TUKWILA CITY COUNCIL April 16, 2001 7:00 p.m. Tukwila City Hall Council Chambers REGULAR MEETING MINUTES CALL TO ORDER/PLEDGE OF ALLEGIANCE: Mayor Steve Mullet called the meeting to order at 7:00 p.m.; and led the audience in the Pledge of Allegiance. City Administrator John McFarland; City Attorney Bob Noe; City Clerk Jane Cantu; Deputy City Clerk Bob Baker; Council Analyst Lucy Lauterbach; Public Works Director James Morrow; Volunteer Coordinator Roberta Nelson; Public Works Project Manager Ryan Partee; and Finance Director Alan Doerschel arrived at 7:38 p.m. City Clerk Jane Cantu called the roll of Council. Those present included Council President Joan Hernandez; and Councilmembers Joe Duffle; Pam Carter; Jim Haggerton; David Fenton; and Richard Simpson. Duffie moved; Hernandez seconded; to excuse the absence of Councilmember Pamela Linder. The motion carried 6 -0. PROCLAMATIONS /APPOINTMENTS: a. Proclamation declaring the Week of April 22-28, 2001, as National Volunteer Week Reading from the original document, Mayor Mullet recognized the outstanding volunteer spirit which exists within the City; and proclaimed Tukwila volunteers are to be honored April 22 28, 2001. Roberta Nelson, Volunteer Coordinator, accepted the original proclamation and thanked the Mayor and Council for their support and recognition. More importantly to Roberta, was her desire to name the individuals who donate freely of their time and energies which make the program so successful. The following were named by Ms. Nelson as those who continually give of themselves: (in no particular order) Paul Surek, Donna West, Roy Steinhauer, Love, Inc., Dixie Archer, Margaret Bratcher, Linda Reiber, Marlus Ireland, Don Dart, Bob Abbott, Karen Wright, Marja Murray, Rosa Krows, Meredith Stetson, Dave Johnson, Sherry McConnaughey, Jeff Murphy, Claudette Nussbaum and Everett Parr. b. Proclamation designating the Week of April 29 -May 5, 2001, as Municipal Clerks Week Reading from the original document, Mayor Mullet recognized the accomplishments of the Office of the Municipal Clerk and recognized the week of April 29 May 5, 2001, as Municipal Clerks Week. Further, he extended appreciation to City Clerk Jane Cantu and Deputy City Clerk Bob Baker, (and "all Municipal Clerks for their exemplary dedication to the communities they represent. City of Tukwila City Council Regular Meeting Minutes Citing work performed on behalf of the Washington Municipal Clerks Association, Mayor Mullet presented Bob Baker with the WMCA President's Award of Distinction. Noted for serving a three -year term as a publication editor for the organization, Baker received the award for "exemplary service." City Clerk Jane Cantu announced Deputy City Clerk Bob Baker had recently been accepted into the first level of the Master Municipal Clerks Academy of Education Program. Upon reaching the fourth level of the academy, members are awarded the prestigious designation of Master Municipal Clerk, MMC; and are then able to drop the previous designation of Certified Municipal Clerk (CMC). Plaque and lapel pins are given to new members into the newly created academy by the International Institute of Municipal Clerks. CITIZEN COMMENT /CORRESPONDENCE: Gary Johnson, Cascade View Neighborhood, asked the Mayor and Council for the City's preferred choice of routes for Light Rail. Mayor Mullet responded the City is in favor of the old E -3 Route (Southcenter Route). CONSENT AGENDA: BID AWARD: c. WMCA President's Award of Distinction d. Entrance Into Master Municipal Clerks Academy of Education a. Approval of Minutes April 2, 2001 Regular Meeting b. Approval of Vouchers 227311- 227860; in the amount of $724,266.34 Duffie moved; Hernandez seconded; approval of the consent agenda, as presented. The motion carried 6 -0. Award a contract to Barnett Implement Co., Inc., in the amount of $31,096.40, for purchase of a replacement tractor for Foster Golf Course Carter moved; Haggerton seconded; approval to award a contract to Barnett Implement Company, Inc., in the amount of $31,096.40, for the purchase of a replacement tractor with front -end loader and backhoe attachment, for use in the Foster Golf Course. The motion carried 6 -0. NEW BUSINESS: Page 2 of 6 April 16, 2001 a. Authorize Mayor to sign a contract amendment with Ball Janik, LLP, in the amount of $15,000.00 per month, plus expenses, for federal representation and lobbying services in 2001 Fenton moved; Haggerton