VALUATION OF CONSTRUCTION Valuation for new construction and additions are calculated by the Department of Community Development prior to application submittal. Contact the Permit Coordinator at 431 -3670 prior to submitting application. In all cases, a valuation amount should be entered by the applicant. This figure will be reviewed and is subject to possible revision by the Building Division to comply with current fee schedules. BUILDING OWNER / AUTHORIZED AGENT If the applicant is other than the owner, registered architect/engineer, or contractor licensed by the State of Washington, a notarized letter from the property owner authorizing the agent to submit this permit application and obtain the permit will be required as part of this submittal. EXPIRATION OF PLAN REVIEW Applications for which no permit is issued within 180 days following the date of application shall expire by limitations. The building official may extend the time for action by the applicant for a period not exceeding 180 days upon written request by the applicant as defined in Section 304(d) of the Uniform Building Code (current edition). No application shall be extended more than once. On 3/20/92 (my day off), I tried to return Mr. Roppo's call of 3/19 @ 4:47, but got no answer ( Roppo's phone message was missed when I left for the day). On 3/23/92, I talked with Mrs. Roppo in the morning and Mr. Roppo in the afternoon. We discussed the following: A. Mr. Roppo said that he had talked with Mr. Caldwell on the phone and he seemed amenable to working out a solution. However, Caldwell missed the meeting with Roppo they had scheduled to work out issues. B. Roppo doesn't want to get lawyers involved, but is ready to if really needed. C. I checked the file and told Roppo that a new building plan had been submitted today, but couldn't estimate processing time. D. I urged him not to wait on Caldwell, but to set a date when the sewer issue should be settled and then begin taking actions to establish whatever rights he had to the sewer. E. I emphasized that this was important since once the building permit was issued construction could being immediately, before he could get file an adverse possession action; and he would have to vacate the house once the sewer line was broken. F. I clearly objected to his assertion that his verbal discussions with City staff constituted a constructive notice of adverse possession. I stated that this is not a legal basis for the City to treat Mr. Caldwell any different than other single family application. Such a case would have to be made in writing with adequate documentation and decided in court. I referenced our earlier conversations (see my earlier memos) when I told him that this is a case of one property owner asserting his rights over another and that the City does not get involved in such civil cases. G. I told Roppo that I had written up the issues in a memo and discussed it with John Pierog of Public Works and Bob Benedicto of Building and had recommended that Mr. Caldwell be strongly urged to solve this problem before permit issuance. They will checking to see if his sewer issue had been resolved, but can't stop the permit without Roppo's adverse possession action. To: John Pierog, Assoc. Engineer Public Works Department From Vernon Umetsu Department of Community Development Date: 3/16/92 MEMORANDUM RE: B92 -0069: Caldwell Residence. I have done some follow -up work to and have the following findings and recommendations which may assist in your review. 1. The Caldwell property and the Roppo property were a single legal lot of record until 1975 when it was short platted as approved by the City. The property was then sold to two new parties with the Roppo's buying the parcel with an existing house. Mr. Caldwell is the second owner of the vacant parcel (Roppo, 3/12). 2. Prior to short platting, a sewer line had been installed by the original owner. This side sewer line now runs over the Caldwell property, but no sewer easement was ever established for it. 3. This side sewer is about 1 ft. deep (Roppo, 3/12/92) and is located under the proposed driveway and /or foundation. I would expect the sewer would be breached at the beginning of any earth work since the building foundation requires a 6 ft. cut into the hill and the driveway requires a 1.5 ft. excavation. 4. Breaching of the side sewer would most likely require that the Building Official declare the Roppo residence unfit for occupancy and the Roppo's would very likely have to evacuate (Griffin, 3/16/92). 5. Based on a verbal description of the above, the City Attorney feels that the Roppo's have a very arguable case of adverse possession (Kenyon, 3/13/92). 6. I have recommended to both Mr. Roppo and Mrs. Roppo to separate occasions (3/12 and 3/13 respectively) that they first try to work out something with Mr. Caldwell and consult a land use attorney. A developer recommended one to Mr. Roppo as we spoke at the counter on 3/12. 7. I told Mrs. Roppo on 3/13 that: a. the City would most likely view this as a establishing the rights of one party (the line) over another person's property, and would not become involved in establishing for one party, b. they should get an attorney to make any arguments of adverse possession or other matter to the City, c. the City has a specific duty to Mr. Caldwell to process his building permit application in a timely manner so they need to make any objections to the normal processing of this building permit as soon as possible before permit issuance, and d. failure to establish their legal rights as the basis of an objection would probably result in the normal permit processing of the permit and issuance in 7 - 10 days. e. I did not mention the need to vacate their house upon breach of the sewer line as I did not realize the implications until Saturday (3/14). RECOMMENDATION civil matter Roppo's sewer that the City such a right I discussed this matter with Rick Beeler on 3/13 at 5:30 p.m. We have determined that this is a utilities issue which should be proactively approached. There do not seem to be any Zoning Code issues involved. We urge you to: A. resolve the side sewer issue prior to approving a permit, since to do otherwise would most likely force us to evict the Roppo's when their sewer is breached, B. talk with Mike Kenyon and Ron Cameron to establish a firm City position on this matter, C. explain the situation to Mr. Caldwell and encourage him to call Mr. Roppo (246 -3710) to work out something prior to beginning work and /or D. set up a meeting between all parties to work out a solution.
