Application and plans must be complete in order to be accepted for plan review. VALUATION OF CONSTRUCTION Valuation for new construction and additions are calculated by the Department of Community Development prior to application submittal. Contact the Permit Coordinator at 431 -3670 prior to submitting application. In all cases, a valuation amount should be entered by the applicant. This figure will be reviewed and is subject to possible revision by the Building Division to comply with current fee schedules. BUILDING OWNER / AUTHORIZED AGENT If the applicant is other than the owner, registered architect/engineer, or contractor licensed by the State of Washington, a notarized letter from the property owner authorizing the agent to submit this permit application and obtain the permit will be required as part of this submittal. EXPIRATION OF PLAN REVIEW Applications for which no permit is issued within 180 days following the date of application shall expire by limitations, The building official may extend the time for action by the applicant for a period not exceeding 180 days upon written request by the applicant as defined in Section 304(d) of the Uniform Building Code (current edition). No application shall be extended more than once. You were notified that you must provide the City with a written course of action to repair or demolish the structure within forty-five (45) days from the service of that notice and that your course of action must include a set of plans which must be stamped by either a licensed engineer or a licensed architect. You were also advised that in the event that these plans were not submitted within the time allotted, you would be required to vacate the entire complex on the forty-sixth (46th) day. As of February 1, 1994, we have not received the required information during the 45-day Y grace period that was provided you. This notice will serve as your final opportunity to respond prior to civil action being taken by the City. You have ten (10) days from the service of this notice to provide the required set of plans, stamped by either a licensed engineer or a licensed architect. Again, if these plans have not been submitted within the 10 -day period, you will be required to vacate the entire complex on the eleventh (11th) day. (206) R23 6421 CITY RECEIVE JAN 2 4 1994 PERMIT CENTER On December 2, 1993, an inspection of Pacific Village Apartments located at 13504 Pacific Highway South was conducted by Mr. Darren Wilson, Code Enforcement Officer. The inspection report requires the following repairs and improvements be made to the buildings as outlined below and as shown on the attached plans. Please review this proposed work and amend the approved plans for the permits noted above. BUILDING #1 (UNITS 1 & 2) Units 1 & 2: 1. Replace untreated posts with 4 "x4 "s treated for ground contact. 2. Replace concrete post bases as necessary. 3. Install 2 "x4" treated cross bracing as required by Section B, approved plans, Permit #6564. 4. Install 6" O.S.B. lap siding skirting and 15# felt on exterior foundation walls. Install 1/2" CDX plywood skirting on carport foundation walls. 5. Install 4 "x4" treated post on 12 "x 12" concrete post base at centerline of existing carport header. Nail steel post cap to attach top of post to header. 6. Install and test smoke detector in Unit 2, (completed) BUILDING #2 (UNITS A, B, 4, 5) Unit A: 1. The plaster walls in this unit were severely damaged due to settling and jacking up the structure as required by replacing the foundation and floor support structure per approved plans, Permit #6564. All of the interior partitions and plaster walls were removed to prepare for renovation. Plans and detail drawings are attached for the interior improvements. 2. A separate electrical permit will be obtained by a licensed electrical contractor to remove and replace the electric cable, outlets, switches and fixtures in this unit. They have failed to perform nearly all of the agreed work, have not filled one vacancy in six months and I understand that they have upset long term tenants who have since moved out. I brought a work party to the complex and the roofs and exteriors were pressure washed and litter and debris were removed from the grounds and storage areas. Several appliances have been repaired or replaced. We are cleaning and preparing the vacant units to be leased and the new management will continue these efforts. I bought this property with the plan to clean, repair and improve it as a long term investment. Thus far I have lost tens of thousands of dollars through thefts, mismanagement, rental loss and landslide as well as the funds spent on repairs and improvements, however, I remain committed to improving and maintaining the property as well needed low income housing. These apartments were built 70 years ago during