BACKGROUND
The Notice to Proceed for Contract No. 09 -101 with Lakeside Industries, Inc of Covington,
Washington, was issued on June 29, 2009 for construction of the 2009/2010 Overlay Program.
Project 09 -RWO1 provided roadway repairs and overlays on 23 street segments in the City. The
construction was physically completed on December 4, 2009.
ANALYSIS
Three change orders were issued during construction and involved various items that totaled
$79,665.81. Change Order No. 1 was required to obtain a special railroad permit and insurance.
Change Order No.2 provided the replacement of 321 feet of curb, gutter, and sidewalk on East
Marginal Way, which had settled and was uneven. Change Order No. 3 replaced 18
handicapped /sidewalk ramps and added truncated domes along East Marginal Way that were
determined to not be in compliance with current standards of the Americans with Disabilities Act
(ADA) guidelines.
Under -runs were due, but not limited to; less utility adjustments; less traffic control measures;
less materials such as gravel, concrete and paving; and non -use of gravel borrow, for a total
credit of $66,584.70. The budget for this contract with a 15% contingency was $1,794,733.50.

RECOMMENDATION
The Committee is being asked for formal acceptance and retainage bond release authorization,
subject to standard claim and lien release procedures, for the contract with Lakeside Industries,
Inc. in the amount of $1,573,719.61, and consider this item at the February 16, 2010 Regular
Consent Agenda.

The City was recently notified of an immediate application deadline for 2010 Transportation
Stimulus Funds.

Peter Heffernan, Chair of the King County Project Evaluation Committee (KCPEC), sent out the
attached email at 11:15 p.m. on Friday January 22, 2010 to all KCPEC members. In the email,
Peter emphasizes the need to submit for a second round of Economic Stimulus Project
Prioritization by 5 p.m. Tuesday, February 3, 2010. Only projects that are ready or nearly ready
to advertise for bids within 90 days of March 1, 2010 will qualify for the application.
As required by CIP Policy, this grant application opportunity is being brought to Committee for
approval. Further, the grant funds will not be accepted without full Council approval.
Two projects are being submitted for the stimulus funding Tukwila Urban Center Access
(Klickitat) and Southcenter Parkway Extension. At this stage, it is not clear how much stimulus
funds will be allocated to PSRC for 2010. In 2009, PSRC selected 27 shovel -ready priority
transportation projects for the $78 million in Federal Highway Administration funds available
through the American Recovery and Reinvestment Act (ARRA).
Authorize Staff to apply for the 2010 Transportation Stimulus Funds for the TUC Access and
Southcenter Parkway projects.

Action Needed: Economic Stimulus Prioritization Round Two
Dear KCPEC member:
Please find attached three documents: a summary of our Jan. 13 KCPEC meeting, an Economic Stimulus project
Prioritization form which we are requesting that you fill out and e -mail to Paul Takamine at
paul.takamine @kingcounty.gov by 5:00 PM Tuesday February 3 for projects which you wish to have considered
for a potential second round of stimulus funding, and information /guidance on the development of the project list.
Please proceed quickly with filling out the prioritization forms because there is not much time to prioritize our
projects and develop the requested project lists. Eligible projects are those on the current ARRA contingency list,
recently adopted STP /CMAQ contingency list, and new projects that are able to meet federal and regional
requirements such as being included in or exempt from the regions long range plan (Destination 2030), NEPA and
are ready to obligate funding in 90 days from March I st, 2010.
I realize that this is all moving quickly and may lead to some confusion but
provide you with the explanations you may need. If you have any questions

Pre Retreat Budget Review

As Council President, I will be working with the Finance Director and Legislative Analyst to prepare a
draft agenda for the 2010 Annual Council Retreat. I anticipate having a draft agenda to the Council
sometime during the last week of January /first week of February, and that the majority of the Retreat
will focus on discussion of the budget.
Per Council discussion at the January 11 COW, Council Committees will conduct detailed review of
the 2009 -10 Biennial Budget document in preparation for the 2010 Annual Council Retreat.
Council Committees have each been assigned portions of the budget to review over the course of
three consecutive meetings. The review schedule for the Transportation Committee is included at the
end of this memo. The Committee can choose to move at a faster pace, if desired by its members.
The Committee review process, as discussed at the January 11 COW, is outlined below. It is intended
to assist the full Council in considering potential program alternatives, expense /capital reductions
and /or new revenue opportunities in response to the severity of the City's budget crisis.
Committee Review Process
Utilizing the 2009 -10 Biennial Budget document, review the pages assigned to the Committee
as outlined below.
Committee member review, understanding and familiarity of the assigned budget items should
be thorough enough that the three Committee members feel comfortable serving as the
Council experts for discussion of the appropriate items during the Retreat.
As mentioned above, it is the intent of the Committee review process to prepare Committee
members with adequate knowledge of assigned sections so that they can assist the rest of the
Council in a meaningful discussion of the items at the Retreat.
Department directors and managers will be available during Committee meetings, as a
resource, to answer questions regarding budget items.
Discussions at the Committee meetings should be a Committee -led process, not staff -led.
Specifics on budget items, as discussed in the Committee, will not be documented in the
Committee minutes. Each Committee member should keep ample individual notes that will aid
you in discussing items at the Retreat.
Committees are not being asked to make any recommendations regarding the budget during
the Committee meetings.
Since the strength of the Council is the experience and knowledge of all seven
Councilmembers, policy -level discussions regarding budget issues are best addressed with
the full Council and Mayor working together.
