JOE DUFFIE, JOAN HERNANDEZ, JIM HAGGERTON, Council President; ALLAN EKBERG, STEVE MULLET, PAM CARTER, PAM LINDER. JOHN MCFARLAND, City Administrator; RHONDA BERRY, Assistant City Administrator; BOB NOE, City Attorney; ALAN DOERSCHEL, Finance Director; ROSS EARNST, Public Works Director; TOM KEEFE, Fire Chief; RON WALDNER, Police Chief; STEVE LANCASTER, DCD Director; LUCY LAUTERBACH, Council Analyst; CELIA SQUARE, Deputy City Clerk. SPECIAL PRESENTATIONS Mayor Rants administered the Oath of Office to returning Councilmembers Oath of Office Joe Duffle, Jim Haggerton and Pam Linder; and newly elected Councilmember Dave Fenton. Mayor Rants read A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, EXPRESSING THANKS AND APPRECIATION FOR ALLAN EKBERG'S EIGHT YEARS ON THE TUKWILA CITY COUNCIL. MOVED BY HERNANDEZ, SECONDED BY DUFFIE, THAT RESOLUTION NO. 1391 BE APPROVED AS READ.* Each Councilmember expressed their thanks and appreciation to Councilmember Ekberg for being instrumental in garnering support for annexation of his neighborhood into Tukwila; for serving as a pro- active Councilmember, facilitator, and Council President during his two terms; and for his leadership in the areas of comprehensive planning, residential revitalization, and residential street improvements resulting in better government in Tukwila. *MOTION CARRIED. Councilmember Ekberg welcomed newly elected Councilmember David Fenton and thanked each Councilmember for their support throughout his term as Councilmember. He also thanked the staff for their efforts in championing the spirit that Tukwila represents to the citizens and the community at large. Regular Meeting Minutes January 5, 1998 Page 2 Res. #1391 (Cont'd) CITIZEN'S COMMENTS CONSENT AGENDA NEW BUSINESS Res. #1392 Supporting Tukwila Highline School Districts school levy election Council President Haggerton presented a plaque on behalf of the Council that read: "To Allan Ekberg with true appreciation for eight years of service on the Tukwila City Council as Councilmember and Council President. Your work to bring people together in annexation, the Comprehensive Plan process and through Council leadership have greatly benefited the City and you will be missed by all (1990 1997)." Each Councilmember thanked Councilmember Haggerton for his leadership as Council President in 1997; and congratulated David Fenton for being newly elected to Position #1 on the Tukwila City Council. Robert Greninger, 16727 45th Avenue South, Phone: (206) 242 -8941, commented there is a sewer easement 10 ft. wide, which is the full length of the south side of his lots. This limits building on the areas. He said he would like to restore his legal rights to use a rear setback of 5 ft. instead of 10 ft. so that he can fully utilize and enjoy his back yard, and so that he can build a storage shed. Greninger distributed copies of his proposal to the Mayor and Council. Mayor Rants said he will meet with the Director of the Department of Community Development to review this matter. a. Attorney Bob Noe read A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, SUPPORTING THE TUKWILA SCHOOL DISTRICT NO 406 AND THE HIGHLINE SCHOOL DISTRICT 401 SCHOOL PROGRAM LEVY ELECTIONS AND URGING ALL ELIGIBLE VOTERS TO VOTE FOR SCHOOLS IN THE FEBRUARY 3, 1998 SPECIAL ELECTION. MOTION CARRIED (7 -0). MOVED BY DUFFIE, SECONDED BY HERNANDEZ, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. Attorney Bob Noe read A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, SUPPORTING THE UPCOMING TUKWILA SCHOOL DISTRICT BOND FOR DEMOLITION AND RECONSTRUCTION OF THORNDYKE AND TUKWILA ELEMENTARY SCHOOLS. MOVED BY CARTER, SECONDED BY DUFFIE, THAT RESOLUTION NO. 1393 BE APPROVED AS READ.* Councilmember Mullet commented that he whole heartedly supports this bond for reconstruction of Thorndyke and Tukwila Elementary Schools because it is so badly needed. He says this will complete the structural upgrade of all the City's schools. Councilmember Carter pointed out the various conceptual designs on display in the Council Chambers for Council and citizens perusal. Councilmember Duffie encouraged support of the bond. He said both schools have grown beyond the ability to house their students without the use of temporary portables; and a study has shown the most cost effective and efficient modernizations and expansions of the two schools can be done through their reconstruction. *MOTION CARRIED (7 -0). MOVED BY HERNANDEZ, SECONDED BY HAGGERTON, TO NOMINATE COUNCILMEMBER PAM LINDER AS 1998 COUNCIL PRESIDENT. Councilmember Duffie recommended that the nomination be closed with the one name given. *MOTION CARRIED (7 -0). Regular Meeting Minutes January 5, 1998 Page 4 Election of new Council President (Cont'd) Ord. #1826 Establishing a hotel /motel tax