the 1920's and have been remodeled and repaired numerous times by many different owners. They were not originally built to 1993 code standards and many of the repairs and alterations done in the past were done improperly. A previous owner had the water supply and waste lines replaced, and new electric panels, service entrances, and wiring installed. I do not know if this work was done under a proper permit, however it appears to have been professionally done. I bought the property from a Chinese couple who had not done any significant repairs during their ownership. Trash and debris were piled to the ceiling in every storage area and most of the tenants were drug users, dealers and prostitutes. The police responded to calls there nearly every day. I have done my best to improve this situation and long term residents will gladly attest to the difference under my ownership. I told him at that time that I did not have the financial resources nor was it practical to rebuild the 70 year old apartments into modem units complying with the current building code. We agreed that it was in everyone's best interest that the property be saved from further deterioration and plans were submitted and approved for 2 building permits for repairs and improvements. It was understood that the work would be done unit by unit and building by building as time and funds allowed. Approximately half of the planned work has been completed and approved and the rest will be done on the same terms. As work progresses into areas not covered in the original permits, I will submit plans and applications for additional permits. The following comments are my recommendations as to what may be beneficial to include in the notice to the owner: Give them a specific date that the application for permits have to be received by the city. I thought we had said it would be 60 days as stated in the Housing Code as being the maximum allowed. It should be noted that immediate eviction action will be taken if the permit application(s) are not received by that date. It should also be noted that plans submitted with the permit application must be stamped by a licensed architect or engineer for the structural corrections. It should probably be stated in the notice to the owner that all work done under the required permits must be completed within four months from the time the permit is issued, but not more than 6 months from the date of the notice. It should probably be stated that this list of corrections do not necessarily include all corrections that will be required once the work starts. There is no guarantee at this point that more major problems won't be uncovered as a result of or during the required repair work. I don't think it's necessary to explain the exact appeal procedure word for word in the first notification. It should be sufficient to say that there is a appeal process and indicate that it is contained in Chapter 12 of the Uniform Housing Code. It should also notify the owner that the appeal must be made in writing within 30 days of the notice; and that failure to appeal will constitute a waiver of all right to an administrative hearing and determination of the matter. I would recommend that the notice include a statement that the units currently vacant should not be rented until the buildings are no longer considered substandard. This should probably be checked out with city attorney to see if it is legal to put this type restriction on. General PACIFIC VILLAGE APARTMENTS INSPECTION REPORT SUMMARY On December 2, 1993, an inspection of the property located at 13504 Pacific Highway South, known as Pacific Village Apartments, was conducted pursuant to Tukwila Municipal Code Chapter 16.06.. The inspection was conducted by the City Code Enforcement Officer, a building inspector, and a fire inspector. The inspection revealed that the condition of the buildings, both inside and out, including structural members, meet the criteria of substandard buildings as outlined in the 1988 Uniform Housing Code, as adopted by the City of Tukwila. The specific reasons for declaring the buildings substandard are outlined below. The building and unit numbers can be identified by matching them with the attached drawing showing their location on the property. Building #1 (Units 1 & 2) Units 1 and 2 of this building were not entered. The underside of the building has had non -code complying repairs made to the foundation and other structural supporting members. Inadequate 4x4s and pier blocks, with no protection from horizontal displacement, have been installed as part of the foundation.. These new posts appear to have been recently installed, without a permit. A center bearing post has been removed in the carport between units 1 & 2. It was replaced with a single 2x12. A "strongback" has been nailed to the back side of