AN ORDINANCE OF THE CITY OF TUKWILA, WASHING- TON, AMENDING SECTIONS 14.04.240(c), 14.16.030(1) AND 14.16.065 OF THE TUKWILA MUNICIPAL CODE TO RAISE THE MAXIMUM LIMIT ON INCOME NECESSARY FOR SENIOR CITIZENS AND DISABLED PERSONS TO QUALIFY FOR REDUCED WATER AND SEWER RATES. WHEREAS, RCW 74.38.070 authorizes cities and towns to provide utility service to low income senior citizens at reduced rates, and WHEREAS, Article 8, Section 7 of the Washington State Constitution authorizes cities and towns to make provision for the necessary support of the poor and infirm, and WHEREAS, the City Council of the City of Tukwila finds that there has been a significant rise in the cost of living during the last few years which has adversely affected senior citizens and disabled persons who live on fixed incomes below certain levels, and WHEREAS, the City Council desires to provide for assis- tance to such eligible persons by reducing the rates charged for City water_ and sewer services, now, therefore, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. City Water Rates. Section 14.04.240(c) of the Tukwila Municipal Code is hereby amended to read as follows: to�,c rr�'s c Every person sixty -two years of age or older if married, then either spouse) and every person totally and permanently disabled residing in a separately metered dwelling and who is paying directly for such separately billed service either as owner, purchaser or renter and whose individual income if a single person, or whose combined income, if a married couple, from all sources is less than twelve thousand dollars per year, shall pay a rate equal to fifty percent of the regular water service charge for the first five hundred cubic feet of water used. For each one hundred cubic feet in excess of the five hundred cubic feet, the rate shall be fifty percent of the regular rate. Every such person shall file with the Finance Department their affidavit that he or she is qualified to be charged the special rate. Such affidavits are to contain information as 110 110 required by the Finance Director in order to establish eligibility. Each affidavit will also include an unqualified promise to inform the city of any changes in financial condition that would disqualify the person for the special rates. The Finance Director may require affidavits on an annual basis if deemed neces- sary. Section 2. Sewage Service Charges. Section 14.16.030(1) is hereby amended to read as follows: (1) Residential Sewage Service. Section 14.16.065 of the Tukwila Municipal Code is hereby amended to read as follows: 14.16.065 City Metro Rate. The City -Metro charges as provided for in Section 14.16.060 and as required by the Agreement for Sewage Disposal between c,d5 the Municipality of Metropolitan Seattle and the City of Tukwila is set at the sum of seven dollars and G /14 eighty cents per month per residential customer and per residential customer equivalents. Each affidavit will also include an unqualified promise to inform the City of any changes in financial condition that would dis- qualify the person for the special rate. The Finance Director may require affidavits on an annual basis if deemed necessary. Section 4. Effective Date.