Ord. #1827 amending the 1998 budget Council President Linder thanked Councilmember Haggerton for his excellent work as 1997 Council President. She said she accepts this role as an opportunity, privilege; and as a responsibility to run efficient meetings where full and open discussions can take place. MOVED BY HAGGERTON, SECONDED BY DUFFIE, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. Attorney Bob Noe read AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, LEVYING A SPECIAL EXCISE TAX OF ONE PERCENT ON THE SALE OR CHARGE MADE FOR THE FURNISHING OF LODGING BY ANY HOTEL, ROOMING HOUSE, TOURIST COURT, MOTEL OR TRAILER CAMP, AND THE GRANTING OF ANY SIMILAR LICENSE TO USE REAL PROPERTY; ESTABLISHING A SPECIAL REVENUE FUND (HOTEL /MOTEL TAX NO. 101) FOR THE TAX; PROVIDING PENALTIES FOR NONPAYMENT OF THE TAX OR VIOLATION OF THE REQUIREMENTS OF THE TAX; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY HAGGERTON, SECONDED BY HERNANDEZ, THAT ORDINANCE NO. 1826 BE ADOPTED AS READ.* Council President Linder commented that this issue had been discussed at Finance and Safety Committee meeting and the Committee agreed with one minor change -that the budgeted amount should be $20,000 for the Chamber of Commerce instead of the original $18,000. When the new Council sub committees are established, this issue should be reviewed again in early February. *MOTION CARRIED (7 -0). Attorney Bob Noe read AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING THE 1998 BUDGET ADOPTED BY ORDINANCE NO. 1824, PROVIDING FOR UNANTICIPATED REVENUES AND EXPENDITURES FOR THE HOTEL /MOTEL TAX FUND (NO. 101); PROVIDING FOR BUDGET TRANSFERS WITHIN THE GENERAL FUND FOR A VOLUNTEER Regular Meeting Minutes January 5, 1998 Page 5 Ord. #1827 (Cont' d) REPORTS Mayor Council COORDINATOR POSITION; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY DUFFIE, SECONDED BY HERNANDEZ, THAT ORDINANCE NO. 1827 BE ADOPTED AS READ. MOTION CARRIED (7 -0). Mayor Rants encouraged the Council to read the Suburban Cities report that had been placed in their mailboxes regarding courts of limited jurisdictions (municipal courts) contracting with district courts or remaining within their own jurisdiction. Rants said this is an issue that warrants undivided attention, because he feels municipal courts need to have the ability to determine who will serve as their court administrators and judges. Councilmember Duffle thanked the citizens for electing him to serve another four -year term on the City Council. He extended an invitation to everyone to attend his annual celebration on January 31, 1998 at the Tukwila Community Center. Councilmember Hernandez reported she attended a business and government committee luncheon over the holidays hosted by the Chamber of Commerce. She congratulated Charlie Frame on being appointed the new Chamber President for 1998. Hernandez said she will be attending the Regional Efforts to Achieve Community Housing (REACH) Committee meeting on January 7th, 12:00 noon at U.S. Bank in Renton. She will also participate in a planning session of the Ambassador Committee to discuss the possibility of hosting A Bite of Tukwila in 1998 or 1999. She welcomed any ideas on this venture. Councilmember Carter said she will be drafting additional comments for Council review to submit to the Citizen's Oversight Committee of the RTA. She also feels a letter should be sent to representatives in Washington D.C. regarding developers being able to directly take issues to court rather than working through procedures established within the related City. Councilmember Carter agreed that she will continue to serve as Council representative on the South King County Area Transportation Board (SKCATBd). Regular Meeting Minutes January 5, 1998 Page 6 Reports (font' d) City Attorney MISCELLANEOUS ADJOURNMENT 8:15 p.m. Councilmember Haggerton thanked the Council for all of their kind words and support for his leadership as Council President in 1997. He noted that this Council covered a variety of issues in the past year and works well together but is also not eager to act out of ignorance. They might not always share the same opinions on an issue, but always want to find out the facts before they act. Councilmember Fenton said he's glad to be on board. He said he sat in the audience for a year to watch this Council in action and now he has become one of them. He's looking forward to a remarkable working relationship with the Council. Attorney Noe informed the Council that he attended the Airport Communities Coalition (ACC) vs. Puget Sound Regional Council Trial today (January 5, 1998). A briefing can be prepared upon Council request, Councilmember Hernandez announced the Equity and Diversity Commission will meet January 8, 5:30 p.m., at the Tukwila Community Center.