headers but appears to be overspanned. Unit #2 has no smoke detector. Both units 1 & 2 are occupied. Building #2 (Units A, B, 3, 4, & 5) The entire west side of Building 2 (front) has suffered extensive damage to its structural support. This is due to substandard construction and lack of drainage away from the building. The east side has had some new foundation work and repairs to structure that were started under permit but never completed. It is apparent the new electrical work was also started but not completed. Electrical permit was not available. Rotten flooring below showers and toilets was visible from under the building. Unit A has been completely gutted, including interior bearing walls necessary to safely support roof and ceiling structure. Supporting structural members are now obviously overspanned. Again, no permits have been issued by Tukwila for this work. Electrical wires have been left hanging and three temporary braces are placed along center of unit space. This unit is currently vacant. Pacific Village Apartments Inspection Report Page 2 Unit B (Manager's Unit) has a bathroom sink with a vertical drain pipe lacking a p -trap, which is in violation of the plumbing code. Electrical wires were not installed per code. What appears to be an electrical supply wire exits the roof and runs up to the center of a tree. It is not known if this is a hot wire or not. The roof above a portion of this unit is flat, slightly sagging and water ponds to about 2" deep. This unit also has a leak in the kitchen sink drain. The unit has no smoke detector. This unit is currently occupied. Unit 4 has several problems. The asphalt paving and grade slope toward the front of the building. Floor joist, mudsills, 2x4 sole plates, bottom of studs, and bottom of door jamb have rotted out, leaving the wall above loose at its base. The door jamb is not attached at its bottom and swings when pushed. Consequently, large air leaks exist. A baseboard heater has become dislodged from the wall, has no cover and is in very poor condition. There is also an unused light socket with exposed wiring attached to the ceiling. This unit has a toilet that runs continuously, there isn't a bathroom sink, the bedroom windows don't open, and the living room floor joists are overspanned. This unit is currently occupied. Unit 5 has an ABS drain pipe protruding above the bottom of the shower floor so not all water is allowed to drain out. The bedroom windows don't open. There is an old electrical panel located outside this unit, behind an access door, that is inaccessible due to its location. It is not known whether this panel is active or not. The unit has no smoke detector. This unit is currently occupied. Building #3 (Units 6 & 7) Unit 6.has exposed wiring on hot water tank. Unit 7 has signs of leakage between bedroom and bathroom wall. The attic in this unit has been used as a bedroom and the attic access is open with damage to drywall ceiling around it. There is exposed wiring on the bathroom light fixture and the smoke detector is not working. This unit is currently occupied. Building #4 (Unit 8) Unit 8 was not accessible and was not inspected. This unit is currently occupied. Building #5 (Units 9 thru 18) General Foundation repairs on the south end of this building have been Pacific Village Apartments Inspection Report Page 3 accomplished under a Tukwila building permit that has not been finaled as of the date of inspection. The work under this permit was required when a portion of the building previously slid downhill after a heavy rainfall. It appears there have been many temporary or emergency repairs made to the foundation at the other end of this building without benefit of a building permit. These repairs include retaining walls built with untreated lumber and braced to floor joists and joists supported by untreated lumber on earth where original joist ends have rotted off. Rotted structural supports have left the structure unsupported in places. Common problems to all units were apparent. They include inoperable or nonexistent smoke detectors, windows in bedroom that don't open, outlet and switch plates missing, and temperature /pressure relief valves on hot water tanks that do not terminate in a safe location. Inadequate ventilation in bathroom is causing numerous mold and dampness problems in different ares o f the entire building. In this building units 10, 11, 13, 15, 16 and 17 are currently vacant. Unit 12 will become vacant on 12/15/93. Units 9, 14, and 18 are currently occupied. Unit 9 was not accessible. From the outside we could see broken windows. Units 10 and 11 do not have working smoke detectors. Unit 12 bathroom ceiling has collapsed. The upper kitchen cabinets are falling off the wall. Windows are broken and duct taped. Unit 14 has a rotten floor below the toilet, bathroom