Mullet called the Regular meeting to order at 7:00 p.m. and led the audience in the Pledge of Allegiance. City Clerk Jane Cantu called the roll of Council. Present were Council President Joe Duffle; and Councilmembers Joan Hernandez, Pam Carter, Jim Haggerton, Pamela Linder, Dave Fenton and Richard Simpson. City Administrator John McFarland; City Attorney Bob Noe; City Clerk Jane Cantu; Deputy City Clerk Bob Baker Council Analyst Lucy Lauterbach; Finance Director Alan Doerschel; Community Development Director Steve Lancaster; Public Works Director Jim Morrow; Police Chief Keith Haines and Parks Recreation Director Bruce Fletcher. Also present were Associates Engineers Mike Cusick and Jill Mosqueda. SPECIAL PRESENTATIONS: a. Swearing in of Lateral Police Officer Karen Herritt Police Chief Keith Haines introduced Ms. Karen Herritt. This laterally hired police officer comes to Tukwila from the City of Arcada, California. Mayor Mullet administered the Oath of Office to Ms. Herritt. c. Presentation on Regional Transit Sales Tax Proposal David Hopkins Regional Transit Manager, King County Executive's Office (considered out of order at the request of Mayor Mullet item heard before Item c) David Hopkins addressed the Council on the .2 percent Regional Transit Sales Tax proposal. King County Executive Ron Sims presented his proposed budget to the King County Council today. His Transportation Budget proposal provides recommendations for guiding future Metro Transit Services and capital investments if voters approve a .2 percent sales tax measure on November 7. The proposal would keep buses moving; enhance Metro Transit service and focus on congestion relief projects. The proposed tax would raise $80 million to restore bus service, set to be eliminated because of voter approved Initiative 695. Temporary funds approve by the City of Tukwila Page 2 of 14 City Council Regular Meeting Minutes October 16, 2000 Legislature will be depleted by spring, 2001. Thus, they are giving counties the opportunity for local- option taxes to preserve local transit service. Mr. Hopkins then reviewed the contents of a packet of information distributed to Council. He noted a few of the highlights of the local- option tax would enhance the overall transit system by strategically adding another 575,000 annual service hours over the next six years to the 3.3 million service hours currently provided. If the revenues are not generated, bus service would be reduced by about 500,000 annual service hours in 2001. Future transit related improvements were also highlighted. At the same time, Mr. Hopkins fielded questions from the City Council. Councilmembers spoke in general support of the proposed transportation budget proposal. Councilmember Hernandez asked if a notation could be included with the proposal to Sims' Office that the City of Tukwila is in need of, support for increased park, and ride enhancements in the Tuwkila area. Councilmember Carter agreed noting the current park and ride is over utilized as it attracts riders from far away places. Councilmember Carter spoke in favor of sending a letter of support to Sims' Office with inclusion of a notation regarding the park and ride situation in Tukwila. Councilmembers concurred. Mayor Mullet noted a letter would be drafted and distributed to Council before being sent. b. Mayor's presentation of 2001 Proposed Budget Financial Planning Model/CIP. (considered out of order at the request of Mayor Mullet item heard after item c) Mayor Mullet proudly distributed his first proposed budget to the City Council. Noting the City must move forward as quickly as possible to maintain pace with area growth and booming businesses, Mayor Mullet stated this is the most complex and convoluted set of issues to date, in his nine years of association with the Tukwila City Council. On a high note, Mayor Mullet noted Tukwila continues to prosper with new sewer lines, residential construction, increased businesses, commercial and residential street improvements; and, the construction of Cascade Park may soon be under way. He said public safety will be enhanced and economic development will be addressed. Mayor Mullet noted the budget reflects a conservative approach to anticipated revenues using a variety of economic theories. Increased staffing is allowed and necessary for the City to keep up with the times or we could all fail. PROCLAMATIONS /APPOINTMENTS: a. Annointments to Boards Commissions: