It will last no more than 30 minutes, and no decisions will be made during the Executive Session. Attendees: Jim Haggerton, Mayor; Steve Lancaster, City Administrator; Shawn Hunstock, Finance Director; Stephanie Brown, Human Resources Director; Cabot Dow, Labor Consultant; Tukwila City Councilmembers Joe Duffie, Joan Hernandez, Dennis Robertson, Allan Ekberg, Verna Seal, De'Sean Quinn. 6 p m Councilmember Hougardy entered the Council Chambers End. 7 p.m COMMITTEE OF THE WHOLE MEETING CALL TO ORDER/PLEDGE OF ALLEGIANCE Council President Robertson called the Tukwila City Council meeting to order at 7 p.m. and led the audience in the Pledge of Allegiance. OFFICIALS Present were Dennis Robertson, Council President; Councilmembers Joe Duffie, Joan Hernandez, Allan Ekberg, Verna Seal, Kathy Hougardy, De'Sean Quinn. CITY OFFICIALS Jim Haggerton, Mayor; Steve Lancaster, City Administrator; Shawn Hunstock, Finance Director; Peggy McCarthy, Deputy Finance Director; Bob Giberson, Public Works Director; Gail Labanara, Public Works Analyst; Stephanie Brown, Human Resources Director; Rick Still, Parks and Recreation Director; Shannon Fisher, Special Events Coordinator; Nick Olives, Fire Chief; Chris Flores, Assistant Fire Chief; Dennis McOmber, Police Commander; Mary Miotke, Information Technology Director; Kimberly Matej, Council Analyst; Melissa Hart, Deputy City Clerk. CITIZEN COMMENTS Sheila Malbrain, 14255 53` Avenue South, indicated that she walks to work and is concerned with the safety of the pedestrians that use the walkway along Macadam Road. She explained that the walkway is not clearly defined, and she would like to see clear markings to better identify it as a walkway. Councilmember Seal explained the Transportation Committee could review this item SPECIAL ISSUES a. Authorize the Mayor to Accept Grant Funding from the U.S. Department of Justice for the Secure Our Schools Project in the amount of $76,437.00. (No City match required.) Councilmember Quinn indicated this item was discussed at the Finance and Safety Committee meeting on November 2, 2010. The committee members were unanimous in recommending approval The Tukwila Police Department is seeking acceptance of a U.S Department of Justice Community Oriented Policing Services Secure Our Schools grant in the amount of $76,437. The Tukwila School District will provide a 50% match of grant funds, and the Tukwila Police Department will handle fiscal management and reporting to the U S. Department of Justice The goal of the grant application is Tukwila City Council Committee of the Whole Minutes November 8, 2010 Page 2 of 4 designed to increase school safety, deter criminal incidents, improve the effectiveness of identifying individuals involved in unsafe and /or criminal activity, and to control access to the school buildings COUNCIL CONSENSUS EXISTED TO FORWARD THIS ITEM TO THE NEXT REGULAR MEETING. b. Water and Sewer Code Changes. Councilmember Hougardy indicated these items were discussed at the Utilities Committee meeting on October 26, 2010 The committee members were unanimous in recommending approval. 1. An Ordinance relating to the updating and expanding of the regulations relating to Water Rates and Backflow Prevention Assemblies within the City. 2. An Ordinance relating to the updating and expanding of the regulations relating to Sewer Rates and Discharge within the City. These 2 ordinances will update the water and sewer regulations in the Tukwila Municipal Code, Chapters 14 04, 14 06, 14.12 and 14.16. Besides minor housekeeping items, the new additions with fees include special meter reads, unauthorized water usage, and updating utility records. Interest will now be charged on delinquent water and sewer bills, rather than a flat late fee Backflow prevention assemblies, unlawful discharge of prohibited foreign substances, and exhaust steam and hot water have all been updated to the current regulations. The Councilmembers reviewed the 2 proposed ordinances and the technical changes to the sewer ordinance and asked clarifying questions of staff Council President Robertson requested the reference to the "Finance Director" in section 14.16.020 (page 32 of the agenda packet) be changed to "Finance Department." 3. A Resolution adopting a New Public Works Fee Schedule. Gail Labanara, Public Works Analyst, indicated that the City's Water, Sewer, and Surface Water rates need to be increased to meet operational and capital expenditures for their corresponding enterprise funds The single and multi family minimum water meter charge will increase from $8 00 to $10.00. The sewer fund's monthly residential flat rate will increase from $13.39 to $16 06 King County is increasing their sewer fee from $31.90 to $36.10 per month in 2011. The Surface Water fees will increase from $85.00 to $93 00 for residential parcels. COUNCIL CONSENSUS EXISTED TO FORWARD THIS ITEM TO THE NEXT REGULAR MEETING. c. An Ordinance amending Tukwila Municipal Code Chapter 5.04 regarding Business Licenses and Regulations. Councilmember Quinn indicated this item was discussed at the Finance and Safety Committee meeting on November 2, 2010. The committee members were unanimous in recommending approval. Shawn Hunstock, Finance Director, explained the City has a number of unpaid and /or delinquent customer accounts whose collectability could increase if there was an enforceable action that could be taken in response to non payment. He indicated