CITY OF TUKWILA
ORDINANCE NO. i
AN ORDINANCE REGULATING THE THE PRESENCE OF MINORS BETWEEN
CERTAIN AGES IN PUBLIC STREET AND OTHER PLACES BETWEEN
CERTAIN HOURS, DEFINING THE DUTIES OF PARENTS OR OTHERS IN
REGARD TO SUCH MINORS, PROVIDING PENALTIES FOR THE VIOLATION
THEREOF AND REPEALING ANY AND ALL OTHER ORDINANCES IN CON-
FLICT HEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, AS FOLLOWS:
Sec. 1 Definitions:
(a) The term "street" shall mean any alley, thorough-
fare, pathway, sidewalk, or other place of travel
open to the public.
(b) The term "highway" shall include any road, lane
or other terminal or continuance of any roadway
open to the public.
(c) The term "public place" shall include, but shall
not be limited to places of amusement, entertain-
ment and eating establishments, public buildings,
parks, playgrounds, recreational facilities of
every kind and description, dance halls, vacant
lots or other unsupervised places.
(d) The term "parent" or "guardian" shall mean the actual
parent or legal guardian or the authorized person
having the care, custody or control of such minor
by the consent of such parent or legal guardian or
by court decree.
(e) The hours of time specified in this Ordinance shall
refer to the standard time prevailing in the City
of Tukwila from period to period regardless of
its designation as Pacific Standard Time or
Pacific Daylight Time.
(f) The masculine gender as used in thi4Ordinance shall
include the feminine gender and the singular shall
include the plural.
Sec. 2 It shall be and it is hereby declared to be unlawful for any
person under the age of 15 years to congregate, loiter, idle,
wander, stroll, play or be upon or about any street, highway,
or public place as herein defined between the following sched-
uled dates and hours:
(a) During the months of June, July and August of each
and every year between the hours of 10 P.M. to 5
A.M. each day, and each Friday and Saturday be-
tween the hours of 10 P.M. to 5 A.M. during the
remainder of each and every year.
(b) During the period from September 1 to May 30 of
each year, from Sunday to Thursday, inclusive,
between the hours of 9 P.M. to 5 A.M.
It shall be and it is hereby declared to be unlawful for
any person under the age of 19 years to congregate, loiter,
idle, wander, stroll, play or be upon or about any street,
highway or public place as herein defined between the following
scheduled dates and hours:
(a) During the months of June, July and August of each
and every year between the hours of 11 P.M. to 5
A.M. each day; and on each Friday and Saturday from
12 o'clock midnight to 5 A.M. throughout the year.
(b) During the period from September 1 to May 30 of
each year, from Sunday to Thursday, inclusive,
between the hours of 10 P.M. to 5 A.M.
It is provided, however, that the provisions contained
in this Section shall not apply to a minor who is duly accompan-
..ied by his parent or guardian or in the case where such minor
is engaged in legitimate employment duly approved by the parent
or guardian or the proper administrative authority designated
in the State Child Labor Statutes.
,;ec. 3 It shall be unlawful for any parent or guardian as defined here-
in to encourage, condone or permit any such minor as specified
in the immediately preceeding Section to violate any of the
provisions hereof.
Sec. 4 It shall be unlawful for any person not a parent or guardian
to knowingly accompany, congregate, loiter or wander about with
any minor on any street, highway or public place in the City of
Tukwila as hereinabove defined, unless such person has the
consent of the parent or guardian of such minor.
Sec. 5 It shall be unlawful for the proprietor, operator or person
in charge of any business establishment to permit any such
minors to congregate, loiter, play or be upon such establish-
ment or place of business during the hours and times herein
abive specified unless such minors are accompanied by their
parents or guardian.
Sec. 6 Any minor violating any of the provisions contained herein
shall be dealt with in accordance with the Juvenile Court Laws
and if remanded for prosecution shall be fined in an amount
not to exceed $100.00 or confined to jail for a period not
to exceed thirty (30) days, or punished by both such fine
and imprisonment.
Sec. 7 Any parent, guardian or other adult person having the care
and custody of any such minor violating any of the provisions
herein contained shall be guilty of a misdemeanor and upon
conviction thereof shall be punished by a fine not to exceed
$100.00 or confined in jail for a period not to exceed thirty
(30) days, or be punished by both such fine and imprisonment;
however, punishment for a first offense under this Ordinance
shall consist of a fine only in a sum not to exceed 25.00.
lc. 8 Any person violating any of the provisions of Sections 4 and
5 herein shall be guilty of a misdemeanor and upon conviction
thereof shall be punished by a fine not to exceed $100.00 or
by imprisonment in the Jail for a period not to exceed thirty
(30) days or by both such fine and imprisonment; however,
punishment for a first offense hereunder shall consist of a
fine only in a sum not to exceed 25.00.
Sec. 9 Each violation of any of the provisions of this Ordinance shall
constitute a separate offense.
Sec. 10 Should any section, clause or provision of this Ordinance be
declared by the courts to be invalid, the same shall not effect
the validity of the Ordinance as a whole or any part thereof,
other than the part so declared to be invalid.
Sec. 11 Any and all other ordinances and parts of ordinances insofar
as the same are in conflict herewith, are hereby repealed.
Sec. 12 This Ordinance shall be in full force and effect after its
passage, approval and legal publication.
