ISSUE
During the April 4, 2005, public hearing for seven street vacations related to the Sound Transit
Link Light Rail South Corridor proj ect, several issues arose for which Council requested
clarification.
BACKGROUND
At the public hearing, no issues specific to this proposed vacation were raised. In the interest of
clarity and for the record, questions that arose regarding the other vacations will be addressed for
this right-of-way. These are 1) the location of the right-of-way, 2) the proposed vacation limits,
3) the right-of-way surface, and 4) maintaining access for all parcels.
ANALYSIS
This portion of 35tl1 Av. S. lies between Sound Transit property and WashDOT property, north of
S. 154th St. The Tukwila light rail station vvill be built on this site.
The proposed right-of-way limits run the full length of the abutting properties and include the
cul-de-sac bulb. The Sound Transit station will need the full right-of-way limits as proposed to
build the station. There is approximately 23,891 square feet of concrete and asphalt paved right-
of-way.
A right-of-way is an easement over land that benefits the public. Per TMC 11.60.100, a release
of the public right-of-way easement can not prevent legal access to public right-of-way for any
existing lot. When a vacation will create land-locked parcel(s), the vacation ordinance contains a
condition that a private access easement be provided to replace the public easement. In this case,
all of the land-locked parcels belong to Sound Transit.
A Draft ordinance is attached for review and comment. A vacation is not complete until all of
the conditions are met.
RECOMMENDATION
Waive the requirement for an access easement, and approve the ordinance or recommend
changes, and forward to the Regular Council Meeting.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, VACATING CERTAIN PROPERTY LOCATED WITHIN
THE CITY, DEDICATED FOR STREET PURPOSES, GENERALLY
DESCRIBED AS 35TH AVENUE SOUTH, RUNNING SOUTHWESTERLY
FROM SOUTHCENTER BOULEV ARD (SOUTH 154TH STREET) FOR
APPROXIMATELY 354 FEET, INCLUDING THE PARTIAL CUL-DE-SAC
BULB; AMENDING THE OFFICIAL STREET MAP OF THE CITY;
PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE
DATE,
WHEREAS, the City of Tukwila and Sound Transit executed the Development and
Transit-Way Agreement for Sound Transit Central Link Light Rail-- Tukwila Freeway
Route Project on December 8, 2004; and
WHEREAS, TMC 11.60 specifies street vacation procedures including public
notification, a public hearing, review and comment, and submittal of relevant
information to City Council, all of which have been completed; and
WHEREAS, Sound Transit Link Light Rail proposes a station at this location; and
WHEREAS, 35th Avenue South has been a right-of-way for more than 25 years;
and
WHEREAS, Sound Transit provided a real property appraisal from a member of
the American Institute of Real Estate Appraisers in the amount of $446,088.00; and
WHEREAS, utilities exist in the right-of-way proposed to be vacated; and
WHEREAS, vacation of 35th Avenue South will create land-locked lots of record;
and
WHEREAS, the City of Tukwila City Council conducted a public hearing on
April 4, 2005 for the purpose of considering the vacation of certain property located in
the City of Tukwila, as described above; and
WHEREAS, following conclusion of the public hearing, the City Council found the
property should be vacated, subject to conditions identified in this ordinance;
,NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Vacation,
A. The following property located in the City of Tukwila is hereby vacated:
approximately 23,891 square feet of 35th Avenue South, running southwesterly from
Southcenter Boulevard (South 154th Street) for approximately 35 feet, including the
partial cul-de-sac bulb.

