BACKGROUND RECOMMENDATION Information Only City of Tukwila INFORMATIONAL MEMORANDUM February 17, 2010 Aquatics Division Update Informational only Jim Haggerton, Mayor A presentation updating the Committee on the City of Tukwila Pool operations, user groups, and programs. Information and pictures of the special user groups, including kayaking, as requested by Councilmember Duffie at the January 25, 2010 Community Affairs and Parks Committee meeting, will be included in the presentation. CITY COUNCIL City of Tukwila BUDGET PROGRAM GOALS: FOURTH QUARTER REPORT TO COUNCIL October 1 December 31, 2009 Prepared for Community Parks Committee Jim Haggerton, Mayor 1. Seek out opportunities for Councilmembers to further their knowledae, experience and awareness of the different cultures represented within the Tukwila community: Assigned to Community Affairs Parks Committee for implementation and /or follow -up. No activity to report during fourth quarter. 2. Councilmembers continue to sponsor a monthly Coffee Chat in the Tukwila community. 3. Work together in cooperation with nearby cities to address common problems in the Hiahwav 99 corridor and Military Road: Assigned to Finance Safety Committee for implementation and /or follow -up. Mayors from Tukwila and SeaTac have been communicating regarding the possibility of a joint meeting between the two city councils. Due to an increased workload, Tukwila City Council was not able to commit to a specific meeting date during fourth quarter. 4. Provide leaislative support and encouraaement to Tukwila residents livina in rental communities through proarams that hold owners and /or property manaaers accountable for Drovidina safe places to live throuah the implementation of a rental licensina program: Assigned to Community Affairs Parks Committee for implementation and /or follow -up. Tukwila Councilmembers actively opposed HB 1296/SB 5495 which provided for limitations on rental housing inspections. Relative legislation was deferred this legislative session. Department of Community Development staff continues to move forward with developing a rental housing licensing program for Tukwila. 5. Approve and implement standard operating procedures for the Council. Review and update procedures on a reaular basis: Not currently assigned to a specific committee. Current workload assignments prevented the Legislative Analyst from further research and preparation of draft materials relative to Council standard operating procedures. 6. Support the implementation of City endorsed programs (i.e. Walk Roll Plan, Fire Master Plan. Parks, Recreation Open Space Plan) through policy related decisions not associated with direct program fundina: Assigned to Community Affairs Parks Committee for implementation and /or follow -up. DEPARTMENT OF COMMUNITY DEVELOPMENT 2009 YEAR END SUMMARY: Land Use Activity There were a total of 95 land use decisions issued. Of these 95 decisions, 84 were Administrative, three Board of Architectural Review, one Planning Commission, two Hearing Examiner decisions and five were legislative decisions (Comprehensive Plan Amendments, Rezones and Housekeeping Code Amendments). In addition to these five legislative decisions there was other long range planning review done by the Planning Commission including review of the Shoreline Master Program Update, Tukwila Urban Center Plan, and Sign Code Update. The land use applications ranged from 17 SEPA decisions, 8 Boundary Line Adjustments, 5 Shoreline Substantial Development Permits, 7 Short Plats, 3 Design Reviews, 6 Tree Permits, 2 Comprehensive Plan Amendments,2 Rezones, one preliminary approval for a townhouse Subdivision, 2 Variances, one Code Amendment, 6 Wireless Facility Permits, 12 Special Permissions for deviation from code for sensitive areas /signs, 23 Administrative Letters regarding Shoreline Exemption, Zoning letters or Noise Variances. Crisis Diversion Significant staff time has been spent researching the County's proposal to locate a Crisis Diversion Facility within the City. This was not something that was anticipated in DCD's work plan. In September, the Council adopted a six month moratorium on the placement of Crisis Facilities. Staff has conducted hours of research and has had several meetings with King County Staff. Additionally, DCD staff has been working with the City Attorney's Office to respond to a Growth Management Petition that was filed with the Central Washington Growth Management Hearing's Board. Stream Team DCD staff has received a grant from King County to educate residential property owners on how to maintain wetlands and streams on their properties. This is the first official program of the Stream Team which is a joint program between DCD and Public Works. Staff anticipates providing info to the Council on the program early next year. 2009 Fourth Quarter Report Prepared for Community Parks Committee Page 3 Rainbow Trailer Haven In May of 2009, an inspector identified numerous alterations to the existing trailers in the park. A subsequent inspection indicated hazardous electrical service wiring, leaking and unsecured propane tanks, open electrical service panels, lack of minimum fire separation between units, and lack of fire lane access due to parked vehicles. All 40 of the trailer units had violations relating to life safety concerns that would lead to condemnation and removal of illegal additions and some of the