Earlier that day the City of Tukwila ordered that construction operations on the above - referenced project be terminated until appropriate permits were secured from the City. Permission to continue operations was granted following discussions on May 5 between Mr. Griffin and the undersigned, as conditioned by items listed later in this letter. The construction operations in progress at the former Time -DC Terminal are in response to the presence of underground diesel fuel discovered during removal of the former underground storage tanks (USTs) at the facility. All of the USTs have been removed. However, free (floating) product was discovered on the water table of the tank excava- tion at the time of tank removal. This condition was reported immediately to the Washington Department of Ecology, as required by federal law (40 CFR, Part 280.50). Remedial responses to the presence of free product on the water table are specifically governed by state and federal law. Federal law requires that the site owner or operator "begin free product removal as soon as practicable . . ." (40 CFR, Part 280.61(6)) and that "owners and operators must remove free product to the maximum extent practicable . . ." (40 CFR, Part 280.64). Free product on the water table is also addressed by state law (RCW 90.48.325), which requires that "any person owning or having control over oil entering waters of the state . . . "shall "immediately collect and remove the same." City of Tukwila May 8, 1989 Page 2 CONDITIONS AND UNDERSTANDINGS 0 • When free product was discovered at the site, GeoEngineers recom- mended to Bedford Properties that the source of the free product (fuel - contaminated soil) be excavated, removed and treated in order to mitigate the free product problem. Unfortunately, the free product plume was found to extend beneath the former Time -DC Terminal building, and the boundaries of the fuel plume could not be determined readily in this area. Eight bays of the warehouse building were demolished initially in order to access the contaminated soil. Even after this demolition activity, free product continued to enter the enlarged excavation from beneath the remainder of the building. With conditioned approval from the City of Tukwila, two additional bays of the structure were demolished and removed on May 6 and 7, 1989. Excavation of fuel- contaminated soil in the vicinity of these demolished bays will occur on May 8 and 9. It is possible that additional demolition will be needed if the zone of soil contamination is found to extend east of the area of the most recent building demolition. The City of Tukwila granted approval on May 5 for continued cleanup operations subject to the conditions listed below: 1. GeoEngineers must submit a letter of explanation regarding the need for emergency cleanup operations to the City of Tukwila on the morning of Monday, May 8, 1989. 2. A GeoEngineers representative under the direction of a registered professional engineer must witness all excavation activities, free product removal and backfilling operations. 3. No persons can be present inside the warehouse building when demolition activities occur. 4. The temporary wall constructed to enclose the west end of the warehouse building (following demolition) must be reviewed and approved for safety by a structural engineer. This structural approval must accompany Bedford Properties' permit application to the City of Tukwila for construction of this wall. 5. Bedford Properties must obtain a grading and fill permit for the excavation and backfilling operations at this site. Upon removing the old gas and dieeel tanks (City of Tukwila Special permit #15 -89) located at Time DC, leakage of the tanks had occurred and per local laws and requirements SSG Corporation proceeded to remove all contaminated material. Therefore SSG Corporation's scope of work increased as we have been tracking and removing all contaminated material. It was never SSG Corporation's intent not, to procure any acdditionnal, permits required, we were under the belief this portion of work would be .pant of our original. permit. Mr. Gary Gaston of Gaston Brothers Excavating will be applying for the necessary permits as soon as possible. The single remaining tenant currently occupying the Maintenance Building is scheduled to move in September of 1989, after which complete demolition of the building will take place. We are requesting a permit for demolition of an additional 4,000 square feet of the building, leaving only the currently occupied portion, in order to continue excavation of contaminated soil. The soil contamination originated from leaking storage tanks which were recently removed. A temporary wall will be built at the edge of the demolition to achieve security for the existing . space. We will provide, under separate cover, an evaluation from our structural engineer relative to the engineering considerations for the wall. We appreciate the City of Tukwila's cooperation in our efforts to clean up the contamination discovered when the underground storage tanks were removed.