B. As Sound Transit owns all lots that will be land-locked, Council waives a
provision for '1lccess easement( s).
C. This vacation is conditioned upon satisfaction, by April 30, 2007, of the
following:
1. Provision of compensation for $446,088.00.
2. Provision of utility easement(s) for Qwest, Water District 125, Washington
Deparhnent of Transportation, and Seattle Public Utilities~
3. Provision of easement(s) to Sound Transit for construction, operation and
maintenance of the Tukwila Freeway Route Project consistent with the Development
and Transit-Way Agreement referenced herein.
Section 2, Duties of Public Works, The Public Works Department is hereby
directed to record a certified copy of this ordinance with King County, upon
determination by the Public Works Director that the conditions referenced above have
been satisfied.
Section 3, Amendment of Official Street Map. Upon the recording of a certified
copy of the ordinance, the City Public Works Director shall amend the City's official
street map to be consistent with this ordinance.
Section 4. Severability, If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance or its application to any person or situation should be held to
be invalid or unconstitutional for any reason by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of the
remaining portions of this ordinance or its application to any other person or situation.
Section 5. Effective Date. This ordinance or a summary thereof shall be published
in the official newspaper of the City. This vacation shall not become effective until the
conditions contained herein have been fully satisfied, until all fees owed the City have
been paid, and until five working days after the date that this ordinance and all relevant
documents have been recorded with King County Records.

ISSUE
During the,public hearing on April 4, 2005, Council requested response to questions that arose
during the hearing be presented to the Committee of the Whole.
BACKGROUND
This vacation is one of seven vacations related to the Sound Transit Link Light Rail South
Corridor proj ect. At the public hearing, questions arose regarding 1) the proposed vacation
limits, 2) maintaining access to existing parcels, 3) maintaining an area for trucks to turn around,
and 4) fire department access to 4712 S. 134th PI. (Schweiger building).
ANAL YSIS
The proposed right-of-way limits run the full length of the 48th Av. S between S. 134th
PI. and SR-599. These limits represent the area of right-of-way the City no longer needs. This
right-of-way is fully paved.
A right-of-way is an easement over land that benefits the public. Per TMC 11.60.100, a release
of the public right-of-way easement can not prevent legal access to public right-of-way for any
existing lot. When a vacation will create land-locked parcel(s), the vacation ordinance contains a
condition that a private access easement be provided to replace the public easement. In this case,
all of the land-locked parcels belong to Sound Transit and can be accessed from S I 34th Place.
Truck turn-around can be provided by an access easement over the westerly end of 48th Av. S.
There is a fire hydrant at the intersection of 48th Av Sand S 134th PI. The hydrant is within 150'
of the building, meeting fire code. If necessary, the Fire Department could use the access
easement to reach the back of Mr. Schweiger's building.
A Draft ordinance is attached for review and comment. A vacation is not complete until all of
the conditions are met.
RECOMMENDATION
Approve the ordinance or recommend changes, and forward to the Regular Council Meeting.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, VACATING CERTAIN PROPERTY LOCATED WITHIN
THE CITY, DEDICATED FOR STREET PURPOSES, GENERALLY
DESCRmED AS 48TH AVENUE SOUTH, RUNNING NORTHEASTERLY
FROM SOUTH 134TH PLACE TO THE INTERSTATE 5 ON-RAMP AT
STATE ROUTE 599; AMENDING THE OFFICIAL STREET MAP OF THE
CITY; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN
EFFECTIVE DATE.
WHEREAS, the City of Tukwila and Sound Transit executed the Development and
Transit-Way Agreement for Sound Transit Central Link Light Rail-- Tukwila Freeway
Route Project on December 8, 2004; and
WHEREAS, TMC 11.60 specifies street vacation procedures including public
notification, a public hearing, review and comment, and submittal of relevant
information to City Council, all of which have been completed; and
WHEREAS, 48th A venue South has been a right-of-way for more than 25 years;
and
WHEREAS, Sound Transit provided a real property appraisal from a member of
the American Institute of Real Estate Appraisers in the amount of $81,232.00; and
WHEREAS, utilities exist in the right-of-way proposed to be vacated; and
WHEREAS, trucks use the westerly portion of 48th Avenue South as a turn-
around; and
WHEREAS, the City of Tukwila City Council conducted a public hearing on
Aprl14, 2005 for the purpose of considering the vacation of certain property located in
the City of Tukwila, as described above; and
WHEREAS, following conclusion of the public hearing, the City Council found the
property should be vacated, subject to conditions identified in this ordinance;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Vacation.
A. The following property located in the City of Tukwila is hereby vacated:
approximately 10,005 square feet of 48th Avenue South, running northeasterly from
South 134th Place to the Interstate 5 on-ramp at State Route 599.
B. As Sound Transit owns all lots that will be land-locked, Council waives a
provision for access easement(s).

