MINUTES REGULAR MEETING CALL TO ORDER/PLEDGE OF ALLEGIANCE /ROLL CALL Mayor Haggerton called the Regular Meeting of the Tukwila City Council to order at 7 p m. and led the audience in the Pledge of Allegiance. ROLL CALL Christy O'Flaherty, City Clerk, called the roll of the Council Present were Councilmembers Joe Duffie, Joan Hernandez, Dennis Robertson, Allan Ekberg, Verna Seal, Kathy Hougardy, and De'Sean Quinn. CITY OFFICIALS Jim Haggerton, Mayor; Steve Lancaster, City Administrator; Shelley Kerslake, City Attorney; Shawn Hunstock, Finance Director; Peggy McCarthy, Deputy Finance Director; Bob Giberson, Public Works Director; Gail Labanara, Public Works Analyst; Derek Speck, Economic Development Administrator; Lavern Peterson, Fire Battalion Chief; Mary Miotke, Information Technology Director; Christy O'Flaherty, City Clerk. SPECIAL PRESENTATIONS a. Update on Arts Commission activities 2009 -2010 Cynthia Chesak, Arts Commissioner Cynthia Chesak, Arts Commissioner, came forward to provide an overview of the activities of the Arts Commission for 2009 -2010 and introduced the other members of the Arts Commission Trisha Gilmore, Brian Kennedy, and Steve Mullet. She also referenced Bill Gorjance, a founding member of the Commission, who retired in January 2010. Ms. Chesak explained the mission of the Tukwila Arts Commission• Represents the City's interests in art matters and is a spokesperson group for art matters in the City. Examples: Involvement in the Light Rail Station art; Tukwila Station art; 4Culture Grant Review Panel; 2010 Tukwila Art Show in Representative Zack Hudgin's Office Is a central body to whom art organizations, artists, and anyone interested in cultural advancement of the community may come for information or assistance Examples Support to the Rainier Symphony, All Nations Cup Festival, Voices Education Project Encourages and aids programs for cultural enrichment of Tukwila citizens Examples: Plein Air Paint Out, Community Actors Summer Theater in Tukwila (C.A.S.T T Coordinates and strengthens existing organizations in the field of art and develops cooperation with schools, regional and national art organizations. Example. Recycled Art Show Explores ways and methods of obtaining private, local, state, and federal funds to promote art projects within the community. Example: Consistently received sustained support funding and equipment grants through 4Culture. This funding allows the Commission to support several performances and cultural activities Reviews and makes recommendations on all art acquired by the City. Renders any other advice and assistance in the field of art aesthetics and beautification as requested. Renders any other assistance to the City in any other artistic endeavors The Councilmembers thanked Ms. Chesak and the Commissioners for their presentation and service to the City Tukwila City Council Regular Meeting Minutes September 7, 2010 Page 2 of 5 b. Financial Status Update Shawn Hunstock, Finance Director, and Peggy McCarthy, Deputy Finance Director Shawn Hunstock, Finance Director, explained there is a statutory requirement to provide periodic updates to the Council on the financial status of the City. Peggy McCarthy, Deputy Finance Director, provided a summary of budgetary information for the 7 -month period ending July 31, 2010, at which point 58 33% of the year had expired She provided an overview of Governmental Funds, Enterprise Funds, and Internal Service Funds. In summary, fund balances in total increased by $728,000 for the seven months ending July 31, 2010. Governmental funds decreased by $1,768,383, Enterprise Funds increased by $1,119,075 and Internal Service Funds increased by $1,377,820. The Councilmembers thanked Mr. Hunstock and Ms. McCarthy for the presentation. Mayor Haggerton asked for comments from the audience. Georgina Kerr, 3836 South 116 Street, conveyed that as a resident, it is helpful to know that City finances are being well tracked. CITIZEN COMMENTS Blaine Reeder, 13802 38 Avenue South, commented on recurring problems with car stereo noise in his neighborhood and in other areas of the City He would like to see legislation enacted that will allow offenders