trailers. The City could not simply ignore the conditions of the park even if forcing compliance made the residents homeless. In view of this consequence, Staff developed alternatives that would eliminate the life safety violations and coordinated efforts of outside agencies that offered technical and material resources for the park residents. As of 12/29/2009, eighteen of the units have received final inspection approval. All forty of the units now have new electrical service pedestal connections and the leaking propane tanks have been repaired and secured against overturning. The remainder of the units are near compliance and are expected to complete work within the next two weeks. Staff will be continuing the final inspection process until each Notice Orders has been resolved. Howard Hansen Dam In the last quarter of 2009, DCD staff members were tasked with developing a Flood Coop Plan and a Flood Response Plan. Emergency Management Planning was coordinated at Fire Station 51 with representatives from all departments participating in a team effort to develop a city wide response plan. Recovery planning will continue in the first quarter of 2010 as well as, the final draft of the Continuity of Operations Plan (COOP). World Wide Video A business license denial appeal hearing was held in October 2009, with the Hearing Examiner finding in favor of the City's denial of the business license due to ongoing and unresolved building and electrical code violations. In December, the City appeared in Superior Court requesting a Summary Judgment Order of Abatement against the property owner. The judge requested that the parties meet to come to an agreement on the outstanding issues and a timeline for completion. The parties will be meeting on Monday, January 4 at the property to review all outstanding violations. Code Enforcement Activities Courtesy letters: Issued between fifty and one hundred letters to homeowners giving advance warning of violations before issuing formal notices. A majority of violations are resolved as the result of the courtesy notification. Working with Allied Waste to clean up major dump sites within the City. Five sites have been identified. To date, three have been cleaned up. Pro active Code Enforcement for certain violations: Debris accumulation, junk vehicles, and weeds. Provided 20 free dump passes or dumpsters to low income residents. Used volunteers to clean up properties and locations. Volunteer groups include Church of Tukwila, Tukwila Court jail alternative program, and Day of Service (an annual event). Authored five articles for Hazelnut and the City's website. Opened a total of 492 cases. Achieved compliance and closed 309 cases. Participated in the outreach program for flood notification to the Duwamish, Foster Point, and Allentown communities. Issuance and coordination of 40 Notice Orders issued to the residents of Rainbow Trailer Haven for illegal construction. This activity is Ongoing. Worked on the flood aftermath response planning. 2009 Fourth Quarter Report Prepared for Community Parks Committee Page 4 Tukwila Pond Wetland Buffer Enhancement Project Work was largely concluded in November under the King County Waterworks Grant (received in 2008) for enhancement of the wetland buffer adjacent to the recently restored wetland on the southeast side of the pond, bordering Andover Park West. The project, carried out by volunteers and DCD, Parks and Recreation and Public Works staff included blackberry control, planting of over 1100 native trees, shrubs and groundcover, placement of donated logs as habitat features, and creation of an informal woodland trail and a graveled overlook to the wetland. Volunteers contributed nearly 652 hours of labor at 11 work parties from the fall of 2008 through the fall of 2009. Staff in -kind labor contribution was valued at over $27,000.00. An interpretive sign and trail marker signs will be installed in the near future. 4th QUARTER SIGNIFICANT ISSUES: Land Use Activity There were 24 land use decisions issued, the applications ranged from two Design Review applications, one Preliminary approval for a townhouse subdivision, two Comprehensive Plan Amendments, two Rezones, one Code Amendment, two Boundary Line Adjustment, four SEPA decisions, three Special Permissions for deviations from code for sensitive areas /signs, one Tree Permit, and six Administrative Letters regarding Shoreline Exemption, Zoning letters or Noise Variances. BUDGET PROGRAM GOALS: Planning 1. Adopt Shoreline Master Program Update. The City Council Committee held a total of ten work sessions to review SMP issue areas with four during the 4 quarter. In addition, the ordinances implementing the new SMP were reviewed at three Council meetings with final action to adopt on 12/14/09. The adopted SMP will be sent to the Department of Ecology for their review and public hearing. 2. Adopt Tukwila Urban Center Plan and Planned Action. The Planning Commission (PC) sent the draft plan back to staff to revise in response to the public comments. An economic consulting company was hired to test the market feasibility of the proposed development regulations and held three focus groups to gather market data. The consultants presented their findings to the PC in December. Staff will revise the plan based on the results of this study and additional public involvement and bring it back to the PC for another public hearing in 2010. 