WHEREAS the cities named above have entered into an Interlocal Agreement (ILA) for the temporary housing of Tukwila's inmates by Renton, and WHEREAS the ILA has a Payment Schedule in section 4, and WHEREAS the amounts in the payment schedule were governed by the payment schedule of the Long -Term Jail Contract with Yakima County; and WHEREAS the daily charge for an inmate housed in Yakima County Jail will increase to the sum of $58 80, effective January 1, 2003, and WHEREAS the City of Renton has provided timely notice to Tukwila of its desire to raise the daily rate for the temporary housing of Tukwila's inmates effective January 1, 2003, now THEREFORE, the provisions of the Interlocal Agreement between the Cities of Tukwila and Renton, Washington for the temporary custody of inmates before transfer to Yakima County Jail are amended, effective January 1, 2003, as follows Section 4. Payment Schedule: The following amounts are per Identified Offender $25 00 per Identified Offender where that person is in Renton jail for less than 24 hours AND is not detained in the Renton jail overnight. $58 80 per Identified Offender where that person is in Renton Jail for less than 24 hours AND is detained in the Renton jail overnight, OR is detained in the Renton jail for a 24 hour period. $58 80 per day per Identified Offender where that person is in the Renton jail for more than a 24-hour penod. J INTERLOCAL AGREEMENT FOR TEMPORARY CUSTODY OF INMATES BEFORE TRANSFER TO YAKIMA COUNTY JAIL This interlocal agreement ("Agreement") is between the City of Renton ("Renton"), a municipal corporation of the State of Washington, the City of Tukwila ("Tukwila"), a municipal corporation of the State of Washington, and the City of Des Moines ("Des Moines"), a municipal corporation of the State of Washington. WHEREAS, Renton maintains a municipal jail pursuant to R.0 W 70 48, and WHEREAS, Tukwila and Des Moines do not maintain a municipal jail, and WHEREAS, Renton, Tukwila, and Des Moines have contracts with Yakima County to house long term inmates, and WHEREAS, Renton and Yakima County have made arrangements to have inmates transported from Renton to Yakima, and WHEREAS, housing Tukwila and Des Moines inmates in the Renton jail before they are transferred to Yakima County will facilitate their transfer; NOW, THEREFORE, pursuant to the provisions of the Interlocal Cooperation Act, RCW 39 34, Renton, Tukwila, and Des Moines hereby agree as follows. SECTION 1. Definitions. "Committing Party" is defined as Tukwila or Des Moines "Housing Party" is defined as Renton jail. "Identified Offender" is defined as a jail inmate who a city desires to have transferred to Yakima County jail. "Medical Furlough" is defined as a release from custody for medical reasons. "Outside Medical Facility" is defined as a hospital or medical chnic or other medical care provider that is not within the confines of the Renton Jail. "Scheduled Transfer" is defined as any transfer of inmates between Renton and Yakima County that is made according to the schedule attached hereto as Exhibit 1 SECTION 2. Tukwila's Obligations In consideration of the promises of Renton, set forth herein, Tukwila promises as follows. ORDINALS (A) Identify those sentenced offenders for commitment to Yakima County jail, (B) Transfer those identified offenders to the Renton jail no more than 72 hours in advance of the scheduled transfer of inmates. (C) Provide to Renton the commitment papers for each Identified Offender (D) Make payment of the billed amounts by the end of the month following the billing month. Said payment will be made to the City of Renton Finance Department as indicated below (E) Pay for medical care that is provided for Identified Offenders who are transferred to an outside medical facility (F) Provide to Renton a means by which Renton can obtain authonty from Tukwila to medically furlough the Identified Offender should that offender need medical attention from an outside medical facility (G) Provide a supply of medications for those Identified Offenders who are taking medications at the time of transfer Said supply must be for 7 days PLUS the number of days the Identified Offender will be held in the Renton Jail. (H) Reimburse Renton for any medications purchased for Identified Offenders if the supply identified above is not provided. (I) Maintain Insurance as set out below SECTION 3. Des Moines' Obligations In consideration of the promises of Renton, set forth herein, Des Moines promises as follows. (A) Identify those sentenced offenders for commitment to Yakima County jail, (B) Transfer those identified offenders to the Renton jail no more than 72 hours in advance of the scheduled transfer of inmates. (C) Provide to Renton the commitment papers for each Identified Offender (D) Make payment of the billed amounts by the end of the month following the bilking month. Said payment will be made to the City of Renton Finance Department as indicated below (E) Pay for medical care that is provided for Identified Offenders who are transferred to an outside medical facility Interlocal Agreement For Temporary Custody — p 2 of 8 (F) Provide to Renton a means by which Renton can obtain authority from Des Moines to medically furlough the Identified Offender should that offender need medical attention from an outside medical facility (G) Provide a 7 -day supply of medications for those Identified Offenders who are taking