C. This vacation is conditioned upon satisfaction, by April 30, 2007, of the
following:
1. Provision of compensation for $81,232.00.
2. Provision of utility easement(s) for Qwest, Water District 125, ValVue
Sewer.
3. Provision of an access easement on the westerly portion of the right-of-
way.
4. Provision of easement(s) to Sound Transit for construction, operation and
maintenance of the Tukwila Freeway Route Project consistent with the Development
and Transit-Way Agreement referenced herein.
Section 2. Duties of Public Works, The Public Works Department is hereby
directed to record a certified copy of this ordinance with King County, upon
determination by the Public Works Director that the conditions referenced above have
been satisfied.
Section 3, Amendment of Official Street Map, Upon the recording of a certified
copy of the ordinance, the City Public Works Director shall amend the City's official
street map to be consistent with this ordinance.
Section 4, Severability, If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance or its application to any person or situation should be held to
be invalid or unconstitutional for any reason by a court of competent jurisdiction, such
invalidity or unconstihttionality shall not affect the validity or constihttionality of the
remaining portions of this ordinance or its application to any other person or situation.
Section 5. Effective Date. This ordinance or a summary thereof shall be
published in the official newspaper of the City. This vacation shall not become effective
until the conditions contained herein have been fully satisfied, until all fees owed the
City have been paid, and until five working days after the date that this ordinance and
all relevant documents have been recorded with King County Records.

ISSUE
During the public hearing on April 4, 2005, Council requested response to questions that arose
during the hearing be presented to the Committee of the Whole.
BACKGROUND
This vacation is one of seven vacations related to the Sound Transit Link Light Rail South
Corridor project. At the public hearing, questions arose regarding 1) the proposed vacation
limits, 2) maintaining access to existing parcels, 3) fire department access to 4600 S. 134th PI.
(Tukwila Property, LLC).
ANAL YSIS
The proposed right-of-way limits run the full length of the 4ih Av. S., between S. 134th
PI. and SR-599. These limits represent the area of right-of-way the City no longer needs.
The right-of-way surface consists of gravel currently used for parking, approximately ten feet of
paving and a ditch.
A right-of-way is an easement over land that benefits the public. Per TMC 11.60.100, a release
of the public right-of-way easement can not prevent legal access to public right-of-way for any
existing lot. When a vacation will create land-locked parcel(s), the vacation ordinance contains a
condition that a private access easement be provided to replace the public easement. In this case,
the land-locked parcels belong to Mr. Wagner and to Sound Transit.
Access to Mr. Wagner's parcel and to Sound Transit parcels can be provided by an access
easement over the westerly end of 4ih Av. S.
The existing building on the Tukwila Property LLC lot does not have required fire access to the
back of the building. This vacation will allow installation of the fire access to meet fire code.
A Draft ordinance is attached for review and conlment. A vacation is not complete until all of
the conditions are met.
RECOMIVIENDATION
Approve the ordinance or recommend changes, and forward to the Regular Council Meeting.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, VACATING CERTAIN PROPERTY LOCATED WITHIN
THE CITY, DEDICATED FOR STREET PURPOSES, GENERALLY
DESCRIBED AS 47TH AVENUE SOUTH, RUNNING NORTHEASTERLY
FOR APPROXIMATELY 310 FEET, FROM SOUTH 134TH PLACE TO THE
WASHINGTON DEPARTMENT OF TRANSPORTATION RIGHT-OF-
WAY; AMENDING THE OFFICIAL STREET MAP OF THE CITY;
PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE
DATE,
WHEREAS, the City of Tukwila and Sound Transit executed the Development and
Transit-Way Agreement for Sound Transit Central Link Light Rail-- Tukwila Freeway
Route Project on December 8, 2004; and
WHEREAS, TMC 11.60 specifies street vacation procedures including public
notification, a public hearing, review and comment, and submittal of relevant
information to City Council, all of which have been completed; and
WHEREAS, 47th Avenue South has been a right-of-way for more than 25 years;
and
WHEREAS, Sound Transit provided a real property appraisal from a member of
the American Institute of Real Estate Appraisers in the amount of $176,516.00; and
WHEREAS, utilities exist in the right-of-way proposed to be vacated; and
WHEREAS, vacation of 47th Avenue South will create land-locked lots of record;
and
WHEREAS, the City of Tukwila City Council conducted a public hearing on
April 4, 2005 for the purpose of considering the vacation of certain property located in
the City of Tukwila, as described above; and
WHEREAS, following conclusion of the public hearing, the City Council found the
property should be vacated, subject to conditions identified in this ordinance;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Vacation,
A. The following property located in the City of Tukwila is hereby vacated:
approximately 12,125 square feet of 47th A venue South, running northeasterly for
approximately 310 feet, from South 134th Place to the Washington Department of
Transportation right-of-way.