3. Adopt new Sion Code. The PC began review of the Sign Code Advisory Committee recommendations, holding work sessions and a public hearing. DCD and City Attorney staff is currently working on a draft code for Planning Commission review in the first quarter of 2010. 4. Begin Comprehensive Plan Review (2010/2011 Adootion Taraet). Staff continued work with other departments to coordinate review of existing policies. Staff prepared and submitted GMA Update Grant application to Washington Department of Commerce to support staff work for the required Comprehensive Plan update. We have subsequently learned that the grant funds will be removed from the Governor's supplemental budget and are not available. Legislation extending the update deadline will be introduced to the state legislature. MIC /Planned Action Update: No activity this quarter. Climate Chance Response: We have received grants for energy retrofits for City Hall. The City has committed to reducing CO2 emissions by 50 percent by 2020. The City has received a grant in the amount of $125,000 for energy upgrades to City Hall, 6300 Building, the parking lot lights at Starfire, and the parking lot lights at the Community Center. It is anticipated that the lighting upgrades will reduce CO2 emissions from City operations by 5 percent. Additionally, the City will realize immediate cost savings by using less electricity. City Council will be briefed early next year on the grant, and to authorize the City to accept it. PAA clean -uo: Staff met with the City Attorney to discuss zoning for Orillia Road annexation. Housina /Jobs target review: Completed in third quarter. 5. Comprehensive Plan Annual Amendments,: City Council held a hearing and adopted two amendments, including: 1) designation change /rezone from Medium Density to High Density Residential on .75 acres at 3241 S. 144 and 2) Urban Renewal Overlay District with supplemental 2009 Fourth Quarter Report Prepared for Community Parks Committee Page 5 development regulations to encourage mixed -use development on 7 acres along Tukwila International Boulevard. 6. Recycling Proaram: Staff submitted grant applications for program funding in 2010 -2011. Continued upgrades to recycling programs for Tukwila businesses. Selected "Business Recycler of the Year." 7. Review Small Lot Residential Development Policies and Standards. No activity this quarter. 8. Complete Tukwila South Master Plan and Annexation. City Council approved Tukwila South Master Plan and the annexation occurred on December 31, 2009. 9. Complete TIB Revitalization Plan Update with Transit Oriented Develooment. No activity this quarter. Code Enforcement 1. Increase Community Outreach Programs. a. Assisted with flood preparedness by photographing every home in the Foster Point neighborhood and personally delivering meeting notices and other information to the affected residents. b. Participated in the Crime Hot Spots Task Force. c. Provided cleanup sites for the Court's alternative service program for people performing service in lieu of jail time. d. Provided information to landlords during a Crime -Free Housing training. 2. Rental Housing Licensina and Inspection Kathy Stetson presented an overview and update of the Rental Housing Licensing and Inspection program to the Community Affairs and Parks Committee in December. The Committee indicated their support of the proposal and encouraged staff to proceed with development of a draft ordinance. Staff will be forming a Stakeholder Advisory Committee consisting of interested Tukwila tenants, landlords, and other citizens to discuss the issues and concerns regarding this program. We hope to start the stakeholder process in January or February 2010, with the goal of presenting a draft ordinance to the Council in third quarter 2010. Kathy is also working with AWC and representatives from the Cities of Auburn, Everett, Seattle, Pasco, as well as tenant organizations (Solid Ground, Columbia Legal Services) on a proposed bill being brought forward by the landlord associations, which would regulate and limit rental licensing and inspection programs statewide. At the request of State Senator Hobbs, we have met with landlord representatives in an attempt to find common ground. Meetings are continuing in January. 3. Noise Ordinance Update Kathy Stetson and Stacy MacGregor presented an overview and update of the proposed changes to the Noise ordinance. The changes include clarifying the variance procedures and a redefinition of the method used to measure and verify public disturbance noises. The Committee indicated their support of the proposed language and encouraged staff to proceed with development of a draft ordinance. Staff anticipates having a draft ordinance for consideration in first or second quarter 2010. Permit Coordination and Building 1. Adopt the 2008 National Electrical Code and related WAC rules,: Adopted the 2008 Washington Cities Electrical Code. This code includes the provisions of the 2008 National Electrical Code and amended WAC rules. 2. Adopt the 2009 State Building Codes and consolidate the administrative provisions for Title 16 of the TMC including permit fee schedules: State amendments to this code have not been published as of this writing. No activity this quarter. 3. Develop a trackina and notification system for Backflow test reports: Completed 3 quarter. 4. Develop a combination permit for Single Family Residential construction: Completed 3 quarter. 