HomeMy WebLinkAboutOrd 1396 - Furnishing Alcohol to Minors 2 0 rsos C TUKWI 0042.16008 WASHINGTON RPB /jt 05/19/86 ORDINANCE NO. 06/09/86 AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, l AMENDING SECTION 8.03.010 OF THE TUKWILA MUNICIPAL CODE TO DELETE THE ADOPTION BY REFERENCE OF RCW 66.44.270; AND ADDING A NEW SECTION 8 03 020 ENTITLED "FURNISHING LIQUOR TO MINORS-- POSSESSION USE WHEREAS, the Tukwila City Council finds that the State law governing the possession and use of alcohol by minors was limited by a recent Washington Supreme Court case, and WHEREAS, the Tukwila City Council finds that minors should not be in public after having consumed liquor and that an ordinance is needed to prevent this activity, and WHEREAS, the Tukwila City Council finds that this ordinance is in the interest of the public health, safety and welfare, now, therefore, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 8.03.010 of the Tukwila Municipal Code is hereby amended to read as follows: 8.03.010 ALCOHOLIC BEVERAGE CONTROL ENFORCEMENT. There is hereby added to the Tukwila Municipal Code a new Section 8.03.020 to read as follows: 8.03.020 FURNISHING LIQUOR TO MINORS POSSESSION AND USE A. It is unlawful for any person under the age of twenty -one years to be or remain in any public place after having consumed liquor. B. It is unlawful for anyone under the age of twenty -one years to acquire or have in his possession or consume any liquor. C. It is unlawful for anyone to give or otherwise supply liquor to any person under the age of twenty -one years, or permit any person under that age to consume liquor on his premises or on any premises under his control. D. Subsections (B) and (C) of this section shall not apply when liquor is given or permitted to be given to a person under the age of twenty -one years by his parent or guardian for beverage or medicinal purposes, or administered to him by his physician or dentist for medicinal purposes or when liquor is being used in connection with religious services. Section 3. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitu- tional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect tionality of any other section, sentence, clause or phrase of this ordinance. Section 4. This ordinance shall take effect and be in full force summary which is hereby approved. Amends Section 8.03.010 to delete the adoption by reference of RCW 66.44.270. Section 2. Adds a new Section 8.03.020 which makes it unlawful for minors to possess, consume or be or remain in a public place after having consumed liquor. Also makes it unlawful to furnish liquor to minors. Section 3. .Contains a severability provision. Section 4. Establishes an effective date. The full text of this ordinance will be mailed without charge to anyone who submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
