Gentlemen:
The Federal za dNJ'ubs� Aces L abeling Act, administered by
the Food and Drug Admini rati h been in effect since February 1, 1962.
The requirements of this 1 haven sent .to you from *me to time describing
how this act requires that a ' pzardous substance" distrititted in containers
that are carried to the household are to be labeled with the ��p riate
` information and warning statements to protect the user.
Recently, the inspectors from the Department oalth, on,
and Welfare, Food and Drug Administration visited nume us SIjgJl refs
service stations to determine whether or not the se ce stat.on ope tors
were complying with the requirements of the act whe .selling hazar� us prod cts
in containers suitable for household use. We have be inf X d that these
results were very disappointing. Ninety -one service st do various parts
of the were
were investigated by these inspecl I on dine caAies did
they find . 'that the complete warning labeling was p ied. hey also" found
that in four cases partial warning labels were appli t in 78 .cases n
warning" labels_a a] 1 � g ,scd, Q so, these , inspect de, mined...t i
10 of these 78 cases, stick -on labels were available terv� ce n,
at the time of the sale but were not applied by the ope or. \
We are enclosing a booklet which explains in,:rion- technical language
the requirements of this'act with respect to the labeling of petroleum
dispensed by service station operators. You may have already received one of
these booklets. However, we .suggest that you familiarize yourself/and your
help with this booklet to help further.v'iolations and u5ge that you
take whatever steps are necessary,. to assure compliance with the provisions of
this act.
Also, we would like to advi6we you that the "Avery Label Company"
labels are still available should you wish to p�trcha�e such labels.