5. Provide code update trainina for all Building Division staff members related to the adoption of the 2009 State Building Code: Two building inspectors attended training on the 2009 International Building Code. The focus was related to the significant changes to the IBC international codes. Building Division Staff will be attending WABO Annual Education Institute in Tukwila scheduled for March of 2010. Planning Commission 1. Review Sian Code Update: PC review of the sign code has continued with a series of work sessions. A draft code will be presented for a hearing in the first quarter of 2010. 2009 Fourth Quarter Report Prepared for Community Parks Committee Page 6 2. Review Tukwila Urban Center Plan: Staff will return with a second draft of the plan in 2010 based on the market feasibility analysis and additional stakeholder input. 3. Review Small Lot Residential Development Policies and Standards: Action on this item has been delayed due to other priorities. 4. Comprehensive Plan Update: No activity this quarter. PARKS AND RECREATION DEPARTMENT 2009 YEAR END SUMMARY: The Parks and Recreation Department continued to offer a variety of recreational and leisure opportunities to residents and visitors throughout 2009. The department hosted many citywide special events including the annual Backyard Wildlife Festival, Tukwila Days Community Festival, and Winterfest event, to name a few. The Tukwila Community Center continued to be a focal point for residents by providing a wide range of activities, programs, and wellness opportunities. Additionally, the Center continued to be a location for businesses to host meetings as well as an attractive location for family events such as reunions and weddings. Two park development projects will result in the opening of Duwamish Riverbend Hill Park and Codiga Park in 2010. Several volunteer work parties were held at each location throughout 2009 which resulted in thousands of hours volunteerism. The golf course continued to improve by rebuilding tee number nine and adding new sprinkler heads throughout the course. The Clubhouse welcomed Billy Baroo's as the new restaurateur in June; the restaurant continues to attract new patrons. The department is very proud of all its accomplishments throughout 2009. 4th QUARTER SIGNIFICANT ISSUES: The fourth quarter was busy for the Parks and Recreation Department. Codiga Park construction started during the 3 quarter and has been an exciting project to see develop throughout the 4 quarter. The park is nearly complete and soon families, fishermen and naturalists will be enjoying the many amenities of the park. The park also provides a beautiful visual entrance into the City. Several events were held including the Adopt -a- Family program, which was restructured to serve more families; the result provided nearly 50 families (versus 30) with gifts, clothing, and gift certificates (to grocery stores). Seniors continued to be active throughout the fall /winter with volleyball, hiking and several day trips throughout the region. Youth after school programs have been restructured to offer more specialized activities and options for participants, the result has been overwhelmingly positive. Foster Golf Links has endured the ups and downs of the northwest weather. Overall, the year ended with play numbers similar to last year. Billy Baroo's continues to gain momentum and the addition of a new partner during the 4th quarter has been positive for business. Live jazz nights, new menu items and consistent business hours have been wonderful improvements. Administration 1. Construct Phase I of Duwamish Riverbend Hill and open the park for public access. In Progress 2. Design Phase II of Duwamish Riverbend Hill and continue grant funding efforts. In Progress 3. Apply for grants to acquire open space for future conservation and park areas as determined by the department's Parks, Recreations and Open Space Plan. Ongoing 4. Extend a long term land lease at Tukwila Swimming Pool with the Tukwila School District. In Progress 5. Design regional trail connections that include new routes from the 154th Street Sound Transit Station to the Green River Trail. Ongoing, trail study and preliminary engineering design from the Tukwila Community Center to the SeaTac Community Center is complete. 6. Redesign and construct Phase II of Codiga Farm Park to include trail system, interpretive markers, picnic area, hand boat launch and parking area. Ongoing 7. Design and construct a passive neighborhood park with the recent purchase of the 57th Avenue Park expansion. Incorporate the TCC Spray Park into the Summer Plavaround Proaram: Postponed due to 2009 budget reductions. Program was limited to one site this year. 3. Offer marathon trainina activities /classes: Complete. Workshop being offered in Winter 2010. 4. Develop a Medical Alert Coalition to assist Tukwila Seniors in notifvina EMS of medical conditions in case of emeraencv: Ongoing. Staff are exploring options to meet the goal in 2010. 5. Increase structured proarammina in After School Proaram by implementina proaram specific classes (i.e. science. cookina. athletics. etc.) and allow flexibility of reaistration for these proarams: Complete. Program has been restructured and changes have been implemented. 