OFFICIALS Present were Dennis Robertson, Council President; Councilmembers Joe Duffie, Allan Ekberg, Kathy Hougardy Councilmembers Hernandez, Seal and Quinn were not in attendance CITY OFFICIALS Jim Haggerton, Mayor; Steve Lancaster, City Administrator; Shawn Hunstock, Finance Director; Bob Giberson, Public Works Director; Gail Labanara, Public Works Analyst; Kimberly Matej, Council Analyst; Melissa Hart, Acting City Clerk. CITIZEN COMMENTS There were no citizen comments. PUBLIC HEARINGS 7:11 p.m. Council President Robertson opened the public hearing and called for public comments. a. Budget Legislation: 1. An Ordinance adopting the Annual Budget for the 2011 -2012 biennium. 2. A Resolution adopting the 2011 -2016 Financial Planning Model and Capital Improvement Program. 3. An Ordinance amending Ordinance No. 2221, which adopted the Budget for the 2009 -2010 biennium. There were no public comments Council President Robertson explained that due to the severe weather situation, he would like the Council to continue the Public Hearing to the December 6, 2010 Regular Meeting. COUNCIL CONSENSUS EXISTED TO CONTINUE THE BUDGET LEGISLATION PUBLIC HEARING TO THE DECEMBER 6, 2010 REGULAR MEETING. b. An Ordinance increasing the Regular Property Tax Levy one percent from the previous year commencing January 1, 2011, on all property, both real and personal. 7:12 p.m. Council President Robertson opened the public hearing and called for public comments. Budget Legislation: Council President Robertson indicated this item was discussed at the Finance and Safety Committee meeting on November 16, 2010 The committee members were unanimous in recommending approval 1. An Ordinance adopting the Annual Budget for the 2011 -2012 biennium. 2. A Resolution adopting the 2011 -2016 Financial Planning Model and the Capital Improvement Program. 3. An Ordinance amending Ordinance No. 2221, which adopted the Budget for the 2009 -2010 biennium. Council President Robertson explained that due to the severe weather situation, the Council discussion will occur at the December 6, 2010 Regular Meeting. COUNCIL CONSENSUS EXISTED TO FORWARD THIS ITEM TO THE NEXT REGULAR MEETING. b. Tax Levy Legislation. Council President Robertson indicated this item was discussed at the Finance and Safety Committee meeting on November 16, 2010 The committee members were unanimous in recommending approval. Shawn Hunstock, Finance Director, explained the City's current levy rate for 2010 is $2.66 per $1,000 of assessed value. In order for the City to levy the maximum of 101 of 2010 revenue, a levy rate of $2.78 would be needed for 2011. The change in levy of $0.12 represents a 4 5% increase over the 2010 levy rates With an average home value of $300,000, with no change in assessed value, the increase in levy rate would cost approximately $36.00 per year for a Tukwila resident. 1. An Ordinance levying the General Taxes for the City of Tukwila in King County for the fiscal year commencing January 1, 2011, on all property, both real and personal. 2. A Resolution declaring a Finding of Substantial Need relating to the City of Tukwila Property Tax Levy commencing January 1, 2011. 3. An Ordinance increasing the Regular Property Tax Levy one percent from the previous year commencing January 1, 2011, on all property, both real and personal. COUNCIL CONSENSUS EXISTED TO FORWARD THIS ITEM TO THE SPECIAL MEETING THIS EVENING. c. A contract with Atkinson Construction for the Tukwila Urban Center Access (Klickitat) Project in the amount of $10,880,180.00. Bob Giberson, Public Works Director, explained that this item was discussed at the Transportation Committee meeting on November 15, 2010. The committee members were unanimous in recommending approval. This project will provide roadway improvements on Southcenter Parkway, Klickitat Drive, and Strander Boulevard by constructing an underpass for the southbound lane on Southcenter Parkway. Seven bids were received and opened on November 4, 2010. The low bid of $10,880,180.00 was from Guy F Atkinson Construction, LLC, who has completed many large construction projects for the Washington State Department of Transportation (WSDOT) COUNCIL CONSENSUS EXISTED TO FORWARD THIS ITEM TO THE SPECIAL MEETING THIS EVENING. A supplemental agreement to contract #05 -071 with HNTB for design work for the Tukwila Urban Center Access (Klickitat) Project in the amount of $107,764.00. Bob Giberson, Public Works Director, explained that this item was discussed at the Transportation Committee meeting on November 15, 2010. The committee members were unanimous in recommending approval The design of the Tukwila Urban Center Access (Klickitat) Project has a number of outstanding issues requiring the additional Supplement No. 11 with HNTB. The supplement will design WSDOT's requirements of a monotube sign bridge on Southcenter Parkway and the Puget Sound Energy and Qwest