Parks Commission Renea Blanchette Position #2 Term Expires 03/31/03 (fills unexpired term) City of Tukwila Page 3 of 14 City Council Regular Meeting Minutes October 16, 2000 Bruce Fletcher introduced Renea Blanchette. Ms. Blanchette has volunteered with and work with youth soccer for a long time. At one point, she was recognized as being the volunteer who put in the most hours in the area of youth soccer. She will be a tremendous asset to the Commission. Hernandez moved; Linder seconded; the appointment of Renea Blanchette to Position #2 of the Parks Commission with a term set to expire on 03/31/03. Said appointment fills an unexpired term. The motion carried 7 -0. b. Sister City Committee Kathy Znak, Position #5 Term Expires 12/31/02 (fills unexpired term) John McFarland introduced Kathy Znak who served as an Ad Hoc Committee member recently when the visiting Ikawa delegation arrived earlier than expected. Mr. McFarland noted Kathy maintains a tremendous sense of organization and will bring much to the Sister City Committee. Carter moved; Hernandez seconded; the appointment of Kathy Znak to Position #5 of the Sister City Committee with a term set to expire on 12/31/02. Said appointment fills an unexpired term. The motion carried 7 -0. CITIZEN COMMENT /CORRESPONDENCE: Troy Wallin. 12607 East Mareinal Wav South, Tukwila, spoke out regarding a neighbor on the corner of East Marginal Way South and 30th Avenue South. He noted the property is in disarray and reflecting poorly on the neighbors the neighborhood in general. He spoke of two camper units being on the site; one currently being occupied. Mr. Wallin asked Council whom he could speak to regarding the situation. Mayor Mullet identified the property as the Hemmerling property; with which the City is currently involved with litigation. The Mayor noted the City is currently awaiting a court date for that item. Bruce MacVeieh, 14245 59th Avenue South. Tukwila, spoke against the ability of buses to change traffic lights at their will; yet not against the .2% tax in general. He asked the Council to envision the intersection of Interurban and Grady when three buses approach it at the same time. He stated his disbelief in the sophistication of the proposed traffic plan as outlined by Mr. Simms' Office. This type of work is done on theory; not practice. Bob Bernhardt. 3418 South 126th. Tukwila. spoke in opposition to the neighbors' property, previously mentioned by Troy Wallin. One of the people who live in one of the trailers (previously mentioned by Wallin) approached Mr. Bernhardt and asked if they could put their trailer on his vacant lot and live in it. He response was in the negative. Mr. Bernhardt asked if a petition in favor of clean up and reconditioning of the lot would be in order. City Attorney Bob Noe responded in the affirmative. Additionally, Mr. Noe stated written affidavits or declarations as to the condition of the property or views of the neighbors may also be helpful. CONSENT AGENDA: a. Approval of Minutes 10 -02 -00 Regular Meeting b. Approval of Vouchers #223986- 224258, in the amount of $1,034,862.76 City of Tukwila Page 4 of 14 City Council Regular Meeting Minutes October 16, 2000 c. Approve the position reclassification of Recreation Supervisor to Recreation Superintendent Duffie moved; Hernandez seconded; approval of the consent agenda, as presented. The motion carried 7 -0. PUBLIC HEARINGS: a. Street Vacation 35th between, Lying between 124th to 126 Mayor Mullet opened the public hearing. Public Works Director Jim Morrow introduced Senior Engineer Mike Cusick, lead person on this proposed vacation. Mr. Cusick used a large map to outline the affected area in question. Property to the east is owned by the Sabey Corporation. The property to the west, except corner lot is also owned by the Sabey Corporation. He also showed the Bernhardt parcels as well. The proposed vacation is to allow for use for the Exodus site and Group Health. Councilmember Duffie confirmed that once the street is vacated, it will not be re- opened. Mr. Cusick responded that the street will be left opened for the use of the Sabey Corporation and bollarded off to allow for ingress and regress of fire trucks to the site. Mr. Cusick also stated that if Mr. Barnhardt's property is ever developed, they will be allowed egress to their parcels from 124th, via easement, as part of the proposed ordinance. Councilmember Carter questioned the zoning