CALL TO ORDER Mayor Haggerton called the Special Tukwila City Council Meeting to order at 8:44 p.m. directly following the Committee of the Whole meeting. ROLL CALL Melissa Hart, Deputy City Clerk, called the roll of the Council. Present were Councilmembers Joe Duffie, Dennis Robertson, Verna Seal, Kathy Hougardy, De'Sean Quinn and Kate Kruller. MOVED BY SEAL, SECONDED BY DUFFIE TO EXCUSE COUNCILMEMBER EKBERG. MOTION CARRIED 6 -0. CITY OFFICIALS Jim Haggerton, Mayor; David Cline, City Administrator; Mike Villa, Police Chief; Bob Giberson, Public Works Director; Stephanie Brown, Human Resources Director; Chris Partman, Community- Oriented Policing Coordinator; Mary Miotke, Information Technology Director; Laurel Humphrey, Council Analyst; Melissa Hart, Deputy City Clerk. CONSENT AGENDA An ordinance repealing Ordinance No. 1309, as codified at Tukwila Municipal Code Chapter 3.80, reenacting Tukwila Municipal Code Chapter 3.80, "Equipment Rental and Replacement Fund," to update covered equipment and method of replacement funding. [Reviewed and forwarded to Consent by Utilities Committee on 12/2/13.] ORDINANCE NO. 2427. MOVED BY DUFFIE, SECONDED BY HOUGARDY THAT THE CONSENT AGENDA BE APPROVED AS SUBMITTED. MOTION CARRIED 6 -0. UNFINISHED BUSINESS a. Authorize the Mayor to sign a lease agreement with Engineering Solutions for property located at 6300 Southcenter Boulevard, Suite 209. MOVED BY ROBERTSON, SECONDED BY DUFFIE TO AUTHORIZE THE MAYOR TO SIGN A LEASE AGREEMENT WITH ENGINEERING SOLUTIONS FOR PROPERTY LOCATED AT 6300 SOUTHCENTER BOULEVARD, SUITE 209. MOTION CARRIED 6 -0. b. An ordinance repealing Ordinance No. 1017, as codified at Tukwila Municipal Code Chapter 2.30, reenacting Tukwila Municipal Code Chapter 2.30 as "Tukwila Arts Commission" to update the terms of membership and reestablish a Municipal Arts Fund. MOVED BY QUINN, SECONDED BY SEAL THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED 6 -0. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, REPEALING ORDINANCE NO. 1017 AS CODIFIED AT TUKWILA MUNICIPAL CODE CHAPTER 2.30; REENACTING TUKWILA MUNICIPAL CODE CHAPTER 2.30 AS "TUKWILA ARTS COMMISSION" TO UPDATE THE TERMS OF MEMBERSHIP AND REESTABLISH A MUNICIPAL ARTS FUND; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY QUINN, SECONDED BY DUFFIE THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ. MOTION CARRIED 6 -0, TO ADOPT ORDINANCE NUMBER 2428. c. Authorize the Mayor to sign an agreement with King County for Institutional Network (I -NET) services in the amount of $71,784.00 (excluding tax). MOVED BY ROBERTSON, SECONDED BY HOUGARDY TO AUTHORIZE THE MAYOR TO SIGN AN AGREEMENT WITH KING COUNTY FOR INSTITUTIONAL NETWORK (I -NET) SERVICES IN THE AMOUNT OF $71,784.00 (EXCLUDING TAX). MOTION CARRIED 6 -0. d. A resolution fixing the time for a public hearing for vacation of right -of -way within the City of Tukwila dedicated for street purposes, generally described as portions of 41st Avenue South. MOVED BY KRULLER, SECONDED BY HOUGARDY THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED 6 -0. Melissa Hart, Deputy City Clerk, read the proposed resolution by title only. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, FIXING THE TIME FOR A PUBLIC HEARING FOR VACATION OF RIGHT -OF -WAY WITHIN THE CITY OF TUKWILA DEDICATED FOR STREET PURPOSES, GENERALLY DESCRIBED AS PORTIONS OF 41ST AVENUE SOUTH. MOVED BYQUINN, SECONDED BY DUFFIE THAT THE PROPOSED RESOLUTION BE ADOPTED AS READ. MOTION CARRIED 6 -0, TO ADOPT RESOLUTION NUMBER 1810. e. Authorize the Mayor to sign a collective bargaining agreement with the United Steelworkers for Police Non - Commissioned employees for a period of January 1, 2014 through December 31, 2016. MOVED BY QUINN, SECONDED BY HOUGARDY TO AUTHORIZE THE MAYOR TO SIGN A COLLECTIVE BARGAINING AGREEMENT WITH THE UNITED STEELWORKERS FOR THE POLICE NON - COMMISSIONED EMPLOYEES FOR A PERIOD OF JANUARY 1, 2014 THROUGH DECEMBER 31, 2016. MOTION CARRIED 6 -0. f. Authorize the Mayor to sign an Interlocal Agreement with the Tukwila Metropolitan Park District (MPD) for contract support services. Councilmember Seal explained that her daughter works at the Tukwila Pool and she would recuse herself from voting on contracts between the City and the Tukwila Metropolitan Park District. 8:49 p.m. Councilmember Seal recused herself and left the Council Chambers. MOVED BY HOUGARDY, SECONDED BY ROBERTSON TO AUTHORIZE THE MAYOR TO SIGN THE INTERLOCAL AGREEMENT BETWEEN THE CITY AND THE TUKWILA METROPOLITAN PARK DISTRICT (MPD) FOR CONTRACT SUPPORT SERVICES IN SUBSTANTIAL FORM AS THE AGREEMENT IN THE AGENDA PACKET. MOTION CARRIED, 5 -0 WITH SEAL RECUSED. 8:50 p.m. Councilmember Seal returned to the Council Chambers. Tukwila City Council Special Meeting Minutes December 9, 2013 Page 3 of 3 g. Authorize the Mayor to sign Supplement No. 10 to contract #07 -123 with KPFF for the Tukwila Urban Center Pedestrian /Bicycle Bridge Project in the amount of $221,419.39. MOVED BY KRULLER, SECONDED BY ROBERTSON TO AUTHORIZE THE MAYOR TO SIGN SUPPLEMENT NO. 10 TO CONTRACT #07 -123 WITH KPFF FOR THE TUKWILA URBAN CENTER PEDESTRIAN /BICYCLE BRIDGE PROJECT IN THE AMOUNT OF $221,419.39. MOTION CARRIED 6 -0. Mayor Haggerton thanked the Councilmembers and City staff for their work during 2013.
