AMENDING SECTION "8.80.020 OF THE TUKWILA MUNICIPAL
CODE TO ADD THE ADOPTION BY REFERENCE OF THE
WASHINGTON CLEAN INDOOR AIR ACT, RCW 70.160.020-
.070, PROSCRIBING SMOKING IN CERTAIN PUBLIC
PLACES, REQUIRING OWNERS TO POST SIGNS PROHIBITING
OR PERMITTING SMOKING, AND ESTABLISHING PENALTIES
FOR VIOLATIONS OF THE SECTION; DIRECTING THE CLERK
TO MAINTAIN ON FILE A COPY OF STATE STATUTES
ADOPTED BY REFERENCE AND ESTABLISHING AN EFFECTIVE
DATE.
WHEREAS, the Tukwila City Council finds that the provi-
sions of the Washington Clean Indoor Air Act, RCW 70.160, should
be adopted by reference and contained in Title 8 of the Tukwila
Municipal Code, and
WHEREAS, the City Council finds that this addition will
be in the best interest of the public health, safety and welfare,
now, therefore,
THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 8.80.020 of the Tukwila Municipal
Code is hereby amended to read as follows:
8.80.020 Littering, Pollution and Smoking. The
following statutes of the State of Washington are
adopted by reference:
RCW 70.93.060 Littering
RCW 70.54.010 Polluting water supply
RCW 70.160.020 -.070 Smoking prohibited
Section 2. The City Clerk is hereby directed to
maintain not less than one (1) copy of RCW 7.160.020 -.070 on file
in the Office of the City Clerk for use and examination by the
public pursuant to RCW 35A.12.140.
Section 3. If any section, sentence, clause or phrase
of this ordinance should be held to be invalid or unconstitu-
tional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitu-
tionality of any other section, sentence, clause or phrase of
this ordinance.

Section 4. This ordinance or a summary thereof shall
be published in the official newspaper of the City, and shall
take effect and be in full force five (5) days after the date of
publication.

TO MAINTAIN ON FILE A COPY OF STATE STATUTES
ADOPTED BY REFERENCE AND ESTABLISHING AN EFFECTIVE
DATE.
On 1986, the City Council of the City
of Tukwila passed Ordinance No. /3 6 7 which provides as
follows:
Section 1. Adopts RCW 70.160.020 -.070 by reference.
RCW 70.160.070(1) states in part:
Any person intentionally violating this chapter by
smoking in a public place not designated as a
smoking area or any person removing, defacing, or
destroying a sign required by this chapter is
subject to a civil fine of up to one hundred
dollars.
Section 2. Directs the City Clerk to maintain one copy
of RCW 70.160.020 -.070 on file.
Section 3. Contains a severability provision.
Section 4. Sets an effective date of five days after
the date of publication of this summary.
The full text of this ordinance will be mailed
without charge to anyone who submits a written
request to the City Clerk of the City of Tukwila
for a copy of the text.
