent negligence of the City, its agents or employees, this obligation to indemnify, defend and hold harmless is valid and enforceable only to the extent of the negligence of the Consultant, its officers, agents and employees. 8. Insurance. The Consultant shall secure and maintain in force throughout the duration of this contract comprehensive general liability insurance, with a minimum coverage of $500,000 per occurrence and $1,000,000 aggregate for personal injury; and $500,000 per occurrence! aggregate for property damage, and professional liability insurance in the amount of $1,000,000. Said general liability policy shall name the City of Tuk\vila as an additional named insured and shall include a provision prohibiting cancellation of said policy except upon thirty (30) days prior written notice to the City Certificates of coverage as required by this section shall be delivered to the City within fifteen (15) days of execution of this Agreement. 2 9 Independent Contractor The Consultant and the City agree that the Consultant is an inde- pendent contractor with respect to the services provided pursuant to this Agreement. Nothing in this Agreement shall be considered to create the relationship of employer and employee between the parties hereto. Neither the Consultant nor any employee of the Consultant shall be entitled to any benefits accorded City employees by virtue of the services provided under this Agreement. The City shall not be responsible for withholding or otherwise deducting federal income tax or social security or for contributing to the state industrial insurance program, othenvise assuming the duties of an employer \vith respect to the Consultant, or any employee of the Consultant. 10. Covenant Against Contingent Fees. The Consultant warrants that he has not employed or retained any company or person, other than a bonafide employee working solely for the Consultant, to solicit or secure this contract, and that he has not paid or agreed to pay any company or person, other than a bonafide employee working solely for the Consultant, any fee, commission, percentage, brokerage fee, gifts, or any other consideration contingent upon or resulting ITom the award or making of this contract. For breach or violation of this warrant, the City shall have the right to annul this contract without liability, or in its discretion to deduct ITom the contract price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage fee, gift, or contingent fee. 11. Discrimination Prohibited. The Consultant, with regard to the work performed by it under this Agreement, will not discriminate on the grounds ofrace, color, national origin, religion, creed, age, sex or the presence of any physical or sensory handicap in the selection and retention of employees or procurement of materials or supplies. 12. Assignment. The Consultant shall not sublet or assign any of the services covered by this Agreement without the express written consent of the City 13. Non-Waiver. Waiver by the City of any provision of this Agreement or any time limitation provided for in this Agreement shall not constitute a waiver of any other provision. 14. Termination. A. The City reserves the right to tenninate this Agreement at any time by giving ten (10) days written notice to the Consultant. B. In the event-of the de-ath of a member, partner or officer of the Consultant, or any of its supervisory personnel assigned to the project, the surviving members of the Consultant hereby agree to complete the work under the terms of this Agreement, if requested to do so by the City This section shall not be a bar to renegotiations of this Agreement between surviving members of the Consultant and the City, if the City so chooses. 15 Attorneys Fees and Costs. In the event either party shall bring suit against the other to enforce any provision of this Agreement, the prevailing party in such suit shall be entitled to 3 recover its costs, including reasonable attorney's fees, incurred in such suit from the losing party 16. Dear Ms. Knighton: In accordance with your request, our proposed scope of work is summarized for preparation of a preliminary special benefit/proportionate assessment study for potential LID formation in conjunction wiL" the proposed Klickitat/Southcenter Access Improvement Project. Research completed for the recent feasibility study will be utilized and incorporated into this new scope of work, where applicable. Also, we have prepared a scope of work for preparation of three summary appraisal reports for right-of-way acquisition purposes. The first scope of work discussed will involve completion of a prelimL'1ary special benefit/proportionate assessment study and preparation of a report summarizing our findings. This report will consider physical and economic characteristics of each affected parcel. A base study will be undertaken, to consist of L;e assemblage of pertinent market data and investigation of the environmental, economic, governmental and social forces influencing the subject area. Consideration will be given to current zoning, land use trends, building improvements, highest and best use and other factors influencing market value for each property type or ownership, without and with the amenity of the LID road improvement project The appraisal report will be prepared in conformity with Standard 6 of the uniform Standards of Professional Appraisal Practice (USP AP) for summary mass appraisal reports. As such, it results ;n a limited valuation process whereby there are certain allowable departures from USPAP The depth of discussion to be contained in the report will be specific to the needs of the client. The increase in probable market value adhering to each parcel due to the UD project is the measure of special benefit. The total assessment to be levied will be obtained from the municipal LID coordinator. Tne sum of the special benefit estimated for each parcel is the total special benefit attributable to assessable property within the proposed LID; this total divided into the total UD assessment wil! provide the assessment ratio or the UD assessment per dollar of special benefit. The special benefit to each parcel times the cost!benefit ratio will result in the individual assessment recommended to that parcel. ~!S. Cyndy Knighton June 6, 2006 page nvo a) The recommended assessment will be equal to or less than the special benefit accruing to that particular parcel. b) Each recommended assessment will be fair and in proportion to the special benefit derived by that parcel and all other parcels due to the LID project. Completion of our work. as the assigruhent is described herein, will result in a preliminary formation special benefit study report which outlines the recommended LID boundary ih'1d provides a narrative summary of the study and tabulation of recommended assessments for all assessable parcels spedal1y benefitted by the project. Due to the size of the project and number of parcels, individual appraisal reports on each are not prepared. Limited assignment appraisal techniques arc utilized and a spreadsheet summarizing our value conclusions without and with the LID assumed completed is underta.1.,en. Based on previous projects completed by our firm and our hourly rates, our estimated fee for completion of above scope of work is not to exceed 584,000. An itemized cost breakdown is available if needed. Our second scope of work involves preparation of three separate summary appraisal reports for right-of- way acquisition purposes. Based on information provided, two of the properties (:VlcDonalds Restaurant and Double Tree Plaza) will involve temporary construction easement rights. The third appraisal (Sumay Investments) will involve fee simple rights. Each of above properties wi!! be valued before and after acquisition of specified property rights. The difference in the before and after values is the recommended just compensation amount. The appraisals would be developed and the appraisal reports prepared in conformity with and subject to the requirements of the Code of Professional Ethics of the Appraisal Institute and the Uniform Standards of Professional Appraisal Practice of the Appraisal Foundation and will also be in conformance with WSDOT appraisal standards. Our estimated fee for completion of the two temporary construction easement reports is $2,000 each and $5,000 for the fee simple report for a total fee estimate of $9,000.
