CALL TO ORDER/PLEDGE OF ALLEGIANCE /ROLL CALL
Mayor Haggerton called the Regular Meeting of the Tukwila City Council to order at 7:02 p.m. and led the
audience in the Pledge of Allegiance.
ROLL CALL
Christy O'Flaherty, City Clerk, called the roll of the Council. Present were Councilmembers Joe Duffie,
Joan Hernandez, Dennis Robertson, Allan Ekberg, Verna Seal, Kathy Hougardy, and De'Sean Quinn.

MINUTES
a. Introduction of Chris Daugherty, new Police Officer
Regular Meeting
March 1, 2010- 7:00 P.M.
Don Lincoln, Assistant Police Chief, introduced Chris Daugherty, the City's newest Police Officer. Officer
Daugherty was previously employed by Tukwila as an officer and has also worked in law enforcement for
the Cities of Duvall and Enumclaw. He has also spent time in Iraq as a police advisor and is a member of
the United States Coast Guard.
Mayor Haggerton administered the Oath of Office to Officer Daugherty, Badge #187.
The Councilmembers welcomed Officer Daugherty to the City.
b. State of the Municipal Court Kimberly Walden, Municipal Court Judge
Kimberly Walden, Municipal Court Judge, provided an overview of activity in the court for 2009. Some of
the statistics for 2009 are as follows:
Criminal Case Filings 2,318
Civil Case Filings 3,343
Hearings Conducted 13,359
Jury Trials Set 287
Non Jury Trials 14
Defendants on Probation 150
Judge Walden also provided a summary of programs the Court has initiated that not only save money,
but help to deter illegal activity:
Consumer Awareness Class: This class, which is ordered by the court for defendants who have theft
charges, provides instruction regarding exercising better judgment. There were 121 participants in 2009,
and of those participants only three have committed new theft offenses since completing the class.
Judge Walden estimates that if 60 of the participants had not attended as ordered by the court, the cost of

one day in jail would have been $20,168. The participants in the class paid fees equaling $3,119, and the
net cost to the City was $443.
Jail Alternatives Program:
Savings from the Secure Continuous Remote Alcohol Monitor (SCRAM) program $386,152
Savings from Pre -Trial Home Monitoring $2,710
Savings from Day Reporting $40,340
Savings from Community Work and Elective Day Reporting $10,504
Total Jail Savings $439,705
Court Accomplishments for 2009 involve community outreach efforts to include members of the court
staff helping in Tukwila schools; students coming to court for mock trials; Police Citizen Academy; and
Court Twitter and Facebook pages.
Goals for 2010 involve ongoing efforts toward a paperless court to include E- tickets, online forms and
forms in multiple languages.
The judge credited Trish Kinlow, Court Administrator, and the entire Court team for the successful
implementation of programs in the Court.
The Mayor and City Councilmembers thanked Judge Walden and the entire court staff for the innovative
and effective problem solving efforts they provide for issues involving the court.
PROCLAMATIONS /APPOINTMENTS
A proclamation supporting the goals and ideals of the 2010 U.S. Census
Mayor Haggerton welcomed Mr. Ahmed A. 0 Scego from the United States Census Bureau and asked
him to introduce Census Bureau staff and community partners in the audience. Mr. Scego recognized the
following individuals: Abdirahim Mohamed, Deeqa Ibrahim, Dmitry Kvasnyuk, David Yoon Lee, Eric Lim,
Ogbamicael (Michael) G. Goitaom, Pricilla Mekam, Sylvia Van dorn, and Ahmed Jama.
Mr. Scego explained that every 10 years, a snapshot is taken of our country by conducting a national
census. A great deal of outreach is undertaken to involve all individuals, particularly those who have fled
other countries and may be distrustful of government. He conveyed the importance of all people
participating in the census, as there is more than $400 billion per year in federal and state funding
allocated to cities and states based on census data. The revenues go toward roads, hospitals,
transportation, schools, and programs for children and seniors. The form takes 10 minutes to complete
and has only 10 questions, and the information is confidential. Mr. Scego then displayed a short video
regarding the U.S. Census.
Councilmember Hernandez thanked Mr. Scego for the recent open house event and for attending the
City's Equity and Diversity Committee meeting. She asked if there was anything more the Committee
members could do to help.
Mr. Scego indicated the City has done a superb job of spreading the word through the media.
Mayor Haggerton indicated he wrote a letter regarding the 2010 Census that has been distributed and
printed by the Federal Way News.
Mayor Haggerton then read a proclamation declaring that Tukwila is committed to partnering with the U.S.
Census Bureau to help ensure a full and accurate count in 2010. In part, the proclamation reads that the
City of Tukwila will support the goals and ideals of the 2010 Census; encourage people in our community
to place an emphasis on the 2010 Census; and create or seek opportunities to collaborate with other like
minded groups by participating in Complete Count Committees.
The Mayor and Councilmembers thanked Mr. Scego and members of the census team for their important
work on this project.