faucet missing knob, and exposed electrical wiring to light fixture. This unit also separated from unit #13 due to repairs made to unit 13's foundation. A two inch cap in front siding has been sealed with duct tape to stop air leakage. Unit 15 has a bath exhaust fan in ceiling that is powered by plugging lamp cord into plug above sink. Unit does not have a working smoke detector. Unit 16 has a weak floor patch and unsanitary condition behind kitchen sink. Unit does not have working smoke detector. On Monday, Nov 29, I had a phone msg from John M. dtd 24 Nov, 4:10 PM to call him regarding Pacific Village Apartments. I had left at 4 P.M. because the word came around that we could go home at 3:30 PM. 2. Before I called. John I asked Rick if he knew what. John wanted. He said that Wed afternoon a bunch of tenants from the apartments had showed up, along with a member of the landlord /tenant group, and they had had a meeting with John, Darren, and some other people. Rick told me that the garbage hadn't been picked up since September because the owner hadn't paid the garbage bill. Rabanco came & cleaned up on Friday at city's expense. City attorney (Mike) was at meeting on Friday. . 3. I talked to Darren and he said they had had the meeting and the tenants were. saying there are some structural problems with the buildings, along with a lot of other problems. Darren said he had forwarded me an RFA on the subject (which I haven't received). He asked if'one of the building inspectors could.accompany him. to the apartments' for an inspection. I agreed and asked him to set up an appointment with the owner /manager so that the areas in question could be open for inspection. 4. Darren and Dave went to the site. Garbs o hag boon piling up around the Pacific Highway South complex for two - and -a -half months because the landlord has ignored an ordinance requiring trash disposal and recycling services in apartment buildings. He's also instructed her to hand out plastic trash bags to each of the tenants. SHE NOTED that a health rats and repel tenants, according to complex managers Nora Smith and Leon Howard. They say although the litter piles up regularly, this is the first time it was allowed to continue for more than two months. One tenant even left a dead rat on an exterior window sill with a note informing the reader that the resident was at a tenants' meeting. LANDLORD BRYON Moeller said hie problem is money. Tonanto aren't paying rent on time, he complained. Ho said he's lost about $30,000 "sub- sidizing" the complex in the last year. "I'm broke. I do not have the mon- ey," he said. If the garbage continues to stack up along with the fines, the city could haul it away and bill the owner, but that could be set a dangerous precedent, he added. "Then we're playing the cat chases the mouse," Wilson said. "I'm doing just about every- thing I can at this point." In a worst -case scenario the city could close the entire com- plex, he said. Wilson checked and found Moeller had no contract with SeaTac Disposal. Alvin Kenneth Hibbitt died some- time Monday of a gunshot wound to the head, said a King County Medi- cal Examiner's Office spokesman. Neighbors at the Willow Creek Apartments, 4220 S. 154th St., became concerned after seeing Hib- bitt's garage door standing open overnight, said Tukwila Sgt. Doug Partlow. A maintenance man checked the townhouse about 5 :45 p.m. and found the door between the unit and the garage open, Partlow said. The man found Hibbitt lying dead on the bathroom floor. His hands were bound behind. his back and there is evidence his feet were also tied at some point, Partlow said. ' It is not clear whether there was a struggle, Partlow said. Some of the rooms were apparently ransacked. "We don't know what they were looking for," he said. Hibbitt's car was taken, but police don't yet know if anything else is missing, Partlow said. Police are hoping someone will spot Hibbitt's ear and call in. The car is a red or maroon 1987 Ford Mustang. The Washington license plate is 660 -EEZ. No one reported hearing any unusual noises coming from the apartment, Partlow said. Hibbitt's sister told police that she last saw her brother around 1 p.m. more than two months. The city responded Friday by paying to have the refuse pile picked up by SeaTac Disposal, but Tukwila officials plan to bill property owner Bryon Moeller. . • City Code Enforcement Offi- cer Darren Wilson said he placed a lien on the property until the owner pays the trash bill. He added that if the bill is not paid by January, Moeller may not be able to renew his business license. "We had to ' do 'what we: ' thought was best," Wilson said. Given Moeller's record on rubbish control, Wilson sug- gested that resident managers of the complex' deduct a portion of their rent for a contract with SeaTac Disposal..