determination in the immediate area affected. Mr. Cusick responded this is MIC Light (on the North side of 126th). On the south side, the zoning is residential. It was clarified that there are actually two single- family residences on the Bernhardt property. They would have access from the south as long as they like, unless they ever develop commercially. At that time, they would have to enter from South 125th. Councilmember Linder confirmed bollards will be present, that are able to be removed in the area, that can be removed. Mr. Cusick said they will be breakaway bollards. Ralph Hagler, o /b /o Sabev Corporation, petitioners in this matter, presented a package to Council which speaks to the methodology and rationale behind the proposed vacation. Mr. Hagler noted the vacation of 35th Avenue will provide safe pedestrian access along the existing 35th Avenue while concurrently precluding vehicular traffic from infringing on either the resident on 126th Street or the unvacated portion of 35th Avenue South. The proposed vacation is a blocked off street which prevents through- traffic into a single family residential neighborhood from MIC Light zoned area. Mr. Hagler noted Sabey Corporation has followed the prerequisites and agreed to perform a number of items requested by the City as a part of allowing the request for vacation to be filed. As part of the agreement, new curbs, gutters and sidewalks would be installed along the east side of the unvacated portion of 35th Avenue. Additionally, provisions for emergency access to the City of Tukwila Page 5 of 14 City Council Regular Meeting Minutes October 16, 2000 southerly portion of the vacated area from South 126th and 35th Avenue South will be made. And, finally, existing utilities will remain in place in addition to a new 8" water line being installed. All at the Sabey Corporation's expense. Mr. Hagler contends that a universal benefit would be achieved for the residents of the neighborhood and Sabey Corporation when the vacation is granted. Improvements by the Sabey Corporation would result in a clean, safe setting for the two homes along 35th Avenue and pedestrians would be allowed continued use of the vacated portion of 35th Avenue to walk, exercise, etc. Next, Mr. Hagler noted that the proposed bollards would be the break -away type; allowing for easy access to the Fire Department in the event of need. No portion of the vacation request abuts any property other than that which belongs to Sabey. After his presentation, Mr. Hagler fielded questions for clarification from Council. Gina Nielson. 12527 35th Avenue South, Tukwila. offered clarifications to Council, from her perspective, as it related to items already covered between Mr. Hagler and Council. A point raised by Ms. Nielson was the application for this matter. She stated her initial confusion as to the identity of the petitioner. For the record, Ms. Nielson has discovered both International Gateway East LLC, Inc., and International Gateway East II LLC, Inc., are both shown, on record, with the State Department of Licensing and Secretary of State as being owned, operated and managed by Sabey Corporation. The petitioner recognizes Robert and Sherry Bernhardt as abutting property owners two total property owners. She asserted that pursuant to RCW 36.79.020, that if 50% of the abutting property owners file a written objection to the proposed vacation, with the Clerk, prior to the hearing, the City shall be prohibited from pursuing a resolution on this matter. She also noted the Bernhardts did object, in writing, and in a timely fashion. Ms. Nielson stated particular areas within the City's staff report that are "a bit deceiving." She noted 35th Avenue South was open, for public use, until October 4, 2000, the date the report was prepared. It was closed after said date. Next, she noted the statement regarding residential properties noted (two, single family residences on the Northwest corner of South 126th Street and 35th Avenue South) is deceiving, in that the residential unit she lives in is immediately adjacent to the proposed vacation boundary. Her garage is within 10 feet of the property line. Additionally, Ms. Nielson noted the drawings in this situation are not to scale. She raised concern over such issues as the salmon habitat in the area, proposed parking lot, conditional easements, easements, access for emergencies, and the possibility of a land lock situation (if the