AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON,
ANNEXING CERTAIN REAL PROPERTY COMMONLY KNOWN AS THE
FOSTORIA ASSOCIATES ANNEXATION. PURSUANT TO THE DIRECT
PETITION METHOD SET FORTH IN RCW CHAPTER 35A.14;
REQUIRING SAID PROPERTY TO BE ASSESSED AND TAXED AT THE
SAME RATE AND UPON THE SAME BASIS AS OTHER PROPERTY
WITHIN THE CITY; DIRECTING THE CITY CLERK TO FILE A
CERTIFIED COPY OF THIS ORDINANCE WITH THE COUNTY
COUNCIL; AND FIXING THE EFFECTIVE DATE OF THE
ANNEXATION.
WHEREAS, a Notice of Intent to Annex, signed by owners of
not less than ten percent in value, according to assessed
valuation for general taxation, of the property for which annexa-
tion is sought, was received by the City on June 3, 1985 and on
July 8, 1985, the City Council met with the petitioners, which
was within sixty (60) days of receipt of said Notice of Intent to
Annex, and determined that the City would accept the proposed
annexation, require assumption of existing indebtedness, and
authorized circulation of a petition for annexation, and
WHEREAS, a legally sufficient petition pursuant to RCW
35A.14.120, signed by the owners of at least 75 percent of the
assessed value of the land seeking annexation to the City was
filed with the City on August 1, 1985, and
WHEREAS, said proposed annexation was reviewed in accordance
with the State Environmental Policy Act and a Determination of
Non Significance was issued on September 13, 1985, pursuant to
that Act, and revised on October 16, 1985, and
WHEREAS, said proposed annexation was submitted to the King
County Boundary Review Board pursuant to RCW Chapter 36.93, and
said Board waived review of the proposed annexation at a public
meeting, and
WHEREAS, said property to be annexed is contiguous to and is
a logical extension of the City's corporate limits in light of
circulation, topography, drainage and other City services, and
said annexation is consistent with the provisions of the Tukwila
Comprehensive Plan, and
WHEREAS, the City Council held a public hearing on September
23, 1985, pursuant to notice published in a newspaper of general
circulation in the City and posted notice in at least three
public places within the territory proposed for annexation, and
at the conclusion of said hearing determined that said property
should be annexed to the City, now therefore,
THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The real property commonly known as the Fostoria
Associates Annexation, which property is generally described as
lying in the southeast corner of the intersection of 42nd Avenue
South and S. 133rd Street, and more particularly described on
Exhibit A attached hereto and incorporated herein by this
reference as if fully set forth, should be and is hereby annexed
to and made a part of Tukwila.
Section 2. Pursuant to the terms of the annexation
petition, all property within the territory annexed hereby shall
be assessed and taxed at the same rate and on the same basis as
other property within the City, including assessments for taxes
in payment of any bond issued or debts contracted prior to or
existing as of the date of annexation.
Section 3. The City Clerk is hereby directed to file a
certified copy of this ordinance with the King County Council.
Section 4. This ordinance or a summary therof shall be
published in the official newspaper of the City and shall be in
full force and effect five (5) days after the date of
publication.

The land referred to in this commitment is situated in the County of
King, State of Washington, and described as follows:
That portion of Tract 48, Riverside Interurban Tracts, according
to the plat thereof recorded in Volume 10 of Plats, page 74, in
King County, Washington, lying south of South 133rd Street
(W. W. Beck Road); and
That portion of Tract 18, Fostoria Garden Tracts, according to
the plat thereof recorded in Volume 9 of Plats, page 95, in
King County, Washington, lying south of South 133rd Street
(W. W. Beck Road);
TOGETHER WITH vacated 43rd Avenue South (Squire Street) adjoining;
INCLUDING a tract of land in the northwest corner of said premises,
the westerly line of which is 157 feet in length; the northerly
line of which is 142 feet in length; the southerly line of which
is 133 feet in length and the easterly line of which is 127 feet
in length.

Tukwila passed Ordinance No. /32 which provides as follows:
Section 1. Annexes certain real property to the City of
Tukwila commonly known as the Fostoria Associates Annexation,
which is generally described as lying in the southeast corner of
the intersection of 42nd Avenue South and South 133rd Street, and
more particularly described on Exhibit A attached to this summary.
Section 2. Pursuant to the terms of the Annexation Petition,
all property within the territory annexed hereby shall be assessed
and taxed at the same rate and on the same basis as other property
within the City, including assessments for taxes in payment of any
bond issued or debts contracted prior to or existing as of the
date of annexation.
Section 3. Directs the City Clerk to file a certified copy
of the ordinance with the King County Council.
Section 4. Establishes an effective date.
The full text of this ordinance will be mailed without charge
to anyone who submits a written request to the City Clerk of the
City of Tukwila for a copy of the text.
