HomeMy WebLinkAbout10-071 - Highline School District & Explorer Posts - 2010 Fire Services Training Summer Program 10 -071 Council Approval N/A 1 Fire Services Training Summer Program 2 AGREEMENT 3 2010 4 5 6 This Agreement is made in duplicate originals, by and between Highline School District/Puget Sound Skills Center, 7 hereafter referred to as PSSC, and SeaTac Fire Explorer Post #24 and Tukwila Fire Explorer Post #51 hereafter 8 referred to as the "Explorer Posts" for the establishment and implementation of a Services Training Program 9 hereafter referred to as "the program 10 11 WHEREAS, PSSC desires to offer to its students a program of study aimed at familiarization with the Fire Services 12 field, and the Explorer Posts desires to deliver such a training program; and 13 14 WHEREAS, the parties have agreed upon the terms and provisions of this Agreement for the delivery of curricula 15 and compensation by the PSSC: 16 17 NOW THEREFORE: In consideration of the foregoing, and of the terms and provisions hereinafter set forth, the 18 parties have agreed as follows: 19 20 21 I. SCOPE OF WORK 22 23 The curriculum to be developed and delivered by the Explorer Posts will consist, at a minimum in part, of the 24 curriculum described by the Curriculum Framework "Fire Services Careers" approved under Washington State 25 Standards, and provided to the Explorer posts by PSSC. This curriculum will meet the requirements for exploring 26 entry -level employment in fire services and emergency response. The curriculum will be delivered during the 27 summer program in accordance with the school calendar in use at PSSC, and is expected to include 17 seven and a 28 half hour days of instruction. 29 30 31 II. TERM 32 33 The term of the Agreement shall be for the 2010 summer session, June 28, 2010 through July 30, 2010 (closed 34 Monday, July 5 following the Highline School District School Calendar, and may be renewed for additional 35 summer school terms by mutual written agreement with both participating parties. 36 37 38 III. DELIVERY LOCATION 39 40 Locations for delivery of the curriculum include the primary location, which will be The Tukwila Fire Station #51 41 (444 Andover Park East) or other training sites as agreed to by PSSC and the Explorer Posts as well as the Fire 42 Fighting classroom at PSSC. 43 44 IV. QUALIFIED DELIVERY 45 46 The Explorer Posts agrees to provide an instructor acceptable to PSSC under the certification guidelines provided by 47 PSSC prior to the beginning of classes on June 28, 2010. In the event that said instructor is not available for normal 48 teaching duties for reasons of health or personal issues that would normally result in an excused absence, the 49 Explorer Posts agrees to provide a substitute teacher who has vocational certification through the Office of 50 Superintendent of Public Instruction and has obtained a Washington State Patrol fingerprint clearance. 51 52 53 54 55 56 57 V. SERVICES PROVIDED BY THE EXPLORER POSTS 58 59 a) Shall provide 2 sessions of 90 hours (12 days 7.5 hours per day) of class instruction and internship 60 supervision for up to 30 high school students. 61 b) Classes will be conducted Monday through Friday from 7:30 AM to 3:30 PM congruent with the Highline 62 School District student calendar. 63 c) Instruction and supervision of students covered by this agreement shall be by an instructor who is career 64 and technical education certified by the Office of Superintendent of Public Instruction. 65 d) By the first day of instruction a copy of a valid career and technical teaching certificate for each primary 66 instructor shall be provided to PSSC administration. 67 e) The instructor will provide daily student attendance records to the registrar at PSSC. 68 f) The instructor will report final grades and attendance to the registrar at PSSC on the last class day for each 69 Summer School grading period. 70 71 72 VI. SERVICES PROVIDED BY PSSC 73 74 a) Will provide the names, numbers, and identification of students to be assigned including a copy of the 75 registration form and the identifying resident district and appropriate mailing address. 76 b) The holiday and vacation schedule of each resident district will be provided, however students shall be 77 expected to follow the schedule of PSSC. 78 c) Coordinate enrollment and required Office of Superintendent of Public Instruction reports. 79 d) Require students to adhere to the standards, polices, and regulations of the training center and explorer 80 posts during their learning assignments. In no way will these standards, policies, and regulations conflict 81 with those of the participating school district from which the student attends through PSSC and must 82 conform with the Washington State Administrative Code for student discipline and due process. 83 e) Provide disciplinary support as needed. 84 85 86 VII. EXPENSES TO BE PAID BY THE EXPLORER POSTS 87 88 a) Shall pay for all instructor compensation and per diem, including wages and employee benefits such as 89 medical insurance, retirement plans, and vacation as required. 90 b) Shall pay all of the incidental costs of providing instruction at the primary location. Such costs include but 91 are not limited to the cost of rent, utilities, building cleaning and maintenance. 