Also the approved landscaping must be maintained for the life of the project. This code has been violated,as several trees were cut down in the vicinity of the stormwater pond,and shrubs around the stormwater pond were severely pruned to the ground and are unlikely to recover. Also, although the Himalayan blackberry vines growing around the edge of the stormwater pond have been cut back,the roots are still there and they will grow back. There is also trash present in the stormwater pond. The trees in the parking lot have not been well maintained—they are showing signs of stress,roots are exposed,there is no mulch or groundcover around some of the trees,and there may be no functioning irrigation. The stormwater pond itself has little vegetation in it. Per the City's stormwater code(TMC 14.30), the pond must be planted(the pond itself—not the sides and top)in accordance with the 1998 King County Surface Water Manual that was in effect at the time the pond was approved(planted with grasses,sedges or rushes appropriate to the pond's hydrological design). Therefore,to bring the site into compliance,the property owner or tenant must do the following: 1. Hire an ISA-certified arborist to evaluate the health of the trees in the parking lot and make recommendations for their care and/or or replacement,including evaluating the irrigation system. Submit the arborist report to the City for approval. Submit a planting plan for the stormwater pond and the upland area around it, prepared by a licensed landscape architect for the City's approval that takes into account the following criteria: a. Crime prevention—visibility into the stormwater pond from the street and sidewalk is needed at all times,therefore naturally low growing shrubs should be specified and the current shrubs(Pacific Wax Myrtle)removed b. Stormwater quality compliance—grasses,sedges,and rushes as appropriate for the pond's hydrology,to provide sediment retention. c. Trees,shrubs,and groundcover appropriate to the upland areas around the pond to enhance the aesthetic appearance of the area,while maintaining visibility into the pond and preventing passersby from entering the pond. The City hopes that this Notice has provided you the information you need to ensure that all city code requirements are met.