6. Develop a designated area for teens at the Community Center for activities classes, homework, etc: Ongoing. Staff is working on plan to accomplish this goal. 7. Increase Pre school proaram by addina evenina activities for workina families: Postponed. Funding for this goal was not approved in the budget. 8. Investiaate pricina structure for rentals to better utilize available rental space during slower times of the year: Complete. We offered special holiday rates in 2009. 9. Add one additional youth sports leaaue. i.e.: T -ball, airls' fast pitch. summer basketball. flaa football, etc: In progress due to 2009 budget reductions. 10. Increase participation and activities with the Teen Council Program by implementina new activities once a month: Complete. Staff meet monthly with a group of teens to focus on college preparation, community service, and mentoring. 11. Develop an 8 team Co -Ed Senior Softball Tournament: Postponed due to scheduling. 12. Plan a number of events on Thursdays before and after lunch to increase the daily numbers by 15% to the Senior Lunch Proaram. includina new entertainment during the lunch hour: In progress. Staff is planning Thursday activities to increase this number. 13. Provide leadership and staff support for 2009 Tukwila Centennial events: Complete. 14. Increase weekday (Monday throuah Thursday) rentals at the TCC by 10 Ongoing. Staff are monitoring and providing opportunities for this to occur (for example, more flexibility on reservation deadlines). Aquatics 1. Increase Aquatic Program Fee revenue by 10% each year: Ongoing Revenue is up 13% as of the end of August. 2. Obtain a long term lease agreement with the Tukwila School District that allows for continued aquatic services in Tukwila: Ongoing Attorneys are reviewing information to deliver an estimate for lease extension or purchase. 3. Produce a feasibility study for a remodel /expansion of the Tukwila City Pool: Ongoing. 4. Offer CPR classes or challenges to the community and /or City of Tukwila personnel at least once per quarter: Ongoing 5. Offer Lifeguard Training classes or challenges at least once per quarter to the community and beyond to help keep up optimum part -time staff levels at the Tukwila City Pool: Ongoing 6. Offer after school Special Olympics Swim Team program for Tukwila and other local area School District students in the spring: Complete Special Olympics athletes won nine gold, twelve silver and three bronze medals at the State Championship Games in May. This year's team included 15 athletes. 7. Continue to work with the Tukwila Community Center in marketing and making pool time available for TCC's special events and camps: Ongoing Parks Maintenance 1. Assimilate new parks into the Parks Division (Codiga Farm Park, Macadam Winter Garden, 57th Avenue Park expansion, Duwamish Riverbend Hill) and develop maintenance plans for each: Ongoing 2. Provide assistance to Recreation Division for City -wide events: Ongoing, parks crews have assisted with several special events and volunteer work parties including Tukwila Pond buffer, Backyard Wildlife Fair, Showalter student work day and Family Forth at the Fort. 5. I anticipate having a draft agenda to the Council sometime during the last week of January/first week of February, and that the majority of the Retreat will focus on discussion of the budget. Per Council discussion at the January 11 COW, Council Committees will conduct detailed review of the 2009 -10 Biennial Budget document in preparation for the 2010 Annual Council Retreat. Council Committees have each been assigned portions of the budget to review over the course of three consecutive meetings. The review schedule for the Community Affairs Parks Committee is included at the end of this memo. The Committee can choose to move at a faster pace, if desired by its members. The Committee review process, as discussed at the January 11 COW, is outlined below. It is intended to assist the full Council in considering potential program alternatives, expense /capital reductions and /or new revenue opportunities in response to the severity of the City's budget crisis. Committee Review Process Utilizing the 2009 -10 Biennial Budget document, review the pages assigned to the Committee as outlined below. Committee member review, understanding and familiarity of the assigned budget items should be thorough enough that the three Committee members feel comfortable serving as the Council experts for discussion of the appropriate items during the Retreat. As mentioned above, it is the intent of the Committee review process to prepare Committee members with adequate knowledge of assigned sections so that they can assist the rest of the Council in a meaningful discussion of the items at the Retreat. Department directors and managers will be available during Committee meetings, as a resource, to answer questions regarding budget items. Discussions at the Committee meetings should be a Committee -led process, not staff -led. Specifics on budget items, as discussed in the Committee, will not be documented in the Committee minutes. Each Committee member should keep ample individual notes that will aid you in discussing items at the Retreat. Committees are not being asked to make any recommendations regarding the budget during the Committee meetings. Since the strength of the Council is the experience and knowledge of all seven Councilmembers, policy -level discussions regarding budget issues are best addressed with the full Council and Mayor working together.