B. As Sound Transit owns all lots that will be land-locked, Council waives a
provision for access easement(s).
C. This Ivacation is conditioned upon satisfaction, by April 30, 2007, of the
following:
1. Provision of compensation for $176,516.00.
2. Provision of utility easement(s) for Qwest, Water District 125, ValVue
Sewer, Seattle Public Utility, Washington Department of Transportation, and the City of
Tukwila. -
3. Provision of an access easement.
4. Provision of easement(s) to Sound Transit for construction, operation and
maintenance of the Tukwila Freeway Route Project consistent with the Development
and Transit-Way Agreement referenced herein.
Section 2, Duties of Public Works, The Public Works Department is hereby
directed to record a certified copy of this ordinance with King County, upon
determination by the Public Works Director that the conditions referenced above have
been satisfied.
Section 3. Amendment of Official Street Map, Upon the recording of a certified
copy of the ordinance, the City Public Works Director shall amend the City's official
street map to be consistent with this ordinance.
Section 4. Severability, If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance or its application to any person or situation should be held to
be invalid or unconstitutional for any reason by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of the
remaining portions of this ordinance or its application to any other person or situation.
Section 5. Effective Date, This ordinance or a summary thereof shall be
published in the official newspaper of the City. This vacation shall not become effective
until the conditions contained herein have been fully satisfied, until all fees owed the
. City have been paid, and until five working days after the date that this ordinance and
all relevant documents have been recorded with King County Records.

WASHINGTON, VACATING CERTAIN PROPERTY LOCATED WITHIN
THE CITY, DEDICATED FOR STREET PURPOSES, GENERALLY
DESCRIBED AS A PORTION OF SOUTH 138TH STREET AT THE
INTERSECTION OF SOUTH 138TH STREET AND THE WESTERLY SIDE
OF WASHINGTON DEPARTMENT OF TRANSPORTATION
INTERSTATE 5 RIGHT-OF-WAY; AMENDING THE OFFICIAL STREET
MAP OF TH~ CITY; PROVIDING FOR SEVERABILITY; AND
ESTABLISHING AN EFFECTIVE DATE,
WHEREAS, the City of Tukwila and Sound Transit executed the Development and
Transit-Way Agreement for Sound Transit Central Link Light Rail-- Tukwila Freeway
Route Project on December 8, 2004; and
WHEREAS, the City wishes to vacate this portion of South 138th Street at the
intersection of South 138th Street and the westerly side of Washington Department of
Transportation Interstate 5 right-of-way; and
WHEREAS, TMC 11.60 specifies street vacation procedures including public
notification, a public hearing, review and comment, and submittal of relevant
information to City Council, all of which have been completed; and
WHEREAS, South 138th Street has been a right-of-way for more than 25 years; and
WHEREAS, utilities exist in the right-of-way proposed to be vacated; and
WHEREAS, vacation of South 138th Street will not create land-locked lots of
record; and
WHEREAS, the City of Tukwila City Council conducted a public hearing on
April 4, 2005 for the purpose of considering the vacation of certain property located in
the City of Tukwila, as described above; and .
WHEREAS, following conclusion of the public hearing, the City Council found the
property should be vacated, subject to conditions identified in this Qrdinance;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Vacation.
A. The following property located in the City of Tukwila is hereby vacated:
approximately 647 square feet of South 138th Street, located at the intersection of South
138th Street and the westerly side of Washington Department of Transportation
Interstate 5 right-of-way.
B. This is a City-initiated vacation and compensation is not due the City.

