J gv_a_J�� AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, AMENDING SECTIONS 14.04.240, 14.04.260, 14.04.330, AND 14.16.030 OF THE TUKWILA MUNICIPAL CODE, J AND AMENDING ORDINANCE NO. 1190, SECTION 24(c), ORDINANCE NO. 1290, SECTIONS 24(a) AND 25, AND AMENDING ORDINANCE NO. 1297, SECTION 4(A) AND (B) RELATING TO METERED WATER RATES; AND AMENDING ORDINANCE NO. 934 SECTION 1(1), (2) AND (4) RELATING TO CITY SEWER CHARGES. WHEREAS, the City has approved certain Capital Improvement Projects for the Water and Sewer Funds, and WHEREAS, the City Council desires to have in place an equitable and adequate rate structure to finance the Capital Improvement Projects and the operation and maintenance of the Utilities assets, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: I. Ordinance No. 1190, Section 24(c), adopted the 15th day of December, 1980, is hereby amended to read as follows: Section 24 (TMC 14.04.240[c]) Rates for Metered Water. (c) Every person sixty -two years of age or older (if married, then either spouse) and every person totally and permanently disabled residing in a separately metered dwelling and who is paying directly for such separ- ately billed service either as owner, purchaser or renter and whose individual income if a single person, or whose combined income, if a married couple, from all sources is less than twelve thousand dollars per year, shall pay a rate equal to fifty percent of all water service charges. Every such person shall file with the Finance Department their affidavit that he or she is qualified to be charged the special rate. Such affidavits are to contain information as required by the Finance Director in order to establish eligibility. Each affidavit will also include an unqualified promise to inform the City of any changes in financial condition that would disqualify the person for the spe- cial rates. The Finance Director may require affidavits on an annual basis if deemed necessary. II. Ordinance No. 1290, Sections 24(a) and 25, adopted the 18th day of April, 1983, is hereby amended to read as follows: Section 24 (TMC 14.04.240Ca]) Rates for Metered Water. (a) The rates for metered water supplied within the City, in one month or fractional part thereof, shall be in accordance with the following schedule: CITY OF TUKWILA Water Rates /Sewer Charges Ordinance Page 2 (1) Commercial /Industrial Customers Size of Service Base Charge 3/4 inch 8.50 1 inch 13.50 1 -1/2 inch 19.00 2 inch 24.50 3 inch 47.00 4 inch 63.00 6 inch 115.00 8 inch 176.00 In addition, for each 100 cubic feet of water used, the rate shall be ninety -nine cents per 100 cubic feet. (2) Single Family Customers (one dwelling unit). The base water charge will be $4.00 for each account. In addition, for each 100 cubic feet of water used, the rate shall be eighty cents per 100 cubic feet. (3) Multi- Family Customers (more than one dwelling unit). The minimum charge will be $4.00 for each dwelling unit. In addition, for each 100 cubic feet of water used, the rate shall be eighty cents per 100 cubic feet. Section 25 (TMC 14.04.260) Rates Outside City Limits. The rates for water supplied to consumers not within the City Limits shall be as follows: The same rate schedule as provided in Sections 14.04.240 and 14.04.250 shall apply. The above rates to consumers outside the City limits are subject to the same discount as the rates to consumers inside the City limits; provided, that nothing in this section shall prevent the City Council from fixing other and different rates for the sale of water to water dis- tricts; provided, that all meters for measuring water to outside consumers are installed within the City Limits or within the limits of easements, fran- chises, or rights -of -way belonging to the City. III. Ordinance No. 1297, Section 4(A) and (B), adopted the 15th day of August, 1983, is hereby amended to read as follows: Section 4 (TMC 14.04.330[d] Temporary Water Meters (d) Rates for water used through temporary meters are as follows: (A) Three fourths inch and one -inch, twenty -five dollars plus water usage at the rate of eighty cents per one hundred cubic feet for single family and multi family accounts, and ninety -nine cents for commercial /indus- trial accounts. (B) Two and one half -inch, fifty dollars plus water usage at the rate of eighty cents per one hundred cubic feet for multi- family, and ninety -nine cents for commercial /industrial accounts. IV. Ordinance No. 934, Section 1 (1), (2), and (4), adopted the 21st day of July, 1975, is hereby amended to read as follows: Section 1 (TMC 14.16.030 (1), (2), and (4)) Schedule of Charges. Rates and charges for sewage service furnished and available for use shall be paid by the owner of the property and shall be as follows: CITY OF TUKWILA Water Rates /Sewer Charges Ordinance Page 3 (1) Residential Sewage Service (single dwelling unit). A flat rate of four dollars and no cents per month for each single- family residence shall be charged. Each affidavit will also include an un- qualified promise to inform the City of any changes in financial condition that would disqualify the person for the special rates. The Finance Director may require affidavits on an annual basis if deemed necessary. (2) Residential Sewage Service (multiple dwelling unit perman- ent type). A flat rate of four dollars and no cents per month for each dwell- ing unit shall be charged. (4) Commercial and Industrial Sewage Service. Each account will be charged a flat rate of nine dollars and fifty cents. In addition, the charge for sewage service on premises using more than nine hundred cubic feet of water per month shall be at the rate of nine dollars and fifty cents per nine hundred cubic feet. V. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not ef- fect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. VI. Effective Date. This ordinance shall take effect and be in full force on December 15, 1986.