Bernhardt's were to sell their property). Ms. Nielson reminded Council that the neighbors keep the neighborhood clean. They take pride in their community which is comprised of the elderly and first time homebuyers, doing their best to improve the area. City of Tukwila City Council Regular Meeting Minutes Page 6 of 14 October 16, 2000 She spoke in favor of re- opening the closed portion of the street (closed since October 4, 2000) for residential use. Without that, the local community will feel shut out. Finally, she spoke in favor of denying the request for street vacation. Ms. Nielson then fielded questions from Councilmembers. City Attorney Bob Noe provided a legal definition of abutting property owners. "Abutting property owners for purposes of the RCW, are those property owners who, in the event there is a vacation, would take title to the street being vacated." In this case, the Bernhardt property, in the event that portion of the street is vacated, would not take any title to any portion of the street. Therefore, they are not an abutting property owner under the guises of the statute. In layman's terms, Mr. Noe explained that when a street is vacated, property owners that abut take title to the street. The City basically divests itself of any title and the property goes to the property owners that abut. In this situation, the Bernhardt property is not an abutting property, because if the street is vacated, they don't take title to any portion of the street. In this particular situation, there is only one abutting property owner. Rebuttal: Ralph Hagler, o /b /o Sabev Corporation, petitioners in this matter. noted the drawings are not to scale. The scale will be established and no property rights will be infringed upon by any parties. Council sought additional clarification from Mr. Hagler on miscellaneous points previously covered. Moved by Fenton; to hold the public hearing open to allow for the receipt of additional information, input and data on this item before making a decision. The motion died for lack of a second. Rebuttal: Gina Nielson. 12527 35th Avenue South, Tukwila. provided explanation to earlier comments about the bollards. She said that where 35th Avenue South is blocked off, there's approximately 75 feet North of Sabey's northern most property boundary. Sabey proposes the 35th Avenue street vacation go all the way to the most southern property boundary. Additionally, she noted a petition was filed today at 4:45 p.m., with the City Clerk, with signatures of approximately 85 residents in the neighborhood opposing the street vacation. Councilmember Haggerton asked Ms. Nielson for the main objection of the petition. Ms. Nielson's response: everything you just heard me say. Trot/ Wallin. 12607 East Marginal Wav South. Tukwila. noted he was involved in drafting the petition filed today. After speaking with neighbors while gathering signatures, he relayed their overall concern of the perception that the Sabey Corporation will has not (in the past) and will not live up to promises made. City of Tukwila City Council Regular Meeting Minutes Page 7 of 14 October 16, 2000 Donna West 143864 Tukwila International Boulevard, read a letter into the record on behalf of Dwight McLean, unable to be present. The letter is in support of the Sabey Corporation and the street vacation. Gina Vail, 12607 East Marginal Wav South, Tukwila, rebutted a term used in McLean's letter "wasteland She noted nesting hawks and bunnies used to live in the area before building began. She spoke against Sabey buying that street as it's in her neighborhood. Councilmember Linder sought clarification from Ms. Vail based upon her testimony that Ms. Vail wants the street left open; yet if it's closed, she does not want fire trucks to have access. Others, in the past, have testified they wanted streets closed, so that they live on dead end roads. Ms. Vail does not want to see 35th Avenue a main raceway going up to International Boulevard. She'd like it open for pedestrian use, but not for people to get into and out of Intergate East and West, through the neighborhood. She is concerned the City will just open the street on a whim. Sabey does not keep their promises. Mayor Mullet stressed the City does not operate in such a matter. If the street is closed, it stays closed. It doesn't matter who the "owner" of the road is. If it is closed, it stays closed. Bob Bernhardt. 