HomeMy WebLinkAboutOrd 1388 - McLees Annexation +r /DO CITY OF T WASHINGTON ORDINANCE NO. 0042.010.010 JEH /ko 05/05/86 AN ORDINANCE OF THE CITY OF TUKI +?ILA, WASHINGTON, ANNEXING CERTAIN REAL PROPERTY TO THE CITY COMMONLY KNOWN AS THE MCLEES ANNEXATION PURSUANT TO THE PETITION METHOD SET FORTH IN RCW CHAPTER 35A.14, REQUIRING SAID PROPERTY TO BE ASSESSED AND TAXED AT THE SAME RATE AND ON THE SAME BASIS AS THE OTHER PROPERTY WITHIN THE CITY, ESTABLISHING THE ZONING CLASSIFICATION OF THE PROPERTY AND DIRECTING AMENDMENT OF THE CITY'S ZONING MAP. WHEREAS, a Notice of Intent to Annex, signed by the owners of more than ten percent (10 in value, according to assessed valuation for general taxation of the property described on Exhibit A attached hereto and incorporated herein by this reference as if set forth in full, which property is more commonly known as the McLees Annexation, was received by the City on December 19, 1985, and WHEREAS, the City Council met with the said owners within sixty (60) days of receiving said Notice of Intent and determined that the City would consider pre- annexation zoning for the property prior to determining whether or not to accept the annexation and authorize circulation of a seventy -five percent (750) petition, and WHEREAS, the City Council held two public hearings to consider the proposed pre- annexation zoning for the property of M -1, which hearings were held pursuant to notice and were not less than thirty (30) days apart, and WHEREAS, based upon the input received at the public hearings, the City Council passed Ordinance No. 1385, which established pre- annexation zoning for the property of M -1 (Light Industrial), subject to a Concomitant Zoning Agreement, and WHEREAS, subsequent to the adoption of Ordinance 1385, the City Council met with the said owners again and determined that the City would accept the proposed annexation, require assumption of existing indebtedness, require the adoption of the proposed zoning regulation contained in Ordinance No. 1385 and authorize the circulation of a Petition for Annexation, and WHEREAS, the City Council received a Petition for Annexation of the real property, signed by the owners of not less than seventy -five percent (75 in value, according to assessed valuation for general taxation, of the property described on Exhibit A and processed the same in accordance with the state statutes governing annexation in Chapter 35A.14 RCW, and WHEREAS, said proposed annexation was submitted to the King County Boundary Review Board pursuant to RCW Chapter 36.93 and the Chairman of said Board, pursuant to RCW 36.93.110, determined on March 31, 1986 that review by the Board was not necessary for such annexation and the annexation is therefore deemed approved by said statute, and WHEREAS, upon due and proper notice posted and published, the City Council held a public hearing on the proposed annexation on May 19, 1986 and determined that said annexation should be approved, and WHEREAS, the City's SEPA Responsible Official has issued a Mitigated Determination of Nonsignificance for the proposed annexation, now, therefore, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Annexation. The real property commonly known as the McLees Annexation, more particularly described on Exhibit A attached hereto and incorporated herein by this reference as if set forth in full, should be, and hereby is annexed to and made a part of the City of Tukwila. Section 2. Assessments and Taxes Assumption of Indebtedness. Pursuant to the terms of the Annexation Petition, all property within the territory annexed hereby shall be assessed and taxed at the same rate and on the same basis as property within the City, including assessments for taxes in payment of any bonds issued or debts contracted prior to or existing as of the date of annexation. Section 3. Zoning. Pursuant to Ordinance 1385 of the City of Tukwila, which established proposed zoning regulations for the area hereby annexed to the City, all property described on Exhibit A and annexed hereby is hereby zoned M -1 (Light Industrial) subject to the execution of, and compliance with the terms and conditions of the Concomitant Zoning Agreement referred to in Ordinance 1385. Section 4. Duties of Planning Director. The Planning Director is hereby instructed to effectuate the necessary changes to the Official Zoning Map of the City in accordance with the zoning established by this Ordinance, upon the effective date of the annexation. Section 5. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after the date of publication. On /9 czci /9 1986. Publish: Record Chronicla Friday, May 23, 1986 1986, the City Council of the City of Tukwila passed Ordinance No. 41A7F which provides as follows: Section 1. Annexes the property commonly known as the McLees Annexation, the common location of which is 4526 S. 135th Street, Tukwila, Washington, and the legal description of which is attached as Exhibit A to this summary. Section 2. Provides for assumption of indebtedness by the annexed property. Section 3. Establishes zoning for the property of M -1 (Light Industrial) conditioned upon a concomitant zoning agreement approved by Ordinance No. 1385. Section 4. Directs the Planning Director to make the necessary changes to the Official Zoning Map. Section 5. Establishes an effective date. The full text of this ordinance will be mailed without charge to anyone who submits a written request to the City Clerk of the City of Tukwila for a copy of the text. APPROVED by the City Council at their meeting of AXZNE"ANDERSON, CITY CLERK EXHIBIT A That portion of Tract 14 of Fostoria Garden Tracts, according to the plat recorded in Volume 9 of Plats, on page 95, in King County, Washington, described as follows: BEGINNING at the most Northerly corner of said Tract 14; thence Southwesterly along Northwesterly boundary of said Tract 14, a distance of 494.52 feet to Southwest corner of said tract which point is also the North line of 135th Street (ALSO KNOWN AS Foster Street); thence Southeasterly along said margin of county road, 94.88 feet more or less; thence Northeasterly along the line parallel with said Northwesterly boundary of said tract, 472.12 feet more or less to the Northeasterly boundary of said tract; thence Northwesterly along said Northeasterly boundary, 90.24 feet to the Point of Beginning; EXCEPT therefrom the Northeast 272.12 feet thereof; and EXCEPT that portion thereof lying with South 135th Street.