seconded; authorization for Mayor Mullet to sign a contract amendment with Ball Janik, LLP, in the amount of $15,000.00 per month, plus expenses, for federal representation and lobbying services in 2001. The motion carried 6 -0. b. Motion approving a new Accounting Technician II position for Finance Department Fenton moved; Carter seconded; the motion to approve a new Accounting Technician II position, in the City's Finance Department. The motion carried 6 -0. City of Tukwila City Council Regular Meeting Minutes Page 3 of 6 April 16, 2001 c. Authorize Mayor to execute the 2001 -2002 Construction Management Services contract with Entranco Engineers Carter moved; Fenton seconded; authorization for Mayor Mullet to execute the 2001 -2002 Construction Management Services contract with Entranco Engineers. The motion carried 6 -0. d. Authorize Mayor to execute documents to legally trade identified land parcels with Jim Codiga (for Codiga Farms Side Channel Project). Ryan Partee, newly appointed Public Works Project Manager, informed Council a title report has been completed thus far. Additionally, he stated the approximate dollar value of the trade is currently being scaled and not yet determined. Finally, Mr. Partee informed Council of an April 18 public hearing on the issues of Shoreline and SEPA Approval; at Tukwila Community Center, from 5:00 to 7:00 p.m. Haggerton moved; Fenton seconded; authorization for Mayor Mullet to execute documents to legally trade identified land parcels with Jim Codiga, for the future side channel project. The motion carried 6 -0. e. An ordinance amending Ordinance No. 1955 and clarifying Council stipends. AN ORDINANCE OF THE CITY COUCNIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE NO. 1955 AND TUKWILA MUNICIPAL CODE 2.04.230, CLARIFYING THE LEVELS OF COMPENSATION FOR CITY COUNCILMEMBERS BY POSITION AND SCHEDULED TERM OF OFFICE; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. Fenton moved; Duffie seconded; reading of the proposed ordinance by tile only. The motion carried 6 -0. City Attorney Bob Noe read the title of the proposed ordinance. Fenton moved; Haggerton seconded; adoption of the proposed ordinance as read.* Discussion ensued. Councilmember Carter noted the monthly compensation chart, within the body of the ordinance, differs from that of the past. From her reading of the newly proposed ordinance, Ms. Carter believes Councilmembers filling vacated seats would come in under the lesser of two amounts listed. Such belief was discussed and agreed to by those present. Ms. Carter spoke against that portion of the proposed ordinance as it differs from previous practice and it was not specifically mentioned. Mayor Mullet polled Council to determine whether they agreed with the compensation chart, as presented. With the exception of Councilmember Carter, all agreed with the numbers presented in the proposed ordinance. *The motion to adopt the proposed ordinance, as presented, carried 6 -0. APPROVED ORDINANCE NO. 1956 City of Tukwila City Council Regular Meeting Minutes REPORTS: a. Mayor b. City Council Page 4 of 6 April 16, 2001 Mayor Mullet announced a breakfast, sponsored by the Economic Development Council of Seattle and King County, at the Westin Hotel, at 8 to 9 a.m., on April 27, 2001. He also invited Council to let him know if there is an interest in attending. Mayor Mullet then noted he would be in Olympia on April 17 to hear Senator Margarita Prentice read a Backyard Wildlife Habitat Proclamation into the record. Additionally, he will attend two transportation meetings to speak of issues raised at Suburban Cities Association meetings. Councilmember Duffie spoke against triple- trailer trucks within the State of Washington. These are 40- foot long trailers. He asked Council if they would be in support of signing a letter against these trucks being allowed on the highway in Washington State. Council agreed a letter should be sent. Next, Mr. Duffle invited individuals to an April 24, 9:00 a.m., to a presentation at Tukwila Elementary School entitled Art in Public Places. School officials are invited to ensure proposed developments fall within the parameters of the Tukwila Municipal Code. Mayor Mullet asked Mr. Duffie to try and obtain the plans for City review ahead of the April 24 meeting. Finally, Mr. Duffie noted attendance at an April 12 Museum of Flight educational presentation. He noted others would appreciate their scheduled visit on