utility duct bank to avoid major utility conflicts COUNCIL CONSENSUS EXISTED TO FORWARD THIS ITEM TO THE NEXT REGULAR MEETING. e. A contract with Western Systems of Everett, Washington, for 3 ITS traffic signal control cabinets for the Tukwila Urban Center Access (Klickitat) Project in the amount of $64,326.87. Bob Giberson, Public Works Director, explained that this item was discussed at the Transportation Committee meeting on November 15, 2010. The committee members were unanimous in recommending approval. This purchase is to provide the Tukwila Urban Center Access Project with 3 traffic control cabinets that are to be supplied by the City. The 3 new cabinets will be built to specifications of the City's Intelligent Transportation System (ITS), which provides real -time remote signal and closed circuit television. The cabinets will be provided to the contractor for the project intersections at Interstate 5 /Nordstrom, Klickitat Drive and the new intersection at the Doubletree /McDonalds sites COUNCIL CONSENSUS EXISTED TO FORWARD THIS ITEM TO THE NEXT REGULAR MEETING. f. A contract with Western Systems of Everett, Washington, for 4 ITS traffic signal control cabinets for the Southcenter Parkway Extension Project in the amount of $85,769.16. Bob Giberson, Public Works Director, explained that this item was discussed at the Transportation Committee meeting on November 15, 2010. The committee members were unanimous in recommending approval. This purchase is to provide the Southcenter Parkway Extension Project with 4 traffic control cabinets that are to be supplied by the City. The 4 new cabinets will be built to specifications of the City's Intelligent Transportation System (ITS), and upon completion the cabinets will be provided to the contractor for the project intersections at Southcenter Parkway /South 200 E -line, D -line, and Segale Drive C sites COUNCIL CONSENSUS EXISTED TO FORWARD THIS ITEM TO THE NEXT REGULAR MEETING. g. Grant acceptance from the State of Washington Salmon Recovery Funding Board for the Duwamish Gardens site in the amount of $197,299.00. Councilmember Hougardy indicated this item was discussed at the Utilities Committee meeting on November 9, 2010 The committee members were unanimous in recommending approval Bob Giberson, Public Works Director, explained that a grant has been awarded to the Duwamish Gardens Project by the Washington State Recreation and Conservation Office's Salmon Recovery Funding Board. The City has been awarded $197,299.00 for the design of the project site. COUNCIL CONSENSUS EXISTED TO FORWARD THIS ITEM TO THE SPECIAL MEETING THIS EVENING. An Ordinance adopting the Development Agreement between the City of Tukwila and WEA Southcenter LLC regarding traffic impact fees for the development of Southcenter Mall. Bob Giberson, Public Works Director, explained that this item was discussed at the Transportation Committee meeting on November 15, 2010 The committee members were unanimous in recommending approval. The development agreement between the City and WEA Southcenter LLC determines the methodology and process for calculating traffic impact fees for future expansion or renovation of the Westfield Southcenter Mall. The development agreement will treat the Mall as one site for the purpose of traffic impact fee analysis, establish a "trip ceiling" for the maximum number of trips for the site, allows for a "trip bank" to be created, and streamlines the process for providing traffic analysis to the City. Council President Robertson requested the discussion for this item be conducted at the December 6, 2010 Regular Meeting COUNCIL CONSENSUS EXISTED TO FORWARD THIS ITEM TO THE NEXT REGULAR MEETING. i. A contract with Kenyon Disend PLLC for legal services for 2011 -2012 in the amount of $35,500.00 per month plus expenses. Councilmember Ekberg explained that this item was discussed at the Finance and Safety Committee meeting on November 16, 2010. The committee members were unanimous in recommending approval. The current contract for legal services expires 12/31/10. The proposed 2011 -2012 contract for general City Attorney, Prosecutor and Paralegal Services is $35,500.00 a month, plus expenses. This reduced rate offers a monthly savings of $4,286.00. Council President Robertson requested the discussion for this item be conducted at the December 6, 2010 Regular Meeting COUNCIL CONSENSUS EXISTED TO FORWARD THIS ITEM TO THE NEXT REGULAR MEETING. REPORTS a. Mayor Mayor Haggerton thanked the Council and staff for braving the weather to attend the meeting. b. City Council Council President Robertson explained that the Council will receive an update on the Fire Exploratory Committee findings at the December 6, 2010 Regular Meeting c. Staff There was no report. d. City Attorney The City Attorney's presence is not required at Committee of the Whole meetings e. Intergovernmental There was no report.