CITIZEN COMMENTS
Jackie Sample, Cottage Creek Condominiums in Tukwila, inquired as to when garbage rates went up or
were renegotiated.
Mayor Haggerton asked Ms. Sample to provide her phone number to the City Clerk, and she would be
contacted with an answer to her question.
Additionally, Ms. Sample asked if the Coffee Chats were still occurring. It was conveyed that the next
Council Coffee Chat is on March 13, 2010, and they will continue on the 2nd Saturday of each month.
Ms. Sample requested the Council allocate more funding to the Police Department to ticket jay walkers
around major transit hubs. She referenced the area near J.C. Penney and the Light Rail Station. She
indicated that people dash out across Southcenter Boulevard, and she is concerned that someone will get
hit.
CONSENT AGENDA
a. Approval of Minutes: 2/16/10 (Regular)
b. Approval of Vouchers #351823 352048 and #201003011 201003012 in the amount of $991,186.81
c. Accept as complete the Macadam Road Bridge Soffit Repairs project with Nordic Construction, Inc.
(Contract 09 -159); authorize release of retainage, subject to the standard claim and lien release
procedures (final cost of project, including retainage: $39,098.00).

BID AWARD
Authorize the Mayor to sign a contract with Terra Dynamics, Inc. for the Duwamish Riverbend Hill
project in the amount of $146,182.50.
MOVED BY DUFFIE, SECONDED BY ROBERTSON TO AUTHORIZE THE MAYOR TO SIGN A
CONTRACT WITH TERRA DYNAMICS, INC. FOR THE DUWAMISH RIVERBEND HILL PROJECT IN
THE AMOUNT OF $146,182.50.*
Councilmember Robertson inquired as to the dollar impact to the General Fund for this project.
Rick Still, Interim Parks and Recreation Director, explained that if the full 20% contingency amount is
utilized, the impact to the General Fund would be approximately $23,000.

PUBLIC HEARING
An ordinance renewing a moratorium on the acceptance of applications and /or processing of
applications relating to diversion facilities and diversion interim service facilities for the treatment
of mentally ill and chemically- dependent adults in crisis, repealing Ordinance No. 2248.
7:56 p.m. Mayor Haggerton opened the public hearing and asked for a staff report.
Brandon Miles, Senior Planner, provided an overview of this issue. On September 8, 2009 the Council
passed an ordinance establishing a six -month moratorium on the receipt and processing of building
permit applications, land use applications and any other permit applications for diversion facilities and
diversion interim service facilities. On November 2, 2009, the Council conducted a public hearing and
adopted findings and conclusions to support the moratorium. The moratorium will expire on March 8,
2010.

Staff is currently working on proposed development regulations and referred the siting issue to the
Planning Commission to be discussed at their February 25, 2010 meeting. Additional time is needed for
the City Council to be briefed on the Planning Commission's recommendation. Additionally, modification
of the Zoning Code with regard to crisis diversion facilities requires notification to the Department of
Commerce. The standard review period for the Department of Commerce is 60 days, and while the City
has requested an expedited review period, no information has been received as to the status of that
request.
The Council is being asked to adopt an ordinance extending the moratorium for 90 days to June 1, 2010
to allow adequate time to review the work of the Planning Commission and await the findings by the
Department of Commerce.
Mayor Haggerton called for citizen comments.
No citizen comments were received.

A resolution setting Green Fees for the City's Foster Golf Links.

Councilmember Hernandez indicated she supports having more time to review the Planning Commission
recommendations.
Council President Robertson expressed that the staff and Planning Commission are moving as quickly as
possible regarding this issue.

REPORTS
a. Mayor
Mayor Haggerton attended the Tukwila School Board meeting on February 23, 2010 to honor Ron Lamb
and the Technology Committee with regard to passage of the recent technology levy. On February 24,
2010, the Mayor attended the Cascade Water Alliance meeting in Bellevue where officers were chosen.
Mayor Haggerton will continue as the Secretary- Treasurer for the Cascade Water Alliance for 2010. The
Mayor attended a ribbon cutting event at the Mitel Solution Center on Interurban Avenue on February 25,
2010, and he also participated in the Council Retreat February 27 -28, 2010. The Mayor reported that
Sully Sullenberger will be speaking at the Museum of Flight on March 8, 2010 at 7:00 p.m.
b. City Council
Councilmember Duffie thanked the staff, the Council, and the Council Analyst for the work put forth at the
Council Retreat.
Councilmember Hernandez referenced the recent Council Retreat as being a workshop on the budget,
where there was a great deal of discussion, and no decisions were made.
Council President Robertson reported that the City of Normandy Park uses the Mitel system, and it has
impressive capabilities. Mr. Robertson also attended the recent 20 anniversary celebration for the City
of SeaTac.
Councilmember Ekberg attended the Tukwila School Board meeting on February 23, 2010 and
referenced the significance of the passage of the technology levy. He also attended the Council Retreat
on February 26, 27, and 28, 2010.
Councilmember Seal thanked the staff, Council Analyst and Council President for the excellent Council
Retreat.
Councilmember Hougardy referenced the benefits the technology levy will have on her school age
children.
Councilmember Quinn also attended the Council Retreat and thanked the Council President for filling in
for him at the Transportation Committee meeting.

MISCELLANEOUS
Councilmember Hernandez referenced an invitation from former Councilmember Clarence Moriwaki to
attend an event on March 4, 2010 from 6:30 -8:00 p.m. MOHAI (2700 24 Ave. E., Seattle) will present a
free evening program focusing on the Japanese American internment during World War II.
Ms. Hernandez also mentioned a recent news article regarding Sound Transit taking steps to reduce
noise on the light rail system that may address the concerns of Tukwila residents.
Council President Robertson requested there be a report from staff on the status of noise issues
regarding Sound Transit. Councilmember Ekberg concurred and is also interested in an update regarding
the installation of sound barriers.
