Morgan: City of Tukwila Department of Community Development Rick Beeler, Director Re: Request for Extension of Plan Check Time for Building Permit Application #92 -0265 I have reviewed your above referenced request and have determined that a plan review extension will not be granted for the reasons shown below. Therefore, in accordance with Uniform Building Code Sec. 304(d), your application expired on January 22, 1993. It will be necessary for you to submit plans and pay a new plan review fee in order to renew action on the application. The criteria set forth in the building code for extending the 180 plan review time frame is that the applicant must show that circumstances beyond their control prevented action from being taken. After reviewing the application folder and other background information, from both the Public Works Department and the Planning Division, it appears there were no unnecessary long delays caused by the city regarding this project that were beyond your control. In fact, the file indicates that certain concessions were made in the normal application procedures in an attempt to assist you in getting this application processed in a timely manner. Additionally, you were notified both at the time of application and periodically during the 180 day period after the application was submitted.that the application would expire on January 22, 1993. It appears that the delays being encountered are due to land use issues. Consequently, no plan review has been started yet on the actual building plans. Therefore, upon written request from you, within 30 days from the date of this letter, you will be eligible for a refund of 80% of the plan check fee you have already paid. The file also indicates that you presently have the two sets of building plans that you originally submitted in your possession. Morgan applied for a 4 -lot short plat ( #L92 -0039) in May 1992. In August 1992, the plat was still being reviewed by the City. To expedite completion of 4 single family homes on the lots, Morgan applied for a building permit for construction on the existing lot. Morgan probably anticipated that her short plat would be completed (including approval, recording and parcel number assignment) prior to the expiration of her permit application (January 1993). Usually, this is a reasonable expectation, since most short plats take 60 -90 days. However, Morgan's plat required many more revisions than anyone anticipated. The plat was delayed because we had to wait for Morgan to submit revisions - -and re- revisions, and because each revision had to be reviewed /routed /copied /coordinated with different departments. In some cases, the timing of Morgan's re- submittals coincided with huge backlogs in Planning and Public Works. Most of the plat revisions related to Public Works /utilities issues. John Pierog can give you more information on requested revisions and timing of re- submittals.
