345 -424
TO ENTER UPON SPU PROPERTY AT THE FOLLOWING LOCATIONS:
City of Seattle Cedar River Pipeline 4 Right of Way, on the east and
west sides of the Duwamish (Green) River. See Exhibit "A attached.
(Permit Areas)
FOR THE PURPOSE OF:
Flood Control. The Permittee and its agents may enter upon the
Permit Area for ingress, egress, and placement of Super Sacks (large
sand bags) on the west side of the river, and Hesco units (gabion
like baskets that are filled with sand) along the east side of the
river. All as provided in the attached plans, procedures and
specifications. (Exhibits "B "C and "D

GENERAL TERMS:
1. TERM OF PERMIT: Commencing on the date of Approval by SPU and
terminating on the same day one year later
2. The Permittee is responsible for limiting the use of the Permit Areas to those approved by
SPU.
3. Permittee agrees to comply with all applicable laws and regulations, and to procure any
other permits that may be required. All applicable safety measures and equipment must be
used.
4. During the term of this Permit, the Permittee agrees to operate in compliance with any and
all Environmental Laws and not cause or permit SPU's property to become contaminated
with any Hazardous Substances or Pollutants. Upon notice or discovery of any release of
any hazardous substance or pollutants caused by the Permittee to occur upon SPU
property, the Permittee shall, at its own cost, immediately take all necessary steps to
respond to, and clean up the same and restore the property to its pre- existing condition in
accordance with applicable environmental laws and requirements. The Permittee and shall
report any such release, to SPU within 24 hours of discovery.

5. This Permit is intended to convey limited use and rights only. None of the rights granted to
the Permittee shall affect Seattle's jurisdiction of over the Permit Areas and or SPU's power
to perform work on said Permit Areas. Permittee's use of the Permit Areas shall in no way
interfere with the City's present or future use of said Permit Areas for any purpose.
6. The Permit Areas may be subject to other authorized uses, and the Permittee shall not
interfere with access or use by other such authorized parties.
7. The integrity of the site shall be maintained in such a manner so as to preclude the entry of
unauthorized persons.
8. If, in the opinion of the Director or Staff of the Seattle Public Utilities, the use of SPU
property may result in damage of any fashion to the City, or it is determined to be in the best
interest of the public, this permit may be immediately revoked.
9. The Permittee agrees that the actions of any agents or invitees of the Permittee are
considered to be the same as if performed or caused by the Permittee.
10. Any damage to the site or facilities, as determined by SPU, shall be promptly repaired as to
restore the facility to as good as condition as it was before entry.
11. If the Permittee has not corrected, or made an acceptable agreement with SPU to correct
any condition caused by the Permittee that SPU determines as unacceptable within 30 days
of notification by SPU, SPU may correct such condition, and all reasonable costs incurred
shall be billed to the Permittee. Except SPU may act immediately for conditions which pose
a threat to public health, safety or the environment. The Permittee agrees to pay such bills
in a timely manner.
12. The Permittee shall indemnify and hold harmless the City of Seattle from all claims, actions
or damages of every kind and description, which may accrue, to any persons or property by
reason of its use of this site.
13. This permit is not transferable.
14. This Permit is not valid until signed by an authorized representative for the Permittee and
counter signed as APPROVED by the Manager of SPU Real Property Services.

Flood

In the event of a flood warning, HESCO

ideal for emergency response.
Whether the increase in water level is
gradual or due to sudden surge,
Concertainer units and Floodline units
provide a comprehensive solution to a
wide range of flood defense requirements.
The unique design, strength and versatility
of the standard Concertainer unit and the
specialized Floodline unit means that
corners; curves and angles can be easily
constructed and there is no limit to the
