HomeMy WebLinkAboutOrd 2304 - Sign, Development and Electrical PermitsCity of Tukwila Washington Ordinance No. 1 0 L1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, REPEALING ORDINANCE NO. 2292, RELATING TO THE ACCEPTANCE OF APPLICATIONS FOR SIGN, DEVELOPMENT, AND ELECTRICAL PERMITS FOR CERTAIN TYPES OF SIGNAGE WITHIN THE CITY, PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, on June 21, 2010, the City Council adopted Ordinance No. 2292, which declared an emergency and established a six -month moratorium on the acceptance of applications for sign, development, and electrical permits for certain types of signage within the City of Tukwila; and WHEREAS, the purpose of the moratorium was to allow the City Council time to complete its review of the Planning Commission Recommended Draft Sign Code provided to the City Council in the summer of 2010; and WHEREAS, on June 28, 2010 the City Council conducted a public hearing on the Planning Commission Recommended Draft Sign Code; and WHEREAS, on July 12, 2010 the City Council heard additional public input regarding the Planning Commission Recommended Draft Sign Code and subsequently requested that staff make changes to the Draft Sign Code; and WHEREAS, on August 9, 2010, the City Council reviewed a revised Draft Sign Code that reflects the changes requested by the City Council; and WHEREAS, on August 16, 2010, the City Council passed Ordinance No. 2203, which enacted a new Sign Code for the City of Tukwila; and WHEREAS, the passage of Ordinance No. 2203 makes the current moratorium unnecessary and the City Council wishes to repeal the moratorium; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. Moratorium Repealed. The moratorium imposed by Ordinance No. 2292 on the acceptance of applications for sign, development, and electrical permits for certain types of signage within the City of Tukwila is hereby repealed. Section 2. Repealer. Ordinance No. 2292 is hereby repealed. Section 3. Severability. If any section, subsection, paragraph, sentence, clause, or phrase of this ordinance or its application to any person or situation should be held to be invalid, unconstitutional or unenforceable for any reasons by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 4. Effective Date.