3418 South 126th. Tukwila, noted his objection to the street closure as it'll reduce the net worth of his property. Further, Mr. Bernhardt also rebutted the wasteland statement in McLean's letter. Public Works Director Jim Morrow noted his was responsible for the NO TRESPASSING sign being posted. It was for public safety during construction. 8:50 p.m. Moved by Fenton; seconded by Linder; to keep the record open for an unspecified period of time to allow for the receipt of additional information for Council consideration related to: clarification of map presented by Ralph Hagler; property lines and buffers; property issues; salmon habitat issues; fish ladder distance to proposed parking lot; map to scale showing tax parcels and identifying people's properties who testified; location of proposed bollards; Fire Department input on their position in the matter; traffic circulation diagram with two scenarios (one with 35th opened and one with 35th closed); proposed pedestrian routes; and access options into and out of the neighborhood. The motion carried 7 -0. 9:00 p.m. Mayor Mullet called for a 5 minute recess. 9:10 p.m. Mayor Mullet reconvened the meeting. b. Vacation of Unopened Right -of -Way at the 4200 Block of South 148th Street AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, VACATING CERTAIN PROPERTY LOCATED WITHIN THE CITY, DEDICATED FOR STREET PURPOSES, GENERALLY DESCRIBED AS THE WEST 25' OF LOT 5, BLOCK 1, ADAMS HOTRACTS 2ND ADDITION, AMENDING THE OFFICIAL STREET MAP City of Tukwila Page 8 of 14 City Council Regular Meeting Minutes October 16, 2000 Mayor Mullet opened the public hearing. Public Works Director Jim Morrow introduced Senior Engineer Jill Mosqueda. Ms. Mosqueda noted the area in question is commonly referred to as the Thayer Short Plat. On that property, four parcels have been created with 25 feet of right of way being dedicated for future access to connect 148th to 150th. The property next door dedicated 25 feet when they short platted; as did the two properties south. Since that time, changes have occurred and the City may not get a connection from 148th to 150th. When Thayer did his short plat, the road was built to a standard the City no longer approves. When Northwest Development brought the property, the City requested 1/2 street improvements. Northwest argued. In the course of the argument, a developer's agreement was created. It contains language that the City would vacate the 25 feet of right of way. Twenty Five feet of property will return to each property who originally donated same. From there, there will be maintenance agreements, with five conditions. City Administrator McFarland provided background for Council's consideration. Afterwhich Council sought clarification to issues discussed. Jerry Robeson, o /b /o of Northwest Development, noted this is a situation, which, in his experience, would have been a private road, as part of the original short plat. However, it does not appear that a through street will be achieved. The logical thing is to return it back to a private road, rather than have the City be responsible for its maintenance. Maintenance agreements for responsible parties would be entered into in that situation. Bruce MacVeieh, P.E., Civil Consultant EnEineer, o /b /o property owner Hedin., spoke in favor of the vacation; making the road become "private," with no curbs, gutters or sidewalk provisions. Terry L. Hedin, 4310 South 150th Street. Tukwila, spoke in support of the street vacation. He'll work the others to ensure the private road is maintained. 9:30 p.m. Mayor Mullet closed the public hearing. Hernandez moved; Fenton seconded; to have the proposed ordinance read by title only. APPROVED ORDINANCE #1933 OLD BUSINESS: OF THE CITY; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE a. Tax levies for 2000 from previously- adopted ordinances regarding tax levies from 1999. City of Tukwila City Council Regular Meeting Minutes 1) An ordinance levying the general taxes for the City of Tukwila for the fiscal year commencing January 1, 2000. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, LEVYING THE GENERAL TAXES FOR THE CITY OF TUKWILA IN KING COUNTY FOR THE FISCAL YEAR COMMENCING JANUARY 1, 2000, ON ALL PROPERTY, BOTH REAL AND PERSONAL, IN SAID CITY WHICH IS SUBJECT TO TAXATION FOR THE PURPOSE OF PAYING SUFFICIENT REVENUE TO CARRY ON THE SEVERAL DEPARTMENTS OF SAID CITY FOR THE ENSUING YEAR AS REQUIRED BY LAW; REPEALING ORDINANCE NO. 1889; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE Alan D. noted these are our attempt to re -pass taxes levied in 1999 for 2000. APPROVED ORDINANCE #1934 2) An ordinance relating to the City of Tukwila regular levy from the previous year, commencing January 1, 2000, on all property, both real and personal. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, RELATING TO THE CITY OF TUKWILA REGULAR LEVY FROM THE PREVIOUS YEAR, COMMENCING JANUARY 1, 2000, ON ALL PROPERTY, BOTH REAL AND PERSONAL, IN COMPLIANCE WITH SECTION 209 OF SSB 5835; REPEALING ORDIANCNE NO. 1894; PROVIDING FOR SEVERABILITY; AND ESTABLSHING AN EFFECTIVE DATE Carter moved; Duffie seconded; proposed ordinance be read by title only. City Attorney Bob Noe read the title of the proposed ordinance. Duffie moved; Haggerton seconded; adoption of the proposed ordinance as read.* Discussion: Dwayne Traynor. 14940 58th Ave. So.. Tukwila, spoke against the ordinance and asked Council to "regroup" their thinking on this proposed ordinance. He stated his belief that the ordinance would hurt those on a fixed income. Councilmember Carter confirmed there has been no increase in the property tax rate in at least 3 years for Tukwila residents. At which time, Mayor Mullet asked Finance Director Doersche4l to state the dollar impact to a single family homeowner. Mr. Doerschel responded the increase would be $14 $20 year year. *The motion carried 7 -0. APPROVED ORDINANCE #1936 b. An ordinance vacating a portion of 37th Avenue South, North of South 126th Street. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, VACATING 37TH AVENUE SOUTH FROM 126TH STREET TO APPROXIMATELY 520 FEET NORTH, LOCATED IN THE CITY OF TUKWILA; AMENDING THE OFFICIAL STREET MAP OF THE CITY; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. APPROVED ORDINANCE #1937 NEW BUSINESS: a. An ordinance authorizing short-term financing for the golf course capital plan. Monies may be available for as low as 5% interest. Additionally, Mr. Doerschel noted he may seek the permission of Council to obtain $600,000.00, as the need may exist in the near future. Clarification was sought and Mr. Doerschel informed Council that repayment of the debt is made from golf course revenues received. *The motion carried 7 -0. APPROVED ORDINANCE #1938 b. Authorization to send lodging tax budget to Lodging Tax Advisory Board for Review An Update from Katherine Kertzman on Tourism Marketing. Carter moved; Linder seconded; authorization to send the proposed Lodging Tax Budget for 2001 to the Lodging Tax Advisory Board for review. The motion carried 7 -0. Update from Katherine Kertzman on Tourism Marketing In a year -to -date comparison, Ms. Kertzman informed Council that hotel room rentals at local hotels are up 15% (first nine months of 1999 vs. first nine months of 2000). Advertising efforts are also proving positive as more than 3,750 requests for area information have also been received via telephone and website inquiries. Ms. Kertzman informed Council of the www.thinktukwila.com website. Said website has been added to many search engines and directories, using various ways of spelling Tukwila, so that no matter how the word is spelled, the website will display. City of Tukwila Page 12 of 14 City Council Regular Meeting Minutes October 16, 2000 Next Ms. Kertzman spoke of the Tukwila Raincheck program. This program has 13 hotelier participants and is offered during the offseason (November 1 to March 31) when nightly room rentals are down nearly 40 The premise of the program is as follows: A party rents a room for at least two nights. If it rains at any time during their stay, that party will receive one nights room rental at no charge upon their next visit. In conjunction with this program, the Rainforest Cafe has graciously donated 5,000 to 10,000 gift bags which are then filled with coupons and discounts to local area malls, restaurants, Family Fun Center; movie theaters, etc. Finally, Ms. Kertzman noted that she will continue to work hard on the www.thinktukwila.website design and will not work as many trade shows as in the past. Additionally, she said she will continue her work with the Museum of Flight as it relates to the observance of Memorial Day. Council asked various questions of Ms. Kertzman. Of particular interest was the fact that Seattle hoteliers are down 8% over last year at this time; and SeaTac is down 3% from last year at this time. Conversely, Bellevue is up slightly. Carter moved; Duffie seconded; approval to expend funds in the amount of $1.3 million for the purchase of property for park land.