CALL TO ORDER Council President Phelps called the Committee of the Whole to
order.

Continued from Regular Meeting
Brad Collins, Planning Director, explained that the City
Attorney reviewed the model ordinance from D.O.E. and made
recommendations on revisions. There were three types of
regulations to be used: (1) Exclusive (City cannot change
language); (2) Mandatory (City could add to the language but
could not negate the intent of the regulation); (3) Options
for City to exercise choice. It is desireable to adopt the
ordinance by October 1, 1984. There is some concern that the
community has not had enough time to review the changes. The
ordinance can be revised after adoption if necessary.
Jim Haney, City Attorney, said that the proposed ordinance
meets the particular needs of the City. It will give the
City the maximum flexibility in dealing with environmental
issues covered under the new regulations.
Cris Crumbaugh, audience, said they would like to have a copy
of the document that shows the changes made in the current
ordinance.
Discussion was held on the significant decisions that need to
be made.
Decision 1: What policies (Ordinance, plans, regulations,
codes, etc.) should the City adopt as the basis for imposing
or denying projects under SEPA?
MOVED BY BOHRER, SECONDED BY PHELPS, THAT COUNCIL CONCUR WITH
THE STAFF'S RECOMMENDATION ON SIGNIFICANT DECISION #1. ALL
OPERATING DOCUMENTS RELATIVE TO SEPA BE REFERENCED AS
OPERATING DOCUMENTS FOR CONDITIONING PROJECTS. MOTION
CARRIED.
Decision 2: Should administrative appeals of threshold
determination and /or adequacy of final EIS's be permitted?
City Attorney recommends that there be an administrative
appeal process. The appeal must be in writing, made within
10 to 14 days from the SEPA's responsible officials decision,
and that the matter be appealed by filing with the Planning
Director or the City Clerk, then transferred to Council for a
hearing date.
City Attorney and Planning Director will come back to the
next meeting with the new language on the appeal process,
consistent with other ordinances. The intent is to have a
broad base to the appeals process.
Decision 3: Should the City retain the existing environmen-
tally sensitive area designation in the comprehensive plan
for exclusion under the new SEPA rules from categorical
exemptions?
Brad Collins recommended reference to the Comprehensive Land
Use Policy Plan Map as it designates the location of environ-
mentally sensitive areas within the City and add "as special
development consideration areas."

Council Member Morgan said that staff is responsible to note
the fact that there are somethings on the map that need
updating and they should be prioritized on a work plan.
MOVED BY MORGAN, SECONDED BY BAUCH, THAT COUNCIL ACCEPT THE
COMPREHENSIVE LAND USE POLICY PLAN MAP AS THE BASIS FOR
DESIGNATING ENVIRONMENTALLY SENSITIVE AREAS. (Staff will
recommend the items to not be exempted). MOTION CARRIED.
Decision 4 Should the levels of categorical exemptions be
raised?
Planning Department will bring back further information.
Decision 5 What public notice should be given per the new
SEPA rules?
Brad Collins recommended notification of property owners of
record of those properties within 300' of the subject pro-
perty for site specific proposals; posting the property, for
site specific proposals; publishing notice in a newspaper of
general circulation in the county, city or general area where
the proposal is located; notifying public or private groups
or individuals which have requested in writing notification
for a certain proposal being considered.
MOVED BY MORGAN, SECONDED BY HARRIS, THAT COUNCIL CONCUR WITH
RECOMMENDATION OF THE PLANNING DIRECTOR. MOTION CARRIED.
Fees are not required for processing a threshold deter-
mination or processing an Environmental Impact Statement, but
the attorney recommended that fees be charged.
MOVED BY HARRIS, SECONDED BY MORGAN, THAT THE MEETING
ADJOURN. MOTION CARRIED.