the updates to Tukwila Municipal Code Chapter 5.04 address the denial and revocation of a business license due to non payment of fees due and owing to the City With the adoption of the proposed ordinance, the Finance Department will become the issuing Department for business licensing. COUNCIL CONSENSUS EXISTED TO FORWARD THIS ITEM TO THE NEXT REGULAR MEETING. d. Budget follow -up from the October 19, 2010 Budget Work Session: Special Community Events. Council President Robertson explained that at the October 19, 2010 Budget Work Session, the Council requested additional information on the costs and benefits of special community events such as Tukwila Days, Family 4 at the Fort, and the Backyard Wildlife Festival. Rick Still, Parks and Recreation Director, explained that City events having a special theme have attracted more Tukwila residents to the events. Staff is proposing to continue with the Backyard Wildlife Tukwila City Council Committee of the Whole Minutes November 8, 2010 Page 3 of 4 Festival, reduce hours for the Family 4th at the Fort event, and conduct 3 mini Tukwila Days events in the neighborhoods to replace the current one -day event. Mr Still reviewed the following proposed events: Backyard Wildlife Festival proposed budget: $15,000 (funding through lodging tax funds) Tukwila's Family 4 at Fort Dent reduced hours and a proposed budget of $35,000 Tukwila Days Mini Event 1: Tukwila Kids' Festival (June 2011) proposed budget of $2,500 Tukwila Days Mini Event 2• Tukwila's History Culture Fair (August 2011) proposed budget of $2,500 Tukwila Days Mini Event 3 Tukwila Truck Safety Fair (Sept/Oct 2011) proposed budget of $2,500 The Councilmembers discussed the events recommendation and asked clarifying questions of staff COUNCIL CONSENSUS EXISTED TO INCORPORATE THE STAFF PROPOSED EVENT CHANGES IN THE 2011 -2012 BUDGET. e. Budget follow -up from the October 19, 2010 Budget Work Session: Fire Department. Nick Olivas, Fire Chief, explained that at the October 19, 2010 Budget Work Session, the Council requested that City Administration provide additional information on the proposed Fire Department program and service reductions. Since that work session, the Administration's budget proposal has been modified in response to a tentative agreement reached with Tukwila Firefighters Local No. 2088, which reduces the cost of compensation for 2011. Chris Flores, Assistant Fire Chief, utilized a PowerPoint presentation to update the Council on the following Hazardous Materials HAZ -MAT Participation Zone: County, Regional, and State Technical Rescue Technical Rescue Participation. Zone, County, Regional, and State Type of Mutual Aid received and provided in the past 5 years Fire Department Overtime The Council asked clarifying questions of staff on the above topics. f. Briefing on Memorandum of Understanding by and between the City of Tukwila and Tukwila Firefighters Local No. 2088. Stephanie Brown, Human Resources Director, explained that City Administration and the Tukwila Firefighters Local No 2088 have reached an agreement on a wage freeze for 2011. This agreement will result in the Administration recommending that the 3 firefighter positions that were proposed for elimination in the 2011 -2012 Preliminary Budget be restored. The Administration has also agreed to continue discussions with the Union regarding the costs and benefits of a Law Enforcement Officers' and Firefighters' Plan 1 (LEOFF) buyout. The City will notify the Union of the outcome of the analysis by November 30, 2010 Mayor Haggerton commended and thanked the Firefighters of Local No. 2088 for support and acceptance of the City's proposal. COUNCIL CONSENSUS EXISTED TO FORWARD THIS ITEM TO THE SPECIAL MEETING THIS EVENING. REPORTS a. Mayor Mayor Haggerton attended the Tukwila Urban Access (Klickitat) bid opening on November 4, 2010. City Council Councilmember Duffie attended the November 8, 2010 Community Affairs and Parks Committee meeting. He also reminded the Council of the Veterans Day Assembly at Tukwila Elementary School on Friday, November 12, 2010, with the program commencing at 2:00 p.m Councilmember Hernandez attended the Tukwila Government Affairs Committee meeting on November 2, 2010. On November 4, 2010, she attended the Equity and Diversity Commission meeting Councilmember Ekberg participated in the Southwest King County Chamber of Commerce Senior Housing Assistance Group (SHAG) tour on November 4, 2010 Councilmember Hougardy alerted the Council that the Duwamish Gardens grant acceptance will be reviewed at the November 9, 2010 Utilities Committee meeting, and due to time constraints, will not follow the standard Council process Councilmember Quinn commended the first responders who assisted the young woman in distress at the King County Courthouse on November 4, 2010. Council President Robertson explained that in light of a recent news story about a Tukwila hotelier, he plans to make the safety in local lodging and a nuisance ordinance his top priority for 2011 c. Staff There was no report. d. City Attorney The City Attorney's presence is not required at Committee of the Whole meetings e. Intergovernmental Kimberly Matej, Council Analyst, announced that the 2011 Council Coffee Chat information will be forthcoming MISCELLANEOUS Mayor Haggerton acknowledged the City Clerk's Office for the purchase of an atomic clock that has proven beneficial in the acceptance of bids.