* Discussion: c. A motion approving the purchase of property for park land. Dwayne Traynor, 14940 58th Ave. So., Tukwila, quoting from the CAS associated with this item, noted it said "using the land for a park if possible." He sought clarification and wanted assurance there is no hidden agendas for the property. Mayor Mullet noted there are no hidden agendas and regarding the monies, noted it will be used for a park, absolutely. He also noted the only reason we 're not specifically mentioning the property is because we haven't bought it yet. Dennis Robertson. former City Councilmember, asked has the piece of land been identified. Mayor Mullet and unknown Councilmembers answered in the affirmative. Mr. Robertson noted his hope that piece of land is not owned by a Councilmember. Council President Duffie answered in the negative. Mayor Mullet noted the City Council has been down this road once before. And, with no other discussion, called for a vote on the motion. *The motion carried 7 -0. REPORTS: a. City Council: Councilmember Hernandez attended an October 11 Suburban Cities Meeting as well as the Southwest King County Chamber of Commerce Business luncheon. Ms. Hernandez attended the Finance Safety Committee this evening. Councilmember Carter attended an October 12 Transportation Policy Board Meeting of the Puget Sound Regional Council. She plans to attend an October 17 SCATBd as well as the Foster Community Club meeting. Councilmember Duffie met with Foster High School wherein they discussed a Junior City Council. More information will follow. Councilmember Haggerton attended the October 11 Suburban Cities meeting in Normandy Park. He was happy to see three Councilmembers and the Mayor present. He also attended the T -5 Community Oriented Policing meeting on October 12. Next, he reported attendance at an October 14 Working retreat with ACC members wherein they discussed 2001 goals. Mr. Haggerton plans to attend, and invited others to attend the ACC Annual dinner with the legislators on October 18, 2000. Councilmember Linder announced attendance at a recent King County International Airport Part 150 Advisory study meeting. It would appear that there are virtually no changes for the next 6 years. Cynthia Stewart will bring detailed information to a future Council meeting; especially with regard to certain residents receiving FAA funding for sound insulation of home windows. Funding may be available to those whose homes are up to code. This could cause concern and result in many homes not actually receiving the assistance. More information will follow. Councilmember Fenton will attend the October 18 Apartment Managers Banquet, at 6:30 p.m., at the Tukwila Community Center. Mr. Fenton also announced a lunch with representatives at the Bai Tong II restaurant, Noon, on October 24. Councilmember Simpson attended the Highway 99 Action Committee meeting on October 10 wherein they learned about some of the warning signs and what to look for as it relates to potential methamphetamine labs. c. Staff: City Administrator McFarland noted the draft, supplemental EIS for the Tukwila Freeway Route has been issued. Copies were distributed to Council and analysis is being done at the Staff level. Prior comments presented by the City seem to have been included and incorporated. A draft memorandum of understand between the City and Sound Transit is being worked on as the City gets closer to getting some agreement on the Tukwila Freeway Route. Parties are working toward the same goal of identifying the Tukwila Freeway Route as a viable freeway route. Next, Mr. McFarland noted Bruce Fletcher will be providing an update on the Casey Foundation at the October 23, 2000, C. O. W. meeting. He asked that information in the written update be kept confidential by Councilmembers as it contains items protected under the guises of the Revised Code of Washington. MISCELLANEOUS: Councilmember Carter inquired about Notices of Public Hearings which were reported not to have been received. She asked if City staff could check with the post office to ensure those items are mailed out and in a timely fashion. Mr. McFarland assured her City staff goes above and beyond the State requirements in notifying individuals of public hearings and noted staff also sends them via first -class mail and in a timely fashion.
