CALL TO ORDER: Committee Chair Hougardy called the meeting to order at 5:03 p.m.

II. BUSINESS AGENDA
A. Annlication of Utility Leak Adiustment Policy
As per section 4.9 of the City's Utility Leak Adjustment Policy, a property owner is requesting
administrative review by the Utilities Committee disputing a decision made regarding an adjustment for a
water leak on his property.
A water leak was discovered on the subject property in January 2009. The City Council approved a
Utility Leak Adjustment Policy in October 2009. Several months after the leak was identified, the
property owner was informed that the City was working on creating a formal policy regarding leaks and
subsequent adjustments. In November 2009, the property owner submitted a request for adjustment per
the policy. The request was denied because the owner was unable to provide proof of repair work through
repair bill or materials receipts (he completed the repair work himself), and the leak occurred prior to the
Council adopting the Utility Leak Adjustment Policy.
The Committee was asked to make administrative decisions on the four items listen below. The
Committee decision follows the inquiry.
Should a retroactive leak adjustment be made regarding the subject property? Committee
Decision: Yes, allow adjustment and credit to utility account as appropriate (2
committee members, yes; 1 committee member, no).
Should the Utility Leak Adjustment Policy be amended to accept a waiver and /or affidavit
for self repair work in lieu of repair bills or materials receipts? Committee Decision: Yes,
accept waiver and /or affidavit for self repair work as appropriate (2 committee
members, yes; 1 committee member, no).
Should this policy be applied retroactively to leaks that were identified prior to the policy
implementation date, and if yes, what should be the cut -off date? Committee Decision:
Yes, apply retroactively, through January 1, 2009.
Should a customer who is disputing a bill be required to continue paying disputed charges
until a written decision has been issued by the City? Committee Decision: Yes.

B. City Council Pre Retreat Budget Review
The Committee reviewed the 2009 -10 Biennial Budget pages as listed on the following page in
preparation of the upcoming Council Retreat.