to be cited and vehicles to be impounded Pam Carter, 4115 South 139 Street, encouraged the City Council to oppose Initiatives 1100 and 1105 involving the privatization of liquor sales. From her standpoint, if adopted, these measures would impact the City's budget by $459,000, to include the additional expense of police services in dealing with the sale of hard alcohol at mini -marts and stores CONSENT AGENDA a Approval of Minutes 8/16/10 (Regular); 8/23/10 (Special) b. Approval of Vouchers #355354 355581 and #201009071 201009072 in the amount of $508,209.80 c Accept as complete the Howard Hanson Dam Flood Response Emergency Levee work (Contract #09- 164) with Goodfellow Brothers, Inc.; authorize release of retainage, subject to the standard claim and lien release procedures (final cost of project, including retainage $2,565,465.13) MOVED BY DUFFIE, SECONDED BY HERNANDEZ THAT THE CONSENT AGENDA BE APPROVED AS SUBMITTED. MOTION CARRIED 7 -0. UNFINISHED BUSINESS a. An ordinance regarding concurrency standards and transportation impact fees vesting. MOVED BY SEAL, SECONDED BY DUFFIE THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED 7 -0. Christy O'Flaherty, City Clerk, read the proposed ordinance by title only. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, REPEALING ORDINANCE 2111 §1 (PART) AS CODIFIED AT TUKWILA MUNICIPAL CODE CHAPTER 9.48, REGARDING CONCURRENCY STANDARDS AND TRANSPORTATION IMPACT FEES VESTING; PROVIDING FOR SEVERABILITY, AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY SEAL, SECONDED BY QUINN THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ. MOTION CARRIED 7 -0 TO ADOPT ORDINANCE NUMBER 2305. Authorize the purchase of a Voice Over IP (VOIP) telephone system from Mitel in an amount not to exceed $534,200.00. MOVED BY QUINN, SECONDED BY SEAL TO AUTHORIZE THE PURCHASE OF A VOICE OVER IP (VOIP) TELEPHONE SYSTEM FROM MITEL IN AN AMOUNT NOT TO EXCEED $534,200.00. MOTION CARRIED 7 -0. 2. Authorize the purchase of Microsoft Enterprise Licensing in the amount of $103,378.00 per year for 3 years in the total amount of $310,134.00. MOVED BY QUINN, SECONDED BY SEAL TO AUTHORIZE THE PURCHASE OF MICROSOFT ENTERPRISE LICENSING IN THE AMOUNT OF $103,378.00 PER YEAR FOR 3 YEARS IN THE TOTAL AMOUNT OF $310,134.00. MOTION CARRIED 7 -0. 3. Authorize the purchase of hardware and software to implement the Information Technology component of Tukwila Bond Ordinance No. 2296 in an amount not to exceed $91,320.00. MOVED BY QUINN, SECONDED BY DUFFIE TO AUTHORIZE THE PURCHASE OF HARDWARE AND SOFTWARE TO IMPLEMENT THE INFORMATION TECHNOLOGY COMPONENT OF TUKWILA BOND ORDINANCE NO. 2296 IN AN AMOUNT NOT TO EXCEED $91,320.00. MOTION CARRIED 7 -0. c. An ordinance adopting, by reference, King County Code Title 11, Animal Care and Control Regulations, and creating Tukwila Municipal Code Chapter 7.16, "Dangerous Dogs," and creating Tukwila Municipal Code Chapter 7.20, "Dogs at Large and Leashes." MOVED BY HOUGARDY, SECONDED BY SEAL THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED 7 -0. Christy O'Flaherty, City Clerk, read the proposed ordinance by title only. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, REPEALING TUKWILA MUNICIPAL CODE CHAPTER 7.04, "ANIMAL LICENSING AND REGULATIONS"; ADOPTING BY REFERENCE KING COUNTY CODE TITLE 11, "ANIMAL CARE AND CONTROL," TO BE CODIFIED AS TUKWILA MUNICIPAL CODE CHAPTER 7.12; CREATING TUKWILA MUNICIPAL CODE CHAPTER 716, "DANGEROUS DOGS CREATING TUKWILA MUNICIPAL CODE CHAPTER 7.20, "DOGS AT LARGE AND LEASHES PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY DUFFIE, SECONDED BY HERNANDEZ THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ. MOTION CARRIED 7 -0 TO ADOPT ORDINANCE NUMBER 2306. d. Tukwila Village: Support the continued marketing of the Tukwila Village site to prospective developers and consideration of use of a portion of the site by King County Library Systems as a stand -alone library. The Councilmembers discussed this issue and exchanged comments as follows: The need to wait for the economy to pick up before building a stand -alone library; the option to treat this as a phased development with inclusion of a library as a first