C. This vacation is conditioned upon satisfaction, by April 30, 2007, of the
following:
1. Provision of utility easements to Seattle Public Utility, ValVue Sewer, and
Washington Department of Transportation.
2. Provision of easement(s) to Sound Transit for construction, operation and
maintenance of the Tukwila Freeway Route Project consistent with the Development
and Transit-Way Agreement referenced herein.
Section 2, Duties of Public Works, The Public Works Department is hereby
directed to record a certified copy of this ordinance with King County, upon
determination by the Public Works Director that the conditions referenced above have
been satisfied.
Section 3. Amendment of Official Street Map, Upon the recording of a certified
,copy of the ordinance, the City Public Works Director shall amend the City's official
street map to be consistent with this ordinance.
Section 4, Severability. If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance or its application to any person or situation should be held to
be invalid or unconstitutional for any reason by a court of competent jurisdiction, such
invalidity or unconstihttionality shall not affect the validity or constitutionality of the
remaining portions of this ordinance or its application to any other person or situation.
Section 5. Effective Date. This ordinance or a sununary thereof shall be
published in the official newspaper of the City. This vacation shall not become effective
until the conditions contained herein have been fully satisfied, until all fees owed the
City have been paid, and until five working days after the date that this ordinance and
all relevant documents have been recorded with King County Records.

ISSUE
During the, public hearing on April 4, 2005, Council requested response to questions that arose
during the hearing be presented to the Committee of the Whole.
BACKGROUND
This vacation is one of seven vacations related to the Sound Transit Link Light Rail South
Corridor project. At the public hearing, questions arose regarding the location of the right-of-
way, the proposed vacation limits, and the right-of-way surface.
ANALYSIS
This portion of S. 146th Street lies between 51 st Av. S and Interstate 5. It is south of property
owned by Cal Cantonwine and north of property owned by Sound Transit.
The right-of-way limits run the full length of the abutting properties from 51 st Av S. to Interste-5.
The limits represent the area of right-of-way the City no longer needs.
The right-of-way is unopened. It is covered by blackberries and other growth. The Cantonwine
property has direct access to 51 st A v. S.
No land-locked parcel(s) will be created by this vacation.
A Draft ordinance is attached for review and comment. A vacation is not complete until all of the
conditions are met.
RECOMMENDATION
Approve the ordinance or recommend changes, and forward to the Regular Council Meeting.

