BACKGROUND Penhallegon Associates Consulting Engineers, Inc. (PACE), and Tukwila entered into Contract No. 03-144 for design services related to the Fort Dent Stormwater Pump Station #19. Because in-house staff is busy with the existing construction workload, this contract supplement was negotiated for construction inspection and management. ANALYSIS The proposed supplemental scope of work and fee of $50,078 to cover the 90 calendar day contract (approx. 65 working days) is approximately 17% of the engineer's estimated cost and about $770 per working day. The average percentage is about 15% and the average daily cost is about $2,500 per day. RECOMMENDATION Authorize the Mayor to sign Supplemental Agreement No. 1 to Contract No. 03-144 with PACE in the mount of $50,078. attachment~: Supplemental Agreement No. 1 SUPPLEMENTAL AGREEMENT NO. 1 to CONSULTANT AGREEMENT NO. 03-144 THIS SUPPLEMENTAL AGREEMENT is entered into between the City of Tukwila, Washington, hereinafter referred to as "the City," and Penhallegon Associates Consulting Engineers, Inc., hereinafter referred to as "the Consultant," in consideration of the mutual benefits, terms, and conditions hereinafter specified. The City desires to supplement the agreement entered into with the Consultant and executed on November 12, 2003, and identified as Agreement No. 03-144. All provisions in the basic agreement remain in effect except as expressly modified by this supplement. The changes to the agreement are described as follows: 1. Scope of Services is hereby changed to include the attached Exhibit A-1. 2. Payment shall be amended as follows: Payment for the work provided by the Consultant as part of this supplement shall be made and the total amount of payment to the Consultant for this work shall not exceed $50,078.00 without express written modification of the Agreement signed by the City. The maximum amount payable under this agreement as supplemented inclusive of all fees and other costs is now $91,820.00. Mullet Chris A Rhinehart Mayor Project Manager EXHIBIT A-1 CONSULTANT AGREEMENT NO. 03-144 SUPPLEMENTAL AGREEMENT NO. 1 SCOPE OF WORK Penlaallegon Associates Consulting Engineers, Inc., will perform bidding assistance and construction observation services for the Fort Dent Stormwater Pump Station #19 and Drainage Improvements Project. Bidding assistance will consist of receiving the bids fi.om the City; checking Contractor references; tabulating and evaluating the bids received; and recommending the contract award for the City. Construction observation services will consist of 65 working days (x 8 hours/day = 520 hours), made up of observation by PACE and Follett Engineering (electrical engineer) staff. Survey services are included, consisting of 4 hours of 2-man crew time, intended to verify the Contractor's survey work or resolve minor survey issues. On-call engineering assistance (12 engineering hours) and project management for three additional months (6 hours) are included. (PACE) is pleased to submit this proposal for additional services to provide engineering services during the bidding and construction phases of this project. Scope of Additional Service This proposal includes bidding assistance and construction services during the 90 calendar days of the construction contract. Bidding assistance will consist of receiwng the bids f~om the City; checking Contractor references; tabulating and evaluating the bids received; and recommending the contract award for the City. Per your request, construction observation services will consist of 65 working days (x 8 hours/day = 520 hours), made up of observation by PACE and Follett Engineering (electrical engineer) staff. Assigned staff will vary, based on the relevant work being performed by the Contractor on any given day. These staff will report directly to you as Construction Manager, or others designated by you. Assumptions Attendance at construction meetings is assumed to be included in the construction observation hours. Compaction and any other testing will be provided by others. Construction survey and staking will be provided by the Contractor, except as noted under Scope of Additional Service. The fee is based on our 2003/2004 rates. A spreadsheet is attached listing personnel, hours, hourly rates, and extensions. Metro King County 2005 Sewer Rate Increase Metro is increasing its 2005 sewer charges for service and for new connections. They have been charging for new connections since 1990, ' and those rates will go up again next year. Generally people pay the'cost up front or over 15 years. There will be a 9% increase in monthly sewer rates, resulting in an average charge of $32.60 per single-family house in 2005. The connection fee is increasing from $18 per month to $34.05. Pam C noted it is City policy to pass on increases from Metro. Recommend ordinance to COW and Regular Meetings. 2. 2004 Small Drainage Bid Award Dennis Craig, Inc. won the contract for the small drainage projects for this year. There are seven projects, including the S. 180th Street underpass drainage repair. There was not a map of where the other six projects were, and staff promised there would be a map when it went to Council. Dennis asked for a rough cost of each of the projects. Funding for the projects will come from the street fund, although staff is working to get the S. 180th project funded separately. The lowest puce was higher than the engineer's estimate. Recommend bid award to COW and Council for approval. 3. Fort Dent Storm water Pump Station #19 The City tried to repair Pump Station 19, but it was too far gone to be repaired. Replacement of the pump station was needed, and some associated drainage improvements were added. Drainage from the parking lot that now goes to the river will be diverted to the pond, and will be cleaned a little more than currently. The winning bid from Western Engineering Constructors, Inc. for $221,588.17 was quite a bit lower than the engineer's estimate. Recommend bid award to COW and Regular Meeting for approval. 4. Fort Dent .Storm water Construction Services_ Penhallegon Associates Consulting Engineers, Inc. (PACE) won the contract to design the improvements needed at Fort Dent drainage. Staff would normally do this, but they are too busy to be able to do that just now. The $50,078 contract will cover about 65 working days in a 90-day period. Dennis thought it was expensive, but he realized staff couldn't afford to do it. Recommend bid award to COW and Regular Meeting for approval. 5. Information Notices Committee members appreciated seeing what the citizens will see in the Hazelnut. They changed the open house in Allentown from 7-9 to 6-8 October 6th. Information. 6. Other Pam C raised the issue of dead plantings on S. 51st near Bonsai. Staff said they thought it was past the time the contractor had to keep them alive, but said they would check. Information.
