AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON,
VACATING CERTAIN PROPERTY LOCATED IN THE CITY OF
TUKWILA DEDICATED FOR STREET PURPOSES,SAID PROPERTY
BEING GENERALLY DESCRIBED AS SOUTH 133RD STREET LYING
EASTERLY OF SOUTH 134TH PLACE, AMENDING THE OFFICIAL
STREET MAP OF THE CITY, AND ESTABLISHING AN EFFECTIVE
0 DATE.
WHEREAS, pursuant to resolution, the City of Tukwila held a public
�j hearing on June 10, 1985 to consider the proposed vacation of certain pro
0 perty located in the City of Tukwila dedicated for street purposes, said
property being generally described as South 133rd Street lying easterly
of South 134th Place, and more particularly described on Exhibit A
attached hereto and incorporated herein by this reference as if set forth in
full, and
WHEREAS, after the conclusion of the public hearing the City Council
found that the said property should be vacated upon certain conditions, and
WHEREAS, the City intends to reserve an easement in the vacated pro-
perty for the construction, maintenance and repair of public utilities
located on the subject property, and
WHEREAS, pursuant to Section 11.60.050 of the Tukwila Municipal Code
the vacation shall not become effective until the owners of property
abutting upon the property vacated have compensated the City in an amount
not exceeding one -half of the appraised value of the area vacated.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. That certain property located in the City of Tukwila
generally described as South 133rd Street lying easterly of South 134th
Place, and more particularly described on Exhibit A attached hereto and
incorporated herein by this reference as if fully set forth, dedicated to
the City for street purposes, is hereby vacated, subject to the City of
Tukwila retaining an easement in the vacated property for the construc -tion,
repair and maintenance of public utilities, and further subject to the owners
of property abutting upon the property vacated compensation the City in the
sum of 14,000.00 which the City Council finds does not exceed one
half of the appraised value of the area vacated.
Section 2. The City Clerk is hereby directed to record a certified
copy of this ordinance with the King County Recorder.
Section 3. The City Public Works Director is hereby directed to
amend the official street map of the City to be consistent with this
ordinance. r'

PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, at a
regular meeting thereof this "5 day of 1985.
Section 4. This ordinance shall be in full force and effect five
(5) days after passage and publication as provided by law, provided, that the
vacation which is the subject of this ordinance shall not become effective
until the owners of the property abutting upon the property vacated shall have
paid to the City the compensation set forth in Section 1 of this ordinance.

SOUTH 133rd STREET VACATION
That portion of Tract 6, Fostoria Garden Tracts as recorded in
Volume 9 of Plats, page 95, Records of King County, Washington and in
the northeast one quarter of Section 15, T23N, R4E, W.M. described
as follows:
Beginning at the southeast corner of said Tract 6
in said Fostoria Garden Tracts; thence N40 °17'00 "E along the
southeasterly margin of said tract, 285.01 feet more or
less to the westerly right -of -way margin for Primary State
Highway No. 1; thence S88 °40'00 "W 7.13 feet to the TRUE POINT
OF BEGINNING; thence continuing S88 °40'00 "W, 200 feet more
or less to the State of Washington R -0 -W margin as recorded
under King County A. F. No. 5714393; then N01 °20'00 "W,
60 feet; thence N88 °40'00 "E, 200 feet more or less to the west-
erly state right -of -way margin; thence sourtheasterly along
said margin to the TRUE POINT OF BEGINNING.
Subject to perfecting continuing easements for existing utilities
i.e.: telephone, natural gas, electric power, water and cable.
