WHEREAS, a petition signed by the owners of more than two thirds of the real property abutting on South 151st Street, east of 52nd Avenue South and requesting the vacation of said street was filed with the City Clerk of the City of Tukwila on August26, 1985, and WHEREAS, pursuant to Resolution No. 974, passed by the City Council on September16, 1985, the Tukwila City Council's Committee of the Whole conducted a public hearing on October14, 1985, which was not less than 20 nor more than 60 days from the date of passage of Resolution No. 974, for the purpose of con- sidering the requested street vacation, and WHEREAS, at the conclusion of the public hearing, and based upon testimony taken therein, the Committee of the Whole determined that the vacation could landlock some adjacent property and that a recommendation should be forwarded to the City Council to deny the requested street vacation, and WHEREAS, the City Council, at a regular meeting thereof held on October2l, 1985, considered the recommendation made by the Committee of the Whole and concluded, based upon representa- tions made by the owners of the potentially landlocked property that said owners had agreed to sell said property to T.S.D. Buiid- -.1- ing Associates, of the petitioners requestinge street vaca- tion, that the problem of landlocking some property was therefor solved, and WHEREAS, the City Council has determined that a public benefit exists in vacating South 151st Street east of 52nd Avenue South and that the same should be vacated upon certain conditions, now, therefore, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That certain property located in the City of Tukwila generally described as South 151st Street lying east of 52nd Avenue South, and more particularly described on Exhibit A attached hereto and incorporated herein by this reference as if fully set forth, which has been dedicated to the City for street purposes, is hereby vacated, subject to the following conditions: 1. The City shall retain a permanent easement for utilities in the vacated portion of South 151st Street; 2. The property owners to whom the fee interest in the vacated portion of South 151st Street will pass upon vacation shall maintain access, by means of a permanent easement for ingress and egress, for all properties abutting the vacated por- tion of South 151st Street and for the Washington State Department of Transportation to operate, maintain and repair any and all facilities or equipment which it may have located in the vacated portion of South 151st Street; and 3. The petitioners requesting the street vacation shall, pursuant to Section 11.60.050 of the Tukwila Municipal Code, compensate the City in the amount of 2 OI which the City Council finds does not exceed one -half of the appraised value of the property vacated. Section 2. The City Clerk is hereby directed to record a certified copy of this Ordinance with the King County Recorder, upon a determination by the City Public Works Director that all necessary easements specified in condition 2 have been executed and recorded and that the compensation required by condition 3 in Section 1 has -2- been paid to the•ty. Section 3. Upon the fulfillment of conditions 2 and 3 of Section 1, the City Public Works Director is hereby instructed to amend the City's official street map to be consistent with this ordinance. Section 4. This Ordinance or a summary thereof shall be published in the official newspaper of the City and shall take effect and be in full force five (5) days after the date of publication, pro- vided, that the vacation of South 151st Street specified above shall not become effective until the identified conditions have been complied with. Publish: Record Chronicle, 11/08/85 4/ 1985, the City Council of the City of Tukwila, Washington, adopted Ordinance No. /3 7/, which pro- vides as follows: Section 1. Provides for the vacation of a portion of South 151st Street lying east of 52nd Avenue South, as more particularly des- cribed on Exhibit A, published with this Summary, subject to con- ditions relating to the reservation of utility easements to the City, the provision of access to adjacent property owners, and a payment of compensation to the City. Section 2. Provides for recording of the Ordinance with the King County Recorder. Section 3 Provides for amendment of the official street map. Section 4. Establishes an effective date.
