ORDINANCE NO. /C
AN ORDINANCE approving and confirming the
assessments and assessment roll of Local Im-
provement District No. 5, which has been
created and established for the purpose of
paying a part of the cost of carrying out a
system or plan of additions to and betterments
and extensions of the waterworks utility
of the City of Tukwila, Washington, including
the system of sewerage as a part thereof as
adopted by Ordinance No. 381 and ordered to
be carried out by Ordinance No. 382; and levying
and assessing the amount thereof against the
several lots tracts parcels of land and other
property shown on said roll.
WHEREAS, the assessment roll levying the special assessments
against the properties located in Local Improvement District No. 5 in the
City of Tukwila, Washington, created under Ordinance No. 382,was filed
with the City Clerk of the City of Tukwila as required by law; and
WHEREAS, notice of the time and place of hearing thereon
and making objections and protests to said roll was duly published at and
for the time and in the manner provided by law fixing the time and place
of hearing thereon for the 21st day of September, 1964, at the hour of
8 o'clock p.m. (PDST) in the Council Chambers of the City Hall, 59th
Avenue South South 147th, Tukwila, Washington, and further notice thereof
was duly mailed by the City Clerk to each property owner shown on said
roll; and
WHEREAS, at the time and place fixed and designated in
said notice the hearing on the assessment roll was duly held and thereafter
continued to September 22, 1964, at the same time and place and the City
Council considered all protests which were heard or presented in writing and
all persons who wished to be heard were heard at said hearing; and
WHEREAS, further consideration of such protests was given
by the City Council on September 30, 1964, and again at the regular Council
meeting of October 5, 1964; and
WHEREAS, the City Council gave due consideration to the
special benefits to be received by each lot, tract and parcel of land shown upon the
including the increase in the fair market value of each lot, tract and parcel
of land resulting from the improvements carried out in said Local Improvement
District No. 5; and
WHEREAS, the City engineers reported that they had carefully
reexamined and reconsidered each assessment made on said roll and made
their recommendation as to the deletions, corrections and reductions to
be made thereon so that the amounts charged against said parcels of land
are in accordance with the mode of assessment in said District provided by
law and by ordinance of the City Council and clearly reflect the special
benefits to be received by said parcels of land; and
WHEREAS, the City Council determined to make certain
deletions and reductions on said roll and to overrule all other protests
and requests for changes thereon, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
DO ORDAIN as follows:
Section 1. The assessment apprearing on said assessment roll of
Tax Lot 17, Section 23 -23 -4 (Page 102, item 4) owner Lee Phillips, in the
amount of $459.50,is deleted and the following assessments appearing on
said roll are reduced in the following amounts:

All other protests and requests for changes on said roll
are hereby overruled and denied.
Section 2. The assessments on the assessment roll as
corrected and reduced herein be and they are hereby in all respects approved

and confirmed in the total amount of $408,697.62.
Section 3. Each of the lots, tracts, parcels of land and
other property shown upon the said roll is hereby determined and declared
to be specially benefited by said improvements in at least the amount
charged against the same and the assessments appearing against the same,
as herein modified,is inproportion to the several assessments appearing upon
the roll. There is hereby levied and assessed against each lot, tract,
parcel of land and other property appearing upon the roll the amount finally
charged against the same thereon.
Section 4. The assessment roll as approved and confirmed
shall be filed with the Treasurer of the City of Tukwila for collection and
said City Treasurer is hereby authorized and directed to publish notice
as required by law stating that said roll is in her hands for collection and
payment of any assessment thereon or any portion of said assessment can
be made at any time within 30 days from the date of the first publication
of said notice without penalty, interest or cost, and thereafter the sum
remaining unpaid may be paid in ten (10) equal annual installments with
interest thereon hereby fixed at the rate of 5 1/2% per annum. The first
installment of assessments on said assessment roll shall become due and

and payable during the 30-day period succeeding the date one year after the
date of first publication by the City Treasurer that notice of the assessment
roll is in her hands for collection and annually thereafter each succeeding
installment shall become due and payable in like manner. If the whole or any
portion of the assessments remains unpaid after the first 30 -day period, interest up
the whole unpaid sum shall be charged at the rate of 5 1/2% per annum and
each year thereafter one of said installments together with interest due
on the whole of the unpaid balance shall be collected. Any installment not
paid prior to the expiration of the said 30 -day period during which such installment
is due and payable shall thereupon become delinquent. All delinquent install-
ments shall be subject to a charge for interest at 5 1/2% per annum and for
an additional charge of 5% penalty levied upon both principal and interest
due upon such installment or installments. The collection of such delinquent
installments will be enforced in the manner provided by law.
PASSED by the City Council at a regular meeting thereof
and approved by the Mayor of the City of Tukwila, Washington, this 19th
day of October, 1964. j