medications at the time of transfer Said supply must be for 7 days PLUS the number of days the Identified Offender will be held in the Renton Jail. (H) Reimburse Renton for any medications purchased for Identified Offenders if the supply identified above is not provided. (I) Maintain insurance as set out below SECTION 4. Renton's Obligation. In consideration of the promises of Tukwila and Des Moines, respectively, set forth herein, and payment of the amounts set forth herein, Renton will. (A) Provide temporary detention of Identified Offenders for up to 72 hours, pending transportation to Yakima County jail. (B) Provide any in-house medical attention that may be required by Identified Offenders. (C) Provide a monthly bilking based on the payment schedule set forth herein. (D) Provide transportation of Identified Offenders to the transfer point with Yakima County The City of Renton reserves the right to refuse the transfer to the Renton jail of any Identified Offender SECTION 5. Payment Schedule: The following amounts are per Identified Offender - $25 00 per Identified Offender where that person is in Renton jail for less than 24 hours AND is not detained in the Renton jail overnight. $50 00 per Identified Offender where that person is in Renton Jail for less than 24 hours AND is detained in the Renton jail overmght; OR is detained in the Renton jail for a 24 hour penod. (A) Tukwila and Des Moines agree to provide to Renton, and Renton agrees to provide to Tukwila and Des Moines evidence of insurance coverage, in the form of a certificate of insurance from a solvent insurance provider and/or a letter confirming coverage from a solvent insurance company or pool, which is sufficient to address the insurance and indemnification obligations set forth in this Agreement. (B) Each party shall obtain and maintain coverage in minimum liability limits of one million dollars ($1,000,000) per occurrence and two million dollars ($2,000,000) in the aggregate for its liability exposures, including comprehensive general liability, errors and omissions, auto liability and police professional liability The insurance policy shall provide coverage for those events that occur during the term of the policy, despite when the claim is made. SECTION 7. Contact Persons. Indemnification. (B) Tukwila's negligent conduct: Tukwila shall indemnify and hold harmless Renton and its officers, agents, and employees, or any of them, from and against any and all claims, actions, suits, liability, loss, costs, expenses, and damages of any nature whatsoever, which are caused by or result from any negligent act or omission of Tukwila, its officers, agents and employees in performing services pursuant to this Agreement. And, in the event that any suit based upon such a claim, action, loss, or damage is brought against Renton or Renton and Tukwila, Tukwila shall defend the same as its sole cost and expense; and if final judgment is rendered against Renton and its officers, agents, and employees or jointly against Renton and Tukwila and their respective officers, agents and employees, Tukwila shall satisfy the same. (C) Des Moines' negligent conduct: Des Moines shall indemnify and hold harmless Renton and its officers, agents, and employees, or any of them, from and against any and all claims, actions, suits, liability, loss, costs, expenses, and damages of any nature whatsoever, which are caused by or result from any negligent act or omission of Des Moines, its officers, agents and employees in performing services pursuant to this Agreement. And, in the event that any suit based upon such a claim, action, loss, or damage is brought against Renton or Renton and Des Moines, Des Moines shall defend the same as its sole cost and expense, and if final judgment is rendered against Renton and its officers, agents, and employees or jointly against Renton and Des Moines and their respective officers, agents and employees, Des Moines shall satisfy the same. SECTION 8. Term This Agreement shall be effective December 1, 2001 through December 31, 2002 This Agreement shall automatically be renewed for additional one year terms under the same terms and conditions, unless Renton gives Tukwila, or Des Moines, sixty (60) days written notice of its desire to renegotiate any provision herein or its desire to terminate Interlocal Agreement For Temporary Custody — p. 6 of 8 this Agreement; OR unless either Tukwila, or Des Moines, gives Renton sixty (60) days written notice of its desire to renegotiate any provision herein or its desire to terminate this Agreement. SECTION 9. Right to Refuse Identified Offender. Renton shall have the nght to refuse to accept any Identified Offender from Tukwila or Des Moines, when, in the opimon of Renton its inmate census is at capacity or so near capacity that there is a substantial risk that, through usual operation of the jail, the reasonable operational capacity limits of the fail might be reached or exceeded. Further, Renton shall have the nght to refuse to accept any inmate from Tukwila or Des Moines who, in the judgment of Renton, has a current illness or injury which may adversely affect the operations of the Renton Jail, has a history of serious medical problems, presents a substantial risk of escape, or presents a substantial nsk of injury to other persons or property Date 4)c�- Attest: The City of Tukwila, by its Mayor (Cjty Clerk Date Approved as to legal form.
