REGULAR MEETING CALL TO ORDER/PLEDGE OF ALLEGIANCE /ROLL CALL Mayor Haggerton called the Regular Meeting of the Tukwila City Council to order at 7:00 p.m. and led the audience in the Pledge of Allegiance. ROLL CALL Christy O'Flaherty, City Clerk, called the roll of the Council Present were Councilmembers Joe Duffie, Joan Hernandez, Dennis Robertson, Allan Ekberg, Verna Seal, Kathy Hougardy, and De'Sean Quinn Jim Haggerton, Mayor; Steve Lancaster, City Administrator; Shelley Kerslake, City Attorney; Shawn Hunstock, Finance Director; Bob Giberson, Public Works Director; Jack Pace, Community Development Director; David Haynes, Police Chief; Martin Grisham, Acting Assistant Fire Chief; Derek Speck, Economic Development Administrator; Christy O'Flaherty, City Clerk. a. Presentation of a donation by Girl Scout Troop #41601 to the Police Department K -9 Unit Becky Hettman, Troop Leader Becky Hettman, Leader of Girl Scout Troop #41601, introduced Dawn Hettman who came forward to explain the purpose of the donation to the Police Department. Other troop members in attendance were Tahnie Johnson, Amanda Kato, Chauntelle Roush, April Hettman and troop leader, Jeanne Schroeder. Dawn Hettman, troop member, explained her troop was striving to earn a Bronze Award which is given when the troop takes on a project to "make the world a better place The troop members learned of Tukwila's K -9 dog, Gino, being stabbed and they wanted to acquire bullet proof vests for both Gino and Stryker. They had various fundraising events to include a spaghetti feed and silent auction. The Girl Scouts from Troop #41601 presented a donation in the amount of $2,200.00 to the Tukwila Police Department for the acquisition of bullet proof vests for the K -9 unit. Officers James Sturgill and Eric DeVries and K -9 dog, Stryker, accepted the donation on behalf of the Tukwila Police Department and thanked the members of Troop #41601 for their contribution. The Mayor and City Councilmembers applauded the efforts and contribution of the Girl Scouts and their troop leaders for this donation to the City. b. Presentation of the Employer Support of the Guard and Reserve (ESGR) Above and Beyond award to the City of Tukwila and the Police Department Jim Shepherd, ESGR State Chair Jim Shepherd, ESGR State Chair, and Larry Kirchner, ESGR King County Chair, were in attendance to present this award to the City of Tukwila. Mr. Shepherd explained the "Above and Beyond" award is given in limited numbers by State ESGR committees. It recognizes employers at the state and local level who have gone above and beyond the legal requirements for granting leave and providing support for military duty by their employees Mr. Shepherd and Mr. Kirchner presented David Haynes, Police Chief, with the ESGR "Above and Beyond" award Tukwila City Council Regular Meeting Minutes July 19, 2010 Page 2 of 6 Mr Kirchner indicated that Tukwila Police Officer Steven Donnelly nominated the City for the Freedom Award, which is the highest honor that is awarded and speaks to the City's commitment toward members of the National Guard and Reserves. The Mayor and Councilmembers thanked Mr. Shepherd and Mr Kirchner for recognizing the City with the "Above and Beyond" award. CITIZEN COMMENTS Mary Hulvey, Tukwila Code Enforcement Officer, expressed appreciation to Kimberly Matej, Council Analyst, and the Equity and Diversity Commission for their assistance in helping clean up 5 properties in the City. CONSENT AGENDA a. Approval of Minutes: 7/6/10 (Regular) b Approval of Vouchers #354448 354675 and 201007161, 201007192- 201007193 in the amount of $1,840,695 47 MOVED BY DUFFIE, SECONDED BY HERNANDEZ THAT THE CONSENT AGENDA BE APPROVED AS SUBMITTED. MOTION CARRIED 7 -0. UNFINISHED BUSINESS a. An ordinance adopting the 2009 State Building Code, the Washington Cities Electrical Code, and providing for the issuance of permits and collection of fees. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE NOS. 2121 (PART), 2157 (PART), 2171 (PART) AND 2249 (PART) AS CODIFIED AT TUKWILA MUNICIPAL CODE CHAPTER 16 04, "BUILDINGS AND CONSTRUCTION," ADOPTING THE 2009 STATE BUILDING CODE; THE WASHINGTON CITIES ELECTRICAL CODE; AND PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY DUFFIE, SECONDED BY HERNANDEZ THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ. MOTION CARRIED 7 -0 TO ADOPT ORDINANCE NUMBER 2295. b. Authorize the Mayor to enter into the first amendment to Settlement Agreement #08 -056 with Darryl Doak, Sr., Estrella Doak, Darryl Doak, Jr. and Doak Homes. MOVED BY DUFFIE, SECONDED BY HERNANDEZ TO AUTHORIZE THE MAYOR TO ENTER INTO THE FIRST AMENDMENT TO SETTLEMENT AGREEMENT #08 -056 WITH DARRYL DOAK, SR., ESTRELLA DOAK, DARRYL DOAK, JR. AND DOAK HOMES. MOTION CARRIED 7 -0. c. An ordinance relating to contracting indebtedness; providing for the issuance of $1,900,000 par value of Limited Tax General Obligation Bonds, Series 2010A and $3,970,000 par value Limited Tax General Obligation Bonds, Series 2010B to provide funds with which to pay the cost of Southcenter Parkway Improvements and emergency response capital equipment. A resolution establishing a Seattle Southside Visitors' Center Change Fund level. MOVED BY QUINN, SECONDED BY SEAL THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED 7 -0. MOVED BY QUINN, SECONDED BY SEAL THAT THE PROPOSED RESOLUTION BE ADOPTED AS READ. MOTION CARRIED 7 -0 TO ADOPT RESOLUTION NUMBER 1721. e. Budget Items: 1. MOVED BY ROBERTSON, SECONDED BY HERNANDEZ THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ.* Council President Robertson indicated this issue was discussed at a Committee of the Whole meeting and a public meeting was conducted. MOVED BY ROBERTSON, SECONDED BY HOUGARDY THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ.* Council President Robertson indicated this issue was discussed at a Committee of the Whole meeting and a public meeting was conducted. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE NO. 2179 §2 (PART), AS CODIFIED AT TUKWILA MUNICIPAL CODE CHAPTER 5.04, REVISING THE CITY'S BUSINESS LICENSE FEE SCHEDULE; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY ROBERTSON, SECONDED BY HERNANDEZ THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ.* Council President Robertson indicated this issue was discussed at a Committee of the Whole meeting and a public meeting was conducted. Mayor Haggerton called for public comments, and no comments were received. *MOTION CARRIED 7 -0 TO ADOPT ORDINANCE NUMBER 2299. REPORTS a. Mayor Mayor Haggerton read a letter from the Washington State Finance Officers' Association recognizing Shawn Hunstock, Finance Director, for ongoing educational excellence Mr. Hunstock has received this recognition for the last 4 years, and he is also the Vice President of the Puget Sound Finance Officers' Association and is on the Education Committee. The Mayor and Council congratulated Mr. Hunstock on this achievement and the good work he does for the City. Tukwila City Council Regular Meeting Minutes July 19, 2010 Page 5 of 6 Mayor Haggerton reported that on July 14, 2010, he traveled to the home of Anna Bernhard with the Council President and 5 staff members to present her with the "Treasure of Tukwila" award Ms. Bernhard, who is ill, was very appreciative of both the award and the visit by City officials. Additionally, on July 14, 2010 the Mayor attended the Suburban Cities Public Issues Committee (PIC) meeting It was announced at that meeting that Crisis Diversion Facilities (CDFs) have been located within the City of Seattle. At that same meeting, the King County Joint Recommendations Committee asked the PIC to make a recommendation to the Board of Directors to eliminate housing being built along the Green River inundation areas. The PIC chose not to make that recommendation. b. City Council Councilmember Hernandez attended the July 13, 2010 Fire Exploratory Committee meeting for which she is the Chair. The Committee has agreed to meet once a week. On July 14, 2010 she attended the South County Economic Development Initiative (SCEDI) meeting for Councilmember Hougardy, and on July 15, 2010 she attended the Chamber of Commerce after -hours event. Council President Robertson indicated the event at Ms. Bernhard's home on July 14, 2010 was very meaningful. He thanked Councilmember Hougardy for nominating Anna for the "Treasure of Tukwila" award and the Mayor for an exemplary job of acknowledging Anna's contributions Councilmember Seal thanked the Arts Commission for their continued support for the CASTT performances at Foster High School. This was the 8 year she has participated in the performances. Councilmember Quinn commended the Mayor and staff for working through the Crisis Diversion Facilities issue. Additionally, Mr. Quinn reported that he represented the City of Tukwila at the Seafair Pow Wow at Discovery Park on July 17, 2010. c. Staff Steve Lancaster, City Administrator, reported the Department of Ecology has set the date for the public hearing on Tukwila's Shoreline Master Program as September 29, 2010. This will be during the 30 -day comment period. Once that has been completed, their comments will be compiled and brought to the City Council for consideration and final action Mr. Lancaster reported the City of Tukwila was given an honorable mention at the Washington State American Planning Association awards ceremony for the Walk and Roll Plan. Additionally, the City has been awarded $52,929.43 for the design of the Duwamish Gardens Habitat Restoration project by the King Conservation District. d. City Attorney There was no report. e. Intergovernmental The Council Analyst was not present.
