As proposed, the ground equipment was setback 10 feet from the side yard but only 7 feet from the rear property line. In addition, the applicant did not submit a Landscaping Plan, pursuant to code requirements for uses in HDR zones. Staff notified the applicant of these two conditions prior to the hearing but before the applicant could submit materials that could be incorporated into the staff report on this matter. Subsequent to the preparation of the staff report, applicant did file revised plans to address the setback and landscaping requirements. The revised plans now indicate that the ground equipment will meet the 10 foot setback requirements. As proposed the landscaping plan meets the requirements under the code but does not provide screening of the ground equipment from public view. Applicant originally proposed a five foot wide landscaping screen around the ground equipment. Further, applicant has proposed in the submitted landscaping plan that certain shrubs be removed from the site to accommodate the ground equipment. The proposal includes the ground mounting of 5 equipment cabinets. These cabinets will house a primary radio cabinet for processing signals, a back -up generator, a power cabinet designed to transfer power from utilities . to operate radio equipment and two auxiliary cabinets for increased capacity. Two antenna arrays will be mounted on the roof of the apartment building. One array, comprised of 4 antennae, will be at the north end of the building and will measure 27.5 inches (2 1/4 feet) above the roof. The central array, also comprised of 4 antennae, measures 60.34 inches (5 feet) above the roof. A Global Positioning System (GPS) antenna disk, measuring 2" by 4" will be mounted on the rooftop next to an antennae array. The GPS is used for system timing. The ground cabinets and the rooftop antennae will be connected through a cabling system trenched between the cabinets and the building, then mounted onto the north side the building to the antennae. The cabling will be protected in a covered tray throughout its course on the building. Electrical power to operate the equipment will be provided through existing Seattle City Light service to the apartment complex. Connections between the electrical room and the ground equipment will be made through a 230 foot trench from the building through the parking lot. A twelve (12) foot light pole will also be installed within the proposed 5 foot landscape buffer provided to screen the ground equipment. Telephone services will also be available at the ground cabinets. Applicant will also replace 75 feet of fencing along the side property line. Existing Development The site is currently occupied by the Villa Nelle Apartments, a multi - family complex located within a HDR zone. Surrounding Land Uses FINDINGS There are several multi - family complexes at the north end of the site, fronting S. 144th, including the Riverton View, LaRochelle and Colonial Apartments. These properties are zoned HDR. The south edge is fronted by S. 146th, with the . DeCara Apartments, zoned Regional Commercial (RC), across the street. To the 2 Staff Report to the L96 -0034 Planning Commission Sprint Spectrum west edge is the Victoria Arms apartment complex, also zoned HDR and to the east is a triplex unit, immediately followed by Larry's Market. These properties are zoned HDR and Neighborhood Commercial Center (NCC), respectively. Topography The terrain is generally flat at the location for the proposed ground- mounted cabinets, however there is a steep grade change approximately 5 feet from the rear property line. The rooftop of the building is also flat, with a mansard -style roof facade. Vegetation There are some existing shrubs where the ground mounted cabinets will be located. Applicant has proposed removing existing to be replaced with evergreens that shield the cabinets and fencing that will be installed around the cabinets. Access Access to the ground equipment will be made through a gated fence around the equipment. Ground equipment will be located to the northwest edge of the existing parking lot. Rooftop antennae will be accessible through an existing door. Alarms will also be included on the ground equipment in case of intruders. ZONING CODE REGULATIONS The proposed project must conform with criteria detailed in Zoning Code section 18.64.050, (1 -5), concerning Conditional Use Permits: (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is located. Applicant indicates that the facility "does not emit harmful rays, noxious odors, heat, excessive noise or pollutants ". Applicants also indicated that approximately 24 trips per day would be generated during construction, followed by 1 trip per month for maintenance. Applicants indicated that antennae are painted to blend in with their surroundings. Applicants have also proposed to include fencing and lighting to improve security around their ground equipment, as well as ensuring limited access to the rooftop antennae, via access only through the apartment building. (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. 3 Staff Report to the L96 -0034 Planning Commission Sprint Spectrum The applicant has proposed that the ground equipment be sited approximately 10 feet from the side property line and approximately 7 feet from the rear property line. The applicant has also proposed that a five foot landscape buffer be installed around the front and sides of the ground equipment, with the rear of the ground cabinets exposed. .(3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. According to the applicant, 24 trips per day will be generated during the 2 week construction period and following the completion of construction, 1 trip per month for maintenance. To mitigate the project's impact on the existing building and site, the applicant has proposed that the ground equipment will be screened with vegetation. Cabling attached to the building will also be enclosed and painted a color to match the building. All . antennae will be painted to blend in with their surroundings. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 12.1.34. Actively coordinate project implementation with individual utilities based upon Tukwila's Comprehensive Plan and development regulations. When completed, the project will use existing electrical services provided to the apartment complex. The applicant will extend utilities from the electrical room in the basement of the apartment building to the ground equipment. The applicant has secured service from Seattle City Light. The applicant has also secured services from U.S. West for the operation of an on -site telephone services. 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure, use of existing structures and installation of telephone switching facilities in buildings compatible with the surrounding area. The applicant is not proposing a facility that will be shared with any other PCS providers, however the project allows for future expansion of existing ground infrastructure and placement of additional antennae within the existing arrays. The applicant has indicated that no similar provider has expressed interest in this project. 4 Staff Report to the L96 -0034 Planning Commission Sprint Spectrum To minimize visual impacts associated with this project, the applicant will paint the rooftop antennae to blend with the surrounding environment. The applicant also indicated they will screen the ground level equipment with evergreens shrubs, to provide year -round coverage. 5) All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. The applicant has proposed the installation of a five foot landscaping screen around the structure, as detailed above. The applicant has also proposed that a fence be erected between the cabinets and the landscaping, as well as a fence extending 75 feet from the side and rear property line corner, running 75 feet from this point south along the side property line. The fencing has been proposed to provide security for the ground equipment. A 12 foot light pole has also been proposed to provide additional security. The antennae array on the roof will be painted a color that will help them blend in with their surrounding. All of these elements are proposed by the applicant to mitigate possible adverse aesthetic impacts of the project. The proposed project must also conform with zoning code requirements for new developments in the HDR zone, specifically dealing with landscape and setback. Tukwila. Zoning Code section 18.14.070, HDR basic development standards, requires a 10 foot landscaping buffer from both side and rear yards. This section also requires a setback of 10 feet from the side and rear property lines. The applicant has proposed a 5 foot landscaping border surrounding the front and sides of the ground cabinets, with none proposed for the rear. Further, the applicant has proposed that ground cabinets are 10 feet from the side property line and 7 feet from the rear property line. CONCLUSIONS Zoning Code regulations concerning Conditional Use Permits: (1) The proposed use will not be materially detrimental to the public welfare... PCS facilities had been found to not emit harmful rays or pollutants. Transportation will be limited during 2 week construction period and will require one trip per month after construction for maintenance. Therefore, conditions have been satisfied. (2) The proposed criteria shall meet or exceed the performance standards... As submitted, the landscaping proposed by the applicant does not meet this standard. Further, the ground equipment must be setback 10 feet from the side and the rear property line. Applicant's proposal has a 10 foot setback from the side yard but only 7 feet from the rear yard, which does not meet code requirements. For developments in the HDR zone, landscaping must be consistent with applicable regulations in Chapter 18.52 of the Zoning Code, including provisions that require landscaping plans developed by a Landscape Architect licensed in Washington State. Landscaping should also be included along the remaining sides of the ground equipment that shield its use but does not impair access for maintenance purposes. The applicant has been contacted about these provisions and indicated they will comply with setback requirements for the equipment and the development of a landscaping plan meeting the requirements of Chapter 18.52. The applicant will present these amendments, including their landscaping plan, at the time of the public hearing. (3) The proposed development shall be compatible generally with the sun'ounding... There will be a maximum of 24 trips per day during the two week construction period, followed by one trip per month for scheduled maintenance. The ground equipment will be secured. The rooftop antennae will be painted a color to blend with their surroundings. The cabling between the ground equipment and the antennae will be enclosed in protective covering and painted to match the building. The ground equipment is sited to the rear of the building, away from common areas. Applicants have proposed to screen the equipment with vegetation. Upon submission of a Landscaping Plan meeting code requirements and appropriate vegetation screening, all conditions will be satisfied. (4) The proposed use shall be in keeping with the goals and policies... The project is consistent with Land Use Policies 12.1.34 and 12.1.36, respectively. Therefore, conditions have been satisfied. (5) All measures have been taken to minimize the possible adverse impacts... As indicated, the landscaping plan proposed by applicant is inadequate to meet the standards in the HDR zone. All other items proposed by applicant to mitigate adverse impacts, including the fencing and light pole and painting of antennae, are satisfactory. Upon submission of an Landscaping Plan meeting code requirements and appropriate vegetation screening, all conditions will be satisfied.