Street Vacation
ISSUE
During the, public hearing on Apri14, 2005, Council requested response to questions that arose
during the hearing be presented to the Committee of the Whole.
BACKGROUND
This vacation is one of seven vacations related to the Sound Transit Link Light Rail South
Corridor project. At the public hearing, questi~ns arose regarding 1) proposed vacation limits,
2) right-of-way surface, and 3) maintaining access to existing parcels.
ANALYSIS
This portion of S. 133rd Street lies between SR-599 and private property. There is an existing
10' access easement from S 134th St to this 7,149 square feet of right-of-way. This right-of-way
is not used for public access. The vacation limits represent the area of right-of-way the City no
longer needs.
This right-of-way is fully paved and is currently used by Farwest Paints to maneuver trucks onto
a ramp.
A right-of-way is an easement over land that benefits the public. Per TMC 11.60.100, a release
of the public right-of-way easement can not prevent legal access to public right-of-way for any
existing lot. When a vacation will create land-locked parce1(s), the vacation ordinance contains a
condition that a private access easement be provided to replace the public easement. In this case,
the existing 10' access easement will provide access to Sound Transit's parcel. The Northwest
Ironworkers parcel accesses from S 134th PI. and will not be land-locked by this vacation.
There is an existing 60' utility easement to the west of this right-of-way.
A Draft ordinance is attached for review and comment. A vacation is not complete until all of
the conditions are met.
RECOMMENDATION
Approve the ordinance or recommend changes, and forward to the Regular Council Meeting.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, VACATING CERTAIN PROPERTY LOCATED WITHIN
THE CITY, DEDICATED FOR STREET PURPOSES, GENERALLY
DESCRIBED AS A PORTION OF SOUTH 133RD STREET, LOCATED AT
THE INTERSECTION OF SOUTH 133RD STREET AND STATE ROUTE 599
RIGHT-OF-WAY; AMENDING THE OFFICIAL STREET MAP OF THE
CITY; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN
EFFECTIVE DATE.
WHEREAS, the City of Tukwila and Sound Transit executed the Development and
Transit-Way Agreement for Sound Transit Central Link Light Rail - Tukwila Freeway
Route Project on December 8, 2004; and
WHEREAS, TMC 11.60 specifies street vacation procedures including public
notification, a public hearing, review and comment, and submittal of relevant
information to City Council, all of which have been completed; and
WHEREAS, South 133rd Street has been a right~of-way for more than 25 years; and
WHEREAS, Sound Transit provided a real property appraisal from a member of
the American Institute of Real Estate Appraisers in the amount of $101,052.00; and
WHEREAS, a utility exists in the right-of-way proposed to be vacated; and
WHEREAS, the City of Tukwila City Council conducted a public hearing on
. April 4, 2005 for the purpose of considering the vacation of certain property located in
the City of Tukwila, as described above; and
WHEREAS, following conclusion of the public hearing, the City Council found the
property should be vacated, subject to conditions identified in this ordinance;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DOES ORDAIN AS FOLLOWS:

Section 1, Vacation.
A. The following property located in the City of Tukwila is hereby vacated:
approximately 7,149 square feet of South 133rd Street, located at the intersection of
South 133rd Street and State Route 599 right-of-way.
B. This vacation is conditioned upon satisfaction, by April 30, 2007, of the
following:
1. Provision of compensation for $101,052.00.
2. Provision of utility easement(s) for Qwest.

3. Provision of easement(s) to Sound Transit for construction, operation and
maintenance of the Tukwila Freeway Route Project consistent with the Development
and Transit-~ay Agreement referenced herein.
Section 2, Duties of Public Works, The Public Works Department is hereby
directed to record a certified copy of this ordinance with King County, upon
determination by the Public Works Director that the conditions z:eferenced above have
been satisfied.
Section 3, Amendment of Official Street Map, Upon the recording of a certified
copy of the ordinance, the City Public Works Director shall amend the City's official
street map to be consistent with this ordinance.
Section 4. Severability. If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance or its~application to any person or situation should be held to
be invalid or unconstitutional for any reason by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of the
remaining portions of this ordinance or its application to any other person or situation.
Section 5. Effective Date. This ordinance or a summary thereof shall be
published in the official newspaper of the City. This vacation shall not become effective
until the conditions contained herein have been fully satisfied, until all fees owed the
City have been paid, and until five working days after the date that this ordinance and
all relevant documents have been recorded with King County Records.