phase; the necessity of seizing opportunities to spur on future development; the concern that the King County Library System has funding now for a library and delays could jeopardize locating a new library in Tukwila; and acknowledgement that comments from citizens at the Council meetings have been in support of having a library on the site. Tukwila City Council Regular Meeting Minutes September 7, 2010 Page 4 of 5 MOVED BY HERNANDEZ, SECONDED BY SEAL TO SUPPORT THE CONTINUED MARKETING OF THE TUKWILA VILLAGE SITE TO PROSPECTIVE DEVELOPERS AND CONSIDERATION OF USE OF A PORTION OF THE SITE BY KING COUNTY LIBRARY SYSTEMS AS A STAND -ALONE LIBRARY. MOTION CARRIED 6 -1, WITH DUFFIE VOTING NO. REPORTS a. Mayor Mayor Haggerton attended the September 2, 2010 Association of Washington Cities Healthy and Safe Communities Sub Committee Meeting, of which he is the chair person. Topics of discussion included the need for additional tools regarding gang activity, a public safety authority, legislation regarding the election of Municipal Court judges, Liquor Control Board enforcement, driving while license is suspended, and rental housing inspection programs. Also on September 2, 2010, the Mayor met with the City's federal lobbyist and noted that state and federal lobbyists have been asked to participate in reducing expenses. On September 3, 2010, the Mayor attended the Valley Com Administrative Board meeting, where an annexation policy was adopted regarding the costs to Valley Com. based on municipal annexations. Additionally, the Mayor reported that the first black and white patrol cars will be rolled out on September 8, 2010 at the City Hall Flagpole at 4.30 p.m. Only those vehicles being replaced in the normal course of business will be acquired as a "black and white." b. City Council Councilmember Duffie visited the new SCORE Jail facility and attended a soccer game at Fort Dent. He also attended the Duwamish Neighborhood meeting Councilmember Hernandez attended the August 24 and August 31, 2010 Fire Exploratory Committee meetings, of which she is the chair person. The next meeting will be on September 9, 2010, with a recommendation coming to the Council on September 27, 2010. On September 2, 2010 Ms. Hernandez attended the Equity and Diversity Commission meeting and the Intergovernmental Affairs Committee on September 7, 2010. Council President Robertson thanked Councilmember Quinn for chairing the August 23, 2010 Committee of the Whole meeting in his absence. Additionally, he indicated that a new schedule for budget discussions is forthcoming. Councilmember Ekberg attended the August 20, 2010 event at Showalter Middle School where backpacks were provided to students. Staff from Swedish Medical Center were also present to provide immunizations. Councilmember Seal volunteered at the August 20, 2010 event at Showalter Middle School and distributed backpacks, school supplies, and household goods with other community members. She also attended the August 25, 2010 King County LEOFF 1 Board Meeting, where the topic was elder abuse. Ms. Seal also attended the Duwamish Neighborhood meeting. Councilmember Hougardy attended the Fire Exploratory Committee meetings on August 24 and August 31, 2010 She also attended the Duwamish Neighborhood meeting. On September 7, 2010 she attended the Intergovernmental Affairs Committee meeting Councilmember Quinn expressed appreciation to Councilmember Robertson for the opportunity to facilitate the Committee of the Whole meeting on August 23, 2010 He also attended the Duwamish Neighborhood meeting. c. Intergovernmental The Council Analyst is not required to attend Regular Meetings. MISCELLANEOUS Councilmember Seal referenced statements from Pam Carter under Citizen Comments this evening She would like to see the Council pursue opposition to Initiatives 1100 and 1105 regarding the privatization of liquor sales. The Councilmembers discussed this issue and agreed that a resolution opposing the 2 initiatives should be considered by the Finance and Safety Committee. Mayor Haggerton complimented the Council on their handling of the budget in light of some of the issues occurring within other jurisdictions.