92 93 94 VIII. EXPENSES PAID BY PSSC 95 96 a) The financial obligation of PSSC and the Highline School District regarding the delivery of the 97 curriculum as specified herein will be $8,000 per session (for a total of $16,000.00). 98 b) Shall be responsible for the cost of all training materials and equipment including books, photocopying, 99 software, computers and peripherals. 100 c) PSSC will provide a purchase order for the full amount above and will provide one payment upon receipt 101 of invoice. The Explorer Posts will submit an invoice on the first business day of class and PSSC will 102 make payment within thirty days of invoice receipt. 103 d) The cost of transporting students from the main campus (PSSC) to the primary site (Tukwila Fire Station 104 51) and two additional field trips will be the responsibility of PSSC. 105 106 107 IX. STUDENT TRANSPORTATION 108 109 Student transportation to and from the primary location or the alternate sites assigned for curriculum delivery shall 110 be provided by Highline School District. The Explorer Posts bears no responsibility for any accident, incident, 111 death, injury or negligence arising out of the use of private conveyance for the purpose of transporting students to, 112 from, or between sites used to deliver curricula. 113 114 115 116 X. STUDENT CONDUCT 117 118 Students and staff of PSSC shall conduct themselves in a professional manner at all times while at the training site 119 and PSSC. Misconduct by students or staff shall be reported to PSSC administration as soon as possible but in no 120 event longer then the end of the school day in which the misconduct occurred. An administrator from PSSC will be 121 responsible for reviewing and approving proposed discipline, which may result from any infraction or inappropriate 122 behavior as documented by the Explorer Post. Such discipline will be administered with regard to the rights of 123 individuals as set forth in Federal and State laws, the State Board of Education's rules and regulations on procedural 124 due process guarantees, and District Policies. Confidentiality of all information, paperwork or conversation 125 encountered during training shall be maintained. Any physical information or paperwork shall be returned to PSSC 126 administration for proper retention or disposal. The Training Site instructors shall at all times maintain a 127 Student/Trainer relationship consistent with the provisions of the Department of Labor and Industries. 128 129 Documents outlining expected student behavior standards will be provided to each student at the beginning of 130 summer school, along with an acknowledgement page. The student will be required to acknowledge having received 131 and understood the behavioral expectations of both PSSC and the Explorer Post's "Standard Operating Guidelines 132 133 XI. INSPECTION 134 135 PSSC shall have the rights to inspect the records of the Explorer Posts, pertaining to delivery of curricula, including 136 grade books and attendance records. PSSC also has the right to observe the classroom activity on dates and times of 137 its choosing. 138 139 XII. LIABILITY INSURANCE 140 141 The Explorer Post shall maintain insurance coverage for liability and personal injury for accidents or incidents 142 arising from student activities while participating in fire fighting training activities at the primary location. A 143 certificate of insurance stating the liability coverage, limits and listing Highline School District as additionally 144 insured shall be provided to the Highline School District prior to the beginning of classes on June 28,2010. Such 145 policy shall be in effect for the duration of this agreement and shall be for a minimum of one million dollars 146 ($1,000,000) combined for bodily injury (including death) and property damage per occurrence and two million 147 dollars ($2,000,000) in the annual aggregate. Thirty days notice shall be given to the Highline School District prior 148 to cancellation of the coverage or modification of the coverage limits. Such insurance shall be provided by 149 insurance companies licensed to do business in the State of Washington and carry at least an A VIII Best's rating. 150 151 Each party agrees to protect, defend, indemnify, and hold harmless the other from any and all costs, claims, 152 judgments, or awards of damages, arising out of or in any way resulting from the party's own actions, failure to act, 153 or negligence relating to or arising out of the performance of this Agreement brought by or in behalf of any 154 employees, and /or students or staff and includes any judgment, award and cost arising therefrom including 155 attorney's fees. 156 157 The Explorer Posts assures compliance with state and federal guidelines and regulations regarding 158 nondiscrimination against any student trainee on the basis of race, color, national origin, or gender. Harassment of 159 any student trainee with regard to race, color, national origin, or gender is strictly prohibited. 160 161 162 XIII. DEFAULT 163 164 Should PSSC or the Explorer Posts default on any provisions of this Agreement, the non defaulting party may at its 165 option, cancel this agreement by giving thirty (30) days written notice of its intention to do so and by citing the 166 default(s). Should the party in default not correct any cited default(s) during the thirty -day period; this Agreement 167 shall become fully null and void. 168 169 XIV.
