HomeMy WebLinkAbout1916-05-02 Special MinutesSpecial Meeting May 2, 1916 The 9th Council of the Town of Tukwila met in Special Session at the call of the Mayor for the purpose of reconsidering the ordinance passed at the adjourned session April 18th granting the Puget Sound Traction Light a franchise to perate a lighting system within the limits of the Town. Following answered the roll call Mayor Stevens councilmembers Kassner Klein Hemmick Erickson. Mayor Stevens stated that he had presented the ordinance to Sales Manager Gillies of the Electric Company and that he readily agreed to accept the amendment that the franchise was not to be considered exclusive and also the amendment providing that the Electric Company be required to move their poles at their own expense at any time where a sidewalk was to be widened. Manager Gillies said that his company could not agree to the their amendment providing a rate similar to Kent and pointed out the fact that under the laws of the Public Service commission a public utilities corporation cannot enter into a joint contract to specify a certain rate and to do so would make the entire franchise void. No municipal corporation can delegate to itself the right to pass laws which would be in direct conflict with the pwoers given the Public Service Commission. This body alone has the authority to make a certain schedule of rates with any public utilities corporaiton. After a full discussion of the subject a motion was made by Councilmember Klein seconded by Councilmember Hemmick that the section in regards to the joint rate be eliminated from the ordinance and taht the new ordinance then be read for the first time by the Clerk to take the usual course and be brought up for final disposition at the next regular meeting. On roll call the motion was unanimously passed by the following affirmative vote Councilmembers Kassner Klein Hemmick Erickson. Mayor Stevens was authorized to secure the necessary copies of the new ordinance for the next meeting. councilmember designated the places where the 25 electric street lights are to be installed and instructed the Mayor to notify the officials of the Puget Sound Light of the arrangement and to request that the locations named be a aprt of the lighting contract to be entered into between the company and the Town of Tukwila. There being no further business the meeting adjourned to meet in regular session on May 9, 1916. Joseph Hozack Clerk