April 17. Councilmember Carter attended an April 5 Equity and Diversity Commission meeting; an April 6 Tukwila School District Public Relations Advisory Council meeting; an April 9 Transportation Committee meeting; and April 11 Suburban Cities Association meeting. She plans to attend the following meetings: April 17 SCATBd; and April 19 Regional Transit Meeting. Next Ms. Carter noted two free workshops on properly caring for your septic tanks will occur on April 21 at Highline School District Administration Building; and May 12 at Maple Valley Fire Station. Council President Hernandez attended the April 5 Lodging Tax Advisory Board and later Equity Diversity Commission meeting. Next, Ms. Hernandez noted a May 31, 6:30 p.m., Tribes presentation (play, musical performance and reception) at the Foster Performing Arts Center. The Tribes group is working with Renton High School students. Finally, Ms. Hernandez reported attendance at the SWKC Chamber luncheon wherein the guest of honor was King County Executive Ron Simms. Councilmember Haggerton thanked Council Analyst and Council President Joan Hernandez for their efforts in setting up and running the April 3, Joint City Council /School Board meeting. Mr. Haggerton attended an April 4, ACC Executive Committee meeting; and, an April 11 Cascade Water Alliance Board of Directors meeting as well as a Suburban Cities Association General Membership meeting at Kenmore; and the April 13 SWKC luncheon wherein the guest of honor was King County Executive Ron Simms. Councilmember Fenton noted his attendance to the April 12 Museum of Flight program. He spoke very favorably regarding the program. Mr. Fenton attended the Finance Safety Committee meeting earlier this evening and reviewed the contents of that agenda. Councilmember Simpson attended the April 10 Highway 99 Action Committee meeting. City of Tukwila City Council Regular Meeting Minutes c. Staff City Administrator John McFarland had no report. d. City Attorney City Attorney Bob Noe reported that on April 6, a King County Superior Court judge McDermott granted (in part) the City's Motion for Summary Judgment relative to the Hemmerling property, with respect to the debris and accumulation of items on the property. The Court gave Mr. Hemmerling 14 days from April 6 to remove the debris. The summary judgment was also granted in relation to the vehicles on the property. The court gave Mr. Hemmerling 30 days to remove the junk vehicles. The Court did not require removal of the trailers; yet did rule that effective immediately, occupancy therein is unlawful. The motion for summary judgment was denied and a November, 2001, trial date will be set with respect to the garbage trucks on the property. The basis for the trial lies in the fact Mr. Hemmerling is reportedly selling one of the trucks and the other is a personal -use vehicle. The court did not want to deprive Mr. Hemmerling of his only mode of transportation. Mr. Noe reported the Court allowed Mr. Hemmerling to file a counter claim, against the City's Code Enforcement Officer, Jason Jones, for harassment and Civil Rights Violations (for citing the Mr. Hemmerling re: his nuisance problems). The counter claim will be ruled upon at the time of trial in November, 2001. e. Intergovernmental Mayor Mullet reported ValVue is researching the idea of installing sewers on the loop. Additionally, ValVue is looking for City support on annexation of the area into the ValVue Sewer District. MISCELLANEOUS: Page 5 of 6 April 16, 2001 Councilmember Duffie spoke in favor of everyone taking a CPR course or renewing their CPR cards. This, in light of his sister -in -law sustaining a heart attack while visiting his home. He was pleased to report she is alive and well after he and family members were able to perform CPR. Council President Hernandez received a citizen inquiry regarding all the garbage at the house on 42nd. She noted the garbage continues to reappear. Mayor Mullet noted the refuse was gone today. Mr. McFarland reported a certified letter /notice has been sent to the occupant of the duplex as well as the property owner. Councilmember Haggerton thanked the Fire Department staff for their diligence in apprehending the out -of -state school principal who allegedly hired individuals (three) to burn her home (on 42nd) in Tukwila. 8:42 p.m. Hernandez moved; Fenton seconded; to recess the regular meeting, take a 5- minute recess and convene